### 414 Application of Division 1 of Part 14
> This Division applies to –
>
> > > (a) a proceeding which –
> > >
> > > > > (i) is of a class specified by a practice direction authorised by the Chief Justice as being a class of proceedings to which this Division is to apply; and
> > > >
> > > > > (ii) was commenced after the date on which the practice direction took effect; and
> >
> > > (b) an action in which a judge has granted leave to defend under [rule 359](#GS359@EN) ; and
> >
> > > (c) an action in which a judge has given judgment under [rule 358](#GS358@EN) and has ordered that execution of the judgment be stayed pending the trial of a counterclaim or the action; and
> >
> > > (d) an action in which a judge has declined to order judgment under [Division 3](#HP11@HD3@EN) or [4](#HP11@HD4@EN) of [Part 11](#HP11@EN) ; and
> >
> > > (e) any other proceeding in which a party requests in writing to the Principal Registrar that this Division apply to it, or in which a judge, of his or her own motion, has so directed.
