### 966 Application of Part 38
> [*\[Rule 966 Amended by S.R. 2009, No. 52, Applied:01 Nov 2010\]*](/view/html/inforce/2010-11-01/sr-2009-052#GS6@EN) This Part applies to the service on a person in the State of any document in connection with civil or commercial proceedings pending before a court or other tribunal in a foreign country, other than a Hague Convention country, if the Principal Registrar receives –

> > > (a) a letter from the court or tribunal requesting service on the person in the State and –
> > >
> > > > > (i) it is in accordance with a Convention; or
> > > >
> > > > > (ii) it is not in accordance with a Convention and the Attorney-General certifies that effect ought to be given to it; or
> >
> > > (b) a letter from the consular or other authority of the foreign country requesting service on the person in the State and the request is in accordance with a Convention.
