### 338 Notice of constitutional matter > > (1)  A party whose case raises a matter arising under the Constitution or involving its interpretation, within the meaning of section 78B of the *Judiciary Act 1903* of the Commonwealth, is to file a notice of a constitutional matter as soon as practicable, unless the Court or a judge directs another party to do so. > > > (2)  A notice is to state specifically the nature of the matter and the facts showing that the matter is one to which [subrule (1)](#GS338@Gs1@EN) applies.
