### 617 Sale out of Court
> > (1) The Court or a judge may authorise a sale of land to be carried out by proceedings out of Court.
>
> > (2) Any money produced by a sale out of Court are to be –
> >
> > > > (a) paid into Court or to trustees; or
> > >
> > > > (b) otherwise dealt with –

> > as the Court or judge orders.

> > (3) The Court or a judge is not to make an order under [subrule (1)](#GS617@Gs1@EN) unless each person interested in the land to be sold is before the Court or is bound by the order.

> > (4) An order under [subrule (1)](#GS617@Gs1@EN) is to be prefaced by –
> >
> > > > (a) a declaration that the Court or a judge is satisfied of the matters referred to in [subrule (3)](#GS617@Gs3@EN) ; and
> > >
> > > > (b) a statement of the evidence on which the declaration is made.
