Superannuation (Pension Increases) Act 1967

The Act’s logic rests on several defined terms that form a multi‑step calculation. Eligible pensioner means a person who, immediately before the commencing date, was receiving a pension as a former contributor (including a contributor who retired before 30 June 1967) or a non‑contributing pensioner (someone receiving a pension under section 9 or 14 of the Superannuation Act (No. 2) 1956, but not a widow). The definition excludes widows from the “eligible pensioner” category, but widows receive separate treatment under subsection 4(3).

Actual unit contribution is the number of units of pension for which the pensioner was actually paying immediately before the commencing date. Actual unit entitlement is a more generous figure: for most retired contributors, it is the greater of the actual unit contribution and the number of units that would have applied under a scale set out in section 13 (for pre‑1959 retirements) or under section 20 of the Superannuation Act (for later retirements) at a relevant point in time. For non‑contributing pensioners, actual unit entitlement is the lower of the units that would have applied to a salary equal to their pre‑retirement salary under the old section 13 scale and four units. This creates a floor and ceiling.

Adjusted unit entitlement is a hypothetical figure: the number of units that would have applied to the pensioner under section 20(2) of the Superannuation Act 1922‑1967 as at 30 June 1967 if the pensioner had not retired and had been receiving salary equal to their notional annual salary. The notional annual salary is determined by the Treasurer, having regard to general increases in contributors’ salaries after the “relevant time” (the time of cessation of contributions or retirement, whichever applies). For non‑contributing pensioners, the notional salary is capped at the lower of the actual pre‑retirement salary and the minimum annual salary that entitled an employee to contribute for four units under the 1922 Act. The Treasurer’s determination is subjective in that it requires a judgment about “general increases in the rates of salaries of contributors,” but it is expressly linked to the notion of correspondence with the salary that was payable at the relevant time.

Additional unit entitlement is simply the excess of adjusted unit entitlement over actual unit entitlement. If there is no excess, no increase is payable. Where there is an excess, the increase is calculated by multiplying that excess (in units) by the relevant amount. The relevant amount is generally $65, but it is scaled down in several situations: where the pensioner’s actual unit contribution is less than his actual unit entitlement (pro‑rating by the ratio of actual contribution to entitlement); where the pensioner had neglected to contribute or elected not to contribute for units under section 52 of the 1922 Act (pro‑rating by the ratio of actual contribution to the difference between the scale maximum and the units he omitted); where the pension was reduced under special provisions (section 29 proviso, or sections 60M/60O); and where the pensioner had deferred contributions under an agreement with the Board (section 73 of the 1959 Act or section 33 of the 1963 Act). In the last two cases, the relevant amount is further reduced by the proportion that the actual annual pension bore to the pension that would have been payable but for the reduction. The Act also disregards the operation of section 44 of the 1922‑1967 Act in computing those notional pensions, which suggests that certain forfeiture or reduction provisions are excluded from the hypothetical.

The Act directly affects two classes of persons: eligible pensioners (former Commonwealth contributors and non‑contributing pensioners who were receiving a pension before 30 June 1967) and widows of deceased pensioners or deceased employees who would have qualified for an increase had they lived and been in receipt of a pension immediately before the commencing date. Widows are not themselves “eligible pensioners” under the definition in section 3, but subsection 4(3) creates a separate entitlement for them. The widow’s increase is a fraction: one‑half of the husband’s hypothetical increase if the husband elected that section 26 of the Superannuation Act 1922‑1959 should not apply to him (and did not revoke that election), otherwise five‑eighths. The Act therefore distinguishes between widows based on the deceased husband’s earlier election regarding a specific provision of the earlier Act.

Excluded from the increase are pensions payable under section 57 (unless contributions were made to a State Fund as defined in section 101 of the Superannuation Act 1922‑1967), and pensions under sections 53 or 58 of the 1922 Act. Section 57 pensions appear to be those paid from a State Fund (state government superannuation schemes that were transferred), while sections 53 and 58 deal with certain forfeiture or reduction situations (the Act does not reproduce those sections, but the exclusion suggests that the policy intent was to confine increases to the main Commonwealth Superannuation Fund pensions). Additionally, the Act does not apply to pensions that commenced after 30 June 1967, because the definition of “eligible pensioner” requires that the pension commenced before that date.

The class of affected persons is thus closed: it is a cohort of pensioners and widows who were already in the system as of late 1967. No new entrants can qualify. The administrative burden falls on the Commonwealth Superannuation Board (the body that administered the 1922‑1967 Act) to identify eligible pensioners, calculate notional salaries, determine adjusted unit entitlements, and apply the pro‑rating rules. The Treasurer must make determinations of notional annual salary, which gives the executive a discretionary role. Pensioners themselves have no duties under the Act; they are passive recipients of the increase if the calculation yields a positive amount.

The central right created by the Act is the entitlement to an increase in annual pension under section 4(1). This right is conditional on the arithmetic result: the adjusted unit entitlement must exceed the actual unit entitlement, and the increase is capped at the relevant amount multiplied by the additional unit entitlement. The right is also subject to the offset in subsection 4(2): any increases previously granted under the 1957, 1961, and 1963 Acts are deducted from the gross increase. The pensioner receives only the net excess, if any. This means that for pensioners who already received significant ad‑hoc increases in earlier years, the 1967 increase may be small or zero.

Widows have a derivative right under subsection 4(3), which does not require them to be eligible pensioners in their own right. The right is contingent on the husband having been a person who, if alive and receiving a pension, would have been entitled to an increase under subsection 4(1) (or, if the husband died before retirement, would have been entitled if he had retired on the day he died). The widow does not need to prove her own contribution history; the calculation is based on the hypothetical increase the husband would have received, then scaled down to the appropriate fraction.

There is no explicit duty on the Commonwealth or the Board to notify pensioners of the increase, but the payment mechanism under section 6 incorporates the increase into the existing pension payment system under the Superannuation Act 1922‑1967. Sections 6 and 7(1) provide that increases have effect from the first fortnightly payment after the commencing date, which implies that the Board must adjust the pension payment from that date.

The Act does not confer any discretion on the Board or the Treasurer to refuse an increase if the formula is satisfied; the language is mandatory (“the pensioner is … entitled”). However, the Treasurer’s power to determine the notional annual salary is discretionary in that it must be “having regard to general increases in the rates of salaries of contributors”. That determination directly affects whether the adjusted unit entitlement exceeds the actual unit entitlement and by how much. A Treasurer inclined to be generous could adopt a higher notion of “general increases”; a cautious Treasurer could adopt a lower figure. The Act provides no review mechanism or criteria for that determination beyond the vague reference to “general increases”.

The Act contains no penalty provisions. There are no criminal offences, civil penalties, or pecuniary penalties for non‑compliance. Enforcement is not a concept that arises directly because the Act imposes no obligations on pensioners or private parties. The only “enforcement” issue would be if the Commonwealth Superannuation Board failed to pay the increase to which a pensioner was entitled. In that case, the pensioner would have a right to seek judicial review or an order for payment under administrative law, likely through a claim for mandamus in the original jurisdiction of the High Court (at the time) or later the Federal Court. The Act itself does not create a statutory cause of action; it relies on the general law of entitlements under the Superannuation Act 1922‑1967, which section 6 incorporates for payment purposes.

Because the increase is treated as part of the benefits under the principal Act (by virtue of section 6), the existing enforcement mechanisms and dispute resolution procedures under that Act would apply. The Superannuation Act 1922‑1967 likely had provisions for the review of decisions by the Board, but those are not reproduced in this Act. In practice, the absence of penalties means that the main risk for the Commonwealth is legal challenge for underpayment, not a penalty regime.

For widows, the same applies. There is no penalty for late payment or miscalculation; the remedy would be to claim the correct amount plus interest, if any, under general law or under the terms of the principal Act.

Given that this is a 1967 Act dealing with a closed group, any enforcement issues would be historical. Modern litigants would need to establish that the increase was never paid or was miscalculated, which would be a factual question turning on the Treasurer’s determination and the Board’s records.

The Act operates as a supplement to the Superannuation Act 1922‑1967. Section 6 provides that the reference in subsection 10(1) of that Act to “benefits under this Act” includes increases payable under section 4 of this Act and pensions payable under section 5 of this Act. That means the payment machinery (fortnightly payments, deductions, and any other administrative rules) of the principal Act applies to these increases. Section 7 specifies that the increases take effect from the first fortnightly payment after the commencing date, aligning with the payment cycle under the principal Act.

The Act explicitly interacts with earlier pension increase legislation. Subsection 4(2) offsets any increases previously granted under section 11 of the Superannuation Act 1957, section 4 of the Superannuation (Pension Increases) Act 1961, and section 26 of the Superannuation Act 1963. These earlier Acts are effectively subsumed: the 1967 Act provides a new increase, but only to the extent that it exceeds the total of the earlier increases. This stacking mechanism prevents double‑counting and ensures that the cumulative effect of all ad‑hoc increases up to 1967 does not exceed the formula‑based amount. The earlier Acts are not repealed; they remain on the statute book but their practical effect is folded into the 1967 calculation.

The Act also references specific provisions of the Superannuation Act 1922 and its amendments (including the 1922‑1959, 1922‑1963, and 1922‑1967 versions). Section 3(3) provides that expressions used in this Act that are also used in the Superannuation Act 1922‑1967 have the same meaning (unless the contrary intention appears). This means terms like “unit of pension”, “contributor”, “Board”, and “pension” are defined by reference to the principal Act. A reader must have the 1922‑1967 Act at hand to understand the full scope of the definitions.

Subsection 3(4) provides that for the purposes of this Act, the annual salary of a pensioner who was paid at a rate other than an annual rate shall be ascertained as prescribed for the purposes of paragraph 22(1)(a) of the Superannuation Act 1922‑1967. This links the salary calculation to the principal Act’s method for converting non‑annual salaries.

The Act also references section 44 of the 1922‑1967 Act, which is disregarded when calculating certain notional pensions for the purpose of pro‑rating the relevant amount. This suggests that section 44 (likely a forfeiture or reduction provision) is excluded from the hypothetical, ensuring that the pensioner’s own history of reduction is not further penalised in the notional pension.

The Act does not interact with the Income Tax Assessment Act 1936 (or later Acts) directly, but pension increases would be assessable income unless specifically exempted. The Act does not provide any tax exemption.

The user has not provided the text of any amendments, and the Act as reproduced contains no amendment notes beyond a bare “see Note 1” reference. The “Note 1” likely refers to a table of amendments in the official compilation, but that table is not included. From the text itself, there is no internal evidence of amendment: the Act refers to “this Act” as enacted, with no references to substituted provisions or repealed sections (except that section 5 is absent from the provided text, but that may be an editorial omission). The Act appears to be a standalone piece of legislation that was not part of an amending schedule. Given its subject matter (a one‑off pension increase in 1967), it is almost certainly a spent or largely spent Act. It would be unusual for the Commonwealth to amend a targeted increase Act decades later; typically, such Acts are left on the statute book but have no further operation because the cohort of pensioners has all died. However, it is possible that later pension increase Acts (e.g., 1970s legislation) may have superseded this Act by providing further ad‑hoc increases, but that cannot be confirmed from the source. A practitioner would need to check the current version on the Federal Register of Legislation to see if it has been repealed or amended. The absence of amendment history in the source means this deep dive cannot comment on any changes.

The user has not provided any cases, and the Act itself does not mention any litigation. Given the Act’s age and narrow subject matter, it is unlikely to have generated significant reported case law. However, it is possible that litigation arose over the Treasurer’s determination of notional annual salary, or over the pro‑rating rules, particularly concerning the definition of “actual unit entitlement” for non‑contributing pensioners. Such litigation would likely have been in the High Court of Australia in its original jurisdiction (constitutional matters concerning Commonwealth superannuation). No cases can be named because none are mentioned in the source. A thorough legal analyst would search databases like AustLII for cases citing the Act, but for the purpose of this deep dive, the absence of source‑grounded case law means the litigation history section must note that no cases are identified in the provided material. The Act itself does not create a right of review or appeal, so any litigation would have been under administrative law or under the principal Act’s own dispute resolution provisions. Given the closed class and the passage of over 55 years, any potential litigation would be historical and unlikely to be relevant to current practice.

Several features of the Act create traps for the unwary. First, the definition of “actual unit entitlement” is counter‑intuitive: for most pensioners it is the greater of actual unit contribution and the scale‑applicable number, but for non‑contributing pensioners it is the lesser of two numbers (the scale‑applicable number and four units). This means a non‑contributing pensioner who had a high salary could be capped at four units, severely limiting the potential increase. Conversely, a low‑salary non‑contributing pensioner might have a higher actual unit entitlement based on the scale, but then the notional annual salary is also capped at the lower of actual salary and the minimum for four units, so both sides of the equation are compressed.

Second, the off‑set provision in subsection 4(2) means that pensioners who received increases under the 1957, 1961, and 1963 Acts may get no additional benefit from the 1967 Act. The sum of those earlier increases is deducted from the gross increase. This is not immediately obvious from the face of section 4(1) alone. A pensioner expecting a windfall could be disappointed if the earlier increases already exhausted the formula amount.

Third, the pro‑rating of the relevant amount under paragraphs (b) to (e) of the definition is highly nuanced. For example, a pensioner who had elected not to contribute for certain units (section 52 cases) gets a relevant amount that is proportionally reduced. The reduction factor uses the ratio of actual unit contribution to the difference between the scale maximum and the units the pensioner omitted. This can produce a very small relevant amount, making the increase trivial even if the additional unit entitlement is large.

Fourth, the Treasurer’s determination of notional annual salary is a key variable that is not defined with precision. “Having regard to general increases in the rates of salaries of contributors” leaves room for interpretation. A pensioner cannot be certain what salary the Treasurer will deem as corresponding, and the Act provides no appeal mechanism. This discretion could be used to minimise the increase by adopting a conservative view of salary growth.

Fifth, the exclusions in subsection 4(4) are broad. Pensions under sections 53 and 58 of the 1922 Act are excluded entirely, even if the pensioner would otherwise meet the definition. Section 57 pensions are excluded unless contributions were made to a State Fund as defined in section 101 of the 1922‑1967 Act. The meaning of “State Fund” is not reproduced, requiring cross‑reference to the principal Act.

Sixth, the Act’s application to widows depends on the husband’s election regarding section 26 of the 1922‑1959 Act. If the husband made that election, the widow gets only one‑half instead of five‑eighths. A widow who is unaware of her husband’s election may overestimate her entitlement.

Seventh, the Act does not provide for indexation or further adjustments. The increase is a one‑off, and the pension thereafter remains fixed at the new amount (unless later legislation provides further increases). Pensioners cannot assume that future salary increases in the broader economy will be reflected.

Eighth, the definition of “the relevant time” creates a dichotomy: for those who retired before 12 June 1947 and were not non‑contributing pensioners, the relevant time is the earlier of when they stopped paying contributions or attained the maximum age for retirement. For all others, it is the time immediately before retirement. This means a pensioner who retired before 1947 but continued contributing until a later age could have a different basis for calculating the notional salary.

Compliance under this Act is entirely the responsibility of the Commonwealth Superannuation Board (or its successor, the Commonwealth Superannuation Corporation) and the Treasurer. Pensioners have no active compliance obligations; they must simply provide any information requested to verify their contribution history and retirement date, but the Act does not impose a duty to do so. The Board, however, must implement the increases correctly to avoid underpayment or overpayment.

The compliance steps for the administrator are as follows: (1) Identify all persons who were receiving a pension as a former contributor immediately before the commencing date (the date of Royal Assent) and whose pension commenced before 30 June 1967, plus any non‑contributing pensioners (under section 9 or 14 of the Superannuation Act (No. 2) 1956) and any widows of deceased pensioners or deceased employees who would have qualified. (2) For each eligible pensioner, determine the actual unit contribution (units for which pension was payable immediately before the commencing date) and the actual unit entitlement using the appropriate subparagraphs (a) to (d) of the definition, taking care with the “greater of” and “lesser of” rules and the relevant retirement dates. (3) Determine the relevant time for each pensioner: generally the time immediately before retirement, but for those who retired before 12 June 1947 (and are not non‑contributing pensioners), the earlier of cessation of contributions or attaining the maximum retirement age. (4) The Treasurer must then determine the notional annual salary for each eligible pensioner, having regard to general increases in salaries of contributors between the relevant time and 30 June 1967, and ensure it corresponds to the salary that would have been paid at 30 June 1967 for a position comparable to the pensioner’s pre‑retirement position. For non‑contributing pensioners, the notional salary is capped at the lower of the actual pre‑retirement salary and the minimum annual salary for four units under the 1922 Act. (5) Calculate the adjusted unit entitlement using that notional salary and subsection 20(2) of the Superannuation Act 1922‑1967 as at 30 June 1967. (6) Subtract the actual unit entitlement to get the additional unit entitlement (if any). (7) Determine the relevant amount applicable under paragraphs (a) to (e) of the definition, applying any pro‑rating for short contribution histories, omitted units, reduced pensions, or deferred contributions. (8) Multiply the additional unit entitlement by the relevant amount to get the gross increase in annual pension. (9) Subtract the sum of any previous increases under the 1957, 1961, and 1963 Acts to arrive at the net increase (if negative, no increase is payable). (10) For widows, calculate the husband’s hypothetical increase as above, then apply the appropriate fraction (one‑half if the husband had a section 26 election that stood; five‑eighths otherwise). (11) Commence payment of the increase from the first fortnightly payment after the commencing date, including the increase in the regular pension payment under section 6. (12) Maintain records of all calculations, Treasurer’s determinations, and payment history to defend against any future challenges.

Given the age of the Act, most of these steps would have been performed in 1967 and are now purely historical. For a modern auditor or historian, compliance would involve verifying that the Board correctly applied the formulas and that the Treasurer’s determinations were reasonable. Any discrepancies could have financial implications for pensioners still alive (very few, if any, would be alive today, but widows could potentially still be receiving a pension if they were young at the time). The Act does not contain a statute of limitations for recovery of underpayments, so theoretical liability could persist.
