Surveying (Cadastral Surveys) Regulations 2025

The Regulations are built around a set of recurring technical and administrative concepts. Below is a succinct mapping of those concepts to the relevant regulatory text and the operative mechanics they establish.

• Licensed surveyor. The Regulations impose duties only on persons who are licensed surveyors; obligations are framed as duties a licensed surveyor must ensure are met (for example, regulations 6-17). The Regulations do not define licensing criteria; that remains a matter for the Surveying Act 2004 and related instruments.

• Survey accuracy and misclosure. Regulation 7 sets precise numeric accuracy thresholds:

  • internal closure misclosure vector limit: does not exceed 15 millimetres + 100 parts per million (ppm) of the perimeter (reg 7(1)(a));
  • each length measured must be accurate to 10 millimetres + 60 ppm (reg 7(1)(c));
  • heights must achieve an accuracy "equivalent to a survey misclosure of millimetres where 'k' is the distance between any 2 points, in kilometres" (reg 7(1)(d)) , note the text as printed omits a numeric coefficient before "millimetres" and thus creates a drafting gap (see Gotchas).
  • building-defined boundaries where no dimensions are to be shown have a relaxed tolerance: limit of error 50 mm or 1/200, whichever is greater (reg 7(3)).
  • directional and angular measurements must be verified (reg 7(2)).

• Reference systems and datums. The scheme requires use and declaration of standard datums:

  • MGA2020 for horizontal relationships and bearings when abstracts are lodged (reg 11(1)(b); reg 12(2)(b),(c));
  • AHD71 for heights where boundary heights are determined (reg 11(1)(c); reg 12(2)(d)).
  • The Regulations also rely on definitions and provisions in the Survey Co‑ordination Regulations 2024 (definitions for AHD71, MGA2020, electronic plan, standard plan and measurement units) (regulation 5 and reg 6(1)(a)).

• Monumentation and marking protocol. The instrument specifies the nature, placement and minimum standards for:

  • primary cadastral marks: durable, permanent, stable construction and materials approved by the Surveyor‑General; easy access and placed where least likely to be damaged or constitute a hazard (regulation 8);
  • pegs: minimum 50 mm square by 300 mm long, made of sound seasoned timber or other durable material, set with top not more than 20 mm above ground (regulation 9(3));
  • where pegs are impractical, Surveyor‑General approved alternatives may be used (regulation 9(1)(b));
  • the Surveyor‑General can waive marking requirements for Crown land where sufficient information exists (regulation 9(5)).

• Connection requirements and density standards. Regulation 11 mandates connection to at least three permanent marks or primary cadastral marks in the immediate vicinity; where fewer exist, further marks must be placed so that there is a minimum of three (regulation 11(3)(a)). For subdivisions with more than 10 allotments at ground level, marks must be placed so that the maximum distance between marks is 100 metres (regulation 11(3)(b)(i)), subject to an alternate distance approved by the Surveyor‑General (regulation 11(3)(b)(ii)). If more than four marks are required under the density rule, one in every five must be a permanent mark (regulation 11(3)(c)).

• Field records, abstracts and plans. The Regulations require systematic field records and prescribe the minimum content of the abstract of field records and the plan. Abstracts must include datum detail, MGA2020 relationship, bearings on MGA2020, heights on AHD71 (if heights were determined), boundaries and dimensions of subject and adjoining land, marking methods, and other relevant boundary-determining information (regulation 12(2) and (3)). The plan must be a standard plan or an electronic plan and must contain specified items, including version numbering where not prepared under the Subdivision Act 1988 (regulation 12(3)).

• Certification and reporting. A licensed surveyor must sign Form 1 for the abstract (regulation 13, Schedule 1 Form 1), Form 2 or Form 3 for plans as appropriate (regulation 14, Schedule 1 Forms 2-3), and must prepare a detailed licensed surveyor’s report to accompany lodged abstracts (regulation 15). The report must include facts on abuttals and encumbrances, equipment calibration details, whether connections were made or postponed, and methods used where indirect methods were applied (regulation 15(2)).

• Time-limited lodgements and supplementary records. The Regulations provide timed obligations:

  • if placement of permanent marks is postponed under regulation 11(4) (for example where construction may displace marks), a supplementary abstract of field records showing particulars and connections must be lodged with the Registrar within 45 days after construction is completed (regulation 11(5));
  • where a boundary has been re‑established as part of a cadastral survey, a record must be lodged with the Surveyor‑General within 60 days in Form 4 (regulation 16).

• Amendment and consent. Regulation 17 allows the original surveyor to authorise another licensed surveyor to note or amend reports, abstracts or plans, or to bring a survey up to date. It also allows notes or amendments by another licensed surveyor with the consent of the Surveyor‑General (for Central Plan Office lodgements) or the Registrar (for Office of Titles lodgements) (regulation 17(1)-(2)).

These concepts structure the compliance universe for a licensed surveyor undertaking cadastral work: equipment calibration and recordkeeping, adherence to precise accuracy formulas, monumentation and pegging standards, datum conformity, mandatory reporting and certification, and strict timelines for supplementary and re‑establishment records.

Primary legal duty-bearers under the Regulations are licensed surveyors. The obligations in regulations 6-17 are addressed expressly to "a licensed surveyor" or "a licensed surveyor making a cadastral survey". The Regulations therefore regulate the technical conduct and documentation of practising licensed surveyors; they do not extend obligations directly to landowners, developers, or other third parties except where those persons are the clients of, or beneficiaries of, a licensed surveyor's work.

Other public bodies and officials named in the text have procedural roles:

• The Surveyor‑General. The Surveyor‑General is the principal supervisory official referenced repeatedly: comparison records must be made available to the Surveyor‑General (regulation 6(2)); the Surveyor‑General approves materials and placement of primary cadastral marks (regulation 8(a)); may approve alternate marking methods where pegs are impractical (regulation 9(1)(b)); may waive marking requirements for Crown land (regulation 9(5)); may approve alternate distances for mark placement in subdivisions (regulation 11(3)(b)(ii)); may consent to notes or amendments lodged in the Central Plan Office (regulation 17(2)(a)); and may request computation or mathematical information associated with a survey (regulation 15(3)).

• The Registrar. Defined in regulation 5 as having the same meaning as in the Transfer of Land Act 1958, the Registrar is the other official recipient of abstracts and plans; the Registrar may request computations or mathematical information (regulation 15(3)), and the Registrar's consent is required to note or amend lodged material in the Office of Titles (regulation 17(2)(b)). Supplementary abstracts are lodged with the Registrar under regulation 11(5).

• Landowners, developers and construction contractors. While not directly regulated, they are affected financially and operationally because many obligations force the licensed surveyor to place permanent marks, delay marking pending construction, or lodge supplementary records after construction. For example, where construction will displace marks, the surveyor may postpone mark placement (regulation 11(4)), but a supplementary abstract must be lodged within 45 days after construction is completed (regulation 11(5)). Those measures create coordination obligations between surveyors, developers and contractors.

• Crown land managers. Where Crown land is involved, the Surveyor‑General may waive the requirement to mark boundaries if sufficient information exists (regulation 9(5)). That discretion affects how public land is surveyed and the timing of monumentation.

• Data custodians and registry users. Central Plan Office and Office of Titles staff will handle lodgements, versioning and amendments. Plans prepared outside the Subdivision Act 1988 framework must carry new version numbers each time amended (regulation 12(3)(b)(iv)), which creates an administrative tracking requirement for registry systems.

Who bears the cost. The Regulations impose tangible compliance costs on licensed surveyors and, indirectly, on their clients (developers, owners). Examples of cost-incurring requirements include:

• calibration and comparison of survey equipment to external standards and retention of comparison records for inspection (regulation 6);
• placing permanent marks and pegs to the specified material, size and spacing requirements, including the placement of additional permanent marks in subdivisions (regulation 11(3)(b)-(c));
• preparing the licensed surveyor's report with calibration details and potentially providing computational records upon request (regulation 15);
• lodging supplementary abstracts and re‑establishment records within tight timeframes (regulation 11(5); regulation 16).

Who decides. The Surveyor‑General and the Registrar exercise discretionary and supervisory roles: approving materials and alternate methods, consenting to amendments or notes lodged by other surveyors, approving alternate mark spacing, and requesting supporting computations (regulations 8, 9(1)(b), 11(3)(b)(ii), 15(3), 17(2)). These powers concentrate operational decision-making with those statutory officers.

Who benefits. The Regulations aim to produce consistent, high-quality cadastral surveys, benefiting land title registries, third-party purchasers of survey products, and public record integrity. That benefit accrues diffusely to registry users, conveyancers, lenders and landholders relying on accurate surveyed boundaries, as the instrument's objectives state (regulation 1).

The Regulations set out affirmative duties for licensed surveyors and procedural entitlements for the Surveyor‑General and Registrar. Rights are largely statutory discretion and requisition powers; duties are standards and timing obligations.

Principal duties of licensed surveyors

• Use of calibrated equipment and record retention: survey equipment must be compared to a recognised standard in units set out in the Survey Co‑ordination Regulations 2024 (regulation 6(1)(a)) and the process and basis of comparison must be adequate to reach the required accuracy (regulation 6(1)(b)). Records of comparisons must be retained and provided to the Surveyor‑General on request (regulation 6(2)).

• Achieve specified measurement and closure accuracy: ensure internal closure misclosure vector and linear measurement accuracy meet the numerical formulas in regulation 7(1)(a) and (c). Verify angular and directional measurements (regulation 7(2)). Apply a relaxed limit for building-referenced boundaries where no dimensions are to be shown (regulation 7(3)).

• Adopt and verify datum; coordinate conversion: adopt and verify a datum in accordance with a previous cadastral survey or plan; bring the bearing datum onto MGA2020 when abstracts are to be lodged with the Surveyor‑General or Registrar (regulation 11(1)(a)-(b)).

• Heights: where boundary heights are determined, relate them to AHD71 and properly verify the connection (regulation 11(1)(c)).

• Connections: measure position connections unless previous surveys have satisfactorily determined the subject land position; connect the cadastral survey to relevant permanent marks, primary marks, pegs and other survey marks (regulation 11(1)(d)-(e)).

• Monumentation and marking: place pegs and other boundary marks meeting the specified dimensions and materials; ensure line identification so that defined boundaries can be found (regulation 9(1)-(3)).

• Field recordkeeping and plan contents: maintain systematic field records containing an instruments list, all measurements, and sufficient information to prepare an abstract (regulation 12(1)); prepare abstracts containing datum, MGA2020 relationship, bearings, heights (if applicable), boundaries and dimensions, methods of marking, and other relevant boundary-determining information (regulation 12(2)); prepare plans as standard or electronic plans with required contents and versioning rules when appropriate (regulation 12(3)).

• Certification: include a certificate in Form 1 in the abstract of field records (regulation 13 and Schedule 1 Form 1) and use Form 2 for plans based on a cadastral survey or Form 3 for plans prepared under direction but not based on a cadastral survey (regulation 14 and Schedule 1 Forms 2-3).

• Licensed surveyor’s report: prepare, sign and date a detailed report to accompany any abstract required to be lodged with the Surveyor‑General or Registrar; include facts on abuttals, calibration, whether connections were made or postponed, and methods used where indirect methods were employed (regulation 15(1)-(2)).

• Provide supporting computations on request: if requested by the Surveyor‑General or Registrar, give copies of any computations or mathematical information associated with determinations (regulation 15(3)).

• Timely lodgements: lodge a record of a re‑established cadastral boundary within 60 days using Form 4 (regulation 16). Lodge a supplementary abstract within 45 days after construction is completed where mark placement was postponed under regulation 11(4) (regulation 11(5)).

Duties of the Surveyor‑General and Registrar (procedural and supervisory rights)

• Approval and waiver powers: the Surveyor‑General approves materials and placement standards for primary cadastral marks, may approve alternate marks where pegs are impractical, may waive marking for Crown land, and may approve alternate mark spacing in subdivisions (regulations 8, 9(1)(b), 9(5), 11(3)(b)(ii)).

• Consent for amendments: the Surveyor‑General and Registrar may consent to notes or amendments to lodged material by other licensed surveyors (regulation 17(2)(a)-(b)).

• Inspection and requisition: the Surveyor‑General may request to inspect records of equipment comparison (regulation 6(2)); both Surveyor‑General and Registrar may request computations and other mathematical information associated with surveys (regulation 15(3)).

Rights and limitations

• Authorisation to amend: a licensed surveyor may authorise another licensed surveyor to note or amend their report, abstract or plan, or to undertake additional field surveys to bring the survey up to date (regulation 17(1)(a)-(b)). Where material has already been lodged, the other surveyor may note or amend it only with the consent of the Surveyor‑General (for Central Plan Office) or Registrar (for Office of Titles) (regulation 17(2)).

• Exceptions and postponements: the Regulations permit postponement of permanent mark placement when marks are unlikely to be disturbed during construction; a postponed placement requires a supplementary abstract within 45 days after construction is finished (regulation 11(4)-(5)). The Surveyor‑General may also waive marking requirements for Crown land where sufficient information is available (regulation 9(5)).

Notably absent from the Regulations themselves are explicit penalty clauses, monetary fines, or specific licensing sanctions tied to breaches of individual regulation provisions. The Regulations therefore establish duties and reporting/inspection mechanisms; enforcement consequences (discipline, fines, criminal sanctions) are not set out in the Regulations text and will rely on the Surveying Act 2004 or other statutory regimes for any sanctions. The text does, however, produce certification obligations (Forms 1-4) that create professional attestations by the licensed surveyor (regulations 13-14; Schedule 1), which have legal and professional implications outside the Regulations.

Within the text of the Surveying (Cadastral Surveys) Regulations 2025 itself there are no express criminal offences, monetary penalties or administrative fines attached to contraventions of specific regulations. The instrument focuses on mandatory technical standards, recordkeeping, certification, and supervisory functions rather than specifying enforcement sanctions. Practical enforcement mechanisms and compliance levers that the Regulations do create or imply are the following.

Inspection and requisition powers

• The Surveyor‑General is explicitly authorised to request inspection of certain records. Regulation 6(2) requires a licensed surveyor to retain records of equipment comparisons and make them available to the Surveyor‑General for inspection upon request. Regulation 15(3) requires a licensed surveyor to provide computations or other mathematical information if requested by the Surveyor‑General or the Registrar. These are administrative requisitions that support oversight and audit.

Certification and professional attestation

• The Regulations require licensed surveyors to provide signed certificates in the forms set out in Schedule 1 for abstracts and plans (regulations 13-14 and Schedule 1 Forms 1-3) and to lodge re‑establishment records in Form 4 within prescribed timeframes (regulation 16). These signed certificates are formal attestations that the survey was conducted in accordance with the Surveying Act 2004 and that the survey accuracy accords with regulation 7. That statutory certification creates a formal record that can be relied upon by registries and third parties. Although the Regulations do not state sanctions, a false or negligent certificate may have professional or civil consequences under other laws or the Surveying Act 2004.

Delegated and supervisory discretion

• The Surveyor‑General and the Registrar exercise approval and consent powers under the Regulations in a way that can effectively shape compliance. For example, the Surveyor‑General can approve alternate mark spacing (regulation 11(3)(b)(ii)) and can consent to amendments to lodged material (regulation 17(2)(a)). Those discretionary powers are tools of administrative control that can be deployed to enforce standards or resolve non-compliance.

Timing and lodgement obligations as administrative levers

• The Regulations create time-bound obligations (supplementary abstracts within 45 days after construction completion, re‑establishment records within 60 days) that can be enforced administratively by the Registrar when considering lodgement of titles and plans (regulations 11(5), 16). Failure to lodge records is likely to impede registry processes, which is an indirect compliance pressure.

Enforcement pathway not set out in the Regulations

• Because the Regulations do not create express sanctioning mechanisms, where breaches occur parties and regulators will need to rely on the Surveying Act 2004, the Transfer of Land Act 1958, professional disciplinary regimes or other statutory powers to impose penalties, suspend licences, or take legal action. The Regulations' repeated references to the Surveyor‑General and the Registrar (for inspection and consents) indicate that enforcement will be mainly administrative via those offices rather than via fines embedded in the Regulations themselves. The legal consequences of failing to meet the certification obligations in Schedule 1 will turn on the Surveying Act 2004 and professional liability regimes, not the Regulations alone.

Implementation risk and compliance monitoring

• The principal on‑paper enforcement risk is not the absence of sanctions, but the practical capacity of the Surveyor‑General and Registrar to inspect records, to require computations, to withhold consent for lodged amendments, and to refuse to accept non‑conforming plans or abstracts into the public record. The Regulations create specific evidentiary requirements (calibration records, computations, abstracts) which the supervisory offices can demand before acting on lodgements. The operational capacity of those offices to audit and to impose administrative consequences will determine how effectively the Regulations are enforced.

In short, the Regulations prescribe mandatory conduct, reporting, and certification mechanics and give inspection and consent powers to the Surveyor‑General and Registrar. They do not themselves set express penalties; enforcement will proceed by administrative oversight, certification consequences and recourse to other statutes and professional regulation for sanctions.

The Regulations are explicitly designed to operate within a statutory ecosystem. They both refer to and defer to other Acts and subordinate instruments for definitions, standards and exceptions. The principal statutory instruments and the nature of the interaction are:

• Surveying Act 2004. The Regulations are made under section 63 of the Surveying Act 2004 (regulation 2) and repeatedly reference compliance with that Act in the required certificates (Schedule 1 Forms 1-4). The Regulations do not attempt to replicate licensing criteria, disciplinary sanctions, or other governance elements that the Surveying Act 2004 will contain. Instead, they implement technical and procedural rules under the Act’s delegation.

• Survey Co‑ordination Regulations 2024 and Survey Co‑ordination Act 1958. The Regulations rely on definitions and technical references in the Survey Co‑ordination Regulations 2024: AHD71, MGA2020, electronic plan, standard plan and a units-of-measurement requirement in regulation 14(a) of the Survey Co‑ordination Regulations 2024 are incorporated by reference (regulation 5; regulation 6(1)(a)). Primary cadastral marks are defined in relation to the Survey Co‑ordination Act 1958 (regulation 5). This linkage means horizontal and vertical datum, coordinate system conversions, and plan format standards are standardised in the co‑ordination instruments, and the cadastral survey regulations expect conformity to those instruments.

• Transfer of Land Act 1958. The Registrar, defined as in the Transfer of Land Act 1958 (regulation 5), receives certain lodged abstracts and plans and can request computations (regulation 15(3)). The interaction anticipates registry procedures under the Transfer of Land Act for registration of plans and titles.

• Subdivision Act 1988. The Regulations carve out an express exception for plans prepared under the Subdivision Act 1988 and its regulations: the certification requirements in regulations 14(1) and (2) do not apply to plans prepared under that Act (regulation 14(3)). Additionally, versioning rules for plans prepared not under the Subdivision Act are set out: such plans must receive a new version number each time amended (regulation 12(3)(b)(iv)). This creates parallel pathways for plans prepared under subdivision approvals and plans prepared in other contexts.

• Geographic Place Names Act 1998. If a plan includes the name of a place, the plan must use the current geographic name registered in the Register of Geographic Names under that Act (regulation 12(3)(c)). This requirement ensures consistency of place nomenclature between cadastral plans and the statutory geographic names register.

• Subordinate Legislation Act 1994 and Interpretation of Legislation Act 1984 (ILA). The endnotes reference the Subordinate Legislation Act 1994 for the 10‑year sunset (endnotes) and note ILA provisions authorising style changes and interpretation matters (endnotes: Interpretation details). The text of the Regulations is therefore to be read with standard interpretation rules and the sunset mechanism prescribed by subordinate legislation.

Practical consequences of these interactions

• Technical conformity: licensed surveyors must ensure their workflows, equipment, software and output conform not only to these Regulations but to co‑ordination instruments (Survey Co‑ordination Regulations 2024) for datums and plan formats. References to MGA2020 and AHD71 make those co‑ordination instruments operational constraints.

• Registry dependencies: lodgement practices and acceptance of plans and abstracts depend on the Registrar and Central Plan Office procedures under the Transfer of Land Act. The Regulations’ requirements (versioning, certificates) are designed to be compatible with title registration systems.

• Exceptions and precedence: where conflicting or overlapping requirements exist between the Subdivision Act 1988 regime and these Regulations, the Subdivision Act regime governs certification and plan preparation for subdivision plans, because regulations 14(3) expressly disapply the plan certification rules for plans prepared under the Subdivision Act.

• Administrative discretion: multiple provisions confer discretion on the Surveyor‑General and Registrar (approval of alternate materials/spacing, waivers for Crown land, consent to amendments) , the exercise of these discretions will occur within the broader statutory frameworks of the Surveying Act 2004 and the Transfer of Land Act 1958.

Because the Regulations are tightly interwoven with those primary Acts and co‑ordination regulations, practitioners need to treat the Regulations as one element of a multi‑instrument regulatory matrix. Compliance requires cross‑checking definitions, datum specifications, plan formats and registry lodgement rules in the Survey Co‑ordination Regulations 2024, the Surveying Act 2004, and the Transfer of Land Act 1958.

The Regulations provide a limited amendment and historical trace in their own text and endnotes.

• Revocations. Regulation 4 expressly revokes the Surveying (Cadastral Surveys) Regulations 2015 and the Surveying (Cadastral Surveys) Amendment Regulations 2018 (regulation 4(a)-(b)). The endnotes clarify the specific instruments: S.R. No. 43/2015 as amended by S.R. No. 189/2018, and S.R. No. 189/2018 (Endnotes 3 Explanatory details).

• No amendments since making. Endnote 2 (Table of Amendments) states that there are no amendments made to the Surveying (Cadastral Surveys) Regulations 2025 by statutory rules, subordinate instruments and Acts. That indicates that as at the Version date (1 June 2025, Version No. 001) the instrument is in its initial form and has not been subsequently amended.

• Sunset provision. The endnotes state that the Regulations will sunset ten years after the day of making on 27 May 2035 (see section 5 of the Subordinate Legislation Act 1994). The Regulations were made on 27 May 2025 and commenced on 1 June 2025 (endnotes and regulation 3). The sunset timeline provides an automatic expiry unless republished or remade.

• References to predecessor instruments. The Explanatory details link reg 4(a) and reg 4(b) to the specific earlier statutory rules (S.R. No. 43/2015 and S.R. No. 189/2018), showing the legislative lineage and signalling that the 2025 Regulations replace earlier iterations.

• Style and interpretation updates. The endnotes include interpretive remarks from the Interpretation of Legislation Act 1984 and reference style changes authorised by that Act (endnotes: Interpretation of Legislation Act 1984 (ILA)). Those notes indicate that headings, notes and punctuation within the Statutory Rule form part of the Rule for interpretation purposes, a technicality useful when parsing regulation text.

Practical implication for practitioners

• Current standing: because there are no amendments yet, the text as printed is the operative standard. Practitioners should monitor for new statutory rules before the sunset date to see whether technical requirements, numeric tolerances, or procedural obligations change.

• Repeal and replacement risk: with a sunset provision, regulators may review and replace these Regulations in the medium term; stakeholders with substantial compliance costs should watch for consultation on replacement rules or amendments ahead of the end of the ten‑year term.

• Historical continuity: the revocation of the 2015/2018 instruments suggests the 2025 Regulations are a consolidation and update of prior technical standards. To assess differences in technical tolerances, monumentation practice, or plan format changes, practitioners should compare the 2015/2018 text to the 2025 instrument; however, the Regulations themselves do not contain that comparative analysis.

Overall, the Amendment history section of the instrument is straightforward: the 2025 Regulations replace the 2015/2018 instruments, are currently unamended, and will sunset in 2035.

The Regulations themselves do not contain any litigation history, references to cases, or judicial interpretations. The instrument names no cases and the endnotes (Table of Amendments and Explanatory details) do not record any litigation or legal challenges. Therefore, as of the Version date (1 June 2025), there is no litigation history embedded in this statutory instrument.

Practical observations about litigation risk and potential disputes, grounded in the text

• Certification as a focal point for disputes. The Regulations impose signed certificates (Schedule 1 Forms 1-4) whereby a licensed surveyor certifies compliance with the Surveying Act 2004 and that survey accuracy accords with regulation 7 (Schedule 1 Forms 1-2 and 4). These signed attestations create a documented representation of accuracy and compliance that could become evidence in civil disputes concerning boundary location, conveyancing errors, or professional negligence claims. While no cases are cited in the Regulations, in practice the certification obligations elevate the evidentiary significance of the abstract, plan and licensed surveyor’s report.

• Ambiguity risks that could generate litigation. Certain drafting gaps or potential ambiguities in the Regulations (for example, the missing numeric coefficient in regulation 7(1)(d) for height accuracy) could lead to disagreement between surveyors, registries, and landowners about what standard was required, and could thereby become the subject of administrative review or civil litigation if consequential disputes arise over boundary determination or title registration.

• Administrative decisions and appeals. Many enforcement levers sit with the Surveyor‑General and Registrar (consent for amendments, approval of alternate spacings and marking methods, waiver powers). If the Surveyor‑General or Registrar exercises these discretions in a particular way, affected parties may seek administrative review or judicial review of those discretionary decisions under relevant administrative law principles (for example, seeking merits review or judicial review) , though those procedures are outside the Regulations themselves and depend on wider administrative law frameworks.

Because there is no litigation history recorded in the instrument, researchers or practitioners seeking to understand how courts or tribunals treat these provisions will need to monitor post‑commencement cases and any appeals arising from disputes that hinge on the Regulations.

This section identifies drafting pitfalls, potential compliance traps, and operational friction points visible in the text. Each item is grounded in the Regulations and indicates the concrete mechanism that creates risk or uncertainty.

1. Drafting omission in height-accuracy formula (regulation 7(1)(d))

• The text of regulation 7(1)(d) reads: "all height differences measured or derived achieve an accuracy equivalent to a survey misclosure of millimetres where 'k' is the distance between any 2 points, in kilometres." The absence of a numeric coefficient before "millimetres" is a clear drafting lacuna.
• Practical consequence: surveyors, registrars and the Surveyor‑General will lack an expressly stated accuracy tolerance for heights. That creates uncertainty whether a particular measurement complies with regulation 7(1)(d). The omission is material because the Regulations elsewhere prescribe specific numeric tolerances (regulation 7(1)(a)-(c)). Until clarified by guidance, correction or administrative instruction, this gap poses interpretive and enforcement risk. It could also be relied on by a licensed surveyor to contest a compliance finding, or conversely create prosecutorial ambiguity for professional disciplinary action.

2. Dependence on external instruments for critical definitions and units (regulations 5 and 6(1)(a))

• Several foundational items (AHD71, MGA2020, units of measurement, standard plan, electronic plan) are defined in the Survey Co‑ordination Regulations 2024 and not repeated in these Regulations (regulation 5; regulation 6(1)(a)). Practitioners must therefore consult the 2024 co‑ordination regulations to know precisely what units, datums, plan formats and conversion standards apply.
• Practical consequence: compliance requires cross-referencing multiple statutory instruments. Failure to apply the exact units or datums as specified by the co‑ordination regulations could result in non‑conforming surveys.

3. Mandatory minimum three-mark connection and potential logistical cost (regulation 11(3))

• A cadastral survey must connect to at least three permanent marks or primary cadastral marks in the immediate vicinity (regulation 11(3)(a)). If fewer than three exist, the surveyor must place further marks to reach the minimum.
• Practical consequence: in areas with sparse permanent marks, surveyors or their clients will incur costs to install permanent marks, and must coordinate approvals for placement. There is limited flexibility, although the Surveyor‑General can approve alternate mark spacing in subdivisions (regulation 11(3)(b)(ii)), and may permit postponement in predictable construction scenarios (regulation 11(4)). Placing permanent marks can be expensive and time-consuming.

4. Density rule in subdivisions and required proportion of permanent marks (regulation 11(3)(b)-(c))

• Where more than 10 allotments/lots exist at ground level, additional marks must be placed within the subdivision so that the distance between marks is not greater than 100 metres, unless the Surveyor‑General approves an alternate distance (regulation 11(3)(b)). If more than four marks are required under this rule, one in every five marks must be a permanent mark (regulation 11(3)(c)).
• Practical consequence: developers and surveyors must budget for a significant number of marks in medium to large subdivisions, and ensure a proportion are permanent marks. There is an administrative approval route for alternate spacing but it requires Surveyor‑General engagement.

5. Timing obligations and consequential process risk (regulations 11(5), 16)

• Postponed placement of marks requires lodging a supplementary abstract within 45 days after construction is completed (regulation 11(5)). A re‑established boundary must be lodged in Form 4 within 60 days (regulation 16).
• Practical consequence: these deadlines require active case management between construction schedules and surveying practices. Failure to lodge within the deadlines risks incomplete public records, registry refusal or administrative friction. The 45‑ and 60‑day windows are relatively short; practitioners must plan for timely lodgement.

6. Certification obligations expose surveyors to attestations (regulations 13-15; Schedule 1)

• Schedule 1 Forms require the licensed surveyor to certify that the abstract/plan correctly represents the survey and that survey accuracy accords with regulation 7. The licensed surveyor’s report must detail calibration and methods (regulation 15(2)(b)-(d)).
• Practical consequence: these certifications create a direct attestation that can be used in civil proceedings or professional discipline. Surveyors must ensure their measurements, records, calibrations and computations are available and defensible.

7. Amendment process requires third-party consent for lodged material (regulation 17(2))

• Once material is lodged, another licensed surveyor may only note or amend it with the consent of the Surveyor‑General (Central Plan Office) or Registrar (Office of Titles) (regulation 17(2)). The original surveyor can authorise an initial amendment without such consent (regulation 17(1)).
• Practical consequence: correcting or updating lodged plans can be administratively burdensome if third‑party consents are required. This can delay registry corrections and complicate conveyancing.

8. Interaction with Subdivision Act 1988 plan certification (regulation 14(3))

• Regulations 14(1)-(2) require specific plan certificates but expressly exclude plans prepared under the Subdivision Act 1988 (regulation 14(3)).
• Practical consequence: surveyors working on subdivision plans must ensure they understand which certification regime applies; mixing forms or versioning rules could lead to inconsistent lodgement.

9. Reliance on Surveyor‑General/Registrar capacity

• Many practical compliance outcomes rely on the Surveyor‑General and Registrar for approvals, waivers, inspections and consents (regulations 6(2), 8, 9(1)(b), 11(3)(b)(ii), 15(3), 17(2)). The Regulations do not specify timelines for those administrative actions.
• Practical consequence: delays or inconsistent administration within those offices may create business risk for surveyors and their clients. Practitioners should plan for possible wait times and obtain written approvals where possible.

10. Ambiguity about enforcement and sanctions

• The Regulations do not state explicit penalties. Enforcement will therefore depend on the Surveying Act 2004 and registries’ operational policies.
• Practical consequence: practitioners should ensure compliance not only to avoid registry rejection but to mitigate professional liability, because the Regulations create certification obligations that interact with other statutory sanctions and common law liabilities.

Each of the above "gotchas" is traceable to a concrete subregulatory mechanism in the Regulations; they indicate where extra care, written records, client budgeting, and pre‑lodgement engagement with the Surveyor‑General or Registrar will reduce legal and operational risk.

Below is a practical compliance checklist and operational guidance organised around the Regulations’ explicit duties. The checklist translates each regulatory obligation into actionable steps a licensed surveyor or a surveying firm should follow to meet the Regulations’ requirements.

1. Equipment, calibration and record retention (regulation 6)

• Use survey equipment compared to a standard of measurement in units specified by regulation 14(a) of the Survey Co‑ordination Regulations 2024 (regulation 6(1)(a)). Confirm which units and procedures the 2024 co‑ordination regulations require and ensure instrument software and settings match those units.
• Ensure the process and basis of comparison are adequate to obtain the accuracy required by regulation 7(1)(a)-(d) (regulation 6(1)(b)). Document the calibration procedure, the standard used, date and personnel.
• Retain all records of comparisons and make them readily available for inspection by the Surveyor‑General on request (regulation 6(2)). Keep both digital and physical copies where possible and maintain a retention policy aligned to likely statute-of-limitations and professional insurance timelines.

2. Achieve and verify measurement accuracy (regulation 7)

• Implement field procedures to meet the misclosure tolerance (internally calculate the misclosure vector using "a" and "b" as the easting/northing misclosure components, and ensure misclosure vector length ≤ 15 mm + 100 ppm of perimeter) (regulation 7(1)(a)-(b)).
• Ensure length measurements meet 10 mm + 60 ppm accuracy (regulation 7(1)(c)). Calibrate field instruments and perform independent checks on longer runs of measurements.
• Verify all directional and angular measurements (regulation 7(2)) by redundant observations, repeated instrument stations, or control networks as appropriate.
• For height determinations, check the intended standard in the Survey Co‑ordination Regulations; note the drafting omission in regulation 7(1)(d) and seek formal guidance from the Surveyor‑General or professional body to determine the expected numeric threshold until the regulation is clarified or corrected.
• Where boundaries are to be defined by building parts with no dimensions to be shown, document use of the relaxed tolerance (limit of error 50 mm or 1/200, whichever is greater) and record how this tolerance was applied (regulation 7(3)).

3. Datum adoption and connection to MGA2020/AHD71 (regulation 11; regulation 12)

• Adopt and verify datum in accordance with a previous cadastral survey or plan (regulation 11(1)(a)). Document datum adoption decisions and provide references to the previous surveys used.
• If lodging an abstract with the Surveyor‑General or Registrar, bring bearing datum onto MGA2020 and record the MGA2020 relationship to the adopted cadastral datum (regulation 11(1)(b); regulation 12(2)(b)). Maintain conversion computations and include them in the abstract.
• Where heights are determined, relate heights to AHD71 and verify the physical connection; record and lodge proofs of the vertical connection (regulation 11(1)(c); regulation 12(2)(d)).

4. Connection to permanent marks and mark placement (regulation 11(3)-(5); regulation 8-9)

• Plan surveys to connect to at least three permanent marks or primary cadastral marks in the immediate vicinity. If fewer exist, schedule placement of further marks to reach three (regulation 11(3)(a)).
• For subdivisions with more than 10 allotments at ground level, ensure mark spacing does not exceed 100 metres or obtain the Surveyor‑General's approval for an alternate spacing in advance (regulation 11(3)(b)).
• If more than four marks are required, ensure one in every five marks is a permanent mark (regulation 11(3)(c)).
• Where marks are likely to be disturbed by planned construction, apply regulation 11(4) by postponing further mark placement and document the reason. Then lodge a supplementary abstract showing particulars and connections to marks placed within 45 days after construction finishes (regulation 11(5)).
• Ensure primary cadastral marks use durable, permanent and stable materials approved by the Surveyor‑General, are placed where accessible and not likely to be damaged (regulation 8). Seek written approvals for non‑standard materials or placement.

5. Pegging standards and line identification (regulation 9)

• Use pegs not less than 50 mm square and 300 mm long, made of sound seasoned timber or other durable material, set with top not more than 20 mm above ground (regulation 9(3)(a)-(c)).
• Where pegs are impractical, obtain approval from the Surveyor‑General for other suitable marks and document the approval (regulation 9(1)(b)).
• Do not mark boundaries that are not surveyed in a partial cadastral survey (regulation 9(4)).

6. Field records and abstract content (regulation 12)

• Maintain systematic, comprehensible field records including an instruments list, all measurements made, and sufficient information to prepare an abstract (regulation 12(1)(a)-(b)).
• Prepare an abstract that includes: cadastral datum details, MGA2020 relationship, bearings on MGA2020, heights on AHD71 if applicable, boundaries and dimensions of subject and adjoining land, method of marking perimeter boundaries, and any information used to determine boundaries (regulation 12(2)(a)-(g)).
• Ensure field records are readily available for submission or perusal by any person authorised by the Surveyor‑General (regulation 12(1)(c)).

7. Plan preparation and versioning (regulation 12(3); regulation 14)

• Prepare the plan as either a standard plan or electronic plan as defined in the Survey Co‑ordination Regulations 2024, and include all relevant abstract information related to boundaries and road alignments (regulation 12(3)(a)-(b)(i)).
• Include registered easements, plan or reference number, and where the plan is not prepared under the Subdivision Act 1988, issue a new version number each time the plan is amended (regulation 12(3)(b)(ii)-(iv)).
• If a plan includes a place name, use the current geographic name registered under the Geographic Place Names Act 1998 (regulation 12(3)(c)).
• Endorse plans with the correct certificate: Form 2 when the plan is prepared from a cadastral survey executed under your direction (regulation 14(1) and Schedule 1 Form 2); Form 3 when the plan was prepared under your direction but not from a cadastral survey carried out for the purpose of making the plan (regulation 14(2) and Schedule 1 Form 3). Do not apply these certificates to plans prepared under the Subdivision Act 1988 (regulation 14(3)).

8. Licensed surveyor’s report and support materials (regulation 15)

• Prepare a detailed licensed surveyor's report to accompany any abstract that is required to be lodged, signed and dated (regulation 15(1)).
• Ensure the report covers abuttals and encumbrances, occupation details, relationship with other surveys, how boundaries were determined, calibration details of measuring equipment, whether connections were made or postponed, and method descriptions if indirect methods were used (regulation 15(2)(a)-(d)).
• Keep, and be ready to provide on request, copies of computations and mathematical or other information associated with the survey and boundary determinations (regulation 15(3)).

9. Timely lodging and re‑establishment records (regulations 11(5), 16)

• If marks placement is postponed under regulation 11(4), lodge a supplementary abstract with the Registrar within 45 days after construction completion showing particulars and connections to marks placed (regulation 11(5)).
• Lodge a record of having re‑established a cadastral boundary with the Surveyor‑General in the form of Form 4 within 60 days after re‑establishment (regulation 16 and Schedule 1 Form 4).

10. Amendments and authorisations (regulation 17)

• If another surveyor will note or amend your report, abstract or plan, provide a written authorisation as required by regulation 17(1).
• When seeking to note or amend a lodged document prepared by another surveyor, obtain the Surveyor‑General’s consent for Central Plan Office lodgements or the Registrar's consent for Office of Titles lodgements (regulation 17(2)).

11. Recordkeeping, audit readiness and client communications

• Keep all field notes, instrument lists, calibration certificates, computation files, digital plan files, certificates and signed reports in an organised archive. Where possible, keep backups and metadata demonstrating dates and authorship.
• Communicate to clients the likely costs and timing implications of achieving the required monumentation density, placing permanent marks, lodging supplementary abstracts, and obtaining Surveyor‑General approvals when needed.
• When in doubt about the omitted numeric value in regulation 7(1)(d), obtain written guidance from the Surveyor‑General or seek professional association guidance to reduce exposure.

12. Administrative engagement and pre‑lodgement checks

• Where your work will require the Surveyor‑General’s consent or approvals (alternate mark spacing, prostponement approvals for Crown land, alternative marking methods), engage early and seek written approvals to avoid delays during lodgement.
• Before lodging, perform an internal compliance checklist matching the abstract, plan and licensed surveyor’s report to all requirements in regulations 12-15 and the Schedule 1 certificate wording.

13. Monitor for updates and amendment

• Since these Regulations will sunset in 2035 and are new as of 1 June 2025, monitor for any amendments, corrigenda (particularly for the drafting omission in regulation 7(1)(d)), policy guidance from the Surveyor‑General, and any administrative instructions from the Central Plan Office or Registrar.

Implementing these steps will materially align a surveying practice with the technical, administrative and documentation duties the Regulations prescribe. Where uncertainty or gaps exist,most saliently the height‑accuracy drafting omission,obtain written clarification from the Surveyor‑General and document reliance on that clarification in survey files.
