> If, on an application, an order is not made under [rule 367(3)](#GS367@Gs3@EN) , the judge –

> > > (a) is to direct that the action proceed to trial; and

> > > (b) may give any directions as to the further conduct of the action as may be given on an application for directions under [rule 552](#GS552@EN) ; and
