### 291 Offer to contribute > > (1)  If in any proceeding a defendant makes a contribution claim in respect of any claim for a debt or damages made by the plaintiff in the proceeding, a party to the contribution claim may serve on any other party to the contribution claim an offer to contribute toward a compromise of the claim made by the plaintiff on any terms specified in the offer. > > > (2)  The Court or a judge may take an offer to contribute into account in determining whether the party on whom the offer to contribute was served is to pay the whole or a part of – > > > > > > (a) the costs of the party making the offer; or > > > > > > > (b) any costs which the party making the offer is liable to pay to the plaintiff. > > > (3)  [Rules 286](#GS286@EN) and [287](#GS287@EN) apply, with any necessary modification, to an offer to contribute as if it were an offer of compromise.
