### 972 Procedure > > (1)  An application for an order under the Evidence Act may be made by a person nominated for that purpose by the court or tribunal concerned or, if no person is so nominated, by the Attorney-General. > > > (2)  An application under [subrule (1)](#GS972@Gs1@EN) is to be – > > > > > > (a) made *ex parte*; and > > > > > > > (b) accompanied by an affidavit to which is exhibited the request for the application; and > > > > > > > (c) if the request is not in English, accompanied by a translation of it into English bearing a certificate of the translator, in English, that it is an accurate translation of the relevant document.
