### 331 Enforcement of judgment against members of society > > (1)  A plaintiff may apply for the leave of the Court or a judge to enforce a judgment against any past or present member of the society against whom judgment could have been recovered in respect of the same matter as that to which the judgment to be enforced relates in an action instituted by the plaintiff against that member. > > > (2)  On an application under [subrule (1)](#GS331@Gs1@EN) , the Court or a judge – > > > > > > (a) if the member does not dispute liability, may grant leave; or > > > > > > > (b) if the member disputes liability, may order that the question of the liability be tried and determined in any manner in which an issue in an action may be tried and determined.
