Superannuation (STA Employees) Regulations 2005

The regulations build on a small set of recurring legal and actuarial concepts that practitioners must track.

STA group: Defined in r 3 by historical membership (members of the STA scheme immediately before 1 July 1990 who were transferred into the State scheme). The instrument is therefore population-specific and not generically applicable to all State scheme contributors.

Treatment as new scheme contributors: r 4(a) declares that all members of the STA group are to be "taken to be new scheme contributors". That status alters how the Act’s baseline entitlements and definitions apply.

Contribution period and standard contribution rate: The Act’s definition of contribution period is replaced so it expressly includes the period the contributor was a member of the STA scheme (r 4(b)). The standard contribution rate is replaced by the rate set out opposite the contributor’s name in Schedule 1 (r 4(c)). Schedule 1 therefore operates as a source of individualised contribution-rate data.

Retirement age multiple: Introduced at r 26, the retirement age multiple is a numerical factor used in benefit calculations. The multiple is the Schedule 1 figure for contributors who attained age 60 on the entitlement day; for contributors younger or older than 60 at the entitlement day it is adjusted by 0.0167 per month short of, or past, the 60th birthday (r 26(a)-(c). The regulations use the multiple in the calculation frameworks for lump sums and pensions (see rr 27-32).

Entitlement frameworks with variables: Several provisions state that lump sums and pensions are "calculated as follows" and then define variables (for example M, FS, A, PCP, LS, P) (rr 27(3)-(4), 28(10)-(11), 30(2), 31(2)-(3), 32(2)). The regulations set out which components of a benefit are charged to the contributor’s contribution account (32C) and how employer and employee components are to be treated on transfer or voluntary separation (for example transfer employer component equals twice the employee component, r 28(12)(b)(ii); voluntary separation lump sum employer component equals twice the employee component, r 29(4)).

Preservation and minimum preserved amounts: Where contributors resign or leave under voluntary separation, parts of benefits equivalent to the minimum contribution required to avoid the Superannuation Guarantee charge under the Commonwealth Act are explicitly preserved and attract interest according to an annual rate determined by the Board under s 20A of the Act (see r 28(4)-(6) and r 29(7)-(11)). The regulations therefore integrate a link to the Commonwealth superannuation regime (referred to generically in the instrument as the Commonwealth Act).

Discretion and Board functions: The Board has visible decision points: determining rates of interest in accordance with s 20A of the Act (r 28(7), r 29(11)); extending election periods (r 28(3)); accepting evidence for transfer to another fund (r 28(12)(a)); determining pensions on actuary’s advice (r 29(5)(b)); and, more generally, administering payments and indexation. The regulations also refer to the Board’s need to act on advice (for example actuarial advice for pension determination, r 29(5)(b)).

Indexation: Multiple provisions require that pensions be indexed (rr 27(6), 28(14), 29(6), 31(6), 32(7), 32A(4)). The mechanism or base for indexation is not fully described in these regulations; the instrument preserves pre-existing pensions but separates continuing rights from new indexing rules (r 6(2)).

Special personalised provisions: One declared fixed benefit for a named individual, Kevin A Benger, is set by r 32B at $134,257 adjusted by CPI from 30 June 1990. Schedule 1 also narrowly lists the membership and numeric parameters for a handful of persons and therefore gives the instrument a focused, member-specific character.

Key undefined or cross-referenced terms: The regulations rely on terms and provisions in the Act and the Commonwealth Act (for example "entitlement day", "superannuation guarantee charge", "section 20A", "section 40", "section 40A", "section 45", "section 43AF", "section 43AG") without fully reproducing their definitions or mechanics. Practitioners must therefore work across these instruments to resolve operational questions.

In short, the main concepts are individualised entitlements (via Schedule 1), hybridised treatment relative to the Act (explicit substitutions and exemptions in r 4), actuarial-calculation frameworks for lump sums and pensions using retirement multiples and contribution points, preserved minimums tied to the Commonwealth Act, Board discretion in administration and interest determination, and explicit indexation obligations.

The regulations apply to a narrowly defined population and to several institutional actors. Who is in and who decides matters operationally.

Directly affected persons

• Members of the STA group: the regulations define the STA group as employees who were members of the State Transport Authority Staff Superannuation Fund and Pension Plan immediately before 1 July 1990 and who were transferred to the State scheme from that date (r 3). Schedule 1 then identifies the specific relevant members who were active contributors or had preserved benefits on 1 September 2005. That list is very small: two active members (Jeffrey K Beatty, Ian J Sinclair) and two inactive members with preserved accrued benefits (Frank Czukli, Derek S Lea), plus one member who had preserved benefits before 1 July 1990 (Kevin A Benger) (Schedule 1). The regulations therefore target a closed cohort rather than a general class of employees.
• Survivors and dependants: spouses and eligible children of contributors are affected by the survivor-benefit rules in rr 32-32A. The spouse has an election right on death in service (r 32(2)). Children’s entitlements are specified by formulaic allocations depending on the number of eligible children (r 32(3)-(4), r 32A(2)).

Institutional actors

• The Board: numerous provisions vest the Board with administration tasks, discretion and responsibility. The Board determines rates of interest in accordance with s 20A of the Act for preserved amounts (r 28(7), r 29(11)), accepts evidence of admission to other funds for transfers (r 28(12)(a)), and must act on or give effect to contributor elections (r 27-29). The Board also coordinates indexation adjustments and pays pensions or lump sums as required (for example r 6, rr 27-32).
• Employers and employing authorities: employers must comply with notice obligations (for example if employment is to be terminated by retrenchment, the employing authority must give notice to the Board in accordance with regulations at least one month before termination, r 30(4)). Employers also participate in voluntary separation packages that require Treasurer approval (r 29(1)(b)) and may be involved in invalidity terminations where written Board approval is required (r 31(4)(a)), or where notice requirements apply (r 31(4)(b)(ii)).
• The Treasurer: has a gatekeeping role for voluntary separation packages,s 29 applies only to contributors resigning under a voluntary separation package that has been approved by the Treasurer (r 29(1)(b)).
• Other superannuation funds or schemes: where contributors elect to carry accrued benefits to another approved fund, the receiving fund and the Board interact (r 28(1)(c), r 28(12)), and the regulations require evidence of admission before the Board will pay the transfer amounts (r 28(12)(a)).

Indirectly affected

• Actuaries and advisers: r 29(5)(b) expressly requires actuarial advice for pension amounts in the voluntary separation context, and the calculation frameworks for lump sums and pensions will require actuarial computation in practice.
• Employers’ payroll/accounting: the replacement definition of standard contribution rate (r 4(c)) and the cessation of contribution liability at age 60 (r 4(d)) change payroll deduction and employer contribution calculations for covered individuals. The employer component obligations on transfer/voluntary separation (rr 28(12)(b)(ii), 29(4)(b)) also change employer liabilities in those events.

The net practical effect is concentrated: a very small, identified set of contributors and their dependants, together with the Board, employers, the Treasurer and actuarial advisers, must operate under a bespoke regime. Because the regulations treat STA group members as new scheme contributors (r 4(a)) while preserving STA-era service in contribution periods (r 4(b)), individual entitlements will be computed by reference to combined historical and State-scheme service. The personalised entry in r 32B for Kevin A Benger confirms that the instrument is intended to provide specific, member-level arrangements rather than broad policy.

The regulations create a set of contributor rights and corresponding administrative duties for the Board, employers and contributors. Citations to the relevant provisions follow.

Contributor rights

• Retirement: a contributor may retire any time after reaching age 55 (r 27(1)). On retirement the contributor is entitled to a lump sum and may elect to convert 50 per cent or more of the lump sum to a pension (r 27(2)). Pensions are to be indexed (r 27(6)).
• Resignation options: where a contributor resigns before 55 they may elect to take an immediate payment equivalent to the contribution account balance (r 28(1)(a) and (9)), preserve accrued benefits (r 28(1)(b)), or transfer accrued benefits to an approved superannuation fund (r 28(1)(c)). If no election is made in writing within three months, the contributor is taken to have elected preservation (r 28(2)). The Board may extend that period if not extending it would unfairly prejudice the contributor (r 28(3)).
• Preservation/Deferred access: preserved amounts can be accessed after age 55, on total and permanent incapacity, on death, or must be paid no later than age 65 in some cases (r 28(4)(b) and (8)(a)). Smaller payments (less than $200) are payable immediately on resignation (r 28(4)(a)).
• Voluntary separation: contributors who resign under Treasurer-approved voluntary separation packages have entitlement to a lump sum comprising employee and employer components, and may convert 50 per cent or more to a pension (r 29(3)-(5)). Parts of the lump sum equivalent to the minimum contribution required to avoid the Commonwealth superannuation guarantee charge are preserved and must be paid subject to the same triggers as other preserved amounts (r 29(7)-(11)).
• Retrenchment: on retrenchment the contributor may elect a lump sum or to preserve their superannuation benefits (r 30(1)-(3)).
• Invalidity: contributors whose employment terminates on account of invalidity before age 55 are entitled to a lump sum with the option to convert 50 per cent or more to a pension; the regulation sets out the invalidity criteria and process (r 31(1)-(5)).
• Death benefits: where a contributor dies in employment the spouse has an election between a lump sum and a pension, and eligible children have specified pension entitlements depending on the spouse’s election and number of children (r 32(2)-(4)). For contributors in receipt of a pension, survivors’ pensions are specified as fractions of the deceased’s notional pension (r 32A(1)-(4)).

Board duties and discretions

• Interest and indexing: the Board determines interest rates to be credited to preserved amounts in accordance with s 20A of the Act (r 28(7), r 29(11)). The Board must index pensions as required in the provisions cited (r 27(6), r 28(14), etc.).
• Payments and transfers: the Board is required to make payments on receipt of valid election or when temporal triggers (ages 55/65) occur; it must be satisfied that a contributor has been admitted to an approved fund before making transfer payments (r 28(12)(a)). It is also to determine pension amounts under voluntary separation on advice of an actuary (r 29(5)(b)).
• Administrative extensions: the Board may extend the period for a written election if the three-month limitation would unfairly prejudice the contributor (r 28(3)).

Employer duties

• Notice of retrenchment: the employing authority must give the Board statutory notice in accordance with the regulations at least one month before termination by retrenchment takes effect (r 30(4)).
• Invalidity termination: employer cannot terminate employment on grounds of invalidity unless the requirements of r 31(4)(a) or (b) are satisfied (r 31(5)). The employer is required to obtain the Board’s written approval to terminate on the ground of invalidity or otherwise satisfy the Board before termination that specified incapacity conditions apply (r 31(4)).

Treasurer’s role

• Voluntary separation packages must be approved by the Treasurer for r 29 to operate (r 29(1)(b)), giving the Treasurer an affirmative decision role before a contributor can access the special voluntary separation rules.

Other rights/duties

• Charging against contribution account: benefits payable under the Part are to be charged against the contributor’s contribution account until exhausted (r 32C), which places an accounting duty on the Board to track and exhaust contribution-account liabilities before other funding sources or entitlements are engaged.

Notable operational features

• Preservation of amounts equivalent to the Commonwealth minimum: r 28(5) and r 29(7)-(9) link preserved components to the minimum contribution needed to avoid liability under the Commonwealth Act and provide for annual interest crediting under a Board rate determined under s 20A.
• Personalised fixed benefit: r 32B fixes the benefit for one identified person, adjusted by CPI, reflecting a legacy or negotiated entitlement that the Board must administer.

The rights are concrete (lump sums, pensions, election windows); the duties focus on timing, actuarial determination and administration. The regulations vest multiple decision nodes in the Board, require employer notices in specified circumstances, and preserve a role for the Treasurer in voluntary separation approvals. Absent in the instrument are explicit penalty provisions for non-compliance by employers or the Board; those enforcement matters lie in the Act or other instruments.

The regulations themselves do not set out criminal penalties, specific fines, or administrative sanctions for non-compliance. Instead, they create procedural obligations and decision points and leave enforcement mechanisms to the Act and the Board’s administration. Key enforcement-relevant observations from the text follow.

Absence of express penal sanctions in the instrument

• A search of the regulations shows no provision imposing fines, imprisonment, or express administrative penalties for failure to comply with notice or procedural duties set out in rr 27-32 and r 4. For example r 30(4) requires that the employing authority must give the Board notice of a retrenchment at least one month before termination takes effect, but the regulations do not state a penalty for failure to give such notice. Likewise r 31(5) states "despite any other Act or law to the contrary an employer cannot terminate the employment of a contributor on the ground of invalidity unless the requirements of subsection (4)(a) or (b) have been satisfied", which is an operational restriction, but it does not itself prescribe the legal consequences or sanctions for non-compliance.

Enforcement likely via the Act and administrative remedies

• Because the regulations modify the application of the Superannuation Act 1988 (r 4, r 5), enforcement of obligations and remedies for breaches will likely be determined by the Act and the State’s general administrative and employment law frameworks. The regulations expressly make certain sections of the Act apply and exclude others (r 4(e)-(g)), so the Act’s enforcement architecture will govern those aspects where the Act applies. Practitioners must therefore consult the Act for express enforcement mechanisms, dispute-resolution procedures, and penalties not replicated in the regulations.

Board’s decision-making and review risk

• The Board is given significant administrative discretion (for example, to determine interest rates under s 20A of the Act, to be satisfied about admission to funds for transfers, to determine pensions on actuarial advice, and to extend election periods). Administrative law principles will apply to those decisions. Where the Board fails to perform a statutory duty or exercises discretion unreasonably, affected persons may have remedies by way of merits review (if available under administrative statutes), judicial review of jurisdictional error, or contract/employment remedies depending on context. The regulations do not specify appeal pathways or statutory tribunals for disputes.

Employer obligations and employment law remedies

• Obligations on employers (for example the requirement not to terminate for invalidity unless the r 31(4) procedures are followed) implicate employment law consequences. If an employer terminates in breach of r 31(5), affected contributors will need to rely on employment law, industrial instruments, or the Act to seek remedies; the regulations themselves do not set a monetary sanction.

Record-keeping and accounting consequences

• The requirement that benefits be charged against a contributor’s contribution account until exhausted (r 32C) imposes accounting duties on the Board and potentially on employing authorities that provide data. Failures in accounting could give rise to liability under the Act, contract, or equity, but the regulations do not set out a penalty table.

Cross-reference to Commonwealth Act

• The regulations preserve amounts equivalent to the minimum necessary to avoid the Commonwealth Act’s superannuation guarantee charge (for payment and preservation purposes, r 28(5), r 29(7)-(9)). Enforcement of the Commonwealth superannuation guarantee and its sanctions falls under the Commonwealth Act, not these regulations; the instrument therefore imposes an operational obligation to track amounts relative to Commonwealth thresholds, but does not create dual sanctions.

Practical takeaway

• The regulations establish entitlements and procedural obligations but do not contain express penalty provisions or a tailored enforcement regime. Practitioners should identify enforcement provisions and sanctions in the Act (as modified) and in general administrative and employment law. If a party needs to compel action (for example to require the Board to make a payment, to challenge a Board decision, or to seek remedies for an unlawful termination on the ground of invalidity), the appropriate statutory avenue will almost certainly be found in the Superannuation Act 1988 or in general judicial review and employment law processes rather than in the regulations themselves.

The regulations are explicitly intended to sit as an overlay to the Superannuation Act 1988 and they also reference the Commonwealth superannuation framework. The interaction points to check are substitution/exclusion of certain Act provisions, cross-references to sections of the Act, and reliance on external Commonwealth rules for preserved amounts.

Modifies, replaces and excludes parts of the State Act

• r 4 modifies provisions of the Act in their application to the STA group, including substituting new definitions (r 4(b)-(c)), treating members as new scheme contributors (r 4(a)), specifying when contribution liability ceases (r 4(d)), and stating that s 40 and s 40A of the Act apply (r 4(e)-(f)) while s 45 does not (r 4(g)). r 5 replaces Part 4 of the Act for the STA group with the bespoke Part 4 contained in the regulations. In short, the regulations must be read in conjunction with the Act; in parts the Act continues to apply, in parts the Act is displaced by the text of the regulations.

Cross-references to specific sections of the Act

• The regulations reference s 20A (interest determination), s 40 and s 40A (application to pensions and members), s 45 (non-application) and later ss 43AF and 43AG in r 32A(5) (reduction or disqualification of survivor benefits). Those cross-references mean that the detailed mechanics, limits or further rules in the Act will affect the operation of the regulations for the STA group. The regulations rely on the Act for substance and process in several places.

Interaction with Commonwealth superannuation law

• rr 28(5) and 29(7)-(9) link preserved amounts to the minimum contribution required to avoid the superannuation guarantee charge "in respect of the contributor under the Commonwealth Act". The Commonwealth Act is not named in the regulations, but the reference imposes a cross-jurisdictional operational link: the calculation of preserved amounts depends on Commonwealth-superannuation-law thresholds and any changes to those thresholds or to the mechanics of the Commonwealth regime will affect what must be preserved and paid by the Board. Enforcement of the Commonwealth superannuation guarantee is, however, under the Commonwealth Act; the regulations merely require the Board to preserve and credit interest on the equivalent amounts.

Administrative law and employment law overlay

• The provisions which constrain termination for invalidity (r 31) interact with employment law and industrial relations law. r 31(5) states that "despite any other Act or law to the contrary an employer cannot terminate the employment of a contributor on the ground of invalidity unless the requirements of subsection (4)(a) or (b) have been satisfied." That creates an additional statutory procedural hurdle for employers terminating on invalidity and will interact with industrial instruments, contracts of employment, workplace safety and discrimination laws where relevant. The effect in practice may be to shift employers’ conduct towards meeting the r 31(4) preconditions or facing legal challenge.

Indexation and other State or Commonwealth pension rules

• The regulations require pensions to be indexed (r 27(6), r 28(14), r 29(6), r 31(6), r 32(7), r 32A(4)) but do not set the indexation method. Where the Act contains indexation rules those will apply; where the Act leaves indexation mechanisms to the Board or other rules, there will be an operational dependence on administrative practice. For pensions in payment immediately before 1 September 2005, r 6(2) preserves amounts apart from indexation, reduction or suspension rules, so interaction with the Act’s provisions on indexation or pension reduction will affect real-value outcomes.

Interaction with other approvals and finance processes

• Treasurer approval is required for voluntary separation packages for the specific r 29 regime to apply (r 29(1)(b)). That creates an intersection with public finance and executive decision-making processes outside the superannuation scheme itself and may import policy, budgetary and administrative constraints.

Transitional and continuity interactions

• r 6(1) and (2) confirm that pensions payable under the STA scheme immediately before 1 September 2005 will continue under the Act as modified by these regulations, preserving prior contractual/entitlement positions except where indexation, reduction or suspension rules operate. Practitioners handling legacy pensions must therefore reconcile pre-existing STA documentation, the 1991 regulations (now revoked by Schedule 2), the Act, and these regulations.

Practical implication

• The operational work for counsel, trustees, employers and accountants is to read the regulations together with the Superannuation Act 1988, the relevant provisions cross-referenced in the regulations (for example s 20A, ss 40-45, ss 43AF-43AG) and the applicable Commonwealth superannuation legislation that sets the superannuation guarantee parameters. Where the regulations reference an undefined term such as "entitlement day" or rely on actuarial computations, those definitions and computation rules are likely to be found in the Act, the Board’s policies, or in general actuarial practice; they are not self-contained within the regulations.

The regulations are a single, self-contained instrument made in 2005 and its text contains the immediate legislative history relevant to this instrument.

Commencement and Gazette

• The regulations are cited as the Superannuation (STA Employees) Regulations 2005 (r 1) and come into operation on 1 September 2005 (r 2). The legislative history block notes the principal regulations: Year 2005, No 192, Gazette 1.9.2005 p 3228, with commencement 1.9.2005 (Legislative history note at end).

Revocation of prior instrument

• Schedule 2 revokes the Superannuation (STA Employees) Regulations 1991. That revocation, coupled with the commencement date, shows that the 2005 instrument was intended as a replacement for the 1991 regulatory regime for the STA group.

No further amending instruments recorded in the text

• The version of the instrument provided contains no subsequent amending regulations or later versions. The Legislative history section lists only the principal regulations (2005 No 192). If there have been later amendments since 2005, they are not included in this text; practitioners should check the consolidated statute book or the legislation.sa.gov.au website for subsequent changes.

Embedded continuations and transitions

• r 6(1)-(2) serve as transitional provisions for pensions payable to members of the STA scheme immediately before 1 September 2005, confirming continuity of those pensions under the Act as modified by these regulations, and preserving the amounts (subject to indexation, suspension or reduction rules). That transitional rule is part of the 2005 instrument’s embedded amendment and replacement logic.

Schedule 1 as a likely point of future amendment

• Schedule 1 lists the named members with their retirement age multiple and standard contribution rate. In practice, changes to member lists, contribution rates or multiples would require amendment of the regulations (as Schedule 1 is part of the regulations). Any such changes would appear in subsequent State statutory instruments amending the Schedule or replacing the regulations.

Practical checks to make for a contemporary matter

• Confirm that no subsequent regulation has varied Schedule 1 or other parts of the instrument since 2005.
• Check for any amendments to the Act that affect cross-referenced sections (for example s 20A or ss 40-45 and ss 43AF-43AG) because amendments to the Act will indirectly affect rights and duties for the STA group as the regulations are read alongside the Act.
• If dealing with voluntary separation packages, confirm whether the Treasurer issued any approvals under r 29 during or after the 2005 instrument and whether those approvals were varied or subject to policy change.

The instrument is therefore a 2005 replacement of the 1991 regulations with no further amending history recorded in this text; any additional amendments must be checked in official consolidated legislation sources.

The text of the regulations as provided includes no judicial decisions, case citations, or references to litigation. It names no cases. Accordingly:

• There is no litigation history recorded in the instrument itself. The regulations do not cite any judicial authority, and no cases are referenced or summarised in the legislative history included in the text.

What to do in practice

• To identify whether these regulations have been the subject of litigation, practitioners must search court databases, the South Australian consolidated legislation index, and decisions concerning the Superannuation Act 1988 where the STA group or the Board’s administration under these regulations was in issue. Because the regulations vest several discretionary functions in the Board (interest determination under s 20A, pension calculations on actuarial advice, acceptance of transfer evidence, extension of election periods), those Board decisions are plausible candidates for administrative law litigation, but no such cases are named in the document.

Points to watch that commonly generate disputes (based on the text)

• Calculations and actuarial conversions: because the regulations require Board/actuary determinations for pension amounts in some contexts (for example r 29(5)(b)), disputes over actuarial methodology or disclosure could lead to litigation or review.
• Employer terminations on invalidity: r 31 imposes procedural requirements which, if neglected, may generate employment-law disputes or litigation about wrongful termination or entitlements.
• Preservation and payment timing: the three-month election window for resignations (r 28(2)) and the Board’s discretion to extend it (r 28(3)) could be the subject of disputes over entitlement timing.
• Personalised benefits (r 32B and Schedule 1): disputes over the calculation, CPI adjustment methodology or the Board’s execution of a fixed benefit could give rise to litigation from an affected member or their estate.

Absent explicit litigation references in the instrument, practitioners must perform contemporaneous case searches to establish any existing jurisprudence affecting interpretation or enforcement of these regulations.

The regulations contain a number of traps-for-the-unwary and operational ambiguities. These are matters that often cost clients time or money unless picked up early.

Narrow and personalised scope

• Schedule 1 names only a handful of persons and attributes individual multiples and contribution rates. The regulations are tailored and not broadly applicable. Mistakenly treating the instrument as a generic scheme regulation will lead to incorrect application. Confirm membership status against r 3 and Schedule 1.

Missing explicit arithmetic in the published excerpts

• Many sections state that benefits are "calculated as follows" and then list variable definitions (M, FS, A, PCP, LS, P), but the extract provided does not set out explicit arithmetic formulas connecting those variables. For example, r 27(3) defines M, FS and A but the arithmetic expression for LS is not included in the text provided here. Do not assume a formula (such as LS = M × FS × A) without checking the consolidated printed regulation or consulting the Board/actuary. Practitioners should obtain the official, formatted version of the regulations or the Board’s calculation schedules for certainty.

Undefined or cross-referenced terms not in the instrument

• The "entitlement day" appears in r 26 but is not defined in these regulations. The instruments also refer to the Commonwealth Act and to several sections of the Act (for example s 20A, ss 40-45, ss 43AF-43AG) without reproducing their text or definitions. You must check the Act and any other referenced instruments to resolve key definitions and operational mechanics.

Board discretion and evidence thresholds

• The Board decides rates of interest in accordance with s 20A (r 28(7), r 29(11)), may extend election periods (r 28(3)), and must be "satisfied" that a contributor has been admitted to another fund before making a transfer (r 28(12)(a)). Those terms import administrative discretion and evidentiary standards that can vary in practice. Obtain the Board’s published policies and past practice to anticipate decision outcomes.

Interaction with Commonwealth Superannuation Guarantee

• The regulations preserve amounts equivalent to the minimum contribution required to avoid the Commonwealth Act’s superannuation guarantee charge (r 28(5), r 29(7)-(9)). Changes in Commonwealth rules or interpretation can therefore alter preserved entitlements or the computation of the preserved component. Keep this cross-jurisdictional link in mind.

Employer termination on invalidity: procedural hurdle

• r 31(5) makes termination for invalidity conditional on satisfying the specific procedural preconditions in r 31(4). Employers who fail to follow those procedures may be unable to lawfully terminate. That creates a litigation risk and practical complexity in managing incapacity cases.

Timing traps for contributors

• Contributors who resign and do not make a written election within three months are taken to have elected preservation (r 28(2)). The Board can extend the period only if not extending it would unfairly prejudice the contributor (r 28(3)). Advise clients about the three-month window; missing it locks in preservation rather than immediate payment.

Transfer employer component liability

• If a contributor transfers accrued benefits to an approved fund, the Board pays an employer component equal to twice the employee component (r 28(12)(b)(ii)). That is a significant financial transfer from the State scheme and may have actuarial or budgetary implications. Verify whether the employer actually funds or is treated as funding that employer component under the State accounting rules. The regulation states the employer component but does not specify the funding source.

Personalised fixed benefit and CPI methodology

• r 32B fixes Kevin A Benger’s benefit at $134,257 adjusted by CPI since 30 June 1990, but the CPI base or indexing method (which CPI, which published series, rounding conventions) is not specified. That can generate disputes or practical confusion about calculation dates and compounding. Seek the Board’s calculation methodology and supporting schedules.

Indexation without method

• Pensions are repeatedly required to be indexed (rr 27(6), 28(14), 29(6), 31(6), 32(7), 32A(4)) but the instrument does not supply the indexation formula or timing. Check the Act and Board policy for the indexation mechanism.

s 45 non-application

• r 4(g) provides that s 45 of the Act does not apply to a pension payable to, or in relation to, a contributor. The content of s 45 is not in the regulations; it may have substantive effects (for example, on commutation, forfeiture, or other adjustments). Do not assume what s 45 does; consult the Act.

Benefit exhaustion rule

• r 32C requires that benefits payable under the Part be charged against the contributor’s contribution account until it is exhausted. That sequencing rule may affect the availability of other fund resources to meet liabilities. Ensure accounting systems reflect the priority.

Treasurer approval as a gating mechanism

• Voluntary separation package treatment under r 29 requires Treasurer approval. Absent that approval the special r 29 pathway is not open and the ordinary resignation provisions in r 28 will govern. Ensure approvals are in place before relying on r 29 outcomes.

Collectively these "gotchas" underscore that operational application of the regulations requires cross-referencing the Act, the Board’s policies, and the Commonwealth superannuation rules, as well as obtaining authoritative formatted versions of the regulations and actuarial calculation schedules.

Compliance requires steps for employers, the Board, contributors and advisers. The following is a pragmatic checklist informed by the regulations’ text.

For employers and employing authorities

1. Identify covered persons: confirm whether an employee is in the STA group by checking r 3 and Schedule 1. Do not assume all former STA employees are covered; the Schedule is specific.
2. Payroll/configuration: apply the standard contribution rate set in Schedule 1 for each listed contributor (r 4(c)). Note contribution liability ceases when employment terminates or when the contributor reaches age 60 (r 4(d)); however, if a contributor turns 60 during a pay period they must contribute for the whole pay period.
3. Retrenchment notice: if planning retrenchment of a contributor, give the Board at least one month’s notice in accordance with the regulations (r 30(4)). Obtain the Board’s requirements for the content and format of that notice.
4. Invalidity termination procedures: before terminating employment on the ground of invalidity, satisfy the procedural preconditions set out in r 31(4)(a) or (b) and obtain the Board’s written approval where required. Keep documentary evidence of incapacity and vacancy searches as required under r 31(4)(b).
5. Voluntary separation packages: ensure Treasurer approval is secured if the special regime in r 29 is to apply. Do not assume terms of a voluntary separation will automatically attract r 29 treatment without Treasury sign-off.
6. Record-keeping: maintain precise records of acceptance dates into the STA scheme, salary history (for FS), contribution points, and any extrapolated contribution points used in invalidity or death calculations.

For the Board and scheme administrators

1. Publication of methods: publish or make available the actuarial methodologies and templates used to compute lump sums and pensions under the regulations. Several sections require actuarial advice or otherwise produce amounts that are not fully specified in the body of the regulations (for example r 29(5)(b)).
2. Interest determination and CPI methodologies: determine and publish the rate of interest for preserved amounts in accordance with s 20A of the Act (r 28(7), r 29(11)). Publish the CPI series and indexing methodology to be used for r 32B and indexation more generally.
3. Election windows and notices: implement administrative processes to capture resignation elections within the three-month window under r 28(2) and to extend the window in appropriate unfair-prejudice cases under r 28(3).
4. Transfer and preservation process: lay down the evidence requirements for satisfying the Board that a contributor has been admitted to another approved fund (r 28(12)(a)). Ensure transfers are made with the employee and employer components correctly computed (r 28(12)(b)).
5. Accounting controls: apply r 32C by charging benefits against the contributor’s contribution account until exhausted; maintain accounting trails to demonstrate compliance.
6. Actuarial and legal oversight: where the regulations require pension amounts to be "determined by the Board on the advice of an actuary" (r 29(5)(b)), secure qualified actuarial opinions and keep documents necessary for potential review.

For contributors and advisers

1. Election choices on resignation: if resigning before age 55, make the written election within three months to avoid being deemed to have preserved benefits (r 28(1)-(3)). Understand the consequences: immediate payment for small superannuation payments (under $200) or deferred access rules up to age 65 for larger amounts (r 28(4)).
2. Preservation triggers: be clear on the triggers for payment of preserved amounts (age 55 or 65, total and permanent incapacity, death) and plan financial arrangements accordingly (r 28(4)(b) and (8)).
3. Voluntary separation packages: seek clarity on whether the Treasurer has approved a package and, if r 29 applies, that employer and Board understand the employer component and preservation obligations (r 29(3)-(9)).
4. Death and survivor options: advise spouses about their election rights on death in service (r 32(2)), and ensure beneficiary records are up to date. Where multiple spouses exist (lawful and putative), note the Board’s procedural rule about accepting an election without notice to another spouse (r 32(6)).
5. Seek actuarial explanations: where the regulations refer to extrapolated contribution points or actuarial conversions (r 31(2), r 32(2)), request a written actuarial basis for any calculation offered by the Board.

For auditors, accountants and compliance officers

1. Reconcile preserved amounts with Commonwealth minimums: for preservation calculations tied to the Commonwealth Act’s minimums (r 28(5), r 29(7)-(11)), ensure reconciliations account for changes in Commonwealth thresholds or contribution bases.
2. Check contribution-account exhaustions: substantiate that benefits charged against a contributor’s contribution account are properly reconciled in accordance with r 32C and that subsequent payments are accurate.
3. Confirm s 45 non-application and implications: determine the practical impact of r 4(g) (section 45 does not apply) by reviewing s 45 of the Act.

Practical drafting and procedural tips

• Obtain the authoritative, formatted version of the regulations and the Act. The textual extract here shows variable definitions but not always the arithmetic expression of formulas; the official printed regulation and Board templates will be necessary to compute exact amounts.
• Document Board decisions: minutes, actuarial advice and notices should be kept to support administrative decisions and to defend against judicial review or disputes.
• Pre-clear Treasurer approvals: where voluntary separation packages are contemplated, secure the Treasurer’s approval in writing before treating the package under r 29.

By following these steps, confirming membership and Schedule data, complying with notice and procedural requirements, documenting actuarial methodologies and Board decisions, and coordinating with Commonwealth-rule calculations for preserved amounts, practitioners can align administrative practice with the text of the regulations.
