Superannuation (PSSAP) Approved Authority Inclusion Declaration 2008

This Declaration is short and conceptually narrow. The core terms and concepts in the instrument are these:

• Approved authority: The Declaration does not define the content of "approved authority" within the instrument. Section 3 explicitly imports the meaning of approved authority from the 2005 Act: "approved authority has the same meaning as in the 2005 Act." That creates a cross-reference. The Declaration therefore operates as an implementing instrument whose substantive content depends on how the 2005 Act defines and treats "approved authority." The Declaration itself contains no operational definition, entitlements or obligations attached to the label.

• Declaration power and legal basis: The instrument is made "under subsection 8(3) of the Superannuation Act 2005" (preamble). Section 4 implements that basis by declaring particular bodies to be approved authorities for the purposes of the 2005 Act. Mechanically, the instrument exercises a delegated statutory power in the 2005 Act to add named bodies to the class of approved authorities.

• Schedule mechanism: The Declaration uses a Schedule (Schedule 1) to list the entities included. Schedule 1 is the operative list: Screen Australia; Australian Hearing Services; Housing Australia (Schedule 1 [1]-[3]). The use of a Schedule means the instrument can be amended, and the endnotes show it has been amended on subsequent occasions (Endnote 3; Endnote 4).

• Compilation and amendment trace: The instrument, as presented, is a compilation. The front matter explains that the text shows the law "as amended and in force on 5 March 2025" (Compilation date). The endnotes provide the instrument’s amendment history and registration/commencement details (Endnote 3; Endnote 4). The compilation notes also state that uncommenced amendments and modifications may exist and direct the reader to the Federal Register of Legislation for additional detail.

Because the instrument imports key substance from the 2005 Act, the legal and regulatory consequences of inclusion depend on the 2005 Act’s definitions and provisions. The Declaration itself creates no operational framework beyond the listing exercise; its legal effect is to attach the 2005 Act’s existing rules for "approved authorities" to the named bodies (s 4(1); s 3).

The instrument identifies three named bodies and therefore directly affects those entities by changing their statutory label under the 2005 Act (Schedule 1 [1]-[3]). The Declaration does not itself identify individuals, classes of employees, beneficiaries, or funding streams, but the label it applies will be relevant to any person or entity whose rights, entitlements, liabilities or reporting obligations are governed by the 2005 Act’s treatment of "approved authorities." From the text of the Declaration:

• Directly named entities: Screen Australia; Australian Hearing Services; Housing Australia (Schedule 1). Those bodies are "declared under subsection 8(3) of the 2005 Act to be an approved authority for the purposes of the 2005 Act" (s 4(1)). The Declaration thus mechanically changes the legal classification of those three named organisations for matters governed by the 2005 Act.

• Indirectly affected persons and entities: The Declaration does not enumerate affected employees, members, contractors, or beneficiaries. However, the instrument makes clear that the term approved authority is to be read as it is in the 2005 Act (s 3). Any person whose legal position is determined by whether an entity is an "approved authority" under the 2005 Act will be indirectly affected. The instrument therefore matters to anyone, individuals or institutional parties, whose rights or duties are contingent on an entity’s status under the 2005 Act (for example, eligibility or membership rules that the 2005 Act attaches to approved authorities). The Declaration itself does not specify those contingent rules.

• Administrative actors: The Minister or delegated officers who exercise powers under the 2005 Act are affected in the sense that the class of approved authorities they administer or regulate now includes the named entities (s 4(1)). The instrument is an administrative act that changes status categories the administering agency must recognise.

• Legal reviewers and compliance officers: Because the Declaration imports definitions from the 2005 Act (s 3) and because the schedule has been amended multiple times (Endnote 3; Endnote 4), compliance personnel and legal advisers must treat the Declaration as a component of the statutory regime for superannuation underpinning the PSSAP context, and must consult the 2005 Act and the Federal Register for the latest compilation and uncommenced amendments.

The Declaration does not, on its face, create new financial obligations or transfers. Any fiscal or membership consequences flow only from the 2005 Act’s substantive rules as applied to the newly declared approved authorities.

The Declaration itself contains no substantive duties or rights. It performs a single legal action: it declares named bodies to be "approved authorities" as defined in the 2005 Act (s 4(1); s 3). Therefore, the duties and rights that matter arise from the 2005 Act and attach to the label "approved authority" rather than from the Declaration text.

Direct textual points about duties and rights in the instrument:

• No operational duties set out in the Declaration: The instrument does not establish reporting obligations, contribution rules, fiduciary duties or entitlement formulas. It does not purport to vary the 2005 Act. It simply brings specified bodies within the 2005 Act’s category by reference (s 4(1); s 3).

• Rights and duties are imported from the 2005 Act: Because s 3 says "approved authority has the same meaning as in the 2005 Act," any rights or duties that the 2005 Act bestows on, or imposes upon, an approved authority will apply to the listed bodies by virtue of the Declaration. The instrument therefore functions as an enabling or triggering vehicle: legal consequences are triggered by the 2005 Act’s provision of entitlements, obligations or regulatory oversight for approved authorities.

• Administrative consequence for named bodies: The named entities acquire whatever legal position the 2005 Act attaches to the approved authority category. The Declaration does not quantify or describe those consequences; it locates them in the 2005 Act. Practically, this means the relevant duties and rights must be identified by cross-reference and legal analysis of the 2005 Act.

• No independent enforcement clauses: The Declaration contains no enforcement or penalty provisions; enforcement obligations and sanctions, if any, will be those provided by the 2005 Act’s enforcement architecture in relation to approved authorities.

For practitioners assessing impact, the correct reading is that the Declaration is a status-conferring instrument. To identify the specific duties, rights and administrative requirements that result from inclusion, a reader must consult the 2005 Act’s provisions that define and regulate "approved authorities," because the Declaration explicitly defers substantive content to that Act (s 3).

The body of the Declaration contains no penalty provisions, enforcement mechanisms, or sanctioning regimes. It is a declaratory instrument that classifies certain entities as "approved authorities" for the purposes of the 2005 Act (s 4(1)), and therefore any penalties or enforcement provisions that become relevant are those that the 2005 Act provides for approved authorities. The instrument does, however, carry several implementation and administrative implications from an enforcement perspective:

• No independent sanctions in the Declaration: There are no fines, criminal offences, or administrative sanctions specified in the Declaration itself. Consequently, the instrument does not independently create enforcement obligations or penalties.

• Enforcement depends on the 2005 Act: Because s 3 imports the definition of "approved authority" from the 2005 Act, the content of any enforcement regime applicable to the newly declared bodies must be located in the 2005 Act. Any breach-based sanctions, civil liabilities, compliance reporting or regulator powers relevant to approved authorities are functions of that Act rather than of the Declaration text.

• Administrative recognition and compliance monitoring: The Department or agency administering the 2005 Act will need to recognise the newly declared approved authorities in its compliance, monitoring and enforcement processes. The Declaration therefore triggers a requirement on administrative actors to treat the named bodies as part of the regulated cohort, and to apply the 2005 Act’s enforcement rules to them (the Declaration’s operative clause, s 4(1), effects that shift in regulatory population).

• Use of the Schedule for updates and traceability: Amendments to the Schedule have been recorded over time (Endnote 3; Endnote 4). From an enforcement viewpoint, it is important for regulators and compliance officers to rely on the most current compilation and the Federal Register, as the Declaration’s endnotes warn that uncommenced amendments and modifications may exist and editorial changes may have been made.

Practitioners should therefore not look to the Declaration for enforcement language. Instead, they should identify which enforcement provisions in the 2005 Act apply to approved authorities and then apply those rules to the entities listed in Schedule 1. The Declaration's role in the enforcement chain is purely classificatory: it brings named entities within the reach of the 2005 Act’s enforcement machinery.

The Declaration is expressly a cross-referential instrument. Its legal effect is realised only in interaction with the Superannuation Act 2005. The instrument also sits within the broader legislative architecture of compilations, amendments and administrative practice. Key textual points on interaction:

• Direct statutory cross-reference to the 2005 Act: Section 3 states that "approved authority has the same meaning as in the 2005 Act." Section 4(1) declares several bodies "to be an approved authority for the purposes of the 2005 Act." Thus, the Declaration operates in tandem with the 2005 Act; it does not operate in isolation. Any legal relationships, duties or entitlements arise from the 2005 Act and are applied to the Declaration’s listed entities.

• Delegated instrument exercising a power in the 2005 Act: The Declaration was "made under subsection 8(3) of the Superannuation Act 2005." The instrument therefore is an exercise of delegated statutory authority under the 2005 Act. It should be read as an implementing step within that statute's scheme.

• Compilation and Legislation Act interfaces: The front matter states that the compilation follows the Legislation Act 2003 editorial procedures and that "editorial changes" may be recorded in endnotes. Endnote material also refers to the Legislation Act 2003 (for editorial change authority). These references remind the reader that the Declaration, as a legislative instrument, is subject to composition, registration and compilation procedures under the Legislation Act and that editorial or presentational changes authorised by that Act may appear in the compilation without changing legal effect.

• Amendments and later instruments: The endnotes identify amending instruments and dates (Endnote 3; Endnote 4), showing that the Schedule has been amended across multiple instruments (F2015L00923; F2019L00335; F2025L00283). Any interaction with other laws that depends on whether a body is an "approved authority" must therefore account for these subsequent instruments and their commencement dates.

• Uncommenced amendments and modifications: The compilation warns that effects of uncommenced amendments are not shown and that the compiled law may be modified by other laws without changing text of the compilation. The Declaration therefore interacts procedurally with other legislative instruments and modifications that might affect its operation; practitioners must consult the Register for any modification or uncommenced amendment.

• No direct interaction with other named statutes in this text: The Declaration does not name or alter other statutes directly; all substantive legal effects are channelled through the 2005 Act. The instrument itself contains no express savings or transitional provisions; such matters, if necessary, are found in the amending instruments or the 2005 Act.

In short, to trace the Declaration’s legal interactions, the reader must follow the chain: Declaration (s 4) → 2005 Act definitions and provisions (s 3 import) → any amending instruments recorded in the endnotes and the Federal Register.

The compilation includes endnotes that document the registration and commencement history of the Declaration and subsequent amendment instruments. The Declaration’s amendment history and the timeline for changes are recorded in Endnotes 3 and 4; those are the authoritative evidentiary trail within the compilation. Key entries from the endnotes:

• Original registration and commencement: The Superannuation (PSSAP) Approved Authority Inclusion Declaration 2008 was registered on 26 June 2008 (F2008L02278) and commenced on 1 July 2008 (Endnote 3).

• Amending instruments recorded in the legislation history:

  • Superannuation (PSSAP) Approved Authority Inclusion Amendment Declaration 2015 (No. 1), registered 24 June 2015 (F2015L00923), commenced 25 June 2015 (Endnote 3).
  • Superannuation (PSSAP) Approved Authority Inclusion Amendment Declaration (No. 1) 2019, registered 21 March 2019 (F2019L00335), commenced 22 March 2019 (Endnote 3).
  • Superannuation Legislation (CSS, PSS and PSSAP Membership) Amendment Declaration 2025, registered 4 March 2025 (F2025L00283), with Schedule 1 items 20 and 21 commencing 5 March 2025 (s 2(1) item 1) (Endnote 3).

• Amendment history at provision level (Endnote 4): The Schedule has been amended (Schedule 1 is shown as amended by F2015L00923; F2019L00335; F2025L00283). The table in Endnote 4 lists that s 2 was affected (republished/ repealed) , specifically "s 2... rep LA s 48D" , indicating a provision-level amendment has occurred in relation to s 2 (as recorded in the compilation’s amendment history).

• Compilation updates: The front matter states the compilation date is 5 March 2025 and notes that the compilation displays the law "as amended and in force on 5 March 2025." The endnotes additionally warn that uncommenced amendments are not shown and refer the reader to the Register for the compiled law and uncommenced amendments.

• Editorial and misdescription notes: The compilation explains that First Parliamentary Counsel may make editorial changes under the Legislation Act 2003 and that misdescribed amendments can be incorporated editorially under section 15V of that Act if the amendment can be given effect as intended (Endnote 1). That procedural note explains how certain textual edits may have been made without altering legal effect.

Practitioners should consult the Federal Register entries for each of the amending instruments cited (by F numbers in Endnote 3) if precise timing or the text of the amendments is needed. The compilation’s endnotes contain the necessary references to trace each change set.

The compilation contains no references to litigation, judicial interpretation, or case law. The instrument itself is a statutory declaration and the endnotes record only the legislative and editorial history. Concretely:

• No cases named in the instrument or endnotes: There are no judicial authorities, reported decisions, or litigation references in the Declaration text or endnotes. The endnotes list only legislative amendments, registration and commencement details.

• No recorded litigation-related amendments: The amendment history recorded in Endnote 3 and Endnote 4 shows administrative amendment entries and repeals; none are described as arising from litigation or court orders.

• Practical implication for researchers: If any litigation has since engaged the Declaration’s legal effect as it interacts with the 2005 Act, that material is not recorded in the compilation. The compilation cautions that it shows the law as amended and in force on 5 March 2025 and directs readers to the Register for modifications, uncommenced amendments and editorial detail (compilation front matter; Endnote 1). Therefore, to identify any litigation that touches on the Declaration, a practitioner must search court databases and legislative history beyond the compilation text itself.

For present purposes, the compilation contains no litigation history to cite or analyse. Any reliance on judicial interpretation must come from sources external to the instrument.

This instrument’s apparent simplicity masks several practical traps and procedural edges that a practitioner or compliance officer should note. These are matters drawn strictly from the compilation text and endnotes:

• The Declaration is classificatory, not substantive. The instrument changes the status of the listed bodies under the 2005 Act (s 4(1); s 3), but it does not itself set out the substantive rights, obligations or funding consequences. Do not treat the Declaration as self-contained: the consequences of inclusion must be traced to the 2005 Act.

• "Approved authority" is imported from another statute. Section 3 explicitly says "approved authority has the same meaning as in the 2005 Act." That means a correct legal analysis requires reading the 2005 Act. Failure to do so is a common error: relying solely on the Declaration will miss the operative duties and entitlements.

• Amendments occur by later declarations: The Schedule has been amended on multiple occasions (Endnote 3; Endnote 4). The compilation is dated 5 March 2025 and notes it includes amendments up to F2025L00283 (front matter). Always confirm whether the Schedule’s contents are current by checking the Federal Register of Legislation because the compilation warns that uncommenced amendments and modifications may exist.

• Repeals and editorial changes visible in endnotes: The amendment history notes that section 2 was repealed ("s 2... rep LA s 48D" in Endnote 4). The compilation also explains that editorial changes authorised by the Legislation Act 2003 may alter presentation without changing effect (Endnote 1). Analysts must be alert to the difference between textual edits and substantive amendments.

• No transitional or savings provisions in the Declaration: The instrument contains no transitional arrangements or savings; if transitional arrangements were needed for persons affected by inclusion, they must be found in the 2005 Act or in the specific amending instruments (the amending instruments listed in Endnote 3 may contain those provisions). Do not assume the Declaration itself provides them.

• Reliance on the compilation date: The compilation states it shows the law "as amended and in force on 5 March 2025." That date matters. If you are advising on an action taken before or after that date, or relying on amendments after that date, the compilation may not reflect later changes. The compilation explicitly directs readers to the Register for uncommenced amendments and modifications.

• The instrument is silent on operational detail: For compliance, payroll or membership systems, do not infer contribution or benefit rules from this Declaration. Instead, identify the corresponding provisions in the 2005 Act that attach those rules to "approved authorities."

• Names may be amended or removed by later declarations: Because the Schedule is the operative list and has been amended before (Endnote 3; Endnote 4), inclusion is not necessarily permanent. Subsequent amending declarations can add or remove bodies; always verify the current Schedule on the Register.

These points are not speculative; they follow from the instrument’s cross-references, its Schedule mechanism, and the endnotes that record amendment and editorial procedures.

The Declaration itself imposes no procedural compliance requirements, reporting duties, or payment obligations; it is a status declaration that brings the listed entities within the scope of the 2005 Act. Compliance therefore requires a two-step approach grounded in the Declaration’s text:

1. Treat the Declaration as a trigger to consult the 2005 Act. Section 3 of the Declaration imports the 2005 Act’s definition of "approved authority" and section 4(1) places the named bodies within that definition for the purposes of that Act. The Declaration therefore creates an obligation to read the 2005 Act to identify applicable duties, reporting regimes, contribution rules, membership entitlements and regulator interaction. Compliance tasks therefore begin with a legal review of the 2005 Act provisions that apply to an "approved authority."

2. Administrative and record-keeping steps for affected bodies and regulators:

   • Affected entities named in Schedule 1 (Screen Australia; Australian Hearing Services; Housing Australia) should update internal governance, payroll, and records processes to reflect their status as an "approved authority" under the 2005 Act (s 4(1); Schedule 1). The Declaration does not specify what internal changes are required; those will flow from duties and obligations in the 2005 Act.
   • Compliance officers and legal advisers must reconcile corporate registers and operational manuals with the effective commencement dates recorded in the amending instruments (Endnote 3). For accurate dating and to determine when obligations begin, check the registration/commencement entries for the original Declaration and its amending instruments (Endnote 3 lists registration numbers and commencement dates).
   • Regulators and departmental administrators must update their supervised-entity lists and apply any reporting, auditing or prudential frameworks the 2005 Act imposes on approved authorities, recognising that the Declaration expands the regulated cohort (s 4(1)). The Declaration itself does not specify how monitoring occurs; that regime is in the 2005 Act.

3. Check amendment and compilation status before relying on instrument text:

   • The compilation notes that uncommenced amendments are not shown and that the Register may contain further items (front matter). Practitioners should verify the current instrument on the Federal Register of Legislation, and cross-check the amending instruments cited in Endnote 3 (using their F numbers) to ensure there are no subsequent changes affecting obligations.
   • Be aware of editorial changes authorised by the Legislation Act 2003 and recorded in the endnotes (Endnote 1). Those edits can alter presentation but not legal effect; still, ensure references used in compliance systems match the current official text.

4. Seek or prepare advice that links the Declaration with practical obligations:

   • Because the Declaration is a legal label that imports substantive rules from the 2005 Act, compliance advice should identify precisely which sections of the 2005 Act apply to an "approved authority" and translate those requirements into operational checklists: payroll coding, superannuation contribution arrangements, trustee or board responsibilities (if any), reporting cycles, and interactions with the relevant regulator. The Declaration’s text (s 3 and s 4) makes this cross-reference mandatory.

5. Monitor for further legislative action:

   • The Schedule has been amended several times (Endnote 3; Endnote 4). Entities and advisers should monitor the Federal Register for further amendments or for any modifications that might change inclusion status, because the Declaration’s role is to add or remove entities from a statutory class.

In sum, "how to comply" in relation to this instrument is: recognise that the instrument confers a statutory label; identify the operative 2005 Act provisions that attach duties and rights to that label; update administrative records and governance accordingly; and monitor amending instruments and the Register for any subsequent changes.
