37H Appeal bench
(1) The Court of Appeal is constituted by 3 judges, except under the
following provisions:
• section 37J (Appeal court constituted by single judge)
• section 37L (Appeal judge unable to continue sitting)
• section 37O (4) (which provides for the enforcement of an order).
(2) At least 1 of the judges sitting on the Court of Appeal must be a
resident judge, unless the Chief Justice considers it impracticable for
the Court of Appeal to be so constituted.
(3) A judge must not sit on an appeal from an order made by the judge.
