### 109 Insufficient endorsement
> > (1) The Court or a judge, on the application of a defendant, may set aside a writ which has an endorsement of claim if the endorsement does not contain a statement sufficient to give notice of –

> > > > (a) the nature of the claim; and

> > > > (b) the remedy or relief sought in the action.
