The Rules prescribe a tight checklist of documentary steps and particular items to be completed. Compliance requires using the correct form for the statutory purpose, completing all required fields and following the express instructions embedded in the Schedule.
Step 1 , select the correct prescribed form. Use Form 1 for applications for a warrant under s 5(2)(a) of the Absconding Debtors Act 1978 (r 2; Schedule, Form 1). Use Form 2 as the warrant form if judicial authorisation is granted (r 3; Schedule, Form 2). Use Form 3 for applications for an order restraining transfer or removal of property under s 13(2) (r 4; Schedule, Form 3). Use Form 4 for applications by an alleged debtor seeking to set aside a warrant, to seek discharge from custody, or to vary or quash an order under s 20(2)(b) (r 5; Schedule, Form 4).
Step 2 , complete all required particulars. For applicants, ensure the applicant's name and address are entered exactly as required (Forms 1-3). For alleged debtor details, provide name and address where known (Forms 1-3). Where monetary particulars are required, state the amount of the alleged debt and the costs claimed on Form 2 (Schedule, Form 2). For restraint orders, complete Schedule 1 and/or Schedule 2 in Form 3 with full particulars of the property to be restrained or prevented from removal out of the Territory (Schedule, Form 3).
Step 3 , follow delete-if-not-applicable and variation instructions. For Forms 3 and 4, delete the inapplicable options so the document clearly indicates what relief is sought. For a variation sought under Form 4, set out the terms of the variation and the terms of the original order as the form requires (Schedule, Form 4).
Step 4 , ensure judicial and registry formalities are observed. Address the form to the appropriate judicial officer (Supreme Court Judge or Local Court Judge as the forms require), sign and date where required, and provide the time and place of execution on Form 2 if applicable. Ensure the judge signs Form 2 when issuing the warrant and that the date of issue is recorded on the warrant (Schedule, Form 2).
Step 5 , respect execution timeframes and custody obligations. If a warrant is issued in Form 2, coordinate execution so it occurs within one month of the date of issue. Notify the police executing the warrant of the one-month limit and the requirement that the officer in charge of the police station must bring the arrested person before the Local Court or Supreme Court (Schedule, Form 2, notes).
Step 6 , attach supporting evidence where appropriate. The prescribed forms contain limited space for narrative or evidentiary material. Where the Act or judicial practice requires supporting affidavits, exhibits or further particulars, attach those materials to the prescribed form so the application or warrant is supported by an adequate evidentiary record.
Step 7 , maintain accurate registry copies and records. Retain copies of completed forms, affidavits, execution notices and any return of execution. The forms are the authoritative record of the application and the warrant; ensure the court registry files are updated and that police receive the original warrant as required.
Step 8 , verify currency and amendments. Confirm the version of the form being used reflects any amendments recorded in the Endnotes. The Schedule indicates amendments by SL No. 35 of 2016 and formal changes made by the Interpretation Legislation Amendment Act 2018. Use the current reprint or the official online consolidated form to ensure compliance with the latest text.
Step 9 , advise clients of procedural relief routes. If acting for an alleged debtor, prepare Form 4 to seek setting aside, discharge or variation and ensure the terms of any variation and the original order are set out in full. If acting for an applicant seeking restraint orders or warrants, ensure the applicant understands that the forms will provide the basis for police action and that careful completion of particulars is required to activate that process.
By following the checklist above and completing the prescribed fields in the Schedule’s Forms 1-4, practitioners, applicants and respondents can align their filings with the documentary requirements that these Rules prescribe.
