SURVEILLANCE DEVICES REGULATIONS 2008

The regulations introduce and define several key concepts that amplify the principal Act. A "tracking device" is not separately defined in the regulations but takes its meaning from the Act: a device capable of monitoring the location of a person or object, typically attached surreptitiously. Regulation 3 permits its installation "in accordance with the directions of" a specified person, which means that the official gives a lawful direction, but the regulation does not require the direction to be in writing, recorded, or approved by any external authority. The phrase "in accordance with" implies the person must comply with the direction, but the direction itself need not be specific to each installation. A "monitored offender" is defined as a person subject to a "monitoring requirement". That monitoring requirement is exhaustively listed in reg 3(2) and covers a wide range of orders: community correction orders, intensive community correction orders, suspended sentences, home detention orders, community custody orders, community based orders (both pre and post 2022 amendments), alternative detention orders under youth justice law, conduct agreements under the Bail Act with certain conditions, parole orders with monitoring conditions, supervision orders under the Serious Sex Offenders Act 2013, and leave permits under the Correctional Services Act 2014. The effect is that almost any person on conditional liberty in the NT, including those on parole, home detention, or youth justice orders, may be subjected to warrantless tracking device monitoring at the direction of the Commissioner of Correctional Services or the CEO (Youth Justice). A "relevant conduct agreement" is defined as a conduct agreement under the Bail Act 1982 that contains a provision under s 27A(1)(iaa) or (iab) of that Act. This is a narrower subset of conduct agreements, presumably those that expressly permit electronic monitoring. The regulation also defines "CEO (Youth Justice)" by reference to the Public Sector Employment and Management Act, and "custodial correctional facility" by reference to the Correctional Services Act. The concept of "corresponding law" in reg 2 is critical for interjurisdictional cooperation: it means that a warrant or authorisation issued under a corresponding law is treated as valid in the NT for the purposes of the Act, allowing police to act across borders without separate NT authorisation. Regulation 4 introduces the concept of "police body-worn video" but does not define it separately; the Act covers it as a type of surveillance device recording. The prescribed purposes for its use, communication or publication are listed and include proceedings before NTCAT, civil proceedings, coronial investigations, complaint investigations under various Acts, and broadcasting contracts. Each purpose is an alternative to the general prohibition in s 53(1) of the Act, so the regulation effectively creates a safe harbour for police and other officials to use body-worn video footage without individual consent or specific authorisation.

The regulations affect a broad range of individuals and organisations. Most directly, they affect persons who are subjected to warrantless tracking device monitoring: patients in hospitals or nursing homes, prisoners, persons on community corrections orders or parole, accused persons on bail with a conduct agreement, and persons under youth justice supervision. These individuals lose the default protection of a judicial warrant before being tracked. The regulation uses a "reasonably believes" standard for hospital managers (reg 3(1)(b)(ii)) that may apply to elderly patients with dementia, patients with mental illness, or children in hospital settings, giving managers substantial discretion. The regulations also affect managers of hospitals and nursing homes, who can direct installation of tracking devices without seeking a warrant if they believe a patient is likely to leave without regard to health or safety, likely to be unlawfully taken, or under a legal obligation to stay. This places a compliance burden on private and public hospitals to develop policies for when to use tracking devices and to ensure directions are lawful. The Commissioner of Correctional Services and the CEO (Youth Justice) are given powers to direct tracking device monitoring of a very large class of offenders, far beyond those currently in custody. Community corrections officers, parole officers and youth justice officers will have to implement these directions and likely manage the technical aspects of tracking devices. The Commissioner of Police can direct tracking of accused persons under relevant conduct agreements, which affects both police operations and the accused. Researchers who track animals or things for research projects are exempt from the warrant requirement, affecting university ethics committees and funding bodies. The regulation also affects anyone who comes into contact with police body-worn video: complainants, witnesses, victims, and subjects of police interaction may find their footage used in NTCAT proceedings, civil proceedings, coronial inquests, anti-discrimination complaints, liquor complaints, or complaints to the Children's Commissioner, without their consent. Media production companies that contract with the police agency are affected by regulation 4(h), which allows broadcast of body-worn video footage under contracts that must "protect the privacy of personal information". This will affect the drafting of such contracts and the editorial decisions of broadcasters. Finally, the entire legal profession, including criminal defence lawyers, civil litigators, and administrative law practitioners, must account for these regulations when considering the admissibility of surveillance evidence or the lawfulness of police conduct. The regulations also apply to agencies in other states through the corresponding law mechanism, affecting interstate police conducting operations in the NT.

The regulations create asymmetric duties and rights: they grant extensive rights to install and use tracking devices and to use police body-worn video, while imposing relatively few corresponding duties. The primary right is the right to install, use or maintain a tracking device without a warrant in the listed circumstances, provided it is done "in accordance with the directions" of the authorised person. This right extends to the person who installs the device (which could be a police officer, a security officer, a hospital employee, a researcher, or a private contractor) and to the person directing the installation (the emergency commander, hospital manager, Commissioner, etc.). The only express limitation is that the direction must be given by the specified person and must fall within the listed circumstances. There is no duty to inform the subject of the surveillance, no duty to obtain independent authorisation, no duty to limit the duration of the tracking, and no duty to report the use of the tracking device to any oversight body. The regulations create a right for hospital managers to track patients based on a reasonable belief about likely behaviour, which is a low threshold. For monitored offenders, the right to track is not contingent on any additional risk assessment; it is automatic once the monitoring requirement exists and the Commissioner or CEO gives a direction. The regulation does not require the offender to be informed that tracking will occur, although other legislation (such as the Sentencing Act or the Bail Act) may impose such duties separately. Similarly, the regulations grant a right to use, communicate or publish police body-worn video for the prescribed purposes without the need for the consent that would otherwise be required under s 53 of the Act. This right extends to police officers, perhaps to other officials involved in the prescribed proceedings, and to media production companies under contract. The duty is minimal: the broadcast contract must "protect the privacy of personal information," but the regulation does not specify what that means. There is no duty to anonymise footage, no duty to limit the broadcast to certain parts, and no duty to obtain consent from persons depicted. The regulations also create a right for persons who receive a direction (such as a police officer told by the Commissioner to track an accused person) to comply with that direction, but they also likely have a duty to comply or risk disciplinary consequences. Corresponding laws provisions give a right to rely on interstate warrants, which is a procedural benefit for law enforcement but potentially a loss of protection for NT residents who may be subjected to surveillance authorised under a different state's standards. There is no right for a person subjected to tracking to challenge the direction, no right to be notified after the fact, and no right to access records of the tracking unless other legislation (like the Information Act 2002) provides it. The regulations therefore tilt heavily toward executive discretion.

The regulations themselves do not create any pecuniary penalties or criminal offences. They are made under the Surveillance Devices Act 2007, which establishes offences for unlawful surveillance, communication and publication of surveillance material. The regulations operate by providing exceptions to those offences. Accordingly, enforcement of compliance with the regulations is indirect. If a person installs, uses or maintains a tracking device outside the circumstances listed in regulation 3, they may be committing an offence under s 13 of the Act, which attracts maximum penalties set in the Act (typically imprisonment or large fines). Similarly, if a person uses, communicates or publishes police body-worn video for a purpose not prescribed in regulation 4, they may be in breach of s 53 of the Act. The enforcement burden falls on the police and the Director of Public Prosecutions to prosecute unlawful surveillance. However, the breadth of the exceptions makes prosecution for lawful surveillance difficult. The practical enforcement risk is that the regulations are so permissive that few cases of lawful installation will occur outside them, and those that do will likely be easily defended by relying on the regulation. There is no independent oversight body specifically tasked with monitoring compliance with these regulations. NTCAT may have some oversight role in complaints about police body-worn video use, because regulation 4(b) prescribes NTCAT proceedings as a permitted purpose, but NTCAT's jurisdiction arises from other Acts (e.g., the Information Act, the Anti-Discrimination Act) not from these regulations. The regulations create a safe harbour for police and other officials, so the main enforcement mechanism is the internal discipline of the relevant agency (police internal affairs, correctional services complaints processes, hospital administration). For media broadcasts, the contract protection of privacy is a contractual term, enforceable through civil remedies if breached. The regulations also interact with the privacy complaint mechanisms under the Information Act 2002 (r 4(a)), so a person aggrieved by a use of body-worn video could complain to the Information Commissioner, but the regulation expressly excludes the purpose in s 53(1)(h) of the Act (which deals with complaints about the police), creating a curious carve-out. The end result is that enforcement is largely self-policing by the agencies that benefit from the exceptions. The expansion of surveillance without warrant carries the risk that unlawful surveillance will go undetected or unchallenged. Litigation in civil proceedings (permitted by reg 4(c)) could provide a check if, for example, a person discovers they were tracked without proper authority and sues for trespass or breach of privacy, but the regulation provides a complete defence if the tracking was within its terms.

The regulations explicitly interact with a wide range of NT and interstate legislation. Regulation 2 declares five interstate surveillance laws as corresponding laws, which means that a warrant or authorisation under those laws is recognised in the NT for the purposes of the Act. This creates a web of cross-border reliance: NT police may rely on a Queensland warrant, and vice versa, without double authorisation. The effect is to streamline joint operations but also to export NT surveillance standards to other jurisdictions and import their standards into the NT. Regulation 3 references a dense network of NT criminal justice legislation: the Sentencing Act 1995 (community correction orders, suspended sentences, home detention orders), the Youth Justice Act 2005 (alternative detention orders), the Bail Act 1982 (conduct agreements), the Parole Act 1971 (parole orders), the Serious Sex Offenders Act 2013 (supervision orders with monitoring obligations), and the Correctional Services Act 2014 (leave permits). Each of these Acts has its own procedural requirements, but the regulations override the warrant requirement for tracking devices specifically. For example, a home detention order under the Sentencing Act may already require the offender to comply with electronic monitoring, but the regulation adds that the Commissioner can direct warrantless tracking device use on top of that. Regulation 4 interacts with the Information Act 2002 (privacy complaints), the Coroners Act 1993 (inquests), the Anti-Discrimination Act 1992, the Liquor Act 2019, and the Children's Commissioner Act 2013. Each of these Acts has its own procedural rules for handling evidence and complaints. The regulation permits police body-worn video to be used in these contexts, which may override other restrictions those Acts impose. For instance, the Coroners Act may have its own rules about admissibility of surveillance material, but the regulation provides a separate basis for using the video. Regulation 4(h) interacts with general contract law and media law: a broadcast contract between the police agency and a media production company is required. This raises questions about freedom of contract, public interest, and privacy. The regulation does not define what "protects the privacy of personal information" means, leaving it to the parties to negotiate. This could lead to inconsistent standards across different contracts. The regulations also interact with the parent Surveillance Devices Act 2007, which they are made under. The Act sets the general prohibition on installing tracking devices without warrant (s 13), and the regulations carve out exceptions. The Act also prohibits communication and publication of surveillance device records (s 53), and the regulations carve out exceptions for body-worn video for prescribed purposes. Any use not covered by the regulations remains subject to the Act's prohibitions and penalties. Finally, the regulations may interact with common law torts like trespass and privacy. The regulations do not provide immunity from civil liability; they only provide a defence to the statutory offences. A person could still sue for trespass if a tracking device is installed on their property without consent, but the existence of a lawful direction might make it a defence to trespass as well, depending on the scope of the authorising Act.

The Surveillance Devices Regulations 2008 were originally notified on 5 March 2008 and commenced on the same day. The original regulation contained only reg 2 (corresponding laws) and the predecessor of reg 3 (tracking device circumstances). Regulation 1 (citation) has been amended for formal purposes by the Interpretation Legislation Amendment Act 2018. Regulation 2 was inserted by the Surveillance Devices Amendment Regulations 2010 (SL No. 8 of 2010), which added the current list of corresponding laws. It was later amended by the Surveillance Devices Amendment Regulations 2015 (SL No. 33 of 2015) to update cross-references. Regulation 3 was originally reg 2 and was renumbered as reg 3 by the 2010 amendment. It has been amended numerous times. The Prisons (Correctional Services) (Community Orders) Regulations 2011 (SL No. 53 of 2011) added references to community correction orders and home detention orders under the Sentencing Act. The Serious Sex Offenders Act 2013 (Act No. 9 of 2013) inserted the reference to supervision orders under that Act. The Correctional Services (Related and Consequential Amendments) Act 2014 (Act No. 27 of 2014) updated definitions to refer to the Correctional Services Act 2014. The Bail Amendment Act 2017 (Act No. 5 of 2017) added the reference to conduct agreements under the Bail Act. The Parole Amendment Act 2017 (Act No. 17 of 2017) added the reference to parole orders. The Youth Justice Legislation Amendment Act 2017 (Act No. 19 of 2017) added the alternative detention order under the Youth Justice Act. Most recently, the Justice and Other Legislation Amendment Act 2024 (Act No. 4 of 2024) amended reg 3. The endnotes show that this amendment commenced partly on 30 October 2023 and partly on 25 March 2024, and it added the concept of "relevant conduct agreement" and extended tracking device monitoring to accused persons on bail with such agreements. Regulation 4 (body-worn video) was inserted entirely by the Surveillance Devices Amendment Regulations 2021 (SL No. 1 of 2021), which commenced on 1 March 2021. It was then amended by the Police Legislation Further Amendment Act 2023 (Act No. 18 of 2023) to add the reference to "television broadcast, radio broadcast, internet broadcast or other broadcast if authorised by a contract" with a media production company. The Police Administration Amendment Act 2024 (Act No. 17 of 2024) made further amendments to regulation 4, commencing on 30 October 2024. The endnotes do not specify the exact nature of the 2024 amendments to reg 4, but the list of amending legislation shows it. The overall pattern is a steady expansion of the scope of warrantless tracking: originally narrow emergency and hospital circumstances, gradually broadened to include correctional, parole, bail, youth justice and serious sex offender contexts. The addition of regulation 4 in 2021 marked a significant shift, allowing police body-worn video to be used for a range of external complaint and proceeding purposes without individual consent.

The source text of these regulations contains no references to any litigation. The endnotes do not mention any court cases. As subordinate legislation, the regulations themselves are rarely litigated directly; challenges would typically be brought against the parent Act or against a specific instance of installation or use relying on the regulations. There are no reported NT decisions cited in the source that interpret regulation 3 or regulation 4. This is not surprising for several reasons. First, the regulations are relatively recent in their current form (especially regulation 4, inserted only in 2021). Second, the regulations provide broad exceptions, so a person challenging the use of a tracking device or body-worn video would have to argue that the use fell outside the exception, which is a difficult factual inquiry. Third, the institutions that benefit from the exceptions (police, correctional services, hospitals) are unlikely to be sued often, and any challenge would likely be resolved at the internal complaint stage. Fourth, the corresponding law provisions in regulation 2 are straightforward declarations and unlikely to be litigated unless a question of vires arises. It is possible that cases have been decided in the Northern Territory Supreme Court or Court of Appeal that interpret s 13(2)(d) or s 53(4)(c) of the parent Act and rely on these regulations, but the source does not cite them. A cautious analyst would note that the regulations create a number of discretionary powers that could be subject to judicial review under the Administrative Decisions (Judicial Review) Act or common law. For example, a hospital manager's decision to track a patient based on a "reasonably believes" standard could be challenged for unreasonableness, but no such case is reported in the source. Similarly, the use of body-worn video in a broadcast contract could be challenged for failing to protect privacy, but again no case law is cited. The absence of litigation history may also reflect the difficulty of discovering the surveillance: tracking devices are often covert, and subjects may not become aware of them until after the fact. The regulations do not require notice to the subject, so many potential plaintiffs never know they have been tracked. This is a significant practical barrier to litigation and a systemic lack of accountability.

Several aspects of these regulations are traps for the unwary, both for the individuals subjected to surveillance and for the officials who administer it. First, the "in accordance with the directions of" requirement in regulation 3 is deceptively simple. The direction must be given by the specified person, but the regulation does not require the direction to be in writing, to be specific to the individual, to be time-limited, or to be recorded. A hospital manager could give a blanket direction that all patients in a certain wing be tracked, and that direction would likely satisfy the regulation if the manager "reasonably believes" each patient is likely to leave without regard to safety. The standard is "reasonably believes," which is a lower threshold than "reasonable grounds to suspect" or "reasonable grounds to believe" in many criminal law contexts. A manager who holds a subjective belief that is unreasonable may still be protected if they can point to some objective basis. Second, the regulation does not require the person installing the device to verify the authority of the direction. A security guard told by a hospital manager to attach a tracking device to a patient's wheelchair may have no way of knowing whether the manager's belief is reasonable. The regulation provides a defence to the guard as long as they act in accordance with the direction, even if the direction itself was ultra vires. Third, the monitoring requirement definition in reg 3(2) is extraordinarily broad and includes many orders that are procedural or administrative, not just punitive. For example, a "community correction order" under the Sentencing Act 1995 can be imposed for a wide range of minor offences, yet tracking device monitoring can be applied without any additional court order. Fourth, the "relevant conduct agreement" for bail (reg 3(1)(da)) is a specific subset of conduct agreements. An accused person might agree to a conduct agreement without realising it includes an electronic monitoring condition that triggers this regulation. The regulation does not require the accused to be notified that they may be tracked; the tracking is at the discretion of the Commissioner of Police. Fifth, regulation 4 prescribes "a civil proceeding, including preparation for the proceeding" as a purpose for using police body-worn video. This means that a police officer can release body-worn video footage to a lawyer for use in civil litigation, including defamation or personal injury claims, without the consent of the persons depicted. This could expose individuals to public disclosure of embarrassing or incriminating footage. Sixth, regulation 4(h) allows broadcast under a contract between the police agency and a media production company, provided the contract protects privacy. The regulation does not specify that the privacy protections must be enforceable by the individuals depicted; it only requires that the contract include them. If the contract is poorly drafted or if the media company breaches it, the individuals depicted have no direct right under this regulation to stop the broadcast; their recourse is through the contract or through other causes of action. Seventh, the regulations contain no sunset clause, no independent oversight mechanism, and no reporting obligation. They continue indefinitely without review. Eighth, the corresponding law list includes the Crimes (Surveillance Devices) Act 2010 (ACT), which has less stringent safeguards than the NT Act in some respects. An NT resident could be tracked under an ACT warrant without the protections of NT law. Finally, the regulations do not explicitly prohibit discriminatory or arbitrary use of tracking devices. The powers are given to managers and commissioners, but there is no requirement to apply them consistently or to document reasons.

Compliance with these regulations requires different strategies depending on the entity. For agencies that rely on the tracking device exceptions, the first step is to identify which officials have authority to give directions under reg 3: for hospitals, the "person in charge" or "manager"; for correctional services, the Commissioner of Correctional Services or the CEO (Youth Justice); for police, the Commissioner of Police; for emergency operations, the person in charge of the operation. Each agency should ensure that these officials are clearly designated in writing and are aware of the limits of their authority. The direction should, at a minimum, be recorded in writing, even though the regulation does not require it. A written direction protects the official who relies on it and provides evidence if the tracking device use is later challenged. For hospitals and nursing homes, the "reasonably believes" standard must be satisfied on a case-by-case basis. It is advisable to document the basis for the belief: for example, a clinical note that the patient has attempted to leave before, or a risk assessment indicating cognitive impairment. For patients under a legal obligation to stay (such as forensic patients), the hospital should have a copy of the relevant order. For correctional services and youth justice, the monitoring requirement list is broad. The relevant officer should verify that the offender is subject to one of the listed orders and that the monitoring requirement under that order is currently in force. The direction should specify the scope of the tracking e.g., the geographical range, duration, and any conditions. For researchers tracking animals or things, the activity must be "the subject of a research project". A research project should be defined in a protocol approved by an ethics committee, and the tracking should be conducted in accordance with that protocol. The regulation does not require the researcher to have a permit, but ethical compliance is prudent. For police body-worn video use under reg 4, several steps are important. First, police officers should be trained on the prescribed purposes: privacy complaints, NTCAT proceedings, civil proceedings, coronial inquests, anti-discrimination complaints, liquor complaints, children's commissioner complaints, and broadcast. The use must be for one of these purposes, not for general dissemination. The threshold is that the use, communication or publication must be "for" the purpose, which may include incidental use reasonably connected to it. Second, any broadcast under reg 4(h) requires a contract between the police agency and a media production company that protects personal information. The police agency should review existing contracts to ensure they contain a privacy protection clause. The clause should define personal information, require the broadcaster to delete footage after broadcast, prohibit further dissemination, and provide a mechanism for individuals to complain. Third, for use in civil proceedings, the police should ensure that the recipient of the footage (e.g., a lawyer) is notified that the footage is provided under reg 4 and may only be used for the proceeding. Fourth, the agency should keep a log of all disclosures of body-worn video under reg 4, including the purpose, the recipient, the date, and the authorising officer. This will assist if a complaint is made. For all agencies, a periodic audit of tracking device and body-worn video use should be conducted to ensure compliance with the regulations and to identify any misuse. The audit should check that directions were given by the authorised person, that the circumstances matched the regulation, and that any applicable conditions (such as the duration of the search and rescue operation) were met. Training of all personnel involved is essential, particularly for hospital staff who may not be familiar with surveillance laws. Finally, because the regulations provide a defence to the principal Act's offences, the compliance burden is effectively on the agency to prove it acted within the exceptions if challenged. Therefore, documentation is not optional; it is a practical necessity.
