What it does
This instrument, titled the Superannuation (PSS) (Surcharge Deduction Amount - Conversion Factors) Determination No. 1, is a PSS Board determination under the Rules for the Public Sector Superannuation Scheme. The Board states it acts "pursuant to rule 12.2.10 and for the purposes of Part 9 of the Rules" (opening recital). The determination sets a fixed table of actuarially derived conversion factors, to be used when calculating reductions to pensions that are applied to discharge Surcharge Deduction Amounts, as expressly stated in the Purpose clause (cl 3). The table of conversion factors is presented in the Schedule and covers ages in completed years from 15 through 70, providing a single decimal place conversion factor for each age.
Mechanically, the instrument does three things. First, it identifies the legal basis and issuer: the PSS Board under the Rules and the Superannuation Act 1990 (cl 4(1)). Second, it declares when it takes effect: "from and including 15 May 1998" (cl 2). Third, it supplies the operative data for calculations: a schedule of conversion factors linked to "age in completed years at date of commencement of pension" (Schedule). The Schedule is explicit that these conversion factors are "required under PSS rule 12.2.10" and therefore intended to be applied against that rule.
The instrument also contains a narrow substantive exclusion: the conversion factors "do not apply in respect of any pension payable as a result of the death of a member" (cl 5(2)). The determiner notes that the conversion factors were set "in accordance with advice from an actuary" (cl 3), indicating the underlying actuarial input to the numerical values, although the actuary’s report is not reproduced in the text. The determination is formally adopted and sealed by the PSS Board, with signatures and a common seal dated 4 June 1998.
This instrument does not itself restate the arithmetic of how the conversion factors are to be applied, nor does it define "Surcharge Deduction Amount" or the formula for pension reduction; those definitional and operational matters remain located in the Act and the Rules, to which this determination expressly refers (cl 4(2)) and to which it is tied by reference to rule 12.2.10 and Part 9.
