Superannuation (PSS) Membership Inclusion Declaration 2006

The Declaration operates through a small number of conceptually significant definitions and cross‑references that determine coverage, exclusions and timing.

• Alternative superannuation scheme (s 3(1)). The Declaration defines an alternative superannuation scheme in relation to a person employed in a particular capacity or holding a particular office as a scheme to which contributions are made in relation to that employment or office, but then lists five discrete exclusions (s 3(1)(b)(i)-(v)). Exclusions include schemes funded only in respect of other employment or offices, schemes used only for preservation or payment of productivity benefits, schemes used solely for Superannuation Guarantee (Administration) Act 1992 compliance, schemes funded only in respect of performance pay, and, for prescribed persons, schemes of which the person is taken to be a member for top‑up purposes. The accompanying example in the note clarifies that voluntary contributions alone to a retirement savings account (RSA) do not make that RSA an alternative scheme, whereas employer contributions above the superannuation guarantee rate would (note to s 3(1)).

• Top‑up arrangement (s 3(1)). A top‑up arrangement is defined as an arrangement where a payer contributes, on behalf of a payee, to a superannuation scheme as part of the payee’s overall remuneration and on the basis that the payee will or remains a member of the PSS and the payer is or remains the designated employer. The definition therefore captures remuneration packaging arrangements intended to substitute employer contributions into another scheme while preserving PSS membership for specific administrative or contractual reasons.

• Prescribed person and taken‑to‑be‑member for top‑up purposes (s 3(1) and s 3(2)). The Declaration treats certain persons as "taken to be a member" of a scheme for top‑up purposes if membership derives solely from a top‑up arrangement (s 3(2)). The definition of prescribed person, and the associated special rules, recognises that some employees can elect to take part of their remuneration in a non‑monetary form (for example, a top‑up) and that such arrangements create discrete membership consequences.

• Productivity benefits and performance pay (s 3(1)). The text imports specialised categories , productivity benefits (with reference to s 110A of the 1976 Act) and performance pay (a term defined by reference to particular historical industrial agreements under the Industrial Relations Act 1988) , to exclude participation in schemes solely for those purposes from being treated as an alternative superannuation scheme.

• Cross‑referencing to other statutes and entities (s 3(1) notes). The Declaration draws in terms and entities from a range of other statutes and instruments: the Superannuation Act 1976; the Superannuation Act 1990; Retirement Savings Account Act 1997; Superannuation Guarantee (Administration) Act 1992; the Industrial Relations Act 1988 (historical agreements); and entities established under other Acts (for example, APRA, ASIC, ARPC, ACECQA, Australian Hearing Services, CSC). The Declaration also preserves definitions from the 1990 Act unless a contrary intention appears.

• Application and cessation mechanics (s 4). The operational concept is that section 6 of the 1990 Act applies to persons listed in Schedule 1 (s 4(1)), but for a large number of those persons the application is time‑limited or contingent on specific events, described in precise terminating contingencies across the subsections of s 4 (for example, employment cessation, alternative scheme membership, corporate status changes, and specific historic dates).

These concepts structure who is included in the PSS for the purposes of section 6 and when that inclusion lapses. The definitions are procedural and exclusionary: many of the key questions practitioners will confront are factual (did employer contributions to another scheme trigger “alternative superannuation scheme” status? does a given arrangement qualify as a top‑up arrangement?) and timing‑sensitive (has the trigger date occurred?).

The Declaration makes section 6 of the Superannuation Act 1990 apply to the persons described in Schedule 1 (s 4(1)). The supplied text refers repeatedly to particular items in Schedule 1 by number , for example items 12, 13, 14, 19, 21, 22, 23, 27, 28, 29, 30, 31 and 32 , and couples those item references with named employers and bodies in the cessation provisions. The Declaration therefore targets discrete cohorts of employees and office‑holders connected to named Commonwealth entities and to some state or corporatised entities. From the definitions and s 4 text, the affected parties include, by reference:

• employees of the Nuclear Safety Bureau (NSB) captured at item 12 (s 4(5));
• employees of the Australian Law Reform Commission (ALRC) at items 13 and 14 (s 4(6));
• employees of the Sydney Harbour Federation Trust at item 19 (s 4(11));
• employees of Australian Strategic Policy Institute Limited (ASPI Ltd) at item 21 (s 4(13));
• employees of Snowy Hydro Limited at item 22; the Declaration references the SMHEA corporatisation date and shareholder arrangements for Snowy Hydro (s 4(14)-(15));
• employees of the Commonwealth Superannuation Corporation (CSC) at item 23 (s 4(16));
• employees of the Australian Health Practitioner Regulation Agency (AHPRA) at item 27 (s 4(20));
• employees of ACECQA at item 28 (s 4(21));
• employees of the Australian Reinsurance Pool Corporation (ARPC) at item 29 (s 4(22));
• employees of Australian Hearing Services at item 30 (s 4(23));
• employees of APRA at item 31 (s 4(24)); and
• employees of ASIC at item 32 (s 4(25)).

The Declaration’s text frequently pairs each listed person with three types of termination contingencies: (a) the day the person ceases to be an employee of the named body; (b) the day immediately before the day on which the person becomes a member, in relation to their employment, of an alternative superannuation scheme; and (c) in a number of cases, a corporate‑status test that depends on whether the named body continues to be a Commonwealth entity or a statutory authority or a corporate Commonwealth entity as defined under the Public Governance, Performance and Accountability Act 2013 (for example s 4(11), (15), (20)-(25)). For the Snowy Hydro cohort, the Declaration also triggers cessation where certain payments for benefits or administration costs cease to be made by Snowy Hydro Limited (s 4(15)(d)-(e)).

The Declaration also affects "prescribed persons" and persons subject to "top‑up arrangements" as those concepts determine whether a given scheme is an alternative superannuation scheme (s 3(1) and s 3(2)). In other words, employees who elect remuneration packaging options that include top‑up arrangements, or whose employer makes particular kinds of contributions (for performance pay or productivity benefit preservation), will be treated differently for the purpose of whether section 6 continues to apply.

Two practical implications for identification: (1) the Declaration does not set out the text of Schedule 1 in the supplied extract, so identifying precisely which individuals are covered requires inspecting Schedule 1 in the full instrument; and (2) inclusion is not unconditional , many of the listed individuals cease to be covered once they cease employment, become members of an alternative scheme, or if their employer’s corporate status changes in specified ways (s 4(5), (6), (11), (13)-(16), (20)-(25)).

The Declaration itself is short on express duties and rights; its operative effect is to attach the application of section 6 of the Superannuation Act 1990 to specified persons (s 4(1)). Consequently, the substantive duties and rights that matter in practice are governed by the 1990 Act’s section 6 and by the various superannuation statutes and trust deeds that the 1990 Act and other referenced Acts invoke. The Declaration creates procedural and definitional rules that determine when those underlying duties and rights apply to particular people.

Rights and entitlements

• By applying section 6 of the 1990 Act to the persons in Schedule 1 (s 4(1)), the Declaration effectively brings those persons within whatever membership, benefit, contribution and preservation rules are created by the 1990 Act and the PSS trust deed, as those instruments provide. The Declaration, however, does not itself describe benefits or membership rules; it only identifies who is to be treated as within the ambit of s 6.

Duties and conditionalities

• The key duties that flow from the Declaration are conditional: employers and employees must observe the factual triggers listed in s 4 (for example, cessation of employment, becoming a member of an alternative superannuation scheme, or corporate‑status changes), because those events determine whether section 6 continues to apply. Employers’ administrative duties will therefore include monitoring and documenting when an employee becomes a member of an alternative superannuation scheme, and when corporate or governance changes occur that are listed as cessation contingencies (s 4(5)-(6), (11), (13)-(16), (20)-(25)).

• The Declaration distinguishes between schemes that are and are not alternative schemes by reference to employer contributions and the purpose of participation (s 3(1)(a)-(b) and the note). The definition therefore places an evidentiary or compliance burden on employers and employees to show whether contributions are made "in relation to the person’s employment" and whether participation is for productivity benefits, performance pay, or solely for Superannuation Guarantee compliance (s 3(1)(b)(ii)-(iii), (iv)).

• For top‑up arrangements, the Declaration prescribes specific conditions: the payer’s contributions must be part of the payee’s overall remuneration package and entered into on the basis that the payee will continue to be, or become, a member of the PSS and that the payer will be, or become, the designated employer (s 3(1), top‑up arrangement).

Administrative consequences

• The timing language in the cessation clauses is precise and operationally significant. Multiple provisions use the phrase "the day immediately before the day on which the person becomes, in relation to the person’s employment ... a member of an alternative superannuation scheme" (for example s 4(5)(c), s 4(6)(b), s 4(11)(b), etc.). That drafting creates a specific cut‑off day for the continuing applicability of section 6. Employers must therefore be able to identify the effective date of membership of an alternative scheme to determine whether section 6 still applies as of that "the day immediately before" reference.

• For Snowy Hydro‑related members (s 4(15)), the Declaration requires attention to corporate ownership (a change of shareholder other than Commonwealth, NSW or Victoria), the SMHEA corporatisation date, and whether payments in respect of benefits or administration costs for PSS members employed by Snowy Hydro cease to be made by Snowy Hydro. Those are discrete contingencies that determine whether section 6 remains operative for the relevant cohort.

Limitations in this instrument

• Because the Declaration operates by importing s 6 of the 1990 Act, practitioners must consult the 1990 Act to determine the precise nature of the duties, rights and entitlements that will attach once a person is brought within section 6 by this Declaration. The Declaration does not itself create penalties, benefits or contribution rates.

In short, the Declaration allocates practical duties and rights by controlling the scope of application of section 6; the substantive content of those duties and rights is sourced from the 1990 Act and associated instruments that the Declaration cross‑references (note to s 3).

The Declaration, as supplied, contains no express penalty, offence, sanction or enforcement provisions. It is a declaratory instrument that attaches the application of section 6 of the Superannuation Act 1990 to persons in Schedule 1 (s 4(1)) and specifies the events that end that application (s 4(5), (6), (11), (13)-(16), (20)-(25)). Because the Declaration does not create standalone criminal or civil sanctions, enforcement and penalties , if any , must be sought in the body of law to which the Declaration refers.

• Reference points for enforcement. The Declaration expressly imports terms and coverage from other Acts and notes that definitions in the Superannuation Act 1990 apply unless a contrary intention appears (note to s 3). Any penalties, compliance obligations, administrative remedies, trustees’ duties or employer obligations that might arise for persons covered by section 6 will therefore be found in the Superannuation Act 1990, the Superannuation Act 1976 where relevant (noting the 1976 Act is cited in the definitions), and in other statutes referenced (for example the Superannuation Guarantee (Administration) Act 1992). The Declaration itself does not specify remedy‑provisions, enforcement agencies, or pecuniary penalties.

• Practical consequence for administrators. Because the Declaration’s effect is to determine the population to whom the 1990 Act applies, an administrator or employer that misapplies the Declaration’s provisions risks incorrectly classifying an individual’s membership status. Consequences of misclassification would be determined under the 1990 Act and other applicable laws , not the Declaration text , and therefore practitioners should map compliance and any dispute or remediation process to the underlying statutory regime.

• No express delegation or inspectorate. The Declaration does not appoint an enforcement agency or provide powers for investigation, compliance notices, or infringement processes. The named entities (APRA, ASIC and others) appear in definition paragraphs to identify who is affected and to provide terms; the Declaration does not confer regulatory powers on those agencies by itself.

• Reliance on documentation and factual proof. Because the Declaration relies heavily on factual triggers (for example, the day someone becomes a member of an alternative superannuation scheme, or the day an employer ceases making payments for benefits or administration costs), record‑keeping will be central. Any subsequent enforcement or dispute will therefore hinge on evidence of dates, membership documentation and transactional records, but the Declaration does not itself specify evidentiary standards.

In short, the Declaration does not create new penalties or enforcement mechanisms; it changes the coverage perimeter for section 6 of the 1990 Act. Enforcement questions therefore require reference to the 1990 Act and any other legislative instruments or trust deeds that set out penalties and compliance regimes.

The Declaration is heavily interwoven with existing superannuation statutes and other legislative instruments by explicit reference and definition. It should be read as an instrument that modifies statutory coverage by cross‑reference rather than as standalone substantive law.

Primary cross‑references

• Superannuation Act 1990. The Declaration applies section 6 of the 1990 Act to named persons (s 4(1)) and states that terms defined in the Superannuation Act 1990 have the same meaning unless a contrary intention appears (note to s 3). This creates direct dependence: the substantive content of membership, contributions, benefits and any statutory duties or remedies depends on the 1990 Act.

• Superannuation Act 1976. The Declaration references the 1976 Act in defining "productivity benefits" and points to section 110A of that Act in the s 3(1) definition. The 1976 Act is therefore a definitional source for certain technical categories used to determine whether a scheme is an alternative superannuation scheme.

Other legislative and institutional cross‑references

• Superannuation Guarantee (Administration) Act 1992. The Declaration excludes from the definition of alternative superannuation scheme any scheme where participation is solely for purposes related to satisfying obligations under the Superannuation Guarantee (Administration) Act 1992 (s 3(1)(b)(iii)). That creates an interaction where employer action taken only to meet statutory minimum SG obligations will not trigger alternative scheme status under this Declaration.

• Retirement Savings Account Act 1997. The Declaration explicitly includes RSAs as superannuation schemes for the purposes of the definition of superannuation scheme (s 3(1), superannuation scheme(b)). The explanatory note in s 3(1) clarifies that voluntary contributions to an RSA without employer contributions are not an alternative superannuation scheme, but employer contributions above SG rate to an RSA will be.

• Industrial Relations Act 1988. The definition of performance pay points to particular types of historical industrial agreements (s 3(1), performance pay(a)-(b)). This situates certain payments in relation to the historical industrial law framework and excludes schemes funded only by performance pay from being alternative schemes.

• Governance and entity status statutes. The Declaration uses the concept of whether an entity "ceases to be a corporate Commonwealth entity within the meaning of the Public Governance, Performance and Accountability Act 2013" (s 4(11), (15), (22)-(25)) and whether an entity ceases to be a Commonwealth entity or statutory authority (s 4(20)-(21)). Consequently, changes in governance classification under the PGPA Act 2013 or similar statutory definitions directly affect whether section 6 continues to apply to certain employees.

• Snowy Hydro Corporatisation Act 1997. The Declaration refers to the SMHEA corporatisation date and section 59 of the Snowy Hydro Corporatisation Act 1997 (s 3(1), definition of SMHEA corporatisation date and s 4(14)-(15)). That makes the effect of the Declaration contingent upon timing and events governed under that Act.

Institutional definitions and entities

• The Declaration names APRA, ASIC, ARPC, ACECQA, AHPRA, Australian Hearing Services and CSC and ties coverage or cessation contingencies to employment with those bodies (s 3(1) and s 4(20)-(25)). The status of those bodies under their constituting statutes is used as a trigger for applying or ceasing the application of section 6.

Practical consequence of these interactions

• Because the Declaration is structured to defer substantive legal content to the 1990 Act and other statutes, users must treat it as part of a web of legal instruments. Determining entitlements, employer obligations, and the significance of being a member for top‑up purposes requires reading across the referenced Acts and trust instruments. In addition, corporate governance events under the PGPA Act 2013 and corporatisation events under Snowy Hydro legislation directly alter who remains within the PSS framework via the Declaration’s cessation triggers (s 4).

In sum, the Declaration functions as a connective tissue between the 1990 Act and a set of identified persons and institutions, relying on other statutes for substantive definitions, rights, and obligations.

The supplied text of the Declaration does not include an express amendment history or schedule of repeals or amendments. The document presents the Declaration’s operative name as the Superannuation (PSS) Membership Inclusion Declaration 2006 (s 1) and contains temporal cross‑references and historical dates within its operative provisions (for example the 31 December 1996 cut‑off in s 4(5)(a) and references to pre‑specified dates in the performance pay definition that rely upon historical versions of the Industrial Relations Act 1988). But the instrument excerpt contains no explicit declaratory note describing prior amendments, no schedules listing amending instruments, and no legislative history text.

What the Declaration itself supplies

• The name and the operative definitions are present (s 1, s 3). The text contains multiple embedded references to dates and other Acts which indicate points of legal cross‑reference and historical anchoring (for example, the 31 December 1996 date in s 4(5)(a); the SMHEA corporatisation date defined by reference to section 59 of the Snowy Hydro Corporatisation Act 1997 in s 3(1)).

What it does not supply

• There is no consolidated amendment table in the supplied extract, no recital of enactment or commencement beyond the instrument name, and no notes indicating consequential amendments to other instruments. The Declaration does not reproduce its commencement clause in the supplied text, nor does it show whether later amendments have varied the Schedule or termination contingencies.

How to proceed in practice

• To establish full amendment history and any subsequent changes, a practitioner must consult the consolidated version of the instrument as maintained by the parliamentary or official legislation database, or trace statutory instrument amendments and legislative amendments that alter the Schedule or the cross‑referenced Acts. The supplied extract by itself is silent on whether later legislative action added, removed or changed Schedule 1 items or altered any of the cessation contingencies.

In summary, the Declaration as provided gives its operative name and current definitions and cessation rules, but does not in the supplied extract provide an internal amendment history. Establishing a change log requires external consolidation sources beyond the text here.

The supplied Declaration contains no litigation history, case footnotes or references to judicial consideration. The instrument is a statutory declaration that attaches the application of section 6 of the Superannuation Act 1990 to specified groups; the excerpt provided does not identify any judicial decisions, administrative appeals, or interpretative rulings about its meaning.

What the instrument does show

• The Declaration cross‑references legal terms used in other Acts and identifies specific events and entities whose status can be relevant in disputes (for example, whether an employee became a member of an alternative superannuation scheme on a particular day, or whether a corporate entity ceased to be a Commonwealth entity under the PGPA Act 2013). Those are precisely the kinds of fact patterns that could generate litigation , for example, disputes over membership status, timing of entitlements and employer obligations , but any litigation will turn on the substantive provisions of the 1990 Act and those other statutes, and on the facts.

What is not present

• There are no cases cited in the Declaration text, no references to tribunal or court determinations, and no annotated judicial interpretation provided in the supplied text. There is therefore no litigation history recorded in this extract.

Recommended practitioner step

• If a legal question arises about the construction or operation of the Declaration,for example, the meaning of "alternative superannuation scheme" in a borderline factual context,research should include case law interpreting the Superannuation Act 1990 and any judicial consideration specifically referencing this Declaration or disputes involving the listed bodies. The supplied instrument does not itself provide that jurisprudence.

In short, the Declaration as supplied is silent on litigation history; it records no judicial treatment in the text.

The Declaration contains a number of drafting features and cross‑references that produce practical pitfalls for employers, employees, administrators and legal advisers. These are factual, timing and definitional traps that can change whether a person remains within the scope of section 6 of the 1990 Act.

1. Reliance on Schedule 1 item numbers without the Schedule. The supplied extract repeatedly refers to items in Schedule 1 (for example items 12, 13, 14, 19, 21, 22, 23, 27-32) but does not reproduce Schedule 1. You must examine the full instrument’s Schedule 1 to identify precisely which roles and which persons are captured. The text’s operational clauses assume that Schedule 1 is available and authoritative (s 4(1)).

2. "Day immediately before" timing language. Many cessation triggers use the phrase "the day immediately before the day on which the person becomes ... a member of an alternative superannuation scheme" (see s 4(5)(c), s 4(6)(b), s 4(11)(b), etc.). This creates a sharp legal discontinuity on a single day and requires precise evidence of when alternative scheme membership begins. Administrative systems must record exact effective dates of membership rather than relying on month or payroll period notions.

3. Alternative superannuation scheme depends on employer contributions and purpose. The definition of alternative superannuation scheme turns on whether employer contributions are made in relation to the person’s employment and excludes participation that is solely for productivity benefits or to satisfy Superannuation Guarantee obligations (s 3(1)(a)-(b)(ii)-(iii)). The illustrative note stresses that voluntary contributions alone do not make an RSA an alternative scheme, but employer contributions above the SG rate will (note to s 3(1)). Therefore, employers that increase employer contributions into a non‑PSS fund risk triggering alternative scheme status and consequently a cessation of s 6’s application for that employee.

4. Top‑up arrangements and "taken to be a member." Persons in top‑up arrangements can be taken to be members of an alternative scheme for top‑up purposes (s 3(1) and s 3(2)). The top‑up definition requires that the payer’s contributions are part of the payee’s overall remuneration and that the arrangement is entered on the basis the payee continues to be a PSS member and the payer remains the designated employer. These are legal characterisation questions; the technical framing of an arrangement as a top‑up may determine whether a person is taken out of section 6 coverage.

5. Corporate status and entity definitions influence coverage. Several clauses make the continuation of section 6 contingent upon the named employer remaining a Commonwealth or corporate Commonwealth entity under the Public Governance, Performance and Accountability Act 2013 or remaining a statutory authority (see s 4(11), (15), (20)-(25)). A change in governance type, a corporatisation event (SMHEA corporatisation date), or a change in shareholder profile for Snowy Hydro Limited can trigger cessation of section 6. Employers and trustees must therefore track corporate restructuring and government governance changes.

6. Snowy Hydro special provisions. For item 22 (Snowy Hydro Limited), cessation triggers include not only the employee ceasing employment or becoming a member of an alternative scheme, but also shareholder changes (if a non‑Commonwealth/non‑NSW/non‑Victoria shareholder appears), and the cessation of payments in respect of benefits or administration costs by Snowy Hydro (s 4(15)(c)-(e)). The presence of payment cessation as a trigger means that even if employment continues, the funding arrangements for benefits and administration can end coverage.

7. Prescribed person carve‑outs. The text singles out "prescribed person" for special treatment, particularly in the alternative scheme exclusions (s 3(1)(b)(v)) and in the operation of top‑up arrangements. The Declaration does not define who is a prescribed person in the supplied extract beyond the description that such a person “holds office or is employed under terms and conditions that enable the person to choose whether to take part of his or her remuneration in a non‑monetary form” (s 3(1), prescribed person). Determining whether an individual is a prescribed person may require examination of employment contracts or terms and conditions.

8. Delegation to other statutes for clarity. The Declaration relies on other statutes for key definitions (for example, productivity benefits referencing s 110A of the 1976 Act) and for the substantive legal framework. Practitioners must not treat the Declaration in isolation; cross‑checking into the Superannuation Acts and the PGPA Act 2013 is essential.

9. No enforcement mechanisms in the instrument. Because the Declaration does not set out penalties, misclassification risks must be managed under the 1990 Act and other relevant laws. That makes accurate classification and record‑keeping a compliance priority.

Each of these items is a point at which an otherwise routine payroll or HR change can alter statutory superannuation coverage, so record‑keeping, governance tracking and precise date documentation are critical.

Compliance under this Declaration divides into two interlocking obligations: (A) accurate classification and monitoring of the employees and office‑holders listed in Schedule 1, and (B) precise factual record‑keeping and governance monitoring to determine when cessation triggers in s 4 operate. Because the Declaration attaches the application of section 6 of the Superannuation Act 1990 to particular persons (s 4(1)) and sets out explicit events that end that application (s 4(5), (6), (11), (13)-(16), (20)-(25)), an implementation checklist follows.

1. Obtain and review Schedule 1. The Declaration applies to the persons described in Schedule 1 (s 4(1)). Start by obtaining the complete instrument with Schedule 1 and mapping which positions and roles are captured by each item number. Where the supplied extract references an item by number, identify the exact job titles, employment categories and the cohort composition in Schedule 1.

2. Map each employee to the relevant s 4 cessation provision. For each person in Schedule 1, identify which subsection of s 4 governs their cessation (for example item 12 is covered by s 4(5), items 13 and 14 by s 4(6), item 22 by s 4(14)-(15), etc.). Note the precise list of terminating contingencies (employment cessation, becoming member of an alternative scheme, corporate status change, payment cessation).

3. Monitor employer contributions and alternative scheme membership. The definition of alternative superannuation scheme depends on employer contributions and purpose (s 3(1)). Put processes in place to detect when employer contributions begin to be paid into a non‑PSS fund, and whether such participation is solely for productivity benefits, performance pay, or only to meet Superannuation Guarantee requirements (s 3(1)(b)(ii)-(iii), (iv)). Establish a payroll‑to‑fund reconciliation process and require documentation from employees and receiving funds confirming effective membership dates.

4. Identify and document top‑up arrangements and prescribed persons. For employees who have remuneration packaging or non‑monetary remuneration components, identify whether the arrangement is a top‑up arrangement as defined (s 3(1), top‑up arrangement). For "prescribed persons" (those able to choose part of remuneration in non‑monetary form), document the employment terms that enable such choices and record whether scheme membership is only by virtue of a top‑up arrangement (s 3(2)).

5. Capture precise effective dates. Because the Declaration uses "the day immediately before" formulation as the operative date for cessation (for example s 4(5)(c)), record the effective membership date in the alternative scheme, the date employment ceases, and the date of any corporate status change or payment cessation. Do not rely solely on payroll period approximations; record exact days and supporting documentation.

6. Track corporate governance and entity status. For employers subject to the cessation contingencies tied to corporate status (for example s 4(11), (15), (20)-(25)), maintain a governance watchlist to capture events such as corporatisation (for Snowy Hydro, the SMHEA corporatisation date defined by s 59 of the Snowy Hydro Corporatisation Act 1997), changes to shareholder profile, or changes to entity status under the PGPA Act 2013 (s 4). Coordinate with corporate secretarial functions to obtain formal evidence of status changes.

7. Maintain evidence of payments and administration arrangements. For the Snowy Hydro provisions (s 4(15)(d)-(e)), the cessation can depend on whether payments in respect of benefits or administration costs for PSS members employed by Snowy Hydro cease to be made by Snowy Hydro Limited. Keep clear contractual and transactional records showing who pays benefits and administration costs and when any such payments cease.

8. Coordinate with the PSS administrators and relevant superannuation funds. Because the Declaration triggers the operation of s 6 of the 1990 Act, coordinate with the PSS administrators and any alternate funds to ensure correct processing of membership changes. Where employees move between schemes, obtain written confirmation of receiving fund membership effective dates.

9. Implement written HR and payroll procedures. Create standard operating procedures that set out the steps to be followed when an employee: (a) is offered or accepts a top‑up arrangement; (b) is enrolled in a non‑PSS fund; (c) changes employment status; or (d) an employer undergoes a corporatisation or governance change. Those procedures should assign responsibility for watchlist monitoring, record‑keeping, fund liaison and legal review.

10. Legal review on ambiguous cases. Where the classification of an arrangement as a top‑up, or the characterization of employer contributions as being "in relation to the person’s employment", is unclear, obtain legal advice on the likely operation under the 1990 Act and the terms of the Declaration. Because the Declaration relies on statutory cross‑reference and narrow definitions (s 3), borderline factual cases merit early legal input.

11. Documentation retention and evidentiary planning. Keep documents that can demonstrate the effective dates and the character of the arrangement: employment contracts, remuneration packaging agreements, fund acceptance letters, payment records, trustee correspondence, minutes of shareholder meetings (where relevant), and letters confirming entity status changes.

12. Consult the Superannuation Act 1990 for substantive duties and benefits. The Declaration determines coverage; the 1990 Act determines substantive entitlements and obligations. For payroll and trustee compliance, consult section 6 of the 1990 Act and related provisions in the 1990 Act and the PSS trust deed.

Following these steps will align practical processes with the Declaration’s mechanics: determine who is captured (Schedule 1), monitor the factual triggers listed in s 4 that end coverage, and maintain documentary proof of the exact dates and nature of contributions or arrangements that affect classification.
