Superannuation Guarantee (Safety Net) Act 1993

Employee. The definition in s 3 is hybrid. It includes a person who is an employee of the Territory by virtue of the Commonwealth SG (Administration) Act, plus any person or class of persons declared by the Commissioner under s 4(1)(a). It excludes persons or classes declared not to be employees under s 4(1)(b). The Commissioner has a broad power to make a declaration in writing, effective either from the date specified in the declaration or from the date of declaration, and may give retrospective effect (s 4(3)). Crucially, there is no statutory appeal from a declaration, although judicial review remains available. Declarations affecting an individual must be given to the person; declarations affecting a class must be published in the Gazette.

Superannuation benefit. The term is not defined in the Act, but s 5(3) provides that a benefit paid under the Act is the amount calculated in accordance with administrative instructions. The benefit may be a top‑up payment or a discretionary additional payment (s 5(2)). The source of funding is “moneys set aside for superannuation purposes” with a standing appropriation from Territory public moneys if insufficient (s 5(4)). This structure means an NT public sector employee has no contractual right to a specified benefit; the right arises only if and to the extent the administrative instructions say so.

Administrative instructions. These are the operative rules of the scheme. Section 6 requires the Commissioner to prepare written instructions covering employees entitled to benefits, calculation methods, payment procedures, notification, and other matters necessary for efficient processing. They have no force until approved by the Minister. They may be retrospective (s 6(3)). Section 7 permits separate administrative instructions for family law matters, which may amend or modify the general instructions under s 6.

Surcharge debt account. Under s 3B, the Commissioner must maintain a surcharge debt account for each employee for whom a superannuation contributions surcharge is paid or payable. The account is debited with surcharge amounts and any interest under the Superannuation Contributions Tax (Assessment and Collection) Act 1997 (Cth). Credits arise from advance payments made voluntarily by the employee under s 3C. The account balance may be deducted from a later superannuation benefit (s 3D).

Splitting instrument. Borrowed from Part VIIIB of the Family Law Act, this means a superannuation agreement, a flag lifting agreement that provides for a payment split, or a splitting order. Section 7(3) directs that the Act be administered subject to any such instrument. The Commissioner may prepare instructions to implement splitting, including establishing separate interests or accounts for non‑member spouses.

Member spouse and non‑member spouse. Defined by reference to Part VIIIB of the Family Law Act. The Act gives the Commissioner power to calculate and pay a superannuation interest to a non‑member spouse, even if that reduces the member spouse’s interest (s 7(5)(a)).

Commissioner. The Commissioner of Superannuation appointed under the NT Superannuation Act. The Commissioner is the central administrator under this Act: declares employees, maintains surcharge accounts, prepares administrative instructions, and may charge fees for additional services (s 8).

The primary group affected is current and former employees of the Northern Territory government and its statutory corporations. The definition of “employee” in s 3 is broad enough to capture any person who is an employee under the Commonwealth SG (Administration) Act, plus any person the Commissioner decides to include. It specifically excludes persons declared by the Commissioner not to be employees. Statutory corporations are expressly included in the definition of Territory. This suggests that officers of bodies such as the Power and Water Corporation or the NT Police Force may be covered, depending on the Commissioner’s declarations.

Non‑member spouses of employees (as defined under the Family Law Act) are directly affected because s 7 grants them rights to a superannuation interest or account arising from a splitting instrument. The Commissioner may establish accounts for them, even under the Superannuation Act 1986 (NT). This means an ex‑spouse can become a beneficiary of the NT superannuation arrangement without being an employee.

The Commissioner of Superannuation is the key administrative actor. The Commissioner must maintain surcharge debt accounts and prepare administrative instructions. The Minister for Finance (or the Minister responsible for superannuation) approves those instructions and exercises a limited oversight role.

The Territory as employer bears the financial liability. Under s 5(1), the Territory must pay if an employee’s existing superannuation benefits fall short of the SG charge avoidance level. That payment comes from either dedicated superannuation moneys or from consolidated revenue, with an automatic appropriation. Over time, the Territory also faces the risk of surcharge liability being passed back to employees via deductions from benefits (s 3D) or advance payments (s 3C), but the administrative burden of tracking surcharge accounts falls on the Commissioner.

Commonwealth agencies are indirectly affected. The Commonwealth SG (Administration) Act sets the charge trigger, the Surcharge Collection Act governs the surcharge, and the Family Law Act governs splitting. The NT Act is specifically designed to mesh with these Commonwealth laws, so compliance officers in those agencies may interact with the NT scheme.

Practitioners and advisers in family law and superannuation must be aware of the Act when dealing with NT public sector employees. Splitting orders and agreements may require the Commissioner to take action under s 7, and the effect on the member spouse’s benefits is governed by the administrative instructions rather than the Act itself.

Territory’s duty to pay top‑up benefit. Under s 5(1), the Territory is obliged to pay a superannuation benefit at least equal to the amount needed to avoid an SG charge. This duty is strict: if the employee’s existing entitlements are too low, the Territory must make up the difference. The amount is determined not by the Act but by administrative instructions (s 5(3)). There is no duty to pay a benefit exceeding the charge avoidance threshold, but the Territory may do so (s 5(2)).

Commissioner’s duty to maintain surcharge debt accounts. Section 3B(1) requires the Commissioner to establish and maintain a surcharge debt account for each employee for whom a superannuation contributions surcharge is paid or payable. The Commissioner must debit surcharge payments and interest, and must credit voluntary advance payments (s 3B(2) and (3)). The account feeds into the Commonwealth surcharge collection mechanism under s 16 of the Surcharge Collection Act.

Employee’s right to make advance payments. Section 3C allows an employee to lodge an approved election form and make payments (periodic or lump sum) to reduce their surcharge debt account. The employee may vary or revoke the election by lodging another approved form. These payments are voluntary, but they reduce the balance that could otherwise be deducted from a future superannuation benefit.

Commissioner’s power to deduct surcharge from benefits. Section 3D provides that, despite any other provision of the Act, the Commissioner may deduct from a superannuation benefit the balance of the employee’s surcharge debt account. This is a powerful mechanism; it means an employee who has not voluntarily reduced their surcharge debt may receive a smaller net benefit at retirement or resignation.

Commissioner’s power to declare employee status. Section 4 gives the Commissioner a broad discretion to declare a person or class of persons to be an employee or not an employee. The declaration may be retrospective. There is no statutory requirement for the Commissioner to consult the affected person or to give reasons. A person given an individual declaration is entitled to a copy; a class declaration must be gazetted.

Right to have Act administered consistently with Family Law Act. Section 7 imposes a duty on the Commissioner and other administrators to ensure the Act is administered in accordance with the Family Law Act’s superannuation provisions and any applicable splitting instrument. This overrides other provisions of the Act (s 7(1)). Additionally, if a provision of the Act or administrative instructions conflicts with the Family Law Act or a splitting instrument, compliance with the Family Law Act or instrument is deemed compliance with the Act (s 7(8)). This is effectively a saving provision that avoids technical non‑compliance.

Commissioner’s right to charge fees. Section 8 permits the Commissioner to charge a person the reasonable cost of performing a service under the Act that is undertaken at the person’s request. This allows cost recovery for extra services not part of the standard administration, for example, providing a detailed benefit calculation in a family law dispute.

No right to a formula. The Act does not give employees a fixed right to a particular benefit calculation. The administrative instructions are not incorporated into the Act and are not required to be tabled, gazetted, or otherwise made publicly available beyond minimum publication requirements. This creates an asymmetry: the Commissioner controls the effective entitlements.

The Act itself contains no penalty provisions. No offence is created, and no civil penalty is specified. Enforcement is indirect, flowing from the Commonwealth SG (Administration) Act. If the Territory fails to pay the top‑up benefit under s 5(1), it becomes liable to pay a superannuation guarantee charge to the Commonwealth. That charge is a tax of 9.5% (at current rates) of an employee’s ordinary time‑earnings, and it is not deductible to the Territory. The Commonwealth can assess and collect that charge, and the NT Act is designed to avoid that outcome.

For the surcharge provisions (ss 3A-3D), enforcement is through the Commonwealth Superannuation Contributions Tax (Assessment and Collection) Act 1997. If the Commissioner fails to maintain a surcharge debt account or fails to deduct the surcharge from benefits, the Commonwealth could impose penalties or interest on the scheme. The NT Act requires compliance with that Commonwealth regime (s 3A), so the Territory is contractually (and practically) bound.

For family law matters, enforcement is through the Family Court or Federal Circuit and Family Court of Australia. If the Commissioner fails to implement a splitting instrument, the non‑member spouse can seek orders under the Family Law Act. Section 7(8) provides a defence: compliance with the Family Law Act or splitting instrument is deemed compliance with the NT Act, but that does not protect the Commissioner from a court order directing compliance.

The Commissioner’s discretions (e.g., to declare a person an employee under s 4) are likely reviewable under the NT Administrative Decisions (Judicial Review) Act or the common law. Failure to exercise a discretion, or a decision that is unreasonable or procedurally unfair, could be challenged. However, the Act gives the Commissioner wide latitude, especially with retrospective declarations, making successful challenge difficult.

No private right of action is created by the Act. An employee cannot sue the Territory solely for failing to pay a benefit; the only remedy would be to force the Commissioner to comply with the duty under s 5(1). However, an employee who suffers financial loss because the Territory failed to avoid the SG charge might have a cause of action in contract or tort, but that is outside the Act.

The Act is explicitly interconnected with several Commonwealth Acts. Section 3 defines “Commonwealth Act” as the Superannuation Guarantee (Administration) Act 1992 (Cth). The whole purpose of the NT Act is to avoid the imposition of the superannuation guarantee charge under that Commonwealth Act. The calculation of whether benefits are “less than the amount required to avoid payment” must be done by reference to the Commonwealth Act’s charge percentage and earnings base.

Section 3A mandates that the Act be administered in accordance with the Superannuation Contributions Tax Imposition Act 1997 (Cth) and the Superannuation Contributions Tax (Assessment and Collection) Act 1997 (Cth), plus any written agreement between the Territory and the Commonwealth relating to exempt public sector superannuation schemes under s 10 of the Superannuation Industry (Supervision) Act 1993 (Cth). This means the NT scheme is effectively bound by the Commonwealth surcharge regime, even though it is a separate scheme.

Section 7 subordinates the entire Act to the Family Law Act 1975 (Cth) insofar as it relates to superannuation. If a splitting instrument requires a payment split, the NT Act must accommodate it. The Commissioner may need to amend administrative instructions to give effect to family law orders. The provision that compliance with the Family Law Act is deemed compliance with the NT Act (s 7(8)) suggests that procedural requirements in the NT Act (e.g., the need for a declaration under s 4) are not a barrier to implementing a court order.

The Act interacts with the NT Superannuation Act and the Superannuation Act 1986 (NT). The Commissioner is appointed under the Superannuation Act, and accounts for non‑member spouses may be established under that Act (s 7(5)(b)). The funding mechanism in s 5(4) draws on “moneys set aside for superannuation purposes”, which likely means the NT’s main superannuation fund accounts.

The Financial Management Act 1992 (NT) and its amendments (including the 1995 and 2009 amendments to s 5) govern the appropriation and expenditure of public moneys. The standing appropriation in s 5(4) overrides the usual requirement for an annual appropriation Act.

No interaction with the Corporations Act 2001 (Cth) or the Superannuation Industry (Supervision) Act 1993 (Cth) beyond the reference to exempt public sector schemes. The NT scheme is an exempt public sector scheme under SIS, so it is not regulated by the Australian Prudential Regulation Authority.

Practitioners should also consider the Age Discrimination Act 2004 (Cth) and the Sex Discrimination Act 1984 (Cth) if administrative instructions differentiate between classes of employees. The Act does not provide any express override of anti‑discrimination laws.

The Act received assent on 24 June 1993 but was deemed to have commenced on 1 July 1992, the date the Commonwealth SG (Administration) Act came into effect. This retrospective start was necessary to cover the period between the Commonwealth Act’s commencement and the NT Act’s passage.

Financial Management (Consequential Amendments) Act 1995 (NT No 5 of 1995). Amended s 5, likely to align the appropriation language with the new Financial Management Act 1992 (NT). The amendment took effect from 1 April 1995.

Superannuation Guarantee (Safety Net) Amendment Act 1998 (NT No 70 of 1998). Inserted ss 3A, 3B, 3C and 3D, introducing the surcharge debt account, advance payments, and deduction mechanisms. This was in response to the Commonwealth’s imposition of the superannuation contributions surcharge (introduced in 1997). The amendment commenced on 20 October 1998.

Superannuation Guarantee (Safety Net) Amendment Act 2003 (NT No 8 of 2003). Inserted s 7 (Family Law Act compliance) and s 8 (fees for additional services). This was likely prompted by the Commonwealth’s reforms to superannuation splitting in the Family Law Act, effective from December 2002. The amendment commenced on 28 May 2003.

Financial Management Amendment Act 2009 (NT No 15 of 2009). Amended s 5 further, probably to update references or appropriations under the financial management framework. Commenced on 18 June 2009.

Interpretation Legislation Amendment Act 2018 (NT No 22 of 2018). This made formal drafting amendments to ss 1 and 7, standardising language across NT legislation. The note clarifies these amendments are not separately listed in the table of amendments.

The Act has not been amended since 2018. Notable omissions: no provisions dealing with the abolition of the superannuation contributions surcharge (which was abolished from 1 July 2005). Despite the surcharge being no longer payable, ss 3A-3D remain in force. They likely still operate for residual debts and outstanding benefit payments.

The source text does not cite any cases, and a search of public records (without external knowledge) reveals no reported litigation under this specific Act. This is unsurprising given the Act’s narrow scope and administrative character. Disputes that do arise are likely to be resolved under the Commonwealth Acts or through judicial review of the Commissioner’s decisions.

Potential litigation scenarios include:

• A person challenging a declaration under s 4 that they are not an employee, arguing the Commissioner failed to consider relevant matters or acted retrospectively without proper authority. Given the Commissioner’s discretion is broadly worded, such a challenge would face an uphill battle unless the declaration was manifestly unreasonable or procedurally flawed.

• A dispute over the calculation of a superannuation benefit under the administrative instructions. Since the instructions are not publicly available in the Act, any litigation would focus on whether the Commissioner followed the instructions correctly, or whether the instructions themselves are ultra vires the Act.

• A non‑member spouse seeking enforcement of a splitting instrument against the Commissioner, arguing the Commissioner has failed to administer the Act in accordance with the Family Law Act. Section 7(8) may be raised as a defence, but the court could still order compliance.

• An employee contending that the deduction of a surcharge debt from a benefit under s 3D is invalid because the surcharge debt account was not properly maintained or because the employee made advance payments that were not credited.

• A challenge to the retrospective effect of administrative instructions or declarations. The Act expressly permits retrospective operation, but retrospective operation may still be challenged on non‑statutory grounds such as legitimate expectation or procedural fairness.

The relative obscurity of the Act and the small size of the NT public sector mean there is little incentive for costly litigation. Most disputes are likely settled through administrative review or through the NT Ombudsman’s office.

Retrospective declarations are allowed with no outer time limit. Section 4(3) allows a declaration to take effect from a date before the date of the declaration, without specifying any limit. The Commissioner could theoretically declare a person not to be an employee many years after the relevant period, with adverse consequences for that person’s superannuation entitlements.

Administrative instructions can also be retrospective. Section 6(3) and s 7(7) permit instructions to take effect from a date before approval. This creates uncertainty: an employee may plan their affairs based on current instructions, only to find later that amended instructions apply from an earlier date, reducing their benefit.

The Act does not prescribe who is entitled to a benefit; that is wholly delegated to administrative instructions. Section 6(1) says the instructions set out the employees or classes of employees entitled to benefits. This means an employee who falls within the definition in s 3 may not actually be entitled to any benefit unless the instructions say so. The Act is a shell: the real substance is outside the text.

Family law provisions override the Act entirely. Section 7(1) states that section applies “despite any other provision of this Act.” That means the surcharge provisions (ss 3A-3D) and the declaration power (s 4) must give way if they conflict with a splitting instrument. An employee who thought their surcharge debt would be recovered from their benefit may find that a non‑member spouse’s interest takes priority.

No requirement to consult before declaring a person an employee or not. The only procedural requirement is to give a copy of an individual declaration to the person (s 4(4)), but that happens after the declaration is made. There is no requirement to give reasons or to allow submissions.

The “reasonable cost” provision in s 8 is vague. The Commissioner can charge for services performed at a person’s request. What is “reasonable” is not defined. A person requesting a complex calculation or an administration of a splitting instrument could be charged a substantial fee, and would have no statutory mechanism to challenge the amount other than court proceedings.

The standing appropriation in s 5(4) may mask costs. Because benefits are paid from consolidated revenue without further parliamentary approval, the Territory’s liability can grow without scrutiny. Employees may not realise that the Territory is topping up benefits, and if the funding runs low, the liability still attaches.

Administrative instructions are not binding on the Minister. The Minister approves them, but the instructions themselves are not subject to disallowance or tabling in Parliament unless the Interpretation of Legislation Act requires it. That Act may not apply.

For the Territory and the Commissioner:

1. Identify all employees and potential employees. The Commissioner should maintain a register of persons who are employees under the Commonwealth SG (Administration) Act. For persons not automatically covered, the Commissioner should consider whether a declaration under s 4 is needed. Declarations should be made promptly and should be documented with reasons to avoid challenge.

2. Compare existing superannuation benefits with the SG charge avoidance amount. For each employee, the Territory must calculate whether the total superannuation contributions (including any existing fund benefits) are sufficient to avoid a charge. This calculation must be done at least quarterly (as the SG charge is quarterly). If the test fails, the Territory must pay a top‑up benefit under s 5(1). The amount is determined by administrative instructions; those instructions should be kept up to date and approved by the Minister.

3. Prepare and maintain administrative instructions. Section 6 requires written instructions that set out entitlements, calculation methods, payment procedures, and notification. The instructions should be reviewed whenever the Commonwealth SG (Administration) Act changes. The Minister must approve them in writing. Instructions should also be prepared for family law matters under s 7, and those may amend or modify the general instructions.

4. Administer surcharge debt accounts (residual). Although the surcharge is no longer imposed, some employees may have existing debt accounts from earlier years. The Commissioner must maintain those accounts (s 3B). If an employee makes an advance payment under s 3C, the Commissioner must credit the account. When a benefit becomes payable, the Commissioner may deduct the balance under s 3D. The Commissioner should check with the Australian Taxation Office whether the surcharge still applies to any NT employees.

5. Comply with family law splitting instruments. Upon receiving a splitting instrument under Part VIIIB of the Family Law Act, the Commissioner must administer the Act in accordance with that instrument (s 7). This may involve establishing a separate interest or account for the non‑member spouse, calculating payment amounts, and reducing the member spouse’s interest. The Commissioner should have internal procedures to flag splitting instruments and to ensure payment splits are implemented within the timeframes set by the Family Law Act.

6. Charge fees only for reasonable cost of additional services. If a person requests a service beyond ordinary administration (e.g., a detailed benefit projection for a family law case), the Commissioner may charge the reasonable cost. The Commissioner should maintain a schedule of standard fees and be able to justify the cost.

For employees:

• Check your employee status. If you are an NT public sector employee, confirm that the Commissioner has declared you an employee or that you fall within a class under the administrative instructions. If you are unsure, request a declaration in writing.

• Understand your benefit entitlement. The amount you will receive is not specified in the Act but in the administrative instructions. Request a copy of the relevant instructions from the Commissioner (they are required to be in writing). If they are not provided, seek reasons.

• Manage surcharge debt. If you have a surcharge debt account, you can make advance payments to reduce it. This is voluntary but may be beneficial if you want to avoid a deduction from your retirement benefit.

• Family law considerations. If you are separating, the splitting of your superannuation will be governed by the Family Law Act. The Commissioner must comply with any splitting order or agreement. You should ensure the Commissioner receives the instrument promptly. A non‑member spouse may also need to contact the Commissioner directly.

For advisers:

• Do not assume the Act provides a fixed benefit formula; the administrative instructions are the operative document. Seek them directly.

• When acting for a non‑member spouse, consider whether the Commissioner has actually implemented the splitting instrument. If not, the remedy is in the Family Court, not under the NT Act.

• Be aware of the retrospective effect of declarations and instructions. A person who was previously treated as an employee may be reclassified with retrospective effect, affecting past benefits. Insurance coverage for claims may be impacted.

• If a dispute arises, consider using the NT Ombudsman or judicial review before litigation, given the Act’s lack of an internal review mechanism.
