Surveillance Devices Regulations 1999

The Regulations operate through several interlinked concepts defined either within the Regulations themselves or by cross‑reference to the Surveillance Devices Act 1998 and other statutes. Those concepts determine when surveillance devices may be used without a warrant, who counts as a law enforcement officer, what counts as surveillance information and how records must be handled.

• Forms and authorisation mechanics. Regulation 3 prescribes that warrants under ss 13, 14, 17, 19 or 22 of the Act are to follow Form 1 in Schedule 1, subject to judicial approval of other forms. Applications for emergency authorisation (s 21) must use Form 2 unless the Commissioner of Police approves another form; emergency authorisations use Form 3 or another form approved by the authorised person (reg 3(1)-(3)). The Schedule contains the substance of those forms and the operational authorities a warrant or authorisation can grant, for example entry, electricity supply use and vehicle removal.
• Law enforcement officer definition. For paragraph (d) of the definition of law enforcement officer in s 3(1) of the Act, reg 4 prescribes particular State officers and classes: conservation and land management officers, forest officers, rangers, wildlife officers (each as defined in the Conservation and Land Management Act 1984 s 3), inspectors under the Environmental Protection Act 1986 s 3(1) who are State employees, and fisheries officers employed in the Serious Offences Unit per the Fish Resources Management Act 1994 s 4(1). The prescription expands who can act under the Act’s powers where the Act uses the law enforcement officer concept.
• Commonwealth agencies and cross‑jurisdictional recognition. Regulation 5 prescribes particular Commonwealth agencies for s 4(2) of the Act, namely ASIO, the Australian Federal Police, the ACCC, the Commonwealth migration department, and each of the armed forces, as institutions recognised for Act purposes. This prescribes institutions entitled to operate under or interact with the WA statutory scheme.
• Tracking device warrant exceptions. Regulation 6 sets out multiple situations that count as lawful uses without warrant under s 7(2)(d) of the Act. These include emergency services locating persons or objects in search operations, hospitals and nursing homes using devices to locate vulnerable patients (reg 6(1)(b)), superintendents of prisons locating escaped prisoners (reg 6(1)(c)), researchers using devices where an object’s location is relevant to research (reg 6(1)(d)), public authorities monitoring traffic (reg 6(1)(da)) and police or designated police employees in Border Search Areas identifying radio‑emitting devices for pattern monitoring (reg 6(1)(db)). Regulation 6 also prescribes that attaching a tracking device to recover property believed to be stolen is lawful provided the criteria in reg 6(2) are met.
• Definitions that matter for application. Regulation 6(4) defines terms crucial to the exceptions, for example Border Search Area (as in Misuse of Drugs Act 1981 s 20N(1)), emergency service, hospital (Health Services Act 2016 s 8(4)), nursing home (Commonwealth Aged Care Act definitions), police employee (designation allowed by reg 6(1A)) and vulnerable patient. The vulnerable patient definition sets a subjective threshold based on the opinion of the person in charge of the hospital or nursing home (reg 6(4) definitions).
• Records and Part 5 records. Regulation 7 introduces the concept "Part 5 record" (reg 7(3)) and requires specified agencies to keep such records secure and to destroy them when they would need to be destroyed if they had been obtained under a warrant (reg 7(1)). Agencies must also keep sufficient records to identify documents and comply with Act obligations (reg 7(2)).
• Surveillance information and unlawful possession. Regulation 9 defines surveillance information to include reports or records of private conversations, private activities or geographical location obtained through a surveillance device (reg 9(3)). It makes unlawful possession an offence, subject to exceptions that include possession by law enforcement officers acting in the course of duty, persons assisting law enforcement in that course, records obtained in accordance with Part 5 of the Act, and certain items obtained from someone lawfully in possession where the communication of the information was not an offence under s 9 of the Act (reg 9(1)-(2)).

These core concepts determine decision points: who may authorise or carry out surveillance, in what narrow non‑warranted situations, and the compliance controls for records and possession. The Regulations therefore act as the operational translation of broader statutory authority into institutional roles, procedural paperwork and definitional boundaries.

The Regulations allocate rights, duties and constraints across multiple groups. They affect public authorities that operate surveillance devices, hospitals and aged care providers, researchers, particular classes of State officers, Commonwealth agencies engaged in WA operations, subjects of surveillance and any third parties who might come into possession of surveillance information.

• Law enforcement and designated agencies. The primary burden falls on State law enforcement bodies and prescribed agencies. Regulation 7 explicitly imposes secure storage and destruction duties on the Commissioner of Police, the Corruption and Crime Commission, any designated Commission and the Australian Crime Commission. These bodies must keep Part 5 records securely and destroy them when applicable (reg 7(1)-(2)). The Commissioner of Police is also empowered to designate employees or classes of employee as "police employee" for reg 6(1)(db) purposes under reg 6(1A). The Schedule shows the forms and authorities these officers must prepare and carry when seeking warrants or emergency authorisations (reg 3; Schedule 1).
• Specific State statutory officers. Regulation 4 prescribes additional classes of persons as law enforcement officers for the Act: conservation and land management officers, forest officers, rangers and wildlife officers (each as defined in the Conservation and Land Management Act 1984 s 3), prescribed environmental inspectors and certain fisheries officers working in the Serious Offences Unit (reg 4). These officers, where they fall within the prescribed classes, can be applicants or persons to whom warrants are issued under the forms in Schedule 1.
• Hospitals, nursing homes and vulnerable patients. Regulation 6 permits the person in charge of a hospital or nursing home to attach or use a tracking device to locate a vulnerable patient (reg 6(1)(b)). Where a tracking device is attached for that purpose, the person in charge must give written notice to the patient’s guardian (if one exists under the Guardianship and Administration Act 1990), otherwise to next of kin or, if unknown, to the Public Advocate (reg 6(3)). The Regulations therefore create a legal pathway for residential care providers and hospitals to use tracking technology for certain residents and attach administrative notification duties to that practice.
• Researchers and educational institutions. Regulation 6(1)(d) permits a researcher to attach, install or use a tracking device in relation to an object where the object’s geographical location is relevant to the research. The definition of researcher includes staff and students at educational institutions and staff of government agencies (reg 6(4)). Universities and research institutions will therefore be affected when their studies require locational tracking of objects.
• Public authorities and transport agencies. Regulation 6(1)(da) authorises public authorities empowered under written law to monitor road traffic to use tracking devices for traffic monitoring. The term public authority is defined by reference to the Criminal Procedure Act 2004 s 3(1). This affects bodies charged with road management and monitoring.
• Border Search Area policing and national agencies. Police and designated police employees may use tracking‑style detection to identify radio emitting devices in Border Search Areas for pattern monitoring (reg 6(1)(db), (1A) and 6(4) definitions). Commonwealth agencies prescribed in reg 5 , ASIO, Australian Federal Police, the ACCC, the Commonwealth migration department and the armed forces , are explicitly recognised for Act purposes and thus affected in cross‑jurisdictional operations.
• Members of the public and private enterprises. Persons who come into possession of surveillance information are regulated by reg 9. It creates an offence for unlawful possession subject to exceptions. The Schedule forms also authorise entry to premises, disconnection or connection to electricity supplies and temporary vehicle removal where necessary to attach, maintain or retrieve devices. Those provisions therefore impose constraints and potential liabilities on private property owners, vehicle owners and occupants where a warrant or authorised use is in play.

In short, the Regulations affect operational law enforcement bodies and designated commissions most directly through record and application requirements. They also grant limited, regulated powers and duties to hospitals, nursing homes, researchers and public road authorities. Individuals and private entities may gain or lose rights in practice: subjects of surveillance are exposed to device use in expressly prescribed situations, and third parties risk unlawful possession liability unless within the permitted categories (reg 9(2)).

The Regulations allocate specific duties to public officers and institutions and protect procedural rights through formality and notification requirements. They also prescribe limited private rights and create statutory defences for possession of surveillance information.

• Duties to use prescribed forms and obtain approvals. Regulation 3 requires warrants under several Act sections to be in Form 1 or another form approved by the judge or magistrate; emergency authorisation applications must use Form 2 unless the Commissioner of Police approves another form and emergency authorisations must be in Form 3 or another form approved by the authorised person (reg 3(1)-(3)). Applicants for tracking device warrants or tracking device maintenance/retrieval warrants must use Form 4 or another form approved by the Commissioner (reg 3(4)). These rules oblige applicants and authorised officers to comply with documented form and approval procedures.
• Duty to notify for vulnerable patients. If a tracking device is attached, installed or used for a vulnerable patient in hospital or nursing home contexts, the person in charge must, as soon as practicable, give written notice of that action to the patient’s guardian if one exists under the Guardianship and Administration Act 1990, otherwise to the next of kin or the Public Advocate if next of kin are unknown (reg 6(3)). This is an express duty tying surveillance device use to notification of an authorised family member or substitute decision maker.
• Designation of police employees for Border Search Area activity. The Commissioner of Police may designate in writing employees or classes of employees of the department principally assisting the Minister in the Act’s administration as police employees for the purposes of reg 6(1)(db) (reg 6(1A)). That designation is an administrative duty and decision right for the Commissioner.
• Record‑keeping and destruction duties. The Commissioner of Police, the Corruption and Crime Commission, any designated Commission and the Australian Crime Commission must keep every Part 5 record in a secure place as if it were obtained under a warrant and must destroy Part 5 records when they would have to be destroyed under s 41(1)(b) of the Act if they had been obtained under a warrant. Those agencies must also keep such records as are necessary to enable documents and information to be identified and obligations under the Act to be complied with (reg 7(1)-(2), reg 7(3) definition). The duty has two limbs: secure storage and destruction tied to the Act’s warrant‑based rules, and record maintenance sufficient for audit and compliance.
• Reporting obligations for annual reports. Regulation 8 requires annual reporting under s 43 of the Act to include specified information on applications for warrants and extensions, including number withdrawn, number made on behalf of another law enforcement officer and number made by means other than filing at court. Emergency authorisation reporting must include number withdrawn (reg 8(1)-(2)). Regulation 8A allows designated Commissions to include similar particulars under s 43A. These reporting additions create a data and transparency obligation.
• Rights under prescribed exceptions. The Regulations create limited rights to attach or use tracking devices without a warrant in defined circumstances: emergency services locating people or objects in search operations; hospitals or nursing homes locating vulnerable patients; superintendents locating escaped prisoners; researchers tracking objects relevant to research; public authorities monitoring traffic; police in Border Search Areas to identify radio emitting devices for pattern monitoring; and persons tracking objects they reasonably believe to have been stolen, where the object was formerly in their control (reg 6(1)-(2)). These are statutory permissions rather than private entitlements; they operate as exceptions to the Act’s warrant requirement.
• Possession defences. Regulation 9(2) lists when it is lawful to be in possession of surveillance information, for example where in the course of a law enforcement officer’s duty, where assisting a law enforcement officer, where the information was obtained in accordance with Part 5 of the Act or where obtained from a person lawfully in possession and its communication to the possessor was not an offence under s 9 of the Act. These are legal defences to the offence in reg 9(1) and therefore create a right to possess in defined circumstances.

Collectively, these duties and rights create a framework for operational use, administrative control and accountability. Decision rights (judges and magistrates for form approval; Commissioner of Police for designation; authorised persons issuing emergency authorisations) are concentrated in official actors while compliance duties are given to law enforcement and specified commissions and to hospital/nursing‑home administrators in the narrow vulnerable patient context.

The Regulations contain an express criminal offence for unlawful possession of surveillance information together with a monetary penalty, and they prescribe record‑keeping and destruction duties that are enforceable as statutory obligations. They do not, however, specify enforcement mechanisms for warrant or authorisation abuses, which remain governed by the Act.

• Unlawful possession offence and penalty. Regulation 9(1) sets out a freestanding offence: "A person who is unlawfully in possession of surveillance information commits an offence." The penalty is specified as $5,000. The Regulations also define the meaning of surveillance information and list the lawful possession exceptions in reg 9(2), which operate as statutory defences or exclusions to criminality (reg 9(1)-(3)).
• Regulatory enforcement via record duties. Regulations 7(1)-(2) require specified authorities (Commissioner of Police, Corruption and Crime Commission, any designated Commission and the Australian Crime Commission) to keep Part 5 records secure and to destroy Part 5 records when they would be required to do so under s 41(1)(b) of the Act if the Part 5 record were a record obtained under a warrant. These are operational compliance obligations. The Regulations do not set an explicit penalty for breach of those duties; enforcement would therefore be through the Act’s mechanisms or general administrative law remedies.
• Reporting obligations tied to accountability. Regulation 8 and 8A expand statutory annual reporting requirements under ss 43 and 43A of the Act by specifying additional categories such as number of withdrawn applications and the circumstances of filing. These reporting rules create a transparency mechanism intended to be monitored through the annual report process. The Regulations do not prescribe sanctions for inaccurate reporting; compliance is subject to the Act’s reporting framework and any applicable audit or oversight processes.
• Delegation and designation decisions. Regulation 6(1A) permits the Commissioner of Police to designate employees or classes of employees as police employees for the narrow Border Search Area task in reg 6(1)(db). The Regulations place the power to designate in the Commissioner, but again do not stipulate a penalty for improper designation. Oversight would be governed by administrative and internal law enforcement controls.
• Limitations on private rights of enforcement. The Regulations provide procedural content for warrants , e.g., forms authorise entry by force, electricity use and vehicle removal as necessary , but they do not establish new private causes of action for subjects of surveillance where a statutory power has been exercised. Any challenge to misuse or overreach would primarily invoke the Act’s provisions, judicial review remedies or other relevant statutory causes of action.

In summary, the Regulations create one explicit criminal sanction directly in the instrument (reg 9(1) penalty $5,000) and make several administrative duties enforceable by reference to the Act. The Regulations rely on the Act for many enforcement contours and for the review mechanisms concerning warrants, authorisations and the handling of surveillance information.

The Regulations both reference and incorporate definitions and powers from multiple WA and Commonwealth statutes. They prescribe categories and exceptions by cross‑reference, so the interaction with other laws is structural and often definitional.

• Cross‑referenced Acts and definitions. Regulation 4 relies on definitions in the Conservation and Land Management Act 1984 s 3 to prescribe conservation and land management officers, forest officers, rangers and wildlife officers as law enforcement officers for the Act. It also relies on the Environmental Protection Act 1986 s 3(1) for inspectors and on the Fish Resources Management Act 1994 s 4(1) to define relevant fisheries officers (reg 4).
• Commonwealth agencies recognition. Regulation 5 prescribes specific Commonwealth bodies for s 4(2) of the Act: Australian Security Intelligence Organisation (ASIO), Australian Federal Police (AFP), Australian Competition and Consumer Commission (ACCC) by reference to the Trade Practices Act 1974 s 6A, the Commonwealth department responsible for the Migration Act 1958 and each of the armed forces (reg 5). This creates a statutory bridge for cross‑jurisdictional recognition.
• Road and traffic monitoring. Regulation 6(1)(da) permits public authorities authorised under a written law to monitor traffic on a road, with "road" defined by reference to the Main Roads Act 1930 s 6. The public authority concept is defined by reference to the Criminal Procedure Act 2004 s 3(1) (reg 6(4) definitions). This ties the surveillance device exceptions to road traffic statutory regimes.
• Border Search Area and Misuse of Drugs Act. The term Border Search Area draws on the Misuse of Drugs Act 1981 s 20N(1). Regulation 6(1)(db) allows designated police employees to identify radio emitting devices in Border Search Areas to monitor patterns of movement indicative of criminal activity. The cross‑reference therefore links the surveillance exceptions to the WA statutory scheme regulating Border Search Areas and drug enforcement powers (reg 6(1)(db), reg 6(4)).
• Guardianship and patient protection. Where tracking devices are used in hospitals or nursing homes, the notification duty goes to a guardian appointed under the Guardianship and Administration Act 1990, or to next of kin or, if unknown, to the Public Advocate under the same Act (reg 6(3)). Hospital and nursing home are themselves defined by reference to the Health Services Act 2016 and the Commonwealth Aged Care Act 1997 (reg 6(4)).
• Interaction with criminal procedure and sentencing laws. Regulation 6(1)(e) lists several statutory provisions across WA law where tracking devices may be used for non‑warranted purposes relevant to bail conditions, mental impairment proceedings, emergency management, high risk offender supervision, sentence administration, sentencing and young offender supervision. The listed statutes include the Bail Act 1982, the Criminal Law (Mental Impairment) Act 2023, Emergency Management Act 2005, High Risk Serious Offenders Act 2020, Sentence Administration Act 2003, Sentencing Act 1995 and the Young Offenders Act 1994, with specific sections cited in the Regulations (reg 6(1)(e)(i)-(iv) and related subclauses). These prescriptive cross‑references align tracking‑device exceptions with supervisory regimes and sentencing conditions under other laws.
• Misuse of surveillance information and Act s 9. Regulation 9(2)(d)(ii) makes lawful possession conditional on the communication of the surveillance information to the possessor not having been an offence under s 9 of the Act. This directly links possession defences in the Regulations to the Act’s communication and publication offence provisions.

Because of these cross‑references, the Regulations do not operate in isolation. They lean on definitions and powers in other statutes to identify authorised persons and contexts and to prescribe obligations. Practitioners must therefore read the Regulations alongside the primary Act and the specific statutes cited to determine the scope of authority, any conflicting duties, and the precise meaning of defined terms such as "hospital", "public authority", "Border Search Area" and "law enforcement officer".

The Regulations include a comprehensive compilation table listing amending instruments, dates of publication and commencement. The primary instrument is the Surveillance Devices Regulations 1999, which commenced on the same day as the Surveillance Devices Act 1998 (reg 2). The compilation table and marginal notes in the body of the Regulations record specific insertions and amendments. Key chronological points from the compilation table and the marginal annotations are:

• 1999 original regulations. The Surveillance Devices Regulations 1999 were published 18 November 1999 and commenced 22 November 1999 (r 2; compilation table).
• 2000 amendments. Amendment Regulations 1999 (published 8 Feb 2000) updated forms and Schedule 1 content. Regulation 3 was amended on 8 Feb 2000 to reflect form approval options (marginal note to reg 3 and Schedule entries).
• 2004-2005 and 2006 changes. The Australian Crime Commission (Western Australia) Act 2004 s 73 introduced references to the Australian Crime Commission leading to changes that commenced 1 Feb 2005. Subsequent Surveillance Devices Amendment Regulations in 2005 and 2006 adjusted the Schedule and other operational provisions (compilation table).
• 2007 amendments. Surveillance Devices Amendment Regulations 2007 updated multiple provisions, with effective dates in September 2007 noted in the compilation table. Schedule forms were amended consistent with s 73 changes in 2004 and later.
• 2010 insertion of reg 4. Regulation 4, prescribing classes of law enforcement officers (conservation and land management officers, forest officers, rangers, wildlife officers, certain inspectors and fisheries officers), was inserted by Gazette notice 6 July 2010 (reg 4 inserted: Gazette 6 Jul 2010 p. 3225). The compilation table records the 2010 instrument and commencement.
• 2012-2013 amendments. A series of amendment regulations in 2012 and 2013 updated defined terms and the Schedule forms. The compilation table lists instruments dated January and February 2013 with staggered commencements.
• 2015 amendment to reg 5. Regulation 5 was amended in December 2015 to update the list of Commonwealth agencies prescribed for s 4(2) of the Act (reg 5 amended: Gazette 1 Dec 2015 p. 4821).
• 2016-2017 changes. Multiple amending instruments in 2016 and 2017 updated reg 6 and Schedule forms; details of these include a number of Gazette citations and staggered commencements recorded in the compilation table.
• 2020 and 2023 instruments. The compilation table records several 2020 amending instruments (SL 2020/36, SL 2020/61 and SL 2020/151), which further amended reg 6 and definitions, with staggered commencements in April, May and August 2020. Amendments in 2023 (SL 2023/188) are recorded.
• 2024 and 2025 registry updates. The Police Regulations Amendment (Criminal Law Mental Impairment) Regulations 2024 Pt. 4 and Surveillance Devices Amendment Regulations 2025 (SL 2025/15) made additional textual changes and updates. The body text metadata shows reg 6 was amended multiple times including a list culminating in amendment references up to SL 2025/15 r. 4.

The marginal notes attached to specific regulations indicate when a regulation was inserted or amended, for example reg 4 inserted 6 Jul 2010, reg 7 amended by Act No. 74 of 2004 s 73(2), and reg 3 amended 8 Feb 2000, 5 May 2006. Schedule forms have been amended repeatedly, with annotations showing amendments under Act No. 74 of 2004 s 73(3) and Gazette dates in 2006 and 2007.

Practitioners should consult the compilation table at the end of the Regulations for exact instrument citations, publication dates and commencement dates. The Regulations themselves show marginal notes identifying the amending instruments for the substantive insertions and deletions. Any historical interpretation of a particular version of the Regulations requires reference to the appropriate reprint or the earlier instruments listed in the compilation table.

The Regulations, as reproduced, do not record judicial decisions or litigation history. There are no cases named or summarised within the Regulations themselves. The instrument is procedural and prescriptive rather than declaratory or adjudicative, and it does not include a schedule of judicial determinations.

Consequently, determining the authoritative judicial interpretation of these Regulations requires reference to decisions under the Surveillance Devices Act 1998 and any WA or Commonwealth cases that have considered the Act and these Regulations together. The Regulations should be read alongside the Act, and where legal ambiguities arise , for example on the scope of "vulnerable patient" (a subjective test in reg 6(4)) or the boundaries of "surveillance information" (reg 9(3)) , practitioners must rely on case law interpreting the Act and comparable statutory provisions. Because the Regulations frequently cross‑refer to other statutes, relevant judicial decisions under those statutes (for example cases concerning the definition of Border Search Area, or the duties of hospital administrators under the Guardianship and Administration Act) may also be instructive for disputes that implicate surveillance device use.

For litigation or advisory work, the Regulations direct users to procedural requirements such as forms, notification duties and record‑keeping; non‑compliance could be challenged through the Act’s remedies, judicial review, or statutory cause of action where applicable. However, the Regulations themselves do not catalogue litigation outcomes, so counsel must search case law databases and tribunal decisions for reported authorities construing these specific provisions and their interaction with the Surveillance Devices Act 1998.

The Regulations contain numerous technical points where practitioners commonly run into practical or legal pitfalls. These "gotchas" are procedural traps, definitional surprises and cross‑statutory dependencies that affect admissibility, compliance, liability and institutional practice.

• Forms and approval flexibility. While Schedule 1 prescribes Form 1 for warrants and Forms 2-4 for emergency authorisations and tracking device applications, each provision allows a judge, magistrate, Commissioner of Police or authorised person to approve another form (reg 3(1)-(4)). Practitioners sometimes assume the Schedule is rigid; it is not, approval processes exist. However an unapproved or incorrectly completed form risks procedural invalidity at the point of execution.
• Subjective "vulnerable patient" threshold. The vulnerable patient concept in reg 6(4) is expressly based on the opinion of the "person in charge" of the hospital or nursing home (reg 6(4) definitions). That is a subjective test. Attachment of a tracking device in hospital or aged care contexts carries an immediate written notification duty (reg 6(3)). Failure to give the statutory written notice to a guardian, next of kin or Public Advocate may create administrative non‑compliance and potential collateral legal exposure, but the Regulations do not specify a penalty for failure to notify.
• Delegation and designation power of Commissioner of Police. Regulation 6(1A) permits the Commissioner to designate employees or classes of employees as "police employee" for Border Search Area tasks in reg 6(1)(db). The Regulations do not prescribe form, process or criteria for that designation. Challengeable administrative decisions about designation will require reliance on administrative law principles rather than explicit statutory process in the Regulations.
• Overlap with other statutory regimes. Regulation 6(1)(e) lists multiple specific statutes and provisions where tracking devices may be used without a warrant. Practitioners must read these cross‑references closely. Using a tracking device because it is "permitted" under one of the listed statutes requires verifying the statutory condition in the cited statute and ensuring no additional restrictions apply. Mistaking the list for a general grant increases risk.
• Narrow definition of lawful possession. Regulation 9 creates a solitary offence for unlawful possession of surveillance information and lists narrow lawful possession exceptions (reg 9(2)). The exception in reg 9(2)(d)(ii) requires that the communication of the surveillance information to the person was not an offence under s 9 of the Act. That cross‑reference can be circular in practice and requires checking the Act’s s 9 in every case where the information came from another person who was lawfully in possession.
• Part 5 record handling tied to warrant rules. Regulation 7 requires specified agencies to treat Part 5 records as if they were obtained under a warrant, including secure storage and destruction obligations (reg 7(1)). But "Part 5 record" is an internal definition meaning records delivered under an order under s 31(3)(b) of the Act (reg 7(3)). Misclassifying a record as Part 5 when it is not, or vice versa, changes retention obligations and could affect admissibility.
• Authority to use electricity and remove vehicles. The Schedule forms include express authority to connect surveillance devices to electricity supply systems and to remove vehicles temporarily to attach or retrieve devices (Schedule forms). Users sometimes treat these as implied powers under warrants. The forms make them express conditions. A warrant lacking those checked boxes or particularised text may not authorise these intrusions.
• Border Search Area technicalities. The Border Search Area concept is defined by reference to the Misuse of Drugs Act 1981 s 20N(1) (reg 6(4)). That makes what is permissible in a Border Search Area dependent on the Misuse of Drugs Act’s boundaries and definitions. Practitioners must ensure a location actually falls within the statutory Border Search Area before relying on the reg 6(1)(db) exception.
• Reporting detail and data capture. Regulation 8 requires annual reporting to include numbers of applications withdrawn, applications made on behalf of another law enforcement officer and applications filed other than at court (reg 8(1)). Agencies must therefore capture and retain administrative data to populate annual reports. Failing to track these items creates compliance problems and reduces annual report completeness.
• Amendments and multiple commencement dates. The Regulations have been amended repeatedly with staggered commencement dates recorded in the compilation table. Ensuring compliance with the version of the Regulations in force at a particular time requires checking the compilation table and marginal notes. Practitioners must avoid relying on a pre‑amendment understanding of formularies or definitions.

These practical pitfalls show why reading the Regulations alongside the Surveillance Devices Act 1998 and the cross‑referenced Acts is essential. Procedural formalities, narrow statutory defences and cross‑statutory dependencies create many contexts in which a small technical omission can lead to exclusion of evidence, administrative review risk or criminal liability.

Compliance under these Regulations requires attention to four operational streams: form and application procedure, lawful exceptions to warrants (especially reg 6), records and reporting, and possession rules. The following checklist sets out concrete steps and citations to help institutions and practitioners align practice with the text.

1. Use the correct form and obtain approvals (reg 3; Schedule 1).

   • For warrants under ss 13, 14, 17, 19 or 22 of the Act, prepare Form 1 in Schedule 1 or obtain written approval from the judge or magistrate for another form (reg 3(1)).
   • For emergency authorisations under s 21, lodge Form 2 for applications and use Form 3 for issued authorisations unless the Commissioner of Police or the authorised person approves another form (reg 3(2)-(3)).
   • For tracking device warrants or tracking device maintenance/retrieval warrants, use Form 4 or another Commissioner‑approved form (reg 3(4)).
   • Ensure draft warrants include express clauses for entry, use of electricity supply, vehicle removal, periods of operation and conditions as presented in the Schedule.

2. Verify authorised person and prescribed class status before acting (reg 4, reg 5, reg 6(1A)).

   • Confirm whether the applicant or recipient of the warrant is a prescribed law enforcement officer per reg 4 or a prescribed Commonwealth agency per reg 5.
   • For Border Search Area activities (reg 6(1)(db)), ensure the police employee has been designated in writing by the Commissioner of Police as allowed under reg 6(1A).

3. Use non‑warrant tracking device exceptions only where expressly authorised (reg 6).

   • Confirm the specific reg 6 circumstance applies: emergency service search (reg 6(1)(a)); hospital/nursing home vulnerable patient tracking with required written notification (reg 6(1)(b) and reg 6(3)); prison superintendent for escape risk (reg 6(1)(c)); researcher and object link to research (reg 6(1)(d)); public authority traffic monitoring (reg 6(1)(da)); police pattern monitoring in Border Search Area (reg 6(1)(db)); or recovery of possession for items reasonably believed stolen where all three elements of reg 6(2) are met.
   • For vulnerable patient use, provide written notice as soon as practicable to the guardian under the Guardianship and Administration Act 1990, next of kin or the Public Advocate as required (reg 6(3)).

4. Keep and destroy records in accordance with reg 7.

   • For Part 5 records (records or reports delivered under an order under s 31(3)(b) of the Act), store them securely and destroy them when they would have been required to be destroyed if obtained under a warrant (reg 7(1)-(3)).
   • Maintain records sufficient to identify documents and to demonstrate compliance with statutory obligations under the Act (reg 7(2)).

5. Build reporting and data capture to satisfy reg 8 and 8A.

   • Capture the number of applications for warrants and extensions that were withdrawn, applications made on behalf of another officer, and applications made other than by filing at court, as these must be included in annual reports (reg 8(1)(a)-(c)).
   • Record the number of withdrawn emergency authorisation applications for annual reporting (reg 8(2)).
   • Allow designated Commissions to include similar information under reg 8A.

6. Manage possession risk under reg 9.

   • Avoid retaining surveillance information unless one of the lawful possession categories applies: law enforcement officer in the course of duty, person assisting law enforcement in that course, information obtained under Part 5 of the Act, or information obtained from someone lawfully in possession where communication was lawful per s 9 of the Act (reg 9(2)).
   • Implement internal policies to ensure chain of custody and lawful provenance before distributing surveillance information, given reg 9(1) creates a $5,000 penalty for unlawful possession and reg 9(3) defines surveillance information.

7. Check cross‑statutory conditions.

   • Where relying on a non‑warrant exception tied to another statute listed in reg 6(1)(e) or on definitions imported from other Acts (e.g. Public Authority, Border Search Area, hospital, nursing home), verify the statutory prerequisites under those Acts and ensure local administrative authorisations are in place.

8. Train and document decision processes.

   • Ensure that decision makers and authorised officers understand who can sign emergency authorisations, who may be designated by the Commissioner for Border Search Area work (reg 6(1A)), what constitutes a Part 5 record and the notification duties for vulnerable patients.
   • Keep written records of designations, approvals of alternative form use, reasons for relying on non‑warrant exceptions, and written notifications to guardians or next of kin where applicable.

9. Audit and retention schedule aligned with s 41 and reg 7.

   • Align the agency’s document retention schedule for surveillance material with the Act’s s 41(1)(b) destruction requirements and reg 7 that treats Part 5 records as if obtained under a warrant.

10. Seek judicial or departmental advice for borderline cases.

• Where doubt exists about whether a circumstance fits the prescribed exceptions or where forms or approvals are ambiguous, seek judicial guidance on form approval or departmental legal advice before action, recognising that the Regulations themselves provide formality but not standalone adjudicative guidance.
