What it does
This instrument is a Determination made by the CSS Board under subsection 248(1) of the Superannuation Act 1976. It effects a one-off transfer of assets from the CSS Fund to the PSS Fund. The transfer day is fixed as 31 March 2006. Assets of the CSS Fund as at the end of that day, which fairly and equitably represent (as nearly as practicable) the sum of the transfer amounts calculated under clause 5, are taken to have been transferred on that day to the PSS Fund. The class of persons whose accrued benefits are backed by the transferred assets are transferees as defined in section 3: persons referred to in section 245 of the Superannuation Act 1976 who became members of the PSS in the period from 1 July 2002 to 30 June 2005. The schedule identifies 19 individual transferees with specific exit days, accumulated contributions and employer contributions values. Each transferee has a separate line item in the schedule, so the determination applies to precisely 19 people who moved from the CSS to the PSS during that window.
The transfer amount for each transferee is calculated by a formula set out in clause 5: ((A + B + C) x D). Component A captures the share of CSS Fund assets at the relevant date (30 June of the financial year immediately before the exercise of a transfer election) attributable to that transferee, grown by the CSS Fund rate of return from the relevant date to the exit day. Component B is the amount in column 6 of the schedule, representing contributions and employer contributions from 1 July to the exit day. Component C adds interest on that column 6 amount at the CSS Fund rate of return for the same period. Component D applies a further growth factor: 1 plus the CSS Fund rate of return from the exit day to the transfer day. The result is a compounded amount designed to reflect the share of CSS Fund investment earnings attributable to each transferee up to the transfer day.
