Superannuation (Government Co-contribution for Low Income Earners) Regulations 2022

The regulations operationalise several central concepts in the Act by converting policy choices into administrative rules:

• Eligible account. The regulations define an “eligible account” for both complying superannuation funds and RSAs. An account is eligible if the Commissioner has not been advised it will not accept Government co‑contributions, it has not commenced paying a pension or annuity, and at least one condition of release for the account is not one of the specified items in Schedule 1 to the Superannuation Industry (Supervision) Regulations 1994 or Schedule 2 to the Retirement Savings Accounts Regulations 1997 (reg 6(1)-(2)). This operational test ties eligibility to three discrete facts: Commissioner notification, pension commencement, and the presence of particular conditions of release as listed in the named schedules.
• Account selection hierarchy. Where a person has multiple eligible accounts and has not nominated one to receive co‑contributions, reg 7 sets a hierarchical selection process. The Commissioner must apply the items in order: (1) legal personal representative if deceased; (2) the person if retired and no longer has an eligible account; (3) nominated eligible account; (4) where multiple accounts exist and no nomination, then select according to whether a single eligible account has already received a co‑contribution this financial year, otherwise select the eligible account to which the person made the greatest amount of eligible personal superannuation contributions, or the account with the greatest amount of concessional contributions in the most recent financial year for which the Commissioner has a statement under s 390‑5 of Schedule 1 to the Taxation Administration Act 1953; failing those, fall back to most recent opened account date, the account with the highest account balance in the most recent statement period, or finally the Commissioner’s discretion (reg 7(1)(4)(b)-(e)). The regulation also provides that the Commissioner must disregard certain accounts when applying some of those criteria (reg 7(4)).
• Reporting cadence and content. The regulations establish three reporting days per year (15 January, 15 April, 15 July) and tie several provider obligations to those dates (reg 5; regs 11-12). They also prescribe statutory reporting content the Commissioner must include in Parliament reports about co‑contributions and low income superannuation tax offsets, including specific income buckets and aggregate totals (regs 13-14).
• Information flow. The instrument prescribes the specific information the Commissioner must provide to recipients when making a payment (reg 9) and the specific content required in overpayment/recovery notices to members and to providers (reg 10). It prescribes the circumstances in which providers must give TFN statements to the Commissioner (reg 12) and the duty to report material changes/omissions (reg 11).
• Payment timing and rounding. The regulations specify that the payment date is 60 days after the Commissioner has sufficient information to make the necessary determinations (reg 8) and prescribe rounding rules , interest amounts always round up to the next dollar where cents exist (reg 15(1)) while other payments/repayments are rounded up to the nearest 5 cents where not a multiple (reg 15(2)).

These concepts convert statutory entitlements into administrable processes: they assign decision rights to the Commissioner (reg 7, reg 8), impose procedural duties on superannuation providers (regs 11-12), and create a framework for payments, recoveries and parliamentary transparency (regs 9-14).

The regulations create obligations and decision points that affect a focused set of participants in the superannuation system:

• The Commissioner of Taxation. The Commissioner is the central decision‑maker charged with determining account destination for co‑contributions and underpaid amounts (reg 7), determining payment dates once “sufficient information” is held (reg 8), giving prescribed information to recipients and trustees/providers on payment (reg 9), issuing prescribed notices for recovery of overpayments (reg 10), and preparing prescribed parliamentary reports (regs 13-14). The Commissioner’s role includes exercising discretion where the regulation’s tie‑break rules leave an account unresolved (reg 7(1)(4)(e)).
• Superannuation providers (trustees and RSA providers). Providers face direct procedural duties: they must tell the Commissioner if an account will not accept co‑contributions (implied by the definition of eligible account in reg 6), notify the Commissioner of material changes or omissions to previously given information and comply with the timing tied to reporting days (reg 11). Providers must also provide TFN statements to the Commissioner when a member later quotes a TFN and the Commissioner does not already hold it (reg 12). Providers receive required information from the Commissioner when a payment is made (reg 9(2)), and they receive prescribed notices when a recovery is proposed (reg 10(2)).
• Members (contributors and potential beneficiaries). Individual members are affected in several ways. Only accounts meeting the eligible account test can receive co‑contributions (reg 6). Members can nominate an eligible account to receive the payment; such nomination remains effective until replaced or the account stops accepting co‑contributions or ceases to be eligible (reg 7(2)). Where a person is deceased, retired, has no eligible account, or has multiple eligible accounts, reg 7 sets out where the payment is directed; in some circumstances the person themselves may receive payment if retired and without eligible accounts (reg 7(1) item 2).
• Legal personal representatives. Where the Commissioner is satisfied the person is deceased, the regulation requires payment to the person’s legal personal representative (reg 7(1) item 1). Notices for proposed recovery to persons or their legal personal representatives must include prescribed particulars (reg 10(1)).
• Parliament and public transparency users. The Commissioner must include specified aggregated information about beneficiaries, amounts paid and amounts recovered in Parliamentary reports (regs 13-14). The regulations prescribe the ranges of total income and taxable income that must be used in those reports (regs 13(3) and 13(4); reg 14(2)(d)).

Who pays: payments of co‑contributions and underpaid amounts are made by the Commissioner under the Act, with the regulations specifying timing and destination (regs 7-9). Who decides: the Commissioner holds the initial selection power and timing power, while providers are required to supply information and to update the Commissioner about changes.

The regulations create discrete duties for the Commissioner and superannuation providers and preserve certain rights for members. Key duties include:

• Commissioner duties

  • Account destination determinations: the Commissioner must determine where a Government co‑contribution or underpaid amount is to be paid according to the hierarchical table in reg 7(1). The rules include prioritisation (deceased, retired with no eligible account, nominated account, and detailed tie‑break rules for multiple accounts) and require the Commissioner to disregard certain accounts under reg 7(4).
  • Payment timing: the Commissioner must treat the payment date for co‑contributions as the day 60 days after the Commissioner has sufficient information to determine, under s 13(1) of the Act, that the amount is payable; similarly for underpaid amounts, payment date is 60 days after the Commissioner has sufficient information to determine how the amount is to be paid and to make related determinations (reg 8).
  • Information provision: where a co‑contribution is paid to a person or legal representative, the Commissioner must give specific information (amount, income year, amount of relevant contributions, right to apply for review under s 49) (reg 9(1)). Where payment is made to a trustee or provider, the Commissioner must give prescribed details about both the trustee/provider and the person plus the payment amount (reg 9(2)).
  • Notice content for recovery: the Commissioner must include prescribed particulars in notices proposing recovery from persons or providers and in deduction/debit notices (reg 10).
  • Parliamentary reporting: the Commissioner must include the details prescribed in regs 13-14 in reports to Parliament (regs 13-14).

• Superannuation provider duties

  • Notify material changes or omissions in information previously given to the Commissioner (reg 11(1)), with timing rules linked to reporting days (reg 11(2)). This duty is prospective and recurrent: providers must monitor for material changes and omissions and update the Commissioner promptly relative to reporting days.
  • Give a TFN statement to the Commissioner if they have given information in connection with the Act, the member did not quote a TFN at that time, the Commissioner does not have the TFN, and the member later quotes the TFN. Timing is governed by the reporting day rules (reg 12).
  • Comply with Commissioner-provided payment information, and respond to recovery notices, using the prescribed notice content (regs 9-10).

• Member rights

  • Right to nominate an eligible account for receipt of co‑contributions, and that nomination remains effective until changed or until the nominated account ceases to accept co‑contributions or is no longer eligible (reg 7(2)).
  • Right to apply for a review under s 49 of the Act; the Commissioner must advise recipients of that right in payment and recovery notices (regs 9(1)(d), 10(1)(f), 10(3)(h)).

Notably, the regulations give the Commissioner clear procedural duties on content and timing but also vest the Commissioner with decision rights where the selection rules do not resolve to a single eligible account (reg 7(1)(4)(e)). Providers face recurrent reporting obligations keyed to fixed reporting days (reg 5; regs 11-12). The regulations do not create new criminal offences or pecuniary penalties; enforcement mechanisms are framed through statutory recovery and review processes referenced to the Act (see regs 9 and 10 that reference review rights under s 49 and reg 10 that tailors notices used for recovery under s 24 of the Act).

This instrument prescribes administrative mechanisms to notify, recover and report amounts under the Act; it does not itself create new civil penalties or criminal offences. Enforcement is effected through the Act’s recovery and review framework, with the regulations detailing operational steps:

• Recovery mechanisms. The regulations prescribe the content of notices used for recovery of overpayments. A notice of proposed recovery to a person or the person’s legal personal representative must include the person’s name and TFN, the co‑contribution amount, the amount to be recovered, the payment due date, the right to apply for review under s 49 and the reason for the overpayment (reg 10(1)). A notice to the superannuation provider must similarly include name, account number, date of birth, TFN (if known), amount to be recovered and due date (reg 10(2)). The regulations also prescribe required content for a notice of deduction or debit (reg 10(3)). These prescriptive content requirements structure the administrative steps the Commissioner must take before exercising recovery powers under s 24 of the Act.
• Administrative review. The regulations repeatedly require the Commissioner to advise recipients of their right to apply for review under section 49 of the Act in both payment notices and recovery notices (regs 9(1)(d), 10(1)(f), 10(3)(h)). That preserves the Act’s internal review mechanism and ensures that prescribed notices are the vehicle by which review rights are communicated.
• Rounding and interest. Reg 15 prescribes rounding rules that affect amounts payable or recoverable. Interest amounts calculated under certain subsections of the Act must be rounded up to the next dollar where cents exist (reg 15(1)), and other payments/repayments must be increased to the nearest multiple of 5 cents where not already such a multiple (reg 15(2)). These rules effectively adjust small monetary figures in favour of rounding up, and will be applied when computing amounts that the Commissioner pays or recovers.
• No express penalties in the regulations. The instrument does not attach civil penalty provisions to the information duties imposed on providers (reg 11) nor specify sanctions for non‑compliance. Non‑compliance consequences, where relevant, would therefore be pursued under the Act or other applicable law (for example, a trustee’s general statutory duties or regulatory obligations), but those legal consequences are not specified or altered by these regulations.
• Delegation of decision rights. The Commissioner is given scope to make determinations under reg 7 and reg 8, and to use discretion if account selection criteria do not produce a single result (reg 7(1)(4)(e)). The regulations therefore concentrate enforcement and allocation power in the Commissioner’s administrative process, mediated by the Act’s review right.

In short, enforcement under these regulations is administrative and procedural: the Commissioner issues prescribed notices and carries out recovery under the Act, using the content and timing specifications set out here. The regulations do not themselves create new monetary penalties or criminal sanctions against providers or members for breaches of the reporting or TFN duties; instead, they prescribe the procedural format and timing the Commissioner must follow when exercising statutory powers.

These regulations operate as subordinate instruments to the Act and interlock with other Commonwealth statutes and regulations in several concrete ways:

• The Act. The regulations are made under the Superannuation (Government Co‑contribution for Low Income Earners) Act 2003 (reg 3). They implement and specify procedures required by the Act, for example by setting the payment date in relation to the Commissioner’s determinations under subsections 13(1) and 19(4) of the Act (reg 8), prescribing notice content connected to section 24 overpayment recovery (reg 10), and prescribing reporting detail required by section 54 and section 12G of the Act (regs 13-14).
• Taxation Administration Act 1953. The selection criteria in reg 7(1)(4)(b) and reg 7(1)(4)(d) refer to the Commissioner’s most recent financial year statements under section 390‑5 in Schedule 1 to the Taxation Administration Act 1953. Reg 7(4) further instructs the Commissioner to disregard certain accounts where those s 390‑5 statements are missing or superseded. Thus the Commissioner’s account selection logic relies on information flows governed by the Taxation Administration Act and the statements it mandates.
• Superannuation Industry (Supervision) Regulations 1994 and Retirement Savings Accounts Regulations 1997. The definition of “condition of release” for an eligible account is linked to schedules in these instruments (reg 5). Reg 6 references specific items in SISR Schedule 1 and RSAs Schedule 2 to exclude certain conditions of release from eligibility (for example death, terminal medical condition, permanent incapacity and temporary incapacity items as listed in reg 6). That means definitions and classification of conditions of release under those superannuation regulations directly influence eligibility here.
• Privacy Act 1988. Reg 12 includes a note that providers must comply with any TFN rules issued by the Privacy Commissioner under section 17 of the Privacy Act 1988. The regulation therefore alerts providers that TFN handling for the purposes of these regulations must also meet privacy law and any Privacy Commissioner guidance or rules.
• Superannuation Holding Accounts Special Account. Where a person does not have an eligible account, reg 7(1) item 5 specifies that a new or existing account in the Superannuation Holding Accounts Special Account is to be used. The operation of that Special Account will be governed by the broader legislative and administrative arrangements for Special Accounts, tying the co‑contribution regime to centralised holding account arrangements.
• Continuity with previous regulations. The instrument expressly repeals the 2004 regulations (Schedule 1) but preserves determinations and nominations made under the old regulations that were in effect immediately before commencement for the purposes of the new reg 7 and relevant transitional matters (reg 16(2)-(3)). It also preserves approved forms previously approved under the Taxation Administration Act where applicable (reg 16(5)). That creates an interoperability path between new and old subordinate instruments.
• Reporting and statistical categories. The regulations prescribe income and taxable income ranges for Parliamentary reports (regs 13(3)-(4), 14(2)(d)); those ranges depend on the Act’s “higher income threshold” (note referring to s 10A of the Act) and Schedule 3 to the A New Tax System (Family Assistance) Act 1999 for the adjusted taxable income definition used in reg 14(3). Thus these regulations connect to family assistance definitions and thresholds for statistical purposes.

Overall, the regulations are tightly integrated with the Act and with other taxation and superannuation instruments, relying on data produced under the Taxation Administration Act, definitions in SISR and RSA regulations, TFN handling rules under the Privacy Act and the Superannuation Holding Accounts Special Account framework.

The instrument provides a concise amendment and commencement record:

• Commencement. The instrument commenced in full on 1 April 2022; reg 2 contains the commencement table specifying that “the whole of this instrument” commenced on that date.
• Repeal of prior instrument. Schedule 1 repeals the entire Superannuation (Government Co‑contribution for Low Income Earners) Regulations 2004 , the new 2022 regulations therefore replace and update the subordinate regulatory framework for the scheme (Schedule 1).
• Transitional continuity. Reg 16 contains transitional provisions enabling certain determinations and nominations made under the old regulations, and forms approved under s 388‑50 in Schedule 1 to the Taxation Administration Act 1953 for use with the old regulations, to continue in effect for the corresponding provisions of the new instrument. Specifically:
  • A determination made under subregulation 5(1) of the old regulations in effect immediately before commencement continues for the purposes of section 7 of the new instrument (reg 16(2)).
  • A nomination made under item 3 of the table in subregulation 5(1) of the old regulations that was in effect immediately before commencement continues in effect for the purposes of item 3 in reg 7(1) (reg 16(3)).
  • Section 10 of the new instrument applies to notices given at or after commencement (reg 16(4)).
  • Approved forms used under the old regulations continue to have effect for corresponding provisions in the new instrument where applicable (reg 16(5)).

There are no further amendments, modification clauses or saving provisions listed beyond reg 16 and Schedule 1. The instrument itself is new subordinate legislation implementing the Act as at April 2022; any subsequent amendments would be recorded in later legislative instruments or notices, but none are contained in the text you provided.

The regulations as printed do not include, cite or record any litigation history. They contain no case law references and do not name any judicial decisions. The instrument is administrative and prescriptive in nature; any legal disputes that arise from its application would be litigated under the underlying Act or related statutory regimes, but the instrument itself does not report or summarise such litigation.

Where litigation could arise, the regulations make certain administrative choices that could be the subject of disputes in practice:

• Commissioner determinations under reg 7. Disagreements may arise about whether the Commissioner correctly applied the hierarchical table in reg 7 when choosing an account to receive a co‑contribution. The regulation prescribes a sequence of tie‑break rules that rely on data (e.g. statements under s 390‑5 of the Taxation Administration Act), so litigation could focus on whether the Commissioner had or correctly interpreted the relevant statements or whether an account should have been disregarded under reg 7(4).
• Timeliness and sufficiency of information under reg 8. The payment date is defined as 60 days after the Commissioner has sufficient information; parties could dispute whether information was sufficient on a particular date, or whether the Commissioner delayed beyond that payment date. The Act’s review mechanism (s 49) which the regulations require be notified to recipients (reg 9(1)(d), reg 10(1)(f)) would be a precursor to administrative review or litigation.
• Recovery notices and natural justice. Reg 10 prescribes the contents of recovery notices. Disputes could arise about adequacy of reasons given for proposed recoveries or whether the prescribed notice content was delivered in compliance with reg 10(1)-(3). The right to review is specifically referenced in those notices.
• Provider obligations under regs 11 and 12. Litigation could challenge whether a provider complied with notification timing relative to reporting days, or whether a provider’s failure to supply TFN statements resulted in unlawful payments or recoveries.

Although the regulations themselves contain no litigation history, they embed review rights under section 49 of the Act and require the Commissioner to notify recipients of that right (regs 9 and 10). Any reported case law arising from disputes under these regulations would therefore be generated after operational use, through administrative review and potential judicial review or appeals under the Act’s dispute resolution pathways. The current instrument text does not list or refer to any such cases.

The regulations contain several specific operational details that can produce unintended consequences or compliance traps if not managed carefully. These are concrete, statutory pitfalls for administrators, trustees and members:

• Eligible account can be narrowly defeated. An account ceases to be “eligible” if it has commenced paying a pension or annuity, if the Commissioner has been told it will not accept co‑contributions, or if none of the account’s conditions of release are outside the enumerated items in SISR Schedule 1 or RSA Schedule 2 (reg 6). Trustees that fail to notify the Commissioner that an account will not accept co‑contributions may still have accounts considered eligible; conversely, a provider’s omission can prevent a member from receiving a co‑contribution. Providers must monitor account status and communicate with the Commissioner where appropriate.
• Nominations persist until changed. A member’s nomination of an eligible account to receive a co‑contribution has continuing effect until the member nominates another account or the account stops accepting co‑contributions or ceases to be eligible (reg 7(2)). Members who assume a nomination is one‑off may find payments are directed to the nominated account in later years unless they actively update the Commissioner.
• Commissioner's hierarchical selection and discretion. Where multiple eligible accounts exist and no nomination, the Commissioner must apply a multi‑step test (reg 7(1) item 4). That test depends on data under the Taxation Administration Act (statements under s 390‑5). If statements are missing or out of date, accounts can be disregarded under reg 7(4), and ultimately the Commissioner can choose an account if earlier tie‑breaks fail (reg 7(1)(4)(e)). This centralises selection power and can leave members dependent on the Commissioner’s data reconciliation and discretion.
• Reporting day timing is crucial. Many provider duties are tied to reporting days (15 January, 15 April, 15 July). Providers must act “before that reporting day” if they become aware of a material change at least 30 days before the next reporting day, or otherwise before the reporting day after the next reporting day (reg 11(2)). Similar timing rules apply for TFN statements under reg 12. Operational processes must align with those dates; failure to meet reporting day windows can mean information is late by a whole reporting cycle.
• TFN handling interacts with privacy rules. Reg 12 notes providers must follow TFN rules issued by the Privacy Commissioner under the Privacy Act 1988. Mishandling TFNs in the rushed window between a member quoting a TFN and a reporting day could expose a provider to privacy or TFN‑use rules.
• Payment date defined by “sufficient information.” Payment date is the day 60 days after the Commissioner has sufficient information to determine entitlement (reg 8). The instrument does not define “sufficient information”; disputes can arise about what constitutes sufficiency. That undefined term gives the Commissioner discretion but also creates potential timing disputes between the Commissioner and recipients.
• Rounding rules favour rounding up. Interest amounts containing cents are rounded up to the next dollar (reg 15(1)), and other payments/repayments are increased to the nearest 5 cents when not a multiple (reg 15(2)). These rules slightly increase payable amounts or required repayments compared with truncation or nearest rounding; administrators should account for this in reconciliations.
• Transitional continuity may mask legacy design choices. Reg 16 preserves determinations and nominations made under the old regulations and approved forms approved under the Taxation Administration Act. Administrators relying on legacy forms or determinations must verify that those legacy choices fit the new regulation’s operational logic (for example, whether an old nomination remains valid under the new “eligible account” tests).
• No express penalty in regs for late updates. Reg 11 imposes a duty on providers to tell the Commissioner of material changes or omissions but does not prescribe sanctions in the instrument. Compliance risk therefore attaches to broader legal duties (e.g. trustee obligations) rather than to a specified civil penalty in the regulation; providers must not assume absence of explicit penalty equals absence of consequence.

These “gotchas” are operational: they stem from how the regulations tie eligibility, notification timing, TFN handling and account selection to specified data sources and reporting days, leaving a number of narrow timing, data and discretion points where errors or delays can materially affect beneficiaries and providers.

This section translates the regulations into a practical compliance checklist for Commissioners, superannuation providers and trustees, and for administrators supporting members.

For superannuation providers and trustees

1. Identify and mark eligible accounts (reg 6).

   • Confirm that accounts do not fall into the disqualifying conditions of release listed in the referenced SISR Schedule 1 or RSA Schedule 2 items (see reg 6(1)(c)-(2)(c)).
   • Record whether an account is accepting Government co‑contributions; if an account will not accept co‑contributions, notify the Commissioner promptly so that the account is not treated as eligible.

2. Maintain accurate, dated records of account opening dates, account balances and contribution histories.

   • Reg 7 requires the Commissioner to use the most recent financial year statements under s 390‑5 of the Taxation Administration Act to determine which account received the greatest amount of eligible personal superannuation contributions or concessional contributions. Providers should ensure these statements are complete and available.

3. Handle nominations and member instructions.

   • When a member nominates an eligible account to receive Government co‑contributions, ensure the nomination is recorded and that the Commissioner is informed if required. Remember nominations remain in effect until changed or until the nominated account ceases to be eligible (reg 7(2)).

4. Observe reporting day deadlines (15 January, 15 April, 15 July) and the 30‑day window (regs 5; 11-12).

   • If you become aware of a material change or omission at least 30 days before the next reporting day, update the Commissioner before that reporting day (reg 11(2)(a)); otherwise update before the reporting day after the next reporting day (reg 11(2)(b)).
   • If a member quotes a TFN and the Commissioner does not have it, provide a TFN statement before the next reporting day if quoted at least 30 days before that reporting day; otherwise provide it before the reporting day after the next reporting day (reg 12(2)).

5. TFN privacy compliance.

   • When transmitting TFN statements to the Commissioner, comply with TFN handling rules and Privacy Commissioner guidance under the Privacy Act 1988 (reg 12 note).

6. Respond to recovery notices promptly.

   • If you receive a notice under reg 10(2), it will state particulars including member name, account number, DOB, TFN (if held), amount and due date. Ensure your systems can respond and, where necessary, liaise with the Commissioner about proposed recoveries.

For the Commissioner (administrative and operational actions)

1. Determine account destinations in accordance with reg 7.

   • Apply the table in reg 7(1) in order, and be prepared to exercise discretion under reg 7(1)(4)(e). Where applying reg 7(b)-(d), use statements under s 390‑5 of the Taxation Administration Act; disregard accounts in the circumstances described in reg 7(4).

2. Define “sufficient information” operationally.

   • For reg 8’s 60‑day payment clock, document threshold criteria for “sufficient information” so that payment dates can be computed consistently and defensibly.

3. Provide prescribed payment and recovery notices.

   • For payments to persons or representatives, include amount, income year, amount of relevant contributions and right to apply for review (reg 9(1)). For payments to trustees/providers, include trustee/provider details, person details and co‑contribution amount (reg 9(2)). For recovery notices, include the prescribed particulars in reg 10.

4. Apply rounding rules consistently.

   • Round interest amounts up to the next dollar where cents exist under reg 15(1); increase payments/repayments to the nearest 5 cents where not already a multiple under reg 15(2).

5. Prepare prescribed Parliamentary reports.

   • Include the quarterly and annual aggregates and the income/taxable income ranges prescribed in regs 13-14. Use the income definitions referenced (including Schedule 3 to the A New Tax System (Family Assistance) Act 1999 for adjusted taxable income as specified in reg 14(3)).

Cross‑cutting operational controls

• Reconciliation and audit trails. Keep detailed audit trails of the data used to apply reg 7 tie‑breaks (statements under s 390‑5, account opening dates, contribution amounts and balances), the dates when the Commissioner had “sufficient information” under reg 8, and the dates notices under reg 9 and reg 10 were sent. These records will support review rights under s 49 and any administrative or judicial review.
• Template notices and forms. Create standardised templates that include the mandatory content items set out in regs 9 and 10, and update any legacy forms carried over from the 2004 regulations in accordance with reg 16(5).
• Policies for “material” changes or omissions. Define what constitutes “material” in reg 11 for the provider’s internal compliance processes, consistent with trustee duties under superannuation law and the ministerial expectations to ensure accurate information flows to the Commissioner.
• Member communications. Inform members that nominations persist until changed, that accounts paying pensions are not eligible, and that TFN quotes should be provided in a timely way to avoid delays in payments (reg 6; reg 7(2); reg 12).
• Training and governance. Train call‑centre, member services and compliance staff on reporting day deadlines, the TFN statement rules, the definition of eligible accounts and the operational meaning of “sufficient information”.

Checklist summary (must‑do items with regulatory citations)

• Review and classify accounts for eligibility (reg 6).
• Record and action member nominations; notify Commissioner if account will not accept co‑contributions (reg 7(2); reg 6).
• Provide TFN statements within reporting day windows when a member later quotes a TFN (reg 12).
• Notify Commissioner of material changes/omissions according to reporting day timing (reg 11).
• Use and retain s 390‑5 statements and account data to support Commissioner selection logic (reg 7(1)(4), reg 7(4)).
• Use standardised templates that contain the prescribed items for payment and recovery notices (regs 9-10).
• Apply rounding rules for interest and payments precisely (reg 15).
• Preserve legacy determinations and forms only where reg 16 permits; check that legacy determinations conform to current eligible account tests (reg 16).

Following these steps aligns operational practice with the regulatory specifications and helps manage timing, data and notice content obligations that are central to compliance under this instrument.
