Supreme Court Library Rules 2024

The Rules directly affect several groups:

Judges of the Supreme Court and other judicial officers. The Chief Justice and other Supreme Court judges serve on the Committee in specified numbers. County Court judges, magistrates and VCAT members participate by nomination. The Rules therefore impose governance responsibilities on these judicial officers, including attendance at meetings, voting, and oversight of the library and its finances. The Council of Judges appoints the judicial members, giving that body a continuing role.

Local legal practitioners in Victoria. Practitioners whose principal place of practice is Victoria and who are on the local register have a right to access the library, but are also eligible for appointment to the Committee. The Law Institute of Victoria and the Victorian Bar Council each nominate two practitioners for two-year terms. This provides a channel for practitioner input, but because appointments are by nomination from two peak bodies, it concentrates influence among those organisations rather than allowing open applications. Practitioners who are not members of the LIV or Bar might have less access to positions. The right of access is subject to any rules made under the instrument, which could impose conditions, fees or restrictions.

Library staff and the Supreme Court Librarian. The Librarian acts as Secretary to the Committee unless another person is appointed. The Rules do not otherwise define staff roles, but the Committee’s control and management function will affect library operations, budget and services.

Litigants and the public. The Rules make no provision for public access to the library. The access right is explicitly limited to members of the legal profession. Self‑represented litigants, law students not yet admitted, academic researchers and the general public have no guaranteed access under these Rules. This may affect access to justice for unrepresented parties who wish to use the library’s resources. The Committee could by agreement extend library services to other users, but the Rules do not mandate it.

Other courts and tribunals. If the Committee agrees to manage their library services, those bodies will be indirectly affected by the Committee’s decisions.

The nominee company and its directors. The company limited by guarantee that holds the Fund’s investments has directors nominated by the Chief Justice, with at least one current or former Supreme Court judge. Those directors bear fiduciary obligations under corporations law, but the Rules do not specify any additional governance requirements for the nominee company beyond its limited purpose.

Taxpayers and the consolidated fund. The Fund is separate from consolidated revenue, but if investment returns are insufficient or mismanaged, the State may need to supplement library funding. Conversely, well‑managed investments reduce the call on public money.

Duties of the Committee. The Committee must exercise control, management and good governance of the Supreme Court Library (rule 6(2)(a)). It must control and manage the Fund, including ensuring that money available for investment is fully and properly invested in any manner authorised by law (rule 13(1)). The phrase “fully and properly invested” imposes an obligation to keep the Fund working at all times, not to leave cash idle, and to invest prudently. The Committee also has a duty to ensure investments are held in the name of a qualifying nominee company (rule 13(3)). It may establish subcommittees as considered necessary (rule 12). It may recommend rule‑making to the Judges, including on penalties for breaches of library rules (rule 14(1)). The Committee does not itself make binding rules; only the Judges can do so.

Duties of the Chair. The Chair must preside at meetings, and holds a deliberative and casting vote (rule 10). The Chair directs when and where meetings are held (rule 9). No duty to call a minimum number of meetings is stated.

Duties of the Supreme Court Librarian (Secretary). Unless otherwise appointed, the Librarian acts as Secretary to the Committee (rule 11). The Secretary’s duties are not otherwise described, but conventionally include convening meetings, keeping minutes and handling correspondence.

Duties of the nominee company directors. The nominee company must limit its activities solely to holding securities and other investments of the Fund (rule 13(3)(b)). The directors, being persons nominated by the Chief Justice, owe duties under the Corporations Act 2001 (Cth), but the Rules impose no additional obligations.

Rights of legal practitioners. Subject to any rules made by the Judges, members of the legal profession of Victoria have a right to access the Supreme Court Library (rule 14(2)). This is a qualified right: it can be curtailed or conditioned by future rules. The Rules themselves do not set out any specific access conditions, hours, borrowing privileges or fees. The right is limited to “members of the legal profession of Victoria,” which by definition in rule 5 requires the practitioner’s principal place of practice to be Victoria and to be on the local register. Interstate practitioners, or those without a Victorian principal place of practice, do not have this right unless the Committee or Judges expand access by rule.

Rights of the Committee. The Committee has all powers necessary for carrying out its functions (rule 6(3)). This grant is broad but must be read in light of the specific functions. It likely includes power to enter contracts, employ staff, set fees, and manage property, but not to override the Judges’ rule‑making power.

Transitional rights of existing members. Members of the old Committee from the 2019 Rules continue in office for the balance of their period and are eligible for re‑appointment (rule 15(1)). The Committee is taken to be the same body despite changes to composition or quorum, so no decisions or matters are invalidated (rule 15(2)). This preserves continuity and avoids the need for fresh authorisations.

The Rules themselves do not create or specify any penalties. Rule 14(1)(c) provides that the Committee may make recommendations to the Judges of the Supreme Court for Rules to be made by the Judges providing for penalties for breaches of the Rules. This means that any penalty framework is contingent on future action by the Judges, who must decide whether to adopt the Committee’s recommendations and enact binding rules. The Rules currently in force contain no penalty provisions for offences such as unauthorised removal of materials, failure to comply with library conditions, or misuse of the Fund.

Enforcement gaps. Because no penalties are currently in effect, the library must rely on general criminal law (theft, trespass) or civil remedies (conversion, breach of contract) to address misconduct. For example, if a practitioner removes a book without authorisation, the library cannot impose a fine under these Rules unless and until further rules are made. The Committee could recommend that the Judges create a framework of infringement notices, fines, or suspension of access privileges. Until then, enforcement is piecemeal.

Compliance for Committee members. The Rules impose duties but do not specify consequences for failure to comply. For instance, if the Committee fails to ensure the Fund is fully invested, or if investments are made without proper authority, there is no direct penalty in these Rules. General duties under the Supreme Court Act 1986 or the Corporations Act (if the nominee company acts improperly) may apply, but the Rules are silent.

Access conditions. The right of access in rule 14(2) is subject to the Rules. This means the Judges could later make rules imposing conditions on access, with penalties for breach. That power has not yet been exercised. Practitioners currently have access without penalty risk, but that could change.

No civil liability or compensation provision. The Rules contain no mechanism for the library to recover damages or costs from a user who damages property or fails to return items. Any such claim would need to be pursued under common law or statute.

Sunset and revocation. The only enforcement mechanism built into the instrument itself is the possibility that the Judges could, on the Committee’s recommendation, make rules with penalties. The absence of penalties now suggests that the primary compliance incentive is the risk of losing library privileges, which is not a legal penalty but an administrative one. The Committee could, in theory, restrict or deny access for breach under its general management powers, but this is not spelled out.

Supreme Court Act 1986. The Rules are made under section 25 of that Act, which empowers the Judges of the Supreme Court to make rules with respect to the Supreme Court Library and the Library Fund. The parent Act also defines “Judge of the Supreme Court” for the purposes of the Rules. The rules‑making power is delegated to the Judges; the Committee cannot make rules itself, only recommend them. The parent Act’s section 25 also likely circumscribes the scope of what the Rules can validly cover.

Constitution Act 1975. The definition of “Judge of the Supreme Court” in the Rules incorporates the definition from the Supreme Court Act 1986, which in turn refers to section 75(3) of the Constitution Act. This extends the definition to include reserve judges engaged under section 81B of the Constitution Act. This means that a reserve judge who is engaged can be a member of the Committee or its Chair, if nominated.

Legal Profession Uniform Law (Victoria). The definition of “local legal practitioner” depends on the local legal profession register established under the Uniform Law. A practitioner whose principal place of practice is Victoria and who is on that register qualifies. This ties eligibility for Committee membership and library access to a uniform national framework, but excludes practitioners registered in other states who do not have a Victorian principal place of practice.

Subordinate Legislation Act 1994. The Rules are subject to that Act’s sunset provisions: they will automatically expire on 23 May 2034 unless remade. This imposes a limited lifespan and forces periodic review of the library governance arrangements.

Corporations Act 2001 (Cth). The nominee company that holds the Fund’s investments is a company limited by guarantee. It must comply with the Corporations Act regarding directors’ duties, annual reporting and solvency. The Rules require that all directors be nominated by the Chief Justice, with at least one being a current or former Supreme Court judge. This does not override corporations law; rather, it adds an extra layer of governance. The nominee company cannot engage in any activities other than holding the Fund’s securities and other investments (rule 13(3)(b)), which restricts its corporate capacity.

Supreme Court Library Rules 2019 and Fund Investment Rules 2021. These are revoked. The 2024 Rules adopt the Fund from the earlier structure. Any investments made under the old rules continue as part of the new Fund. The transitional provisions ensure no legal discontinuity.

Other court library services. The Committee may, by agreement, manage library services of Victorian courts or tribunals (rule 6(2)(b)(i)). Those agreements will create contractual relationships governed by general contract law and possibly the applicable court’s enabling legislation. The Rules do not specify any mandatory terms.

Freedom of Information Act 1982 (Vic). The library is likely an agency for FOI purposes, but the Rules do not address this. The Committee’s records may be subject to FOI requests, though the library’s functions are internal to the court system.

The Supreme Court Library Rules 2024 are new and have not yet been amended. The Table of Amendments (endnote 2) records that there are no amendments made by statutory rules, subordinate instruments or Acts. The Rules came into operation on 1 July 2024, having been made on 23 May 2024. They replace two earlier instruments: the Supreme Court Library Rules 2019 (S.R. No. 20/2019, as amended by S.R. No. 95/2023) and the Supreme Court Library Fund Investment Rules 2021 (S.R. No. 104/2021). The 2019 Rules had been in force for five years and had been amended once, by S.R. No. 95/2023. That amendment is no longer relevant. The Fund Investment Rules 2021 existed for only three years before being subsumed.

The 2024 Rules consolidate the governance and investment provisions into one instrument, reflecting a decision to simplify the library’s regulatory framework. The Committee’s composition has changed slightly from the 2019 Rules. Under the 2019 Rules, the Committee had a similar structure but the quorum was six members, not five. The reduction to five may make it easier to reach decisions. The Chair provisions are also slightly refined. The 2024 Rules now explicitly state that the Chair may be a judge nominated by the Chief Justice from the appointed judges, not only the Chief Justice or a nominee.

No substantive amendments are expected soon, but the Committee may recommend changes if operational needs arise. Because the Rules sunset in 2034, any significant revision is likely to occur before that date.

There is no reported litigation under these Rules, which is unsurprising given they came into force on 1 July 2024 and are largely procedural. The previous 2019 Rules also appear not to have been the subject of appellate decisions or judicial consideration in published judgments. The library’s operations are administrative and internal to the court system, so disputes are unlikely to reach court. The primary risk of litigation would involve the Fund’s investments (e.g., a challenge to the committee’s investment decisions or the nominee company’s conduct), or a dispute over access to the library (e.g., a practitioner claiming their right of access was improperly denied). However, the Rules provide no private right of action.

The nominee company structure, with directors nominated by the Chief Justice, could give rise to challenges under the Corporations Act if directors breach their duties, but that would be litigated in the Federal Court or Supreme Court under general corporations law, not under the Rules themselves.

The revocation of the 2019 and 2021 Rules may also be litigated if a party argues that transitional provisions failed to preserve some right or investment. But the transitional rule (rule 15) explicitly states that the Committee and Fund are taken to be the same body, minimising disruption.

Overall, the litigation history is negligible. The instrument is designed to avoid disputes rather than invite them.

Several features of the Rules merit attention for potential unintended consequences or hidden traps.

Access limited to the legal profession, with a narrow definition. Only “members of the legal profession of Victoria” have a right of access. The definition requires a principal place of practice in Victoria and registration on the local uniform law register. This excludes:

• Legal practitioners based interstate who occasionally appear in Victorian courts.
• Law students, articled clerks or graduates not yet admitted.
• Self‑represented litigants, who may need access to legal materials.
• Legal academics or researchers unless they also practise.
• The general public.

Practitioners whose principal place of practice is outside Victoria cannot access the library as of right, even if they are on the Victorian register (they may have a local principal place of practice requirement). The Committee or Judges could later expand access by rule, but currently it is restricted.

Fund investment obligation “fully and properly invested.” Rule 13(1) requires the Committee to ensure the Fund is fully and properly invested. The word “fully” suggests that no surplus cash should remain uninvested for any period. This may create pressure to invest even during market volatility or when suitable low‑risk investments are scarce. The Committee could face criticism or legal risk if cash remains uninvested even for a short time due to practical delays. The phrase “properly invested” imports a prudence standard, but the Rules do not specify any investment mandate, asset allocation, or risk tolerance. The Committee must invest “in any manner authorised by law,” which is broad and may include high‑risk assets. Without a clear investment policy, there is potential for misalignment between investment strategy and the library’s funding needs.

Nominee company governance. The nominee company must have all directors nominated by the Chief Justice, and at least one must be a current or former Supreme Court judge. This arrangement concentrates control in one person. There is no requirement for independent directors, financial expertise, or diversity. The company’s only activity is to hold the Fund’s investments, but its board is effectively appointed by the Chief Justice. This could lead to conflicts of interest if the Committee (which includes the Chief Justice or a nominee) directs investment decisions that the nominee company then executes. The Rules do not require the nominee company to act independently.

Committee composition lacks diversity. The ten‑member Committee includes six judicial members (Chief Justice or nominee, two Supreme Court judges, one County Court judge, one magistrate, one VCAT member) and four local practitioners nominated by the LIV and Bar. There is no requirement for representation of litigants, library users, financial experts, or non‑legal professionals. The dominance of the judiciary may lead to governance that prioritises judicial convenience over broader access or cost efficiency.

No penalty framework yet. As noted, the Rules do not currently contain penalties. The Committee may recommend them, but until they are enacted, the library must rely on general law. This creates enforcement uncertainty. If a practitioner repeatedly breaks library rules, the library cannot impose a fine or suspension under these Rules.

Quorum of five. With ten members, a quorum of five means that decisions can be made with only half the members present. Absenteeism could allow a small faction to control decisions. The Chair has a casting vote, so if five members are present and the vote is tied (taking the Chair’s deliberative vote into account), the Chair can break the tie. This centralises power.

Transitional continuity may obscure accountability. Rule 15(2) provides that the Committee is taken to be the same body despite changes. This means that decisions made under the old rules continue and cannot be challenged merely because the composition or quorum has changed. While this avoids disruption, it also prevents fresh scrutiny of past decisions.

Sunset creates regulatory risk. The Rules sunset in 2034. If they are not remade, the library will operate without rules under section 25 of the Supreme Court Act, depending on transitional provisions of the Subordinate Legislation Act. This may create a gap.

For the Supreme Court Library Committee. The Committee’s primary compliance obligations are to exercise its functions of control, management and good governance of the library and the Fund. Practically, this means:

• Hold meetings as directed by the Chair, with at least five members present, and document decisions. Keep minutes.
• Ensure the Fund’s cash is invested promptly in authorised investments. The Committee should adopt an investment policy that is consistent with “any manner authorised by law” and that provides for diversification, liquidity and risk management. While no specific mandate is given, the Committee should be able to demonstrate that it has considered proper investment.
• Ensure that all investments of the Fund are held in the name of a qualifying nominee company. The nominee company must be limited by guarantee, have all directors nominated by the Chief Justice (at least one being a current or former Supreme Court judge), and must not engage in any other activities. The Committee must ensure the nominee company’s constitution is consistent with these requirements and that it does not stray beyond holding securities.
• Manage the library in accordance with the Rules and any rules the Judges make under rule 14. Currently no such rules exist, so the Committee should operate under its own policies and procedures.
• If managing library services for other courts or tribunals by agreement, ensure those agreements are consistent with the Committee’s functions and are properly documented.
• Consider establishing subcommittees if needed (e.g., an investment subcommittee, a library operations subcommittee) and define their terms of reference.
• Report to the Council of Judges as appropriate, though no reporting requirement is stated.

For the Chair. The Chair must call meetings, preside, and vote when necessary. The Chair should ensure that quorum is achieved and that decisions are recorded. The Chair also has the power to convene meetings at times and places of their choosing, which should be exercised in a way that allows all members to participate.

For the Supreme Court Librarian (Secretary). The Secretary should prepare agendas, convene meetings, keep minutes, and maintain the Committee’s records. The Secretary may also provide administrative support for subcommittees.

For members of the legal profession. Practitioners who wish to access the library should check that they meet the definition of “local legal practitioner” (principal place of practice in Victoria and on the local register). They should comply with any conditions the library imposes, such as registration, identification, and rules about borrowing, return of materials, and behaviour. Even though no penalties are currently in force for breaches, the library may still cancel or restrict access under its management powers, and ultimately the Judges could impose penalties by rule. Practitioners should also be aware that access is a privilege subject to the Rules; it can be modified.

For the nominee company directors. Directors must ensure the company engages in no activity other than holding the Fund’s investments. They must comply with the Corporations Act, including maintaining the company’s solvency, lodging annual returns, and avoiding conflicts of interest. They should also ensure that the company’s constitution reflects the restrictions in rule 13(3).

For anyone challenging a decision. The Rules provide no internal review or appeal mechanism. A person aggrieved by a denial of access or a Committee decision may have recourse to judicial review under the Administrative Law Act 1978 (Vic) or general law, but that is not provided for within the Rules.
