105 Application of secs 106, 107
> Sections 106 and 107 apply to an appeal to the Court of Appeal where the appellant seeks a new trial or the setting aside of a verdict, finding, assessment or judgment—

> > (a) after a trial with a jury in proceedings in the Court, or
>
> > (b) after a trial—
> >
> > > (i) with or without a jury in an action commenced before the commencement of section 4 of the [District Court (Amendment) Act 1975](/view/pdf/asmade/act-1975-1), or
> >
> > > (ii) with a jury in an action commenced after the commencement of that section,
> >
> > in the District Court.
