### 709 Powers of Court or judge
> > (1) The Court or a judge has all the powers conferred on the Court by [rule 693](#GS693@EN) as if –
> >
> > > > (a) the tribunal which made the determination were an inferior court; and
> > >
> > > > (b) the proceedings in which the determination was made were a trial; and
> > >
> > > > (c) the determination were a judgment.

> > (2) Any evidence given before a tribunal may be brought before the Court or judge by affidavit or, if so directed by the Court or judge, by oral evidence.
>
> > (3) The Court or judge may ascertain the evidence given, and the proceedings had, before the tribunal from any material, including counsel's notes, and that material may be used to determine the appeal.
