26 Remote application

(1) An application for a retrieval warrant may be made under section 25 by telephone, e-mail or any other means of communication if—

(a) a law enforcement officer reasonably believes that it is impracticable for the application to be made in person, or

(b) the eligible Judge who is to determine the application requests that it is made that way.

(2) If an affidavit has been prepared, the person applying must transmit a copy of the affidavit, whether sworn or unsworn, to the eligible Judge who is to determine the application.
