### 783 Conduct of proceedings
> > (1) If, under [section 11(1)(b)](/view/html/inforce/2026-04-12/act-1987-078#GS11@Gs1@Hpb@EN) of the Cross-vesting Act, the Court applies the law of another State or a Territory in determining a right of action arising under a written law of that State or Territory, the pleadings are to identify the right of action and the written law under which the proceeding arises.

> > (2) A party seeking to have rules of evidence and procedure, other than those of the Court, applied under [section 11(1)(c)](/view/html/inforce/2026-04-12/act-1987-078#GS11@Gs1@Hpc@EN) of the Cross-vesting Act in dealing with a matter for determination by the Court is to include in the pleadings a statement substantially identifying the rules of evidence and procedure.

> > (3) If a party claims that rules of evidence and procedure other than those of the Court should, under [section 11(1)(c)](/view/html/inforce/2026-04-12/act-1987-078#GS11@Gs1@Hpc@EN) of the Cross-vesting Act, be applied to the determination by the Court of a matter in a proceeding –

> > > > (a) the party is to seek directions on the matter before the proceeding is set down for trial; and
> > >
> > > > (b) the Court, at any time and of its own motion, may –
> > > >
> > > > > > (i) give directions in relation to the matter; and
> > > > >
> > > > > > (ii) revoke or vary any direction.
