What it does
This instrument, titled Superannuation (Productivity Benefit) Declaration No. 6, is a statutory declaration made by the Minister for Finance under the enabling power in section 3d of the Superannuation (Productivity Benefit) Act 1988, as stated in the instrument preamble. It is registered as Statutory Rules 1991 No. 1231 and dated 5 June 1991 (signed by Ralph Willis). The Declaration performs three mechanical functions.
First, it gives a short title for citation at s 1: "This Declaration may be cited as Superannuation (Productivity Benefit) Declaration No. 6." Second, and materially, it substitutes specified monetary amounts into the Table in the Schedule to the Superannuation (Productivity Benefit) Act 1988 for the defined period 1 July 1991 to 30 June 1992, by operation of s 2 of the Declaration. The instrument reproduces the mapping of particular amounts that appear in column 2 of the Schedule Table to new amounts (column 3) that are to apply for that period. The items and substitutions listed in the instrument are:
- $440 (marked "twice occurring") is to be substituted with $452;
- $13.20 is to be substituted with $13.56;
- $709 (marked "twice occurring") is to be substituted with $721;
- $21.27 is to be substituted with $21.63;
- $1,063.50 (marked "twice occurring") is to be substituted with $1,081.50.
Third, s 3 expressly revokes a previously made declaration described in the instrument as "The Superannuation (Productivity Benefit) Declaration No. 1 2 is revoked." The instrument also records that it was notified in the Commonwealth of Australia Gazette on 21 June 1991 and that the earlier statutory rule being superseded is recorded as Statutory Rules 1990 No. 172 (Notes at the end of the instrument).
