Superannuation (Distribution of Surplus) Act 1974

Eligible contributor is defined in section 3(1) by three cumulative conditions. The person’s obligation to contribute under Part III of the Superannuation Act 1922 (or as amended) must have come into existence before the end of the relevant period, which is the ten years ending on 30 June 1972. The person must then fall into one of three categories: be a contributor on the date of Royal Assent (11 April 1974); have become a pensioner after the commencement of the relevant period but before Royal Assent; or have died after the commencement of the relevant period but before Royal Assent while a contributor, leaving a widow or eligible children. Importantly, the definition excludes persons in respect of whom deferred benefits had become applicable under section 119W of the Superannuation Act 1922‑1971 on or before 30 June 1972. This exclusion narrows the pool by removing those who had already elected to defer benefits and thus had a different contractual relationship with the Fund.

Eligible pensioner is defined in section 3(1) as a person who, during the relevant period (1 July 1962 to 30 June 1972), was receiving a pension (other than a non‑contributory pension) under a listed set of Acts, or who would have been receiving such a pension but for suspension. The listed Acts are the Superannuation Act 1922 as amended, section 12 of the Superannuation Act 1957, section 27 of the Superannuation Act 1963, section 5 of the Superannuation (Pension Increases) Act 1961, section 5 of the Superannuation (Pension Increases) Act 1967, and section 10 of the Superannuation (Pension Increases) Act 1971. The critical exclusion is non‑contributory pension, defined in section 3(1) as a pension payable under section 57 of the Superannuation Act 1922 (not being one for which contributions were made to a State Fund), section 58 of that Act, or subsections 9(2) or 14(2) of the Superannuation Act (No. 2) 1956. Non‑contributory pensions are excluded entirely from the distribution, consistent with the logic that only those who paid into the surplus should share in it.

Relevant period is the ten years ending on 30 June 1972. This fixed window governs all eligibility. Actuary means the actuary appointed by the Superannuation Board under section 17 of the Superannuation Act 1922‑1971 to investigate the Fund at 30 June 1972, or, if that person dies or is unavailable, another actuary appointed by the Treasurer. This ensures continuity of expertise.

Object of Act (s 4) is stated as making provision for distribution of the exact surplus figure of $70,015,000 and splits it into two fixed amounts. The Act does not provide for any adjustment if the actual surplus later turned out to be different; it legislatively adopts the actuarial figure as final. The distribution is expressly “out of the Fund”, meaning no new money is appropriated from consolidated revenue; the surplus already resides in the Fund.

Assignment and attachment (s 7) incorporates the protections of the principal Superannuation Act, meaning the amounts payable cannot be assigned, attached, or taken by legal process. This protects the payments from creditors, which reduces the practical utility of the entitlement for debtors but ensures the payment reaches the intended beneficiary or their widow.

The primary affected persons are eligible contributors and eligible pensioners as defined, comprising several thousand federal public servants and their dependants who were members of the Commonwealth Superannuation Scheme during the decade to June 1972. Eligible contributors include persons who had contributed before 30 June 1972 and were still contributing at Royal Assent (11 April 1974), or who had retired on pension after 30 June 1972 but before Royal Assent, or who had died in that window leaving a widow or children. Persons who had taken deferred benefits before 30 June 1972 are excluded from the contributor pool but may be eligible pensioners under subsection 3(2) if the deferred benefits were applicable at 30 June 1972 but not yet payable. This subclass of deferred benefit holders who had not yet started receiving payments is deemed eligible pensioners for the purpose of the distribution. Eligible pensioners are those who received a pension during the 1962‑1972 period under one of the enumerated Acts, provided the pension involved contributions (non‑contributory pensions are excluded). This means the Act largely benefits those who had paid into the Fund and were still in the system or receiving a contributory pension.

The Act also directly imposes duties on the Superannuation Board, the Treasurer, and the actuary. The Board must calculate accrued interest, allocate amounts, and make payments. The Treasurer must set distribution dates, determine the accrual amounts (after receiving Board advice), and approve the allocation method (after receiving actuary advice). The actuary must give advice that ensures a fair and reasonable allocation. These administrative actors bear compliance costs: the Board must gather records to identify eligible persons, calculate individual shares, and ensure timely payment. The Treasurer must exercise discretion in setting dates and approving methodologies, which introduces some implementation risk if the dates are set too early or too late relative to administrative capacity.

Widows and children are secondary beneficiaries: if an eligible person dies before payment, the widow receives the full amount. If there is no widow, the Board has discretion to determine who receives the amount (s 6(2)). This discretion is broad but presumably would be exercised in favour of dependants or the estate. The Board’s discretion is not fettered by statutory criteria, which creates uncertainty for potential claimants and may invite dispute.

Tax implications are not addressed in the Act. The distribution is a one‑off payment out of a superannuation fund. Whether it is treated as assessable income or a capital return depends on other tax legislation. The Act does not exempt the payment from income tax, which could reduce the net benefit to recipients. The lack of tax treatment in the Act shifts that question to the general law, possibly reducing the real value of the distribution for many recipients.

Treasurer’s duties: Section 5(1) requires the Treasurer to publish a Gazette notice fixing separate distribution dates for the contributor pool and the pensioner pool. These dates are entirely at the Treasurer’s discretion, subject only to the requirement that they be fixed before the Board can proceed. The Treasurer must also determine, after receiving advice from the Board, the amount of interest that has accrued to the Fund between 1 July 1972 and the distribution date by reason of retention of the surplus (s 5(2)(a)(ii) and (3)(a)(ii)). This involves a judgment about the Fund’s investment earnings rate over that period. The Treasurer also determines the allocation method after receiving advice from the actuary (s 5(2)(b) and (3)(b)). The actuary must advise on a fair and reasonable basis (s 5(4)), so the Treasurer’s determination is constrained by that advice. If the Treasurer disregards the advice, the allocation might be challenged for being contrary to the Act’s object although the Act does not expressly require the Treasurer to follow the advice.

Board’s duties: The Board must ascertain the relevant amount for each pool (base amount plus accrued interest as determined by the Treasurer) and then allocate the nearest practicable amount among eligible persons in the manner determined by the Treasurer. The Board must then pay the allocated amounts out of the Fund (s 6(1)). If an eligible person dies before payment, the Board must pay the widow if alive; if no widow, the Board determines who receives the amount (s 6(2)). The Board’s determination in that case is not subject to any statutory criteria, giving it broad discretion. The Board must act as soon as practicable after the Treasurer fixes the distribution dates.

Actuary’s duties: The actuary must advise the Treasurer on the allocation method. That advice must have regard to actuarial principles and practice and must take into account all matters relevant to ensure a fair and reasonable basis (s 5(4)). The actuary is not required to approve the final method, only to advise. The responsibility for the final method rests with the Treasurer.

Rights of individuals: Eligible contributors and eligible pensioners have a right to receive the amount allocated to them upon allocation (s 6(1)). They cannot assign or have the amount attached (s 7). If they die before payment, the right passes to the widow or to a person determined by the Board. There is no statutory appeal mechanism for disputes about eligibility or allocation amounts, which means an affected person would need to rely on general administrative law remedies such as judicial review for jurisdictional error. The Act does not create a private right of action.

The Act contains no penalty provisions. No criminal offences are created. There are no civil penalties for failure to comply with the Act’s requirements. The only enforcement mechanism is the duty imposed on the Treasurer, the Board, and the actuary to perform their functions. If the Treasurer fails to fix a distribution date in a timely manner or the Board fails to allocate and pay, the remedy would lie in administrative law: an eligible person could seek an order compelling performance, such as a writ of mandamus. However, the Act does not specify a time limit for the Treasurer to act. The phrase “as soon as practicable” appears in sections 5(2), (3) and 6(1) but is vague and gives considerable latitude. Delay could be challenged only if it were unreasonable in a legal sense. Similarly, the actuary’s duty to advise is not backed by a sanction for giving inadequate advice. The absence of penalties reduces the cost of non‑compliance for the administrators but also reduces the certainty for beneficiaries that the distribution will occur promptly. The only statutory protection for beneficiaries is the anti‑assignment provision (s 7), which prevents creditors from seizing the payment before it is made. That provision is enforced by the courts if a creditor attempts to attach the moneys. The Act itself does not create a complaints mechanism or oversight body. The Auditor‑General might audit the Board’s actions, but that is a general constitutional mechanism, not specific to this Act.

The Act explicitly incorporates provisions of the Superannuation Act 1922‑1973. Section 3(3) provides that expressions used in this Act that are also used in the 1922‑1973 Act have the same meaning unless a contrary intention appears. This ensures consistency of interpretation between the two regimes. The eligibility definitions in section 3 reference numerous other Acts: the Superannuation Act 1922 and its amendments, the Superannuation Act 1957, the Superannuation Act 1963, the Superannuation (Pension Increases) Act 1961, 1967 and 1971. The distribution is to be paid out of the Fund, which is the same Fund established under the principal Superannuation Act. Section 7 directly applies sections 143 and 143A of the Superannuation Act 1922‑1973 to moneys payable under Part III of that Act (the distribution payments) as if they were a benefit under that Act. Section 143 and 143A are the standard provisions restricting assignment and attachment of superannuation benefits. This means the distribution cannot be sold, assigned, or reached by creditors, including by bankruptcy trustees or family court orders. This interaction provides strong asset protection for recipients, but also means that recipients cannot voluntarily assign their entitlement to a third party, for example as security for a loan. The Act does not interact with the Social Security Act; the distribution is a one‑off capital payment that could affect means‑tested benefits under other legislation, but the Act is silent on that point. There is no interaction with the Income Tax Assessment Act mentioned; the tax treatment of the distribution is left to general principles. If the payment is considered a superannuation lump sum, it might be taxed under the rules in force at the time. The Act also interacts with the Financial Management and Accountability Act (or its predecessor) only indirectly, since the payment is from the Fund rather than from consolidated revenue. The Act does not amend or repeal any other legislation; it stands alone as a specific distribution law. Its interaction with later superannuation legislation is limited, as the 1922 Act has since been replaced by the Superannuation Act 1976 and later schemes. However, the Act remains in force until its purpose is spent.

The text provided shows the Act as originally enacted, No. 15 of 1974, assented to 11 April 1974. The document does not include any amendment notes, so it is not possible to state definitively from this source whether the Act has been amended. As a one‑off distribution Act, it is likely that the Act was spent once the distributions were completed. The Act may have been amended to extend the timetable or to update references to superseded superannuation legislation, but no such amendments appear in the source. The Act is still listed on the Federal Register of Legislation as a current Act, but its operative provisions have likely been fully performed. Amendment history would be found in the Federal Register of Legislation; the source provided is the original enactment only. The Act does not contain a sunset clause or repeal provision. If the distribution has been completed, the Act is effectively redundant but technically remains on the statute book. This legal uncertainty could be relevant if further surplus distributions were attempted under similar provisions in later years; the Act would not provide a precedent because its terms are specific to the 1972 surplus.

The text does not mention any litigation. There is no case law cited or incorporated. Given the narrow scope of the Act and the fact that it provides for a beneficial distribution with no penalty provisions, litigation is unlikely but not impossible. Potential disputes could have arisen over: (1) eligibility - whether a person met the definition of eligible contributor or eligible pensioner, particularly the exclusion for deferred benefits or the definition of non‑contributory pension; (2) the actuary’s allocation method - whether it was fair and reasonable as required by s 5(4); (3) the Board’s discretionary determination under s 6(2)(b) regarding who receives payment when there is no widow; (4) the Treasurer’s determination of accruals - whether the amount was correctly calculated. Any such litigation would likely have been in the original jurisdiction of the Federal Court or the High Court under administrative law. The absence of reported cases suggests either that the distributions proceeded without dispute or that disputes were resolved administratively. The lack of litigation history also means there is no judicial guidance on the interpretation of key terms like “fair and reasonable basis” or the scope of the Board’s discretion. This gap means that anyone advising on similar provisions in other contexts would have to rely on ordinary administrative law principles.

1. Narrow eligibility windows: The definition of eligible contributor excludes anyone who had deferred benefits applicable on or before 30 June 1972. A person who elected to defer benefits before that date but who later resumed contributions or retired after Royal Assent is still excluded. That exclusion is arbitrary and could catch persons who were still economically contributing to the surplus. Conversely, subsection 3(2) deems certain deferred benefit holders to be eligible pensioners, but only if the deferred benefits had not yet become payable by 30 June 1972. There is a cliff edge: if the deferred benefits became payable exactly on 30 June 1972, the person is neither an eligible contributor (explicitly excluded) nor an eligible pensioner under subsection 3(2) (because they were payable on that date, not merely applicable). This creates a potential gap where a person may receive nothing.

2. Fixed surplus amounts: The Act legislatively fixes the surplus at $70,015,000 and splits it into two non‑adjustable pools. If the actual surplus at 30 June 1972 was later found to be different due to an error in the actuarial report cited in section 4, the Act does not allow for correction. The Treasurer and Board must distribute exactly those amounts plus accrued interest. This rigidity could lead to a situation where the Fund is over‑distributed or under‑distributed relative to the true surplus, but that risk is borne by the Fund rather than by recipients.

3. Accrued interest determination: The Treasurer determines the amount of interest accrued from 1 July 1972 to the distribution date “after receiving advice from the Board” (s 5(2)(a)(ii) and (3)(a)(ii)). The Act does not specify a benchmark rate. If the Treasurer chooses a rate lower than the Fund’s actual earnings, recipients receive less than the true opportunity cost of retaining the surplus. The actuary does not advise on this accrual; only the Board advises. There is a gap in the safeguards that applies to the allocation method.

4. Board’s discretion on death of payee: If an eligible contributor or pensioner dies before payment and there is no widow, the Board has unfettered discretion to determine who receives the amount (s 6(2)(b)). The Act does not require the Board to prefer dependants, the estate, or any particular class. This could lead to arbitrary outcomes. For example, if the deceased had a de facto partner who is not a legal widow, the Board could choose to pay the partner or could pay a distant relative. No criteria for the Board’s decision are stated.

5. No statutory appeal mechanism: An eligible person who disputes their allocation amount or who is excluded by the Board’s determination under s 6(2)(b) has no statutory right to challenge that decision. The only remedy is judicial review, which is limited to errors of law, not merits. This raises the cost of disputing an error.

6. Anti‑assignment trap: Section 7 prevents assignment and attachment. While this protects the payment from creditors, it also means that a recipient who wishes to assign their entitlement to a third party (such as to a bank as security or to a family member) cannot do so. This reduces the liquidity of the entitlement for any recipient who might want to use it as collateral before payment.

7. Tax treatment unknown: The Act does not exempt the payment from income tax. Depending on the tax law in force at the time of distribution, the payment could be fully assessable. This could substantially reduce the net benefit, especially for higher‑income recipients. The absence of tax clarity is a compliance risk for recipients who may not set aside funds for tax.

Compliance obligations fall almost entirely on the administrators. Individual recipients need take no positive action. They must simply provide current contact details? The Act does not impose a duty on individuals to notify the Board or to claim the payment. The Board must identify eligible persons from its own records. However, an individual who believes they are eligible but has not received a payment may need to contact the Board and potentially provide evidence. In practice, a recipient should verify that the Board has their correct current address to receive the payment. If the recipient dies before payment, their widow or the person determined by the Board should ensure the Board is aware of the death and the identity of the widow. For the Board, compliance involves five steps: (1) identify all eligible contributors and eligible pensioners using Fund records and the criteria in section 3; (2) receive the Treasurer’s advice on the accrual amounts and the allocation method; (3) calculate individual shares in accordance with the method determined by the Treasurer; (4) pay each eligible person the allocated amount from the Fund as soon as practicable after allocation; (5) handle death cases by paying the widow if alive, or making a determination under s 6(2)(b) if no widow exists. The Board must document its actions to demonstrate compliance with the Act and to allow audit. The actuary must provide advice on the allocation method that ensures a fair and reasonable basis, and must have regard to actuarial principles and practice. The actuary should produce a written report detailing the recommended methodology and the reasons. The Treasurer must publish a Gazette notice fixing the distribution dates, determine the accrual amounts after receiving Board advice, and determine the allocation method after receiving actuary advice. The Treasurer should also ensure that the accreation determination is supported by the Board’s advice and that the method is consistent with the actuary’s recommendations. There are no prescribed forms or deadlines beyond “as soon as practicable”. The absence of statutory time frames means the administrators must act reasonably; delay could be challenged. The best practice is to set a realistic timetable and communicate it to affected persons. The distribution is a one‑off exercise, so after completion the compliance burden ends.
