### 729 Intervener in probate action > > (1)  On the application of a person not a party to a probate action, the Court or a judge may grant leave to that person to intervene in a probate action. > > > (2)  An application is to be supported by an affidavit showing the interest of the person applying in the estate of the deceased. > > > (3)  If leave is granted under [subrule (1)](#GS729@Gs1@EN) , the Court or judge may give any direction as to – > > > > > > (a) the service of pleadings; or > > > > > > > (b) the filing of an affidavit of testamentary scripts; or > > > > > > > (c) any other matter as may be appropriate. > > > (4)  A person granted leave to intervene in a probate action is to file a notice of appearance in the action before being entitled to be heard.
