Survey Regulations 2020

The regulations organise around three core regulatory concepts: qualification and competence gating, survey evidence and accuracy standards, and institutional control via the Surveyor‑General and Institution of Surveyors.

1. Qualification and competence gating (Part 2, r 5-8). The rules list discrete acceptable academic qualifications (r 5: specific degrees from University of South Australia and Flinders University, and equivalence certified by the Institution of Surveyors). They then impose a minimum practical experience requirement: 400 days for applicants who have not previously been licensed or registered, with a licence applicant additionally requiring at least 200 days in cadastral surveying (r 6(1)). Experience must be made up of discrete periods of at least four weeks unless the Institution agrees otherwise (r 6(2)-(3)), and each period must be approved by the Institution (r 6(3), (4)). Competence is also assessed through projects or refresher courses set and assessed by persons appointed by the Institution with the Minister’s approval (r 7(3)-(4), r 8(3)-(4)). Former practitioners who have been out of practice for five or more years must complete refresher courses (r 8(1)-(6)).

2. Survey evidence and accuracy standards (Part 3, r 11-21). Surveyors must obtain all information likely to provide evidence of boundaries that is reasonably accessible (r 11(1)). They must locate existing survey marks, reference marks, improvements and natural features; connect the survey to existing surveys and, where significant differences appear, do further work to resolve measurement or placement errors (r 11(2)). Surveys must mark every new boundary with survey pegs so that boundaries are unambiguous on the ground and survey marks must be secure (r 12). Accuracy standards are not numerically set in the instrument; they are left to the Surveyor‑General who determines the "required standard of accuracy" and can require evidence of compliance within 14 days on request (r 14). For land in the coordinated cadastre, the Map Grid of Australia 2020 coordinates recorded in the plan must be accepted (r 20), and any cadastral survey must connect to at least three permanent survey marks with known or established MGA2020 coordinates and be adjusted to their scale and orientation (r 21).

3. Institutional control and duties (Surveyor‑General and Institution of Surveyors). The Institution of Surveyors approves practical experience periods, supervises proposals and progress reporting, approves supervisors and assesses projects and refresher courses (r 6-8). The Surveyor‑General issues directions on permanent marks (r 13), determines required accuracy and requests evidence (r 14), can request reports in approved form (r 16), may exempt surveys or classes of surveys either by notice to a surveyor or by Gazette notice (r 24), may remove or reinstate marks and recover costs (r 23), may require additional work if the Surveyor‑General believes on reasonable grounds that boundaries may be inaccurate (r 25), and must publish directions in the Gazette and on a website (r 26).

Auxiliary concepts include technical definitions of survey peg, reference mark and survey mark (r 10), the requirement to comply with the Lodgement of Boundary Identification Surveys Code for identification surveys (r 17), and mandatory compliance of lodged plans with Registrar‑General requirements under the Real Property Regulations 2024 (r 18). Record retention (field notes must be kept for at least 10 years, r 15(1)), certification formalities (certificates in a form approved by the Surveyor‑General, r 19), and defined timeframes for performance and response are recurring operational concepts.

Taken together, the main concepts create a layered compliance architecture: entry standards and supervised experience gate access to practice; technical and documentary rules shape day‑to‑day survey activity; and the Surveyor‑General and Institution of Surveyors exercise supervisory, corrective and prescribing powers.

Primary affected persons and entities:

• Applicants for licences and registrations as surveyors. The regulations directly set academic qualifications (r 5), practical experience thresholds (r 6), project and assessment requirements (r 7), and refresher course requirements for lapsed practitioners (r 8). Applicants who lack the listed tertiary qualifications must rely on an equivalence determination by the Institution of Surveyors (r 5(e)).

• Licensed and registered surveyors. Surveyors must comply with Part 3 duties when carrying out cadastral surveys, including evidence‑gathering, marking boundaries, protecting marks, meeting accuracy standards set by the Surveyor‑General, recordkeeping and providing reports on request (r 11-16, r 19-21). There are specified penalties and potential recovery of costs where the Surveyor‑General intervenes (r 19, r 22(2), r 23).

• Supervisors and prescribed supervisors. A "prescribed supervisor" is defined as a licensed surveyor licensed for at least two years before supervision begins, or a person with qualifications approved by the Institution who has held those qualifications for at least two years (r 6(8)). Supervisors must certify satisfactory completion of periods of practical experience in a manner approved by the Institution and may be required to submit progress reports (r 6(4)-(7)). Supervisors are constrained by a restriction on supervising multiple supervised persons simultaneously unless one has already completed at least one year (r 6(4)(b), r 6(5)(c)(ii)).

• The Institution of Surveyors and the Surveyors Board. The Institution of Surveyors has substantial gatekeeping roles: approving periods of practical experience, agreeing to proposed supervision arrangements, appointing persons (with Ministerial approval) to set and assess projects and refresher courses, and publishing guidelines that assessments must have regard to (r 6, r 7, r 8).

• The Surveyor‑General. The regulations give the Surveyor‑General operational control over accuracy standards, directions on permanent marks, approval of certified plan forms, requests for reports and information, exemption powers (including Gazette notices), powers to remove marks, require additional work and recover costs, and a duty to publish directions (r 13-16, r 19, r 23-26).

• The Registrar‑General. Plans lodged must comply with requirements issued by the Registrar‑General pursuant to regulation 16 of the Real Property Regulations 2024 (r 18), which brings the Registrar‑General’s technical lodgement rules into play for practising surveyors and those preparing plans for lodgement.

Secondary affected groups and downstream parties:

• Land developers and subdividers. Obligations on reinstatement of marks after division into more than five allotments (r 22) and Surveyor‑General intervention create potential contractual and practical effects on developers who commission surveys.

• Land registrants, conveyancers and title investigators. The rules governing plan certification (r 19), adherence to the coordinated cadastre and MGA2020 coordinates (r 20-21), and compliance with Registrar‑General plan requirements (r 18) affect the reliability and form of plans lodged in the Lands Titles Registration Office, which downstream parties use for title dealings.

• Employers of surveyors and professional indemnity insurers. The supervisory and reporting architecture, plus potential cost recovery by the Surveyor‑General if a surveyor fails obligations (r 22(2), r 23), changes risk allocation for firms that employ surveyors or engage contractors.

Who decides and who pays:

• The Institution of Surveyors decides on education equivalence, supervisory approval and project setting/assessment (r 5, r 6, r 7). That function transfers administrative burdens to applicants and supervisors, who must prepare proposals, reports and certifications.

• The Surveyor‑General decides accuracy standards, exemptions, publication of directions and can require additional work and recover remedy costs (r 13-16, r 24-26). When the Surveyor‑General intervenes (reinstating marks, undertaking additional work), costs may be recovered from the original surveyor as a debt (r 22(2), r 23).

• Individuals pay through time costs to meet 400 days of practical experience, supervisor certification and project/completion assessments, recordkeeping obligations (retaining field notes for 10 years, r 15(1)), and potential liability to repay costs if remedial action is taken by the Surveyor‑General.

The regulations also affect the balance between national/geodetic standards and local practice by requiring connection to MGA2020 and acceptance of coordinated cadastre coordinates (r 20-21), making national coordinate systems a mandatory touchstone in cadastral work.

Duties imposed on applicants and surveyors are explicit and prescriptive; rights are mostly procedural (application and exemption processes) and tied to institutional approvals.

Primary duties on applicants and surveyors

• Academic and experience requirements. Applicants must hold one of specific degrees listed (r 5(a)-(da)) or equivalent qualifications as accredited by the Institution (r 5(e)). For those who have not previously been licensed or registered, applicants must accrue at least 400 days practical experience in surveying; licence applicants require at least 200 days in cadastral surveying (r 6(1)). Experience must be in discrete periods of at least four weeks unless the Institution accepts otherwise (r 6(2)) and each period must be approved by the Institution (r 6(3)).

• Supervision and reporting. Prescribed supervisors must certify satisfactory completion in a manner approved by the Institution (r 6(4)). Where an applicant undertakes a proposed supervised period, supervisors must submit progress reports at specified intervals and within 28 days after completion; failure to submit such reports attracts a maximum penalty of $200 (r 6(4)-(7)).

• Competence demonstration. Applicants must complete projects or courses and demonstrate competence assessed by persons appointed by the Institution with Ministerial approval (r 7(1)-(4), r 8(1)-(4)). Assessment must consider workplace standards and relevant Institution guidelines (r 7(5), r 8(5)).

• Survey process duties. In carrying out cadastral surveys, surveyors must obtain all reasonably accessible information likely to be evidence of boundaries (r 11(1)), locate existing marks and improvements, connect to existing surveys held in the Lands Titles Registration Office, and resolve significant differences found in existing survey data (r 11(2)). Surveyors must place survey pegs making boundaries readily discernible and protect survey marks from accidental disturbance (r 12).

• Accuracy, recordkeeping and disclosure. Surveyors must use equipment and techniques to meet the accuracy standard set by the Surveyor‑General, conduct adequate checks and provide satisfactory evidence of compliance within 14 days of written requests (r 14). They must make and retain records or notes of survey for at least 10 years and supply copies within 14 days of written request (r 15).

• Plan certification and lodgement. Plans lodged in the Lands Titles Registration Office must comply with the Registrar‑General’s requirements under the Real Property Regulations 2024 (r 18). A surveyor must certify a plan in a form approved by the Surveyor‑General and must not certify unless satisfied the survey and plan comply with this Part (r 19(1), r 19(3)). If a certifying surveyor certifies work by another, they must certify supervision and compliance with the Act (r 19(2)).

• Specific geodetic duties. For land within the coordinated cadastre, surveyors must accept MGA2020 coordinates as recorded (r 20). Surveys must connect to at least three permanent marks with known MGA2020 coordinates and adjust to their scale and orientation; discrepancies beyond Surveyor‑General standards must be reported and directions followed (r 21).

Surveyor‑General rights and powers (not framed as rights but as powers):

• The Surveyor‑General can direct placement of permanent survey marks and require information once placed (r 13); determine accuracy standards and request evidence of compliance with 14‑day response obligations (r 14); request survey reports in an approved form and impose timing requirements (r 16); exempt surveyors or classes of surveys from specified requirements where compliance is impracticable or an alternative method will not jeopardise accuracy (r 24); remove and reinstate incorrectly placed marks and recover costs from the person responsible (r 23); require additional work where there are reasonable grounds that a plan’s boundaries may not be accurate (r 25); and must publish directions in the Gazette and on a specified website (r 26).

Procedural rights for surveyors and applicants:

• Right to propose and have the Institution of Surveyors decide on supervised practical experience arrangements (r 6(5)-(6)). The Institution must decide and notify the applicant "as soon as reasonably practicable" whether it agrees to the proposal (r 6(6)).

• Right to apply to the Surveyor‑General for an exemption under r 24(1); the Surveyor‑General may grant exemptions on application and may impose conditions, vary or revoke them (r 24(2)).

Enforcement and recovery mechanics (procedural rights and burdens):

• Where the Surveyor‑General undertakes remedial work because a surveyor did not reinstate marks after a division into more than five allotments, the Surveyor‑General may give not less than 14 days’ written notice and then undertake work and recover costs as a debt (r 22(2)). Similarly, on removal or removal and reinstatement of marks, the Surveyor‑General may recover costs from the person who incorrectly placed a mark (r 23).

Compliance thresholds, timelines and penalties:

• Key response periods are 14 days for providing evidence or reports on request by the Surveyor‑General (r 14(2), r 15(2), r 16(1)), 28 days for supervisor progress and completion reports (r 6(7)), 30 days for reinstating marks after certain divisions (r 22(1)), and 14 days to comply with a Surveyor‑General requirement for additional work (r 25(2)). Statutory maximum penalties are specified for some breaches (r 6(7) maximum $200; r 19 maximum $2,000; r 27 maximum $2,000).

Rights are mostly procedural and conditional: applicants and surveyors can apply for exemptions, present supervised proposals to the Institution, and must be given notice before Surveyor‑General corrective action in certain circumstances (r 22(2)(a)). The balance set by the regulations is therefore strongly oriented towards prescriptive duties with limited procedural recourse.

The regulatory instrument combines monetary maximum penalties, remedial powers exercisable by the Surveyor‑General, and administrative controls via approval and certification regimes. The enforcement architecture uses gradations: small fines for procedural reporting failures, stronger sanctions for certification or ethical breaches, and cost recovery for remedial action.

Specified monetary penalties

• r 6(7) sets a maximum penalty of $200 for the supervisor’s failure to report progress as required when supervising practical experience under an agreed proposal. This is a targeted penalty linked to supervisory reporting duties, rather than general misconduct.

• r 19 sets a maximum penalty of $2,000 for certifying a plan when the surveyor is not satisfied the survey and plan comply with this Part. The rule imposes a certification obligation, and the monetary cap is attached to false or negligent certification.

• r 27 sets a maximum penalty of $2,000 for failure to comply with the provisions of the Professional Practice Rules of the Surveyors Board‑Code of Ethics as adopted by these regulations. The ethics code is applied by reference, and breaches carry the same monetary cap.

Remedial and recoverable enforcement powers

• Recovery as a debt. Where surveyors fail to reinstate marks after a division into more than five allotments, the Surveyor‑General may undertake additional works and place required marks after giving not less than 14 days notice, and then amend a survey plan and recover the costs as a debt from the surveyor (r 22(2)(a)-(b)). The Surveyor‑General may similarly remove incorrect or unlawfully placed marks and recover costs of removal or removal and reinstatement from the person responsible (r 23(a)-(c)). These are enforcement mechanisms that convert corrective action into a debt claim.

• Directions and additional work. The Surveyor‑General may require additional work where there are reasonable grounds that a survey was not carried out in accordance with the regulations and may require compliance within 14 days (r 25). Failure to comply with an additional work requirement engages the risk of further corrective measures and cost recovery.

Administrative and procedural enforcement

• Approval and certification regimes create administrative controls. The Institution of Surveyors approves practical experience periods (r 6(3)-(4)), supervisors certify completion (r 6(4)), and assessors appointed with the Minister’s approval determine competence on projects and refresher courses (r 7(3)-(4), r 8(3)-(4)). Failure to secure approvals or to satisfy assessors prevents licensing or registration, which is an administrative bar enforced through the licensing process under the Act (r 4 cross‑reference to s 22 of the Act).

• Publication and public notice. The Surveyor‑General must publish directions in the Gazette and on a specified website (r 26), and may exempt a class of surveys by Gazette notice (r 24(3)-(4)). Publication serves both as a means of giving notice and as a transparency mechanism that supports compliance monitoring.

Temporal enforcement levers

• Short statutory response times tighten enforcement: 14 days is the standard short deadline for providing evidence of accuracy, field notes copies, and survey reports when requested by the Surveyor‑General (r 14(2), r 15(2), r 16(1)). Failure to comply with these short timeframes may trigger further requirements under r 25 or cost recovery under r 22(2) or r 23.

Allocation of enforcement costs and financial risk

• The regulations place financial risk on surveyors in two distinct ways. First, monetary penalties for specific breaches are directly payable fines (r 6(7), r 19, r 27). Second, the Surveyor‑General’s power to undertake remedial work and recover costs as a debt (r 22(2), r 23) means that remedial enforcement costs can be converted into private financial liabilities against the surveyor who failed to discharge duties.

Discretion and legal standards

• Many enforcement actions are discretionary in the first instance, hinging on the Surveyor‑General’s satisfaction or reasonable grounds (r 13(1), r 24(1), r 25(1)). That discretion is bounded by statutory criteria, practicability, likely non‑jeopardisation of accuracy, or reasonable grounds concerning accuracy, but is nonetheless broad in operational scope. The regulations also require notice in some contexts (r 22(2)(a)).

Interaction with licensing under the Act

• Enforcement of these regulations feeds into the licensing and registration framework under the Survey Act 1992 (the regulations state which Part is made for the purposes of s 22 and s 43, r 4 and r 9). Non‑compliance with these regulations will, in practice, affect the ability to be licensed, to certify plans, and to carry out cadastral survey work that is accepted for lodgement.

Overall, enforcement combines modest pecuniary caps for procedural breaches, stronger administrative remedies tied to certification and ethics, and cost recovery powers that convert supervisory or corrective action by the Surveyor‑General into private debts. The short statutory response times and the Institution of Surveyors’ gatekeeping role create an enforcement environment driven by prompt procedural compliance and institutional approvals.

The regulations are explicitly designed to operate within a broader legal framework. The instrument cross‑references the Survey Act 1992 and imports requirements from other instruments, creating dependencies and interactions that practitioners must track.

Interaction with the Survey Act 1992

• Purpose ties. r 4 and r 9 state that Part 2 and Part 3 are made for the purposes of s 22 and s 43 of the Survey Act 1992 respectively. The regulations therefore operate as delegated legislation implementing statutory licensing and survey instruction functions of the Act. Non‑compliance with the regulations will have consequences governed by the Act’s licensing, registration and enforcement architecture.

Interaction with the Real Property Act 1886 and Real Property Regulations 2024

• Definitions and lodgement. The definition of "allotment" in r 10 adopts the meaning from Part 19AB of the Real Property Act 1886 and expands it to include community titles, strata units and common property under the Community Titles Act 1996 and the Strata Titles Act 1988. This ensures that cadastral obligations apply to a broad range of land‑division instruments governed under those Acts.

• Registrar‑General’s technical requirements. r 18 requires that a plan of a cadastral survey lodged in the Lands Titles Registration Office must comply with any requirements issued by the Registrar‑General pursuant to regulation 16 of the Real Property Regulations 2024 "as in force from time to time." That makes the technical lodgement standards dynamic: surveyors must comply with current Registrar‑General rules, which may change under the Real Property Regulations 2024. Practically, this links surveyors’ certification obligations to the Registrar‑General’s evolving technical specifications.

Interaction with national geodetic standards and the National Measurement Act 1960

• Coordinate systems. r 10 defines "Geocentric Datum of Australia 2020 or GDA2020" as having the same meaning as the determination under s 8A of the National Measurement Act 1960 of the Commonwealth. r 20-21 then require acceptance of MGA2020 coordinates recorded in the coordinated cadastre and connection to at least three permanent marks with known MGA2020 coordinates. The regulations therefore bind cadastral surveys to national geodetic standards established under Commonwealth law, integrating state survey control with national coordinate definitions.

Interaction with institutional instruments and codes

• Codes by reference. The regulations adopt and require compliance with the Lodgement of Boundary Identification Surveys Code (the code) for identification surveys (r 17). The code is identified as the Code of Practice,Lodgement of Boundary Identification Surveys prepared by the Surveyors Board of South Australia, 17 March 2016, "as in force from time to time." The regulations also adopt the Professional Practice Rules of the Surveyors Board‑Code of Ethics published by the Institution of Surveyors as in force from time to time (r 27). These adoptions mean that standards, procedures and ethical obligations contained in these external codes become legally binding obligations under the regulations.

Interaction with Gazette and administrative publication requirements

• The Surveyor‑General’s directions and certain exemptions must be published in the Gazette and on a website determined by the Surveyor‑General (r 24(3), r 26). That connects the regulations to administrative law principles of notice and publication, and makes compliance depend on a mixture of individual written notices and public notices in the Gazette.

Interaction with institutional appointments and ministerial approval

• Project setting and assessment appointees must be appointed by the Institution of Surveyors with the approval of the Minister (r 7(3)-(4), r 8(3)-(4)). This creates an interlock between administrative practice (Institution of Surveyors) and ministerial oversight under the Act, meaning that the executive’s appointment power is embedded in the competence assessment process.

Statutory evolution and replacement of prior instruments

• The regulations revoke the Survey Regulations 2007 (legislative history). The legislative history also records subsequent variations in 2024, 2025 and 2026 that amended defined terms and specific provisions (Legislative history table). Practitioners therefore need to consult the current consolidated text and the Real Property Regulations 2024 for contemporaneous cross‑requirements.

Practical implications of these interactions

• Dynamic external dependencies. Because several obligations reference external and potentially changing instruments (Registrar‑General requirements under the Real Property Regulations 2024, the Lodgement Code, the Code of Ethics and the GDA2020 defined via Commonwealth law), compliance requires active monitoring of those instruments as they evolve.

• Multi‑jurisdictional technical standards. Binding to national datums (GDA2020/MGA2020) imposes technical interoperability obligations that may affect surveying practice and equipment choices, and ties South Australian cadastral accuracy expectations to Commonwealth determinations.

• Administrative coordination. The need to work with the Institution of Surveyors, the Surveyor‑General and the Registrar‑General, and to observe ministerial appointment structures, embeds survey practice within an administrative network where procedural approvals, publications and appointed assessors play a central role.

In short, the regulations do not operate in isolation; they integrate state licence and survey rules with national coordinate standards, Registrar‑General plan lodgement requirements and institutionally managed codes and appointment processes.

The legislative history supplied at the end of the regulations documents the principal regulation, revocation of the prior 2007 regulations and subsequent variations. The amendments recorded in the legislative history are the authoritative trail provided by the regulation text.

Key milestones:

• Principal instrument and commencement. The Survey Regulations 2020 were made as No. 238 in 2020, Gazette 23 July 2020 p3869, with commencement noted at r 2 on 24 August 2020. The 2020 instrument expressly revoked the Survey Regulations 2007.

• 2024 variation. Instrument No. 82, Gazette 8 August 2024 p2421, commenced 8 August 2024 and varied certain provisions. The legislative history lists items varied by 82/2024, including r 2 having been omitted under the Legislation Revision and Publication Act 2002 (commencement 8.8.2024) and r 18 being amended by 82/2024 r 3 (8.8.2024).

• 2025 variation. Instrument No. 82 of 2025, Gazette 7 August 2025 p3015 with commencement r 2 on 7 August 2025, amended r 5 (see the table: r 5 amended by 82/2025 r 3). This indicates that the list of acceptable qualifications or their formulation in r 5 was altered by the 2025 instrument.

• 2026 variation. Instrument No. 2, Gazette 15 January 2026 p30, commenced 15 January 2026 and substituted the definition of "Geocentric Datum of Australia 2020 or GDA2020" in r 10 (the legislative history notes r 10 substitution by 2/2026 r 3). The substitution ties the term directly to the Commonwealth National Measurement Act 1960 determination.

Other editorial and structural changes noted

• r 2 was omitted under the Legislation Revision and Publication Act 2002 on 8 August 2024. Schedule 1 was omitted under the same Act on 8 August 2024. These are drafting and publication housekeeping changes recorded in the legislative history.

• The legislative history provides a table of "Provisions varied" with entries for r 2, r 5, r 10 (GDA2020 substitution), and r 18; it shows the implementing instruments and commencement dates. Those entries are the source text’s record of variation and should be consulted alongside the current consolidated regulations.

Practical compliance implications of amendments

• Qualifications list. r 5 was amended in 2025 (82/2025), which directly affects eligibility criteria for new applicants. Practitioners should consult the current consolidated text to confirm the present list of accepted degrees and the terms for equivalence by the Institution of Surveyors.

• Geodetic anchoring. The 2026 substitution of the GDA2020 definition (2/2026) clarifies the linkage to Commonwealth determinations under the National Measurement Act 1960. For surveyors, this amendment formalises the reliance on the national recognised‑value standard of measurement of position, and thus can affect technical requirements and equipment calibration obligations.

• Registrar‑General requirements. The 2024 amendment to r 18 ties plan lodgement to the Real Property Regulations 2024, which may themselves be updated; the legislative history flags that r 18 has been amended and so the plan lodgement interface is a site of regulatory evolution.

Records and historical versions

• The legislative history lists "Historical versions" with entries for 8.8.2024 and 7.8.2025, indicating versions available for reference. The notes underline that cross‑references to other legislation or instruments may not be automatically updated and may be obsolete, and practitioners should check the Index of South Australian Statutes or legislation.sa.gov.au for current documents.

In short, amendments have been made on technical eligibility, definitional and lodgement points since the principal 2020 instrument. The legislative history documents specific variation instruments and commencement dates; practitioners must work from the current consolidated regulations and referenced external instruments for up‑to‑date obligations.

The provided text contains no cases, judicial decisions, or a history of litigation concerning these regulations. The regulations’ legislative history section lists revocations and variations but does not record any litigation or judicial interpretation.

Practical consequences of the absence of recorded litigation

• No authoritative judicial interpretation in the source. Because the supplied instrument does not include any litigation history or case law, there are no precedents within the text to clarify ambiguous provisions or to interpret how courts have applied specific regulations, such as the Surveyor‑General’s discretion to require additional work (r 25), the meaning of "reasonable grounds" (r 25(1)), or the standards of proof and process required before cost recovery as a debt (r 22(2), r 23).

• Administration will be the primary source of interpretive guidance. Where the text delegates significant discretion (for example r 14 accuracy standards determined by the Surveyor‑General, r 24 exemptions), interpretations and practices will likely be developed through directives, Gazette notices, published guidance and administrative practice rather than court rulings until litigation arises.

• Risk that unresolved legal questions sit with the statutory wording. Unanswered legal questions may include the scope of the Institution’s discretion in approving supervisors and experience periods (r 6(3)-(4)), the procedural fairness required before the Surveyor‑General removes marks and recovers costs (r 23), and whether the 14‑day deadlines can be extended only as permitted by the Surveyor‑General. Those questions would remain open for adjudication if litigated.

How practitioners should approach the lack of judicial guidance

• Rely on primary text, administrative directions and published codes. Because the regulations make extensive use of published directions (r 26), specified codes (r 17, r 27) and Institution guidelines (r 7(5)), surveyors and counsel should prioritise those administrative instruments as the operative guidance absent judicial clarification.

• Maintain contemporaneous compliance evidence. The regulations contain short response deadlines and cost recovery mechanisms. Practitioners should keep detailed records of compliance steps (field notes retained for 10 years, supervisor certifications and progress reports, copies of submissions to the Institution and requests/answers to the Surveyor‑General) so that, if contested, factual records are available to show compliance with the regulations.

• Anticipate administrative rather than judicial correction as the first mover. Given the enforcement design (Surveyor‑General corrective powers, recoverable costs, Institution approvals), most disputes will likely be resolved administratively; escalation to courts would occur over contested exercises of discretion, debt recovery, or enforcement actions that implicate procedural fairness or statutory limits.

In sum, there is no litigation history recorded in the instrument. The practical effect is that administrative practice, published directions, and institutional codes will furnish the primary interpretive content for surveyors and advisers until courts are asked to resolve specific controversies.

The regulations contain several specific traps for the unwary that have practical consequences for time, cost, liability and professional mobility. Below are concrete "gotchas" drawn from the text.

1. Narrow qualification list and Institution equivalence gate (r 5). The regulations specify particular degrees from the University of South Australia and Flinders University, and otherwise require equivalence as accredited by the Institution of Surveyors (r 5(a)-(e)). Practitioners with overseas or other Australian university qualifications must rely on the Institution’s equivalence finding. That shifts uncertainty and potential delay to the Institution’s processes.

2. 400 days practical experience, 200 days cadastral requirement for licence applicants (r 6(1)). The experience threshold is expressed in days and includes a specific cadastral sub‑minimum for licence applicants. Experience must be in discrete periods of at least four weeks unless the Institution agrees otherwise (r 6(2)), and each period must be approved by the Institution (r 6(3)). This structure creates administrative steps and potential gaps where short or piecemeal experience may not count without prior approval.

3. Supervisor single‑supervision constraint and certification form (r 6(4)(b), r 6(5)(c)(ii)). A prescribed supervisor must not supervise multiple persons concurrently for the purposes of these regulations unless the other supervised person has already completed at least one year of supervised experience. Supervisors must certify completion "in a manner approved by the Institution". Failure to observe these constraints can render periods unapproved.

4. Short statutory response times to the Surveyor‑General (r 14(2), r 15(2), r 16(1), r 25(2)). Surveyors have 14 days to provide evidence of accuracy, copies of field notes, and survey reports on written request. The Surveyor‑General may allow a longer period but that is discretionary. Typical surveying projects and administrative processes may struggle to meet a 14‑day turnaround without prepared records.

5. Record retention obligation (r 15(1)). Field notes must be retained for at least 10 years. Failure to produce records within 14 days of a written request (r 15(2)) could lead to administrative consequences; additionally, older practitioners returning after five years must do refresher courses (r 8).

6. Certification liability and monetary cap (r 19). A surveyor must not certify a plan unless satisfied it complies with this Part; the maximum penalty is $2,000. The regulations also require a certifying surveyor who certifies another’s survey to certify that the survey was undertaken under their supervision and complied with the Act (r 19(2)). This imposes a direct legal obligation on signatories that could interact with professional indemnity exposures.

7. Surveyor‑General discretion on accuracy and exemptions (r 14, r 24). The "required standard of accuracy" is not numerically prescribed in the regulations; it is determined by the Surveyor‑General. Similarly, exemptions may be granted where compliance is not practicable or an alternative method will not jeopardise accuracy (r 24(1)). The absence of numerical standards creates uncertainty about the threshold for compliance and the circumstances in which exemptions will be granted.

8. Cost recovery as a debt for remedial work (r 22(2), r 23). If the Surveyor‑General must undertake additional works or remove/reinstate marks, costs can be recovered as a debt from the surveyor. That converts operational remedial costs into enforceable private liabilities and may have immediate cashflow implications.

9. Mandatory connection to MGA2020 and three permanent marks for cadastral surveys (r 20-21). Surveys within the coordinated cadastre must accept recorded MGA2020 coordinates (r 20) and must connect to at least three permanent marks with known or established MGA2020 coordinates and adjust to their scale and orientation (r 21(a)-(b)). Practitioners who lack access to such marks or who use incompatible coordinate systems must obtain exemptions from the Surveyor‑General.

10. Multiple external instruments adopted "as in force from time to time" (r 17, r 18, r 27). The Lodgement of Boundary Identification Surveys Code, Registrar‑General requirements under the Real Property Regulations 2024, and the Professional Practice Rules Code of Ethics are adopted by reference and updateable. Practitioners must monitor these external instruments for changes; failing to do so does not excuse non‑compliance.

11. Supervisor reporting penalty is small but symbolic (r 6(7)). The maximum penalty for late supervisor reports is $200. While small, a sequence of such breaches could indicate systemic non‑compliance that affects licensing outcomes or institutional goodwill.

12. Ministerial approval for assessors and appointments (r 7(3)-(4), r 8(3)-(4)). The persons who set projects and assess competence must be appointed by the Institution with the Minister’s approval. That introduces a political/administrative gate that can constrain who may perform assessments and can induce delays if appointments are not current.

Practical takeaways from these "gotchas": ensure prior approval for practical experience periods and supervisors, keep contemporaneous and accessible field notes and evidence to be able to meet 14‑day requests, verify status of permanent marks and MGA2020 coordinates before commencement, obtain documented supervisor certifications in the Institution’s approved form, and track changes to codes and Registrar‑General lodgement requirements.

Compliance under these regulations requires an operational checklist across entry requirements, supervisory arrangements, survey execution, documentation, liaison with institutions and readiness to respond to Surveyor‑General requests. The following checklist is grounded in the regulations’ concrete obligations.

1. Verify academic eligibility before applying (r 5)

• Confirm the applicant holds one of the degrees listed in r 5(a)-(da) or secure an equivalence accreditation from the Institution of Surveyors under r 5(e). Keep documentary evidence of equivalence decisions.

2. Plan and document practical experience in advance (r 6)

• Aim for at least 400 days total practical experience; if pursuing a licence, ensure at least 200 days are in cadastral surveying (r 6(1)). Break experience into discrete periods of not less than four weeks, unless pre‑approved by the Institution (r 6(2)).
• Before starting a supervised period, prepare a written proposal in the form approved by the Institution containing expected nature/duration, supervisor’s qualifications for the prior two years and supervisor’s undertaking (r 6(5)). Have the proposed supervisor sign it.
• Submit the proposal to the Institution and obtain agreement; retain the Institution’s decision notice (r 6(6)).

3. Use prescribed supervisors and observe supervisor constraints (r 6(4), r 6(8))

• Engage a prescribed supervisor: a licensed surveyor licensed at least two years prior to supervision, or a person with qualifications approved by the Institution who has held those qualifications for at least two years (r 6(8)).
• Ensure a supervisor does not concurrently supervise more than one person for these purposes unless the other has completed at least one year of supervised experience (r 6(4)(b), r 6(5)(c)(ii)).
• Obtain supervisor certifications in the manner approved by the Institution on completion of each period of experience (r 6(4)(a)(ii)).

4. Complete and document project assessments or refresher courses (r 7, r 8)

• For licence applicants, complete a cadastral project or series of projects set by an appointed person and demonstrate competence to an assessor appointed with the Minister’s approval (r 7(1)-(4)).
• For former practitioners absent five years or more, enrol in a refresher course appropriate to the category of surveying and be assessed by an appointed assessor (r 8(1)-(5)).
• Keep assessment reports and evidence showing the assessor’s appointment and the Minister’s approval.

5. Carry out surveys according to evidence and marking rules (r 11-13)

• Before a cadastral survey, obtain all reasonably accessible information likely to provide evidence of boundaries (r 11(1)). Locate existing survey marks, reference marks, improvements and natural features (r 11(2)(a)), and connect to existing surveys on record (r 11(2)(b)).
• Place survey pegs on each new boundary so boundaries are readily and unambiguously discernible; secure and protect survey marks (r 12(1)-(2)).
• Where permanent survey marks or coordinated cadastre rules apply, comply with directions from the Surveyor‑General concerning placement and provision of information relating to marks (r 13).

6. Meet accuracy and geodetic requirements (r 14, r 20-21)

• Use equipment and techniques to meet the accuracy standard determined by the Surveyor‑General; perform adequate checks and maintain documentation that demonstrates compliance (r 14(1)).
• For land within the coordinated cadastre, accept MGA2020 coordinates recorded in filed plans (r 20).
• Connect to at least three permanent marks with known/established MGA2020 coordinates and adjust surveys to their scale and orientation; immediately report discrepancies beyond the Surveyor‑General’s permitted standard and follow directions (r 21).

7. Retain and make field notes and records available (r 15)

• Make records or notes of survey in the course of cadastral surveys, retain them for at least 10 years (r 15(1)), and be prepared to provide a copy to the Surveyor‑General within 14 days of a written request (r 15(2)). Maintain an organised electronic or paper archive to meet short deadlines.

8. Prepare survey reports and certification correctly (r 16, r 19)

• Provide a report to the Surveyor‑General within 14 days of written request, in the form approved by the Surveyor‑General (r 16(1)-(3)). Be aware that the Surveyor‑General can direct alternative timing for classes of surveys (r 16(2)).
• Certify plans using the form approved by the Surveyor‑General and ensure you are satisfied that the survey and plan comply with the regulations before certifying; if certifying another’s survey, certify that it was performed under your supervision and complied with the Act (r 19(1)-(3)).

9. Comply with codes and Registrar‑General requirements (r 17, r 18, r 27)

• For identification surveys, comply with the Lodgement of Boundary Identification Surveys Code; mandatory provisions in the code must be followed and recommendations considered (r 17).
• Ensure plans lodged in the Lands Titles Registration Office meet the Registrar‑General’s requirements under regulation 16 of the Real Property Regulations 2024 as in force from time to time (r 18).
• Observe the Professional Practice Rules of the Surveyors Board‑Code of Ethics as published by the Institution of Surveyors (r 27).

10. Use exemption and dispute pathways where necessary (r 24)

• If compliance is impracticable or an alternative method is proposed that will not jeopardise accuracy, apply to the Surveyor‑General for exemptions in writing (r 24(1)-(2)). Track any conditions attached to exemptions and retain copies of Gazette notices for class exemptions (r 24(3)-(4)).

11. Be ready for remedial action and cost recovery (r 22, r 23, r 25)

• If dividing land into more than five allotments, reinstate required marks and provide required information within 30 days after completion of works for roads/drains/services; non‑compliance may lead to the Surveyor‑General undertaking work after 14 days notice and recovering costs as a debt (r 22).
• If the Surveyor‑General requires additional work because of concerns about a survey, comply within 14 days or obtain an agreed extension (r 25).

12. Maintain administrative readiness and monitoring

• Monitor updates to the Code, Registrar‑General requirements and the GDA2020 determinations, because several obligations are linked to instruments "as in force from time to time" (r 17, r 18, r 10).
• Keep evidence of communications with the Institution, Surveyor‑General and Registrar‑General, and maintain contact details for timely receipt of Gazette and website notices per r 26.

By organising practice around these steps, prior approval for supervised experience, rigorous field‑level documentation, adherence to MGA2020 tie‑ins and rapid response capacity to Surveyor‑General requests, surveyors and firms will align operational processes with the regulatory expectations set out in the Survey Regulations 2020.
