What it does
The Surrogacy Regulation 2016 (the regulation) sets out definitional and procedural detail that operates under the Surrogacy Act 2010 (the Act). Mechanically the regulation does the following.
- Commencement and repeal: it commences on the day it is published on the NSW legislation website (cl 2). It repeals the Surrogacy Regulation 2011 and carries forward existing acts, matters or things that had effect under the earlier regulation (cl 8(1) and (2)).
- Definitions and linkage to parent Act: it defines "the Act" as the Surrogacy Act 2010 and notes that the Act and the Interpretation Act 1987 affect interpretation and application (cl 3).
- Interstate recognition: it declares a list of specified orders to be Interstate parentage orders under s 4(1) of the Act (cl 4), and it declares a list of specified interstate statutes to be Interstate surrogacy laws under s 4(1) of the Act (cl 5).
- Counsellor qualifications: it prescribes the minimum qualifications and membership/authorisation criteria for persons who may exercise the functions of a qualified counsellor under the Act for domestic surrogacy arrangements (cl 6) and for surrogacy arrangements entered into outside Australia (cl 6A). It also prescribes additional requirements for counsellors who give independent counsellor’s reports under Act s 17 (cl 6B).
- Transitional application of amendments: it preserves the operation of the pre‑amendment clauses for persons already engaged as counsellors prior to the commencement of the amending regulation, and it clarifies application of the new clauses to persons engaged for international arrangements before commencement (cl 7). The amending instrument is identified (Surrogacy Amendment (Qualified Counsellors) Regulation 2025) and the term "engaged" is defined to include booking an initial appointment (cl 7).
