27 Equities of defendant
In proceedings in the court, the defendant is entitled to rely on an
equitable defence, or is entitled to equitable relief of any sort, against
any claim (whether at law or in equity) if, in pre-Judicature Act
proceedings of the same type, the defendant would have been entitled
to rely on such a defence, or would have been entitled to such relief,
as the case may be.
