#### 62 Common law and statutory rights and duties 62 Common law and statutory rights and duties > Subject to the provisions of this Act for giving effect to equitable rights and other matters of equity, and subject to section 5 of the [Law Reform (Law and Equity) Act 1972](/view/html/inforce/current/act-1972-028), the Court shall give effect to all legal claims and demands and all estates, titles, rights, duties, obligations and liabilities existing by the common law or by any custom, or created by any statute. > > **s 62:** Am 1972 No 28, sec 3 (3).
