SUPERANNUATION REGULATIONS 1986

Public authority. The Act's definition in section 3(1) includes a paragraph (b) that refers to regulations prescribing bodies. Regulation 4 and the Schedule specify nine entities. The significance of being classified as a public authority is that the employees of those bodies are eligible to be members of the NT public sector superannuation scheme. The list is not exhaustive of all NT government agencies; many are classified directly in the Act. The Schedule captures entities that are statutory corporations or bodies established under separate legislation, such as Charles Darwin University (Charles Darwin University Act 2003), the Power and Water Corporation (Power and Water Corporation Act 1987), and the Menzies School of Health Research (Menzies School of Health Research Act 1985). An entity not listed cannot rely on the regulation to claim public authority status, though it might qualify under other parts of the definition in the Act.

Approved allowance. This concept is defined in rule 1 of the Rules (the Rules are part of the Superannuation Act). Regulation 5 expands on that definition by specifying which allowances must be included in contribution salary and which may be included subject to conditions. The term "contribution salary" is the base on which both member contributions and employer benefit calculations are made. By including more allowances, the regulation increases the contribution salary base, which in turn increases the final pension or lump sum benefit. The classification is not optional: if an allowance falls within subregulation 5(1)(a), it is automatically included. If it falls within 5(1)(b), it is included only if it passes the 75 percent regularity test and the averaging rules in subregulation 5(3).

The 75 percent test is the key gatekeeper. An allowance that is paid irregularly, such as a temporary higher duties allowance that lasts only a few months, will fail the test unless it has been or is likely to be paid in at least 75 percent of pay periods in the relevant 12-month window. This test applies both prospectively and retrospectively: the employer must consider the 12 months immediately before or after the entry date or annual review date. The regulation does not specify a method for predicting future payments, which creates practical compliance uncertainty.

Release authority. Regulation 7 prescribes two Commonwealth tax provisions for the purpose of the release authority definition in section 45DA of the Act. Division 131 of Schedule 1 to the Taxation Administration Act 1953 (Cth) covers release for excess concessional contributions, excess non-concessional contributions, Division 293 tax assessments, and first home saver accounts. Division 135 covers release to pay Division 293 tax specifically. The regulation does not require the NT scheme to release benefits; it only enables the Commissioner to issue a release authority when a member receives a valid Commonwealth notice. The notes to regulation 7 cross-reference the relevant Commonwealth Acts.

Reviewable decision and time limits. Regulation 8 defines the time within which a member must apply for review. The Act provides for an internal review by the Commissioner under section 49C (called the "original decision" review) and a subsequent review by the Tribunal under section 49G (called the "decision on review"). The regulation sets different time limits for each stage and each type of benefit. Death benefits have the shortest limit: 30 days from when the decision was made. Invalidity retirement benefits have the longest: two years. All other decisions (such as disputes about benefit calculation or contribution salary inclusion) have 12 months. The Tribunal may extend time for Tribunal review applications under subregulation 8(2)(a) or (c) - that is, for death benefits and other decisions - but for death benefits it may do so only if satisfied that the Commissioner failed to comply with section 49F (giving reasons for the review decision). The Tribunal may not extend the time for applying for internal review; only the time for applying to the Tribunal itself.

The primary affected group is current and former members of the Northern Territory public sector superannuation scheme established under the Superannuation Act 1986. These are employees of the NT government, its agencies, and the prescribed public authorities listed in the Schedule. The scheme is a defined benefit scheme (the Rules create a final average salary benefit), so the classification of allowances directly affects the amount of pension or lump sum a member receives upon retirement, invalidity, or death.

Employers within the NT public sector are affected because they must correctly classify allowances paid to employees and provide contribution salary data to the scheme administrator. The 75 percent regularity test in subregulation 5(2) requires employers to maintain records of allowance payments over 12-month periods and to make forward-looking assessments. For employers with high staff turnover or frequent temporary promotions, this can be a significant administrative burden. The cost of misclassification falls on the scheme if it overpays benefits, or on the member if it underpays.

The entities listed in the Schedule are directly affected because their employees are eligible for scheme membership. The list includes the Australian Health Practitioner Regulation Agency (AHPRA) insofar as it operates under the NT Health Practitioner Regulation National Law; Batchelor Institute of Indigenous Tertiary Education; Charles Darwin University; Menzies School of Health Research; the Board of the Museum and Art Gallery of the Northern Territory; the NT Legal Aid Commission; and three electricity entities (Power and Water Corporation, Power Generation Corporation, and Power Retail Corporation). These are all statutory corporations or bodies established under NT legislation. Their inclusion means that employees of these bodies are within the scheme's coverage rather than being in an entirely separate superannuation arrangement. For the three power corporations, which are commercial entities that compete in energy markets, the superannuation obligations form part of their cost base and can affect their competitiveness against private sector generators and retailers.

The Commissioner of Superannuation (an office under the Act) is directly affected as the decision-maker who applies regulation 5 when determining contribution salary and regulation 7 when processing release authorities. The Northern Territory Civil and Administrative Tribunal is affected as the external review body that applies regulation 8 time limits and extension powers.

Retirees, surviving spouses, and children who are beneficiaries of death benefits are affected by the short 30-day review window. A surviving spouse who is dealing with grief and estate administration may easily miss the deadline and lose the right to challenge an adverse decision, especially because the Tribunal can only extend time if the Commissioner failed to give reasons - a narrow ground.

Duty of the Commissioner to correctly classify allowances. Under regulation 5, the Commissioner must determine whether an allowance qualifies as an approved allowance and therefore forms part of contribution salary. This is a duty that directly affects benefit amounts. The Commissioner has no discretion to include an allowance that does not meet the regulation's criteria, nor to exclude one that does. The classification must be made at the member's entry date and at each annual review date.

Right of the member to have certain allowances included. Subregulation 5(1)(a) gives members a right to have allowances that are automatically included in contribution salary. These include allowances for a particular skill, qualification, or proficiency; compensation for salary loss during training for promotion; the NT allowance; and housing or quarters allowances. Subregulation 5(1)(b) gives a conditional right for other allowances, but only if the 75 percent pay-period test is satisfied. This is not a right in the sense of an entitlement; it is a right to have the allowance considered according to objective criteria.

Right to apply for review. Regulation 8 implements the right to internal and external review granted by sections 49C and 49G of the Act. The member has the right to apply for review within the specified time limits. The member also has the right to seek an extension of time from the Tribunal (for Tribunal review only), but for death benefits this right is qualified by the need to show Commissioner non-compliance with section 49F.

Duty of the Commissioner to provide reasons under section 49F. This duty is not created by the regulations but is referenced in subregulation 8(4). If the Commissioner fails to provide reasons for a review decision, the Tribunal may extend the time for a death benefit application. This creates an incentive for the Commissioner to comply with the procedural requirement; failure to do so effectively waives the 30-day limit.

Duty of the employer to maintain records. Though not spelled out in the regulations, the 75 percent test in subregulation 5(2) implicitly requires employers to maintain payroll records showing the number of pay periods in which an allowance was paid, and to be able to demonstrate whether an allowance has been paid in at least 75 percent of pay periods in the preceding or following 12 months. Employers also need to determine, for variable allowances, the amount paid over the preceding 12 months under subregulation 5(3)(b). This is a compliance cost that falls primarily on human resources and payroll functions within NT government agencies and the listed public authorities.

Right of the member to receive a release authority under regulation 7. If the member receives a notice from the Australian Taxation Office under Division 131 or 135 of Schedule 1 to the Taxation Administration Act 1953 (Cth), the member has the right to apply to the Commissioner for a release of superannuation benefits to pay the tax debt. The Commissioner must then issue a release authority, enabling the scheme to pay the amount to the ATO. This is a right that reduces the member's future benefit but avoids personal tax liability and interest.

Power of the Tribunal to extend time. Under subregulation 8(3), the Tribunal has the power to allow a longer period for applying for Tribunal review for death benefits and other decisions (but not for invalidity retirement benefits, which already have a two-year period). The power is discretionary for non-death benefits; for death benefits it is conditional on the Commissioner's failure under section 49F.

The regulations themselves do not create penalty provisions. Any enforcement action would arise under the principal Act or under general criminal or civil law. The regulations are procedural and definitional; they define rights and obligations but do not attach monetary penalties or criminal sanctions to non-compliance.

However, non-compliance with the regulations can have significant financial consequences for both the member and the scheme. If an employer or the Commissioner fails to include an allowance that should be included under regulation 5, the member's contribution salary is understated, leading to a lower superannuation benefit. The member's remedy is to apply for review under the Act within the time limits set by regulation 8. If the time limit expires, the member loses the right to challenge the decision, absent the Tribunal's extension power. This is effectively a penalty for delay: a member who discovers the error after 30 days for a death benefit, or 12 months for other benefits, may be barred from correction.

If the Commissioner or the scheme administrator incorrectly includes an allowance that does not meet the criteria, the scheme may overpay benefits. The Act may contain provisions for recovery of overpayments, but the regulations do not address this. The risk of overpayment falls on the scheme, which is ultimately funded by employer contributions and taxpayer subsidies.

The release mechanism under regulation 7 is enforced by the Australian Taxation Office through the Commonwealth tax system. If a member obtains a release without a valid release authority, the transaction may be treated as an illegal early release, attracting penalties under both Commonwealth and NT law. The regulation does not impose any penalty itself.

The time limits in regulation 8 operate as a strict bar to review applications. They are enforced by the Commissioner and the Tribunal as jurisdictional requirements. If an application is lodged outside the time limit and the Tribunal does not extend time, the application will be dismissed. This is a self-executing enforcement mechanism: no separate penalty is needed.

There is no specific enforcement body designated in the regulations. The Commissioner is the primary administrator, and the Tribunal is the review body. The Ombudsman or the Auditor-General might have oversight roles under other legislation, but the regulations do not mention them.

The regulations are made under the Superannuation Act 1986 (NT) and must be read with that Act. The Act contains the Rules (the detailed benefit formulas) which define "approved allowance" and "contribution salary". Regulation 5 fleshes out those definitions. The Act also contains sections 49C, 49E, 49F, and 49G dealing with internal and external review, and section 45DA dealing with release authorities. Regulation 8 and 7 interact directly with those sections.

The primary Commonwealth interaction is through regulation 7, which incorporates Divisions 131 and 135 of Schedule 1 to the Taxation Administration Act 1953 (Cth). This brings in the Commonwealth regime for releasing superannuation benefits to pay tax debts. The notes to regulation 7 expressly cross-reference Division 291 of the Income Tax Assessment Act 1997 (Cth) (excess contributions tax) and Division 293 of the same Act (sustaining the superannuation contribution concession). The Superannuation (Sustaining the Superannuation Contribution Concession) Imposition Act 2013 (Cth) is also referenced. This means a member is not taxed twice: the Commonwealth tax is paid from the member's superannuation account, and the NT scheme acts as a conduit.

The regulations interact with the Interpretation Act (NT) through the general amendments made by the Interpretation Legislation Amendment Act 2018 (NT) to regulations 1 and 8 and the Schedule. These are formal amendments to update drafting style and numbering.

The regulations interact with the enabling legislation of the entities listed in the Schedule. For example, the Power and Water Corporation Act 1987, the Charles Darwin University Act 2003, and the Legal Aid Act 1990 all establish the entities that are classified as public authorities. Those Acts may have their own provisions about superannuation arrangements for employees, but the regulations override them to the extent that they prescribe the entity for the purposes of the Superannuation Act 1986.

The regulations also interact with the Northern Territory Civil and Administrative Tribunal Act (NT), which governs the Tribunal's review powers. Regulation 8 sets the time limits, but the Tribunal's procedural rules and powers to extend time are otherwise governed by that Act. The regulations carve out specific limits on the Tribunal's extension power for death benefits.

Regulation 5 may interact with industrial awards and enterprise agreements that define allowances. For example, a shift allowance under an award may or may not meet the 75 percent test. The classification under the regulations is independent of the award classification; a payment labelled as "shift allowance" in an award is not automatically an approved allowance. It must also satisfy the regularity test.

The regulations do not interact with the Commonwealth Superannuation Industry (Supervision) Act 1993 (SIS) because the NT scheme is a public sector defined benefit scheme and is generally exempt from SIS prudential requirements. However, the release authority mechanism under regulation 7 must be consistent with SIS restrictions on early release; the regulations only apply where Commonwealth law permits release.

The regulations were originally made in 1986 (SL No. 36, 1986) and commenced on 1 October 1986. They have been amended by 20 or more subsequent instruments. The most significant amendments are:

The original regulation 4 (public authorities) was amended multiple times to add and remove entities. In 1998, SL No. 55 substituted a new regulation 4. The Schedule was first inserted by SL No. 6 of 2010, which replaced regulation 4 entirely with a provision that simply referred to a Schedule. This made the list easier to update. The Schedule itself has been amended several times, most notably to add the power corporations in 2014 (Act No. 13, 2014) and to update the Museum and Art Gallery Board in 2014 (Act No. 6, 2014). The repeal of the Northern Territory Tourist Commission from the Schedule occurred in 2006.

Regulation 5 (approved allowances) was originally in a different form. It was amended by the Superannuation Legislation Amendment and Repeal Act 2014 (Act No. 39, 2014) and most recently by SL No. 6 of 2023. The 2023 amendments appear to have clarified the treatment of variable allowances, particularly shift allowances and the averaging method.

Regulation 6 was inserted in 2011 (SL No. 9, 2011) to deal with pre-1986 service or some other transitional matter. It was amended in 2012 and then repealed by the Superannuation Legislation Amendment Act 2019 (Act No. 3, 2019), section 64. The repeal means that the matter formerly covered by regulation 6 is now either obsolete or covered elsewhere.

Regulation 7 was inserted by Act No. 39 of 2014 (commenced 13 November 2014). It has been amended by SL No. 6 of 2023 to update the cross-references to the Commonwealth Taxation Administration Act 1953.

Regulation 8 was also inserted by Act No. 39 of 2014, as part of the same package that introduced internal and external review mechanisms. It was amended by SL No. 6 of 2023, which appears to have clarified the wording of the time limits and the Tribunal's extension power.

The endnotes list numerous general amendment acts that made formal or minor changes, including the Statute Law Revision Act of various years, the Work Health and Safety (National Uniform Legislation) Implementation Act 2011, and the Interpretation Legislation Amendment Act 2018. These are mostly machinery amendments.

The cumulative effect of the amendments has been to modernise the list of public authorities, refine the allowance classification rules, introduce (and later repeal) a transitional provision, and create a full review framework with time limits.

The source material for the regulations contains no references to litigation. No cases are cited in the text of the regulations, in the endnotes, or in the notes to any regulation. There are no annotations or precedent references.

It is possible that decisions of the Northern Territory Civil and Administrative Tribunal regarding time extensions or allowance classifications exist but are not published or are not included in the source. The regulations themselves (being subordinate legislation) are not typically the subject of direct legal challenge except in the context of disputes about decisions made under the Act.

The 75 percent regularity test and the distinction between automatic and conditional allowances are fact-intensive and provide scope for disputes. For example, a member might argue that an allowance should be automatically included under subregulation 5(1)(a)(i) as a "particular skill" allowance, while the Commissioner might classify it as a conditional allowance under 5(1)(b)(i) for being in charge of staff. The outcome would depend on the specific wording of the allowance description in the relevant award or determination. There is no guidance in the regulations on how to resolve such borderline cases.

The time limit provisions could give rise to litigation about the meaning of "made" in subregulation 8(1) - when exactly a decision is made. For death benefit decisions, a single day's delay can be fatal. The Tribunal's interpretation of its own extension power will be decisive, but no case law is apparent from the source.

In the absence of any named cases, a prudent reader should treat the regulations as untested in court. The lack of litigation may reflect the relatively small size of the NT public sector and the limited number of members, or it may reflect effective compliance. It does not mean the regulations are unambiguous.

The 30-day death benefit deadline is brutal. Subregulation 8(1)(a) gives only 30 days from when the original decision was made to apply for internal review. The decision is made when the Commissioner decides, not when the member receives the decision. If the notice is delayed in the mail or the member is overseas, the 30 days may have already expired. The Tribunal can only extend time for a Tribunal review (not the internal review), and only if the Commissioner failed to comply with section 49F (giving reasons). If the Commissioner gave reasons but the member simply missed the deadline, the extension is unavailable.

The 75 percent test applies forward and backward. Subregulation 5(2) requires the allowance to be paid in 75 percent of pay periods "in the 12 months immediately before or after" the entry or review date. This allows the employer or Commissioner to look forward. But predicting future payments is inherently uncertain. An employer might include an allowance based on an expectation that it will continue, only for the employee to be transferred or the allowance discontinued. The regulation does not say what happens if the expectation proves wrong. The member may have received a higher benefit based on an overestimate, raising questions of recovery.

Variable allowance averaging uses a 12-month history, not a projection. Subregulation 5(3)(b) provides that for variable allowances (like shift work), the contribution salary includes the amount paid or due in the 12 months preceding the relevant date. This means that if a member had a period of heavy shift work before a review date, that work inflates the contribution salary even if the member later reduces shift hours. Conversely, a member who just started shift work will have a low contribution salary. The regulation does not provide for pro-rating or normalising.

The Schedule is exclusive, not illustrative. An entity not listed cannot claim public authority status under regulation 4, even if it is a NT government agency. For example, a new statutory corporation created after the Schedule was last amended would need an amendment to be covered. In the meantime, its employees might not be eligible for the scheme.

The definition of "invalidity retirement benefit" in subregulation 8(5) is narrow but includes non-Act benefits. It covers benefits under rule 10 of the Rules, section 45Q of the Act, section 22 of the Legislative Assembly Members' Pensions Act 1979, and clause 6(1)(b) of the instrument establishing the NTSS Scheme. This means the two-year time limit applies only to these specific invalidity benefits. Other invalidity-related decisions (such as a decision not to approve an invalidity retirement) may fall under the general 12-month limit.

The release authority under regulation 7 is for specific Commonwealth tax debts only. It does not allow release for ATO debts generally (such as PAYG withholding or GST). Only excess concessional and non-concessional contributions, Division 293 tax, and first home saver accounts are covered. A member with a general tax debt cannot use this regulation.

The Tribunal's extension power under subregulation 8(3) is limited to subsection (2)(a) and (c). It cannot extend time for invalidity retirement benefit reviews (subsection (2)(b)), which already have two years. But it also cannot extend time for any other decision that falls outside subsections (2)(a) and (c). This is a drafting point: "otherwise" in subsection (2)(c) covers all decisions not falling under (a) or (b).

The regulations contain no provisions about interest on late payments or for missed deadlines. If the Commissioner delays making a decision, the member may miss the review window before receiving the decision. The member's only recourse is to argue that the decision was not "made" until communicated, but the regulation says "made", not "notified".

For employers and scheme administrators, compliance begins with proper classification of each allowance paid to each member. The starting point is to obtain the full description of every allowance under the relevant industrial instrument, enterprise agreement, or determination. Each allowance should be matched against the categories in subregulation 5(1)(a) (automatic) and 5(1)(b) (conditional). If the allowance fits an automatic category, it must be included in contribution salary without further testing. If it fits a conditional category, the 75 percent test must be applied.

The 75 percent test requires payroll records for the 12 months immediately before the member's entry date or annual review date. For a new member, the employer must look forward and make a reasonable estimate of whether the allowance will be paid in at least 75 percent of pay periods in the next 12 months. This estimate should be documented, with reasons. For an existing member at annual review, the employer should look at the preceding 12 months. If the allowance was paid in at least 75 percent of pay periods, it qualifies for inclusion. If not, it does not. The employer should also consider whether the allowance is "likely to be received" in the future if the past pattern is not representative.

For variable allowances (allowances that vary per pay period, such as shift work), subregulation 5(3)(b) requires averaging over the 12 months preceding the date. The employer must calculate the total amount paid or due in that period and express it as an annual rate. This becomes part of contribution salary. The employer should also treat a payment in lieu of a shift allowance during leave as a shift allowance for this purpose (subregulation 5(4)).

Employers of the entities listed in the Schedule should verify that employees are correctly classified as members of the NT superannuation scheme. New employees at Charles Darwin University or the power corporations, for example, should be offered membership.

For members, compliance with review time limits is critical. Any challenge to a decision must be lodged promptly. For death benefit decisions, the 30-day window is extremely short. Members or beneficiaries should request reasons for any adverse decision and check the date the decision was made. If the Commissioner's reasons are not provided, the beneficiary should document that failure, as it may be the only basis for an extension of time at the Tribunal stage.

For members seeking a release of superannuation to pay a tax debt, compliance involves obtaining a valid notice from the ATO under Division 131 or 135 of Schedule 1 to the Taxation Administration Act 1953 (Cth) and applying to the Commissioner under section 45DA of the Act. The member must not attempt to access the benefit without a release authority, as that could constitute illegal early release.

For the Commissioner, compliance with regulation 8 means making decisions on review and providing reasons under section 49F within a reasonable time, because failure to do so can extend the time for Tribunal review of death benefits. The Commissioner should also ensure that decisions are clearly dated and communicated to members and beneficiaries in writing.

For the Tribunal, compliance means applying the time limit rules strictly, particularly for death benefit applications, and only extending time for those categories and conditions specified in subregulation 8(3) and (4). The Tribunal should verify whether the Commissioner complied with section 49F before extending time for a death benefit review.

Systematic compliance involves maintaining a register of allowances for each member, tracking the 75 percent threshold annually, and documenting all classifications. Given the potential for disputes, employers should keep records for at least two years after a member leaves the scheme, as invalidity retirement benefit reviews can be lodged up to two years after the decision.
