#### 65 Failure of a party to a complaint to comply with a determination or direction by the Tribunal (1) If a Tribunal member becomes aware that a party to a complaint has refused or failed to give effect to a determination made by the Tribunal, he or she must, as soon as practicable: (a) if he or she is a Tribunal member other than the Tribunal Chairperson—give particulars of the refusal or failure to the Tribunal Chairperson; or (b) if he or she is the Tribunal Chairperson—do one of the following: (i) give particulars of the refusal or failure to APRA; (ii) give particulars of the refusal or failure to ASIC; (iii) give particulars of the refusal or failure to both APRA and ASIC; as he or she thinks appropriate. (2) If the Tribunal remits a matter to a party to a complaint for reconsideration in accordance with the directions of the Tribunal, the party must reconsider the matter in accordance with those directions as soon as practicable.
