Superannuation Benefit (Interim Arrangement) (Qualified Employees) Regulations

The regulations rely on several defined concepts drawn from the parent Act, which are essential to understanding their operation.

Qualified employee: This is the central concept of the Act. The definition in subsection 3(1) of the Superannuation (Productivity Benefit) Act 1988 originally had paragraphs (a) through (f) covering certain categories of Commonwealth employees (e.g., those employed under the Public Service Act 1922, certain statutory office holders, and others). Paragraph (g) gave the Governor-General power to prescribe additional classes by regulation. These regulations exercise that power. Being a qualified employee is a prerequisite for receiving the productivity benefit under the Act. The regulations make clear that a person who would otherwise be covered by paragraphs (a)-(f) of the definition is not also covered by these regulations: regulation 3 expressly excludes any person “referred to in paragraph (a), (b), (c), (d), (e) or (f) of that definition”. So the regulations are residual in nature - they only apply to employees not already covered by the primary categories.

Employer-sponsored superannuation benefits: This term is defined in regulation 2(1) to mean benefits provided to the person, or to the person’s dependants, under a superannuation or retirement scheme (however established) to which the employer of the person contributes. The definition is deliberately broad. It captures any scheme where the employer makes contributions, regardless of how the scheme is set up. The key effect is that if an employee already receives employer contributions to a superannuation fund, they are generally excluded from being a qualified employee under most entries in regulation 3, unless the specific entry allows an alternative (e.g., where the employee is in a named fund that is deemed acceptable). The phrase “however established” ensures that both statutory and contractual schemes are covered. This definition is critical because the Act’s purpose was to extend superannuation coverage to employees who lacked it, so those with existing employer-sponsored benefits were not intended to benefit.

The Act: Regulation 2 defines “the Act” as the Superannuation Benefit (Interim Arrangement) Act 1988. That Act was the short-lived predecessor to the Superannuation (Productivity Benefit) Act 1988, and the regulations are made under the Productivity Benefit Act, not the Interim Arrangement Act. The reference to “the Act” in the regulations is therefore to the Productivity Benefit Act. This is a potential source of confusion: the regulations’ short title names the Interim Arrangement, but the enabling Act is the Productivity Benefit Act.

Deeming of employment: Regulation 2(2) provides that a person who is an officer or employee of a particular employer is taken to be a person employed by that employer for the purposes of these regulations. This deeming provision likely addresses situations where a person may be seconded or engaged under a contract that labels them an officer rather than an employee. It ensures that the substantive connection to the employer governs, not the formal title.

Listed employers: The bulk of the regulations is a list of 27 specific Commonwealth bodies (e.g., Albury-Wodonga Development Corporation, Australian Broadcasting Corporation, CSIRO, etc.). These are the employers whose employees may become qualified employees, provided the other conditions are met. The list is exhaustive and closed; no other employers are prescribed.

The regulations directly affect four groups: employees of the listed bodies, the employers themselves, the administrators of the superannuation schemes, and ultimately the Commonwealth as the funding source.

Employees: Any person employed by one of the 27 listed employers on or after the commencement date (4 November 1988, with amendments from 6 July 1989) who satisfies the condition of having no employer-sponsored superannuation benefits (or, in limited cases, having benefits under an approved named fund) becomes a qualified employee. This means they are entitled to the productivity benefit under the Act, which typically involved the employer making superannuation contributions on their behalf. Employees who already have employer-sponsored benefits are excluded, even if those benefits are less generous than the productivity benefit. Some entries have temporal conditions: for example, paragraph (n) applies only to persons employed by the Australian National Railways Commission on or after 1 January 1988 who cease employment before the establishment of a specific superannuation scheme. This creates a narrow window of eligibility.

Employers: Each listed body must determine which of its employees are qualified employees under the regulations. This imposes an administrative burden: the employer must ascertain whether each employee has employer-sponsored superannuation benefits, and in some cases, must identify which superannuation fund the employee belongs to. If the employee lacks employer-sponsored benefits, the employer must then provide the productivity benefit, which likely meant making contributions to a complying superannuation fund. Failure to correctly identify qualified employees could result in either underpayment (leaving employees without their entitlement) or overpayment (costing the employer contributions it was not required to make). Because the list is fixed, employers not listed are unaffected, even if their employees similarly lack superannuation coverage.

Scheme administrators: The named funds in some paragraphs (e.g., the Anglo-Australian Telescope Board Staff Superannuation Fund) are affected because employees who contribute to those funds are treated differently: they remain qualified employees even though they have employer-sponsored benefits. This was presumably because those funds were considered acceptable substitutes for the productivity benefit. Administrators of those funds would need to ensure that affected employees were not inadvertently double-covered.

The Commonwealth: The ultimate cost of the productivity benefit falls on the Commonwealth, either directly or through appropriations to the bodies. By expanding the class of qualified employees, these regulations increase the fiscal liability of the Commonwealth. The interim nature suggests the government intended to eventually move these employees to permanent superannuation arrangements, possibly with different contribution levels.

Practical reach: The number of employees affected is likely small, given the specialised list of employers. Many of the bodies (e.g., Australian Bicentennial Authority, Australian Film Commission) are niche or have since been abolished. The regulations are therefore a narrow class measure, not a broad expansion of superannuation coverage.

The regulations themselves do not impose explicit duties; they confer a status. However, that status carries with it duties and rights under the parent Act.

Right to productivity benefit: The primary right created by the regulations is the right of a qualified employee (as defined) to receive the productivity benefit under the Superannuation (Productivity Benefit) Act 1988. The precise nature of that benefit is defined in the Act, but generally it involved the employer making periodic contributions to a superannuation fund on the employee’s behalf, equal to a percentage of the employee’s salary. The regulations do not quantify the benefit; they only gate access to it.

Employer duty to identify and contribute: The Act imposes a duty on the employer of a qualified employee to provide the productivity benefit. For employers listed in the regulations, this means they must have systems in place to identify which employees are qualified employees under regulation 3, and then to make the required contributions. The duty is contingent on the employee satisfying the conditions. An employer who fails to make contributions for a qualified employee may be in breach of the Act.

Employee duty to disclose: While not stated in the regulations, employees likely have a duty to disclose whether they have employer-sponsored superannuation benefits, as the benefit condition depends on that fact. An employee who falsely claims to have no employer-sponsored benefits to obtain the productivity benefit could be liable for fraud or for recovery of overpaid amounts. Conversely, an employee who fails to disclose that they do have such benefits may inadvertently disqualify themselves.

No private right of action: The regulations do not create a private cause of action for employees against their employer for failure to provide the benefit. Enforcement is through the Act and possibly through administrative mechanisms.

Deemed employment: The deeming provision in regulation 2(2) ensures that the status of officer or employee is not a loophole. It imposes on employers the duty to treat officers as employees for the purposes of the benefit. This might affect how employment contracts are structured.

Temporal limitations: Some entries impose time conditions. For example, paragraph (n) only covers employees who cease employment before the establishment of a specific scheme. This creates a window: employees who remain employed after the scheme is established lose their status as qualified employees under these regulations, and the employer’s duty to provide the productivity benefit ceases. This imposes a duty on the employer to monitor the timeline and adjust contributions accordingly.

The regulations themselves contain no penalty provisions. Enforcement is indirect, through the parent Act and general law.

Parent Act penalties: The Superannuation (Productivity Benefit) Act 1988 likely contains offences for non-compliance, such as failure by an employer to make required contributions. The Act may also provide for civil recovery of unpaid amounts, interest, and penalties. However, these regulations do not prescribe any specific sanctions. A person who knowingly provides false information about their superannuation status to become a qualified employee could be prosecuted under the Criminal Code (Cth) for fraud or obtaining a financial advantage by deception.

No enforcement body named: The regulations do not designate an enforcement authority. Responsibility for ensuring compliance would fall to the employer, the trustee of the superannuation fund, and ultimately the Commonwealth. The Australian Prudential Regulation Authority (APRA) or the Australian Taxation Office (ATO) might have oversight, but that is not stated here.

Risk of overpayment: The regulations create a risk that an employee might be classified as a qualified employee when they actually have employer-sponsored superannuation benefits (perhaps through a second job or a previous arrangement). If the employer makes contributions based on that classification, the employer may seek to recover overpaid amounts. The employee who knowingly misrepresented their status could face demands for repayment and potentially legal action.

No criminal penalties in regulations: Because the regulations are definitional, they do not create criminal offences. Enforcement relies on the underlying Act and general law.

Compliance burden on employer: The employer bears the administrative and financial risk of incorrectly classifying employees. A mistaken classification (e.g., treating an employee as a qualified employee when they are not) may lead to improper use of public money. Conversely, failing to treat a qualified employee as such may lead to underpayment claims.

No review mechanism specified: The regulations do not provide for review of decisions about whether a person is a qualified employee. An employee who is dissatisfied with their employer’s determination may need to rely on the Act’s internal review mechanisms, if any, or seek a declaration from a court.

Historical context: The regulations are interim and were made in 1988. They would have been enforced under the legal framework of the time. The absence of penalties in the regulations is consistent with their limited scope.

The regulations sit within a web of Commonwealth superannuation laws and do not operate in isolation.

Superannuation (Productivity Benefit) Act 1988: This is the parent Act. The regulations are made under section 3(1)(g) of that Act. The Act defines the productivity benefit and the conditions for payment. The regulations supplement the Act by specifying who qualifies. The Act likely also contains commencement and transitional provisions, savings, and application rules. The regulations must be read consistently with the Act.

Superannuation Benefit (Interim Arrangement) Act 1988: This earlier Act gave the regulations their short title, but the enabling Act is the Productivity Benefit Act. The Interim Arrangement Act was probably superseded. The reference to it in the title may be historical.

Superannuation Act 1976: This Act provided a superannuation scheme for Commonwealth employees. It is relevant because paragraph (zb) of regulation 3 (added by amendment in 1989) refers to a person employed by AIDC Ltd. who is an “eligible employee” for the purposes of the Superannuation Act 1976. This cross-reference incorporates the definition from that Act, showing that the regulations borrow from other superannuation statutes to determine eligibility.

Specific superannuation funds: Several paragraphs refer to named superannuation funds (e.g., the Anglo-Australian Telescope Board Staff Superannuation Fund). These funds are governed by their own trust deeds and statutory provisions. The regulations treat membership of those funds as an acceptable substitute for the productivity benefit. There may be interactions with the Superannuation Industry (Supervision) Act 1993 (SIS) for ongoing funds, but these regulations predate SIS.

Acts establishing the listed bodies: Each employer listed (e.g., the Australian Broadcasting Corporation Act 1983, the CSIRO Act 1949) has its own enabling legislation. Those Acts may contain provisions about employment terms and superannuation. The regulations operate by adding a benefit on top of what those Acts provide, without overriding them. For example, an employee of the ABC who lacked employer-sponsored superannuation would be entitled to the productivity benefit under these regulations, in addition to any other entitlements under the ABC Act.

Freedom of Information and administrative law: Decisions about whether a person is a qualified employee may be reviewable under the Administrative Decisions (Judicial Review) Act 1977 or the Ombudsman Act 1976, though this is not specified.

Interaction with state laws: Paragraph (n)(ii) refers to superannuation schemes constituted under an Act of the Parliament of South Australia or Tasmania. This shows that the regulations acknowledge state-based schemes and effectively treat employees contributing to them as qualified employees under the Commonwealth scheme. This intergovernmental interaction creates a potential for double coverage or gaps, but the regulations attempt to manage it by setting a condition about the employee ceasing employment before a specific scheme.

Taxation: The productivity benefit contributions would have been subject to taxation under the Income Tax Assessment Act 1936 (later 1997). The regulations do not address tax treatment.

No conflict with fair work or industrial law: The regulations are about superannuation, not wages or conditions. They are complementary to industrial instruments.

The regulations have a very sparse amendment history, consisting of a single amendment.

Original making: Statutory Rules 1988 No. 267, notified in the Gazette on 4 November 1988, commenced on that date. The original instrument contained the citation, interpretation, and a list of qualified employees. The original list likely ended at paragraph (za) (Snowy Mountains Engineering Corporation). The Table of Statutory Rules confirms that 1988 No. 267 was the base.

First and only amendment: Statutory Rules 1989 No. 189, notified on 6 July 1989, commenced on that date. The Table of Amendments shows that only regulation 3 was amended. The amendment added paragraph (zb), which prescribes persons employed by AIDC Ltd. who are “eligible employees” for the purposes of the Superannuation Act 1976. This was a simple addition; no other paragraphs were repealed or substituted.

No further amendments: The compilation was prepared on 2 June 2004, and the regulations appear to have remained in that form. There is no indication of subsequent amendment. The compilation notes do not list any later amendments. Given that the underlying Act was a productivity benefit scheme that was later overtaken by the Superannuation Guarantee regime (from 1992), these regulations likely became obsolete or were repealed by later instruments. However, the compilation as provided does not show repeal.

Significance of the amendment: The addition of AIDC Ltd. (a government-owned investment and development corporation) shows that the list was updated to include new bodies as they were established or as employees sought coverage. The amendment is narrow and specific. No other employers were added or removed, suggesting that the original list captured most intended bodies, or that the government chose not to expand coverage further.

No transitional provisions: Neither the original regulations nor the amendment included application, saving, or transitional provisions (the table shows nothing for either instrument). This implies that the amendment applied from its commencement date forward, without retrospective effect.

Compilation details: The compilation was prepared by the Office of Legislative Drafting, Attorney-General’s Department, dated 2 June 2004. This suggests the regulations were still in force at that date. The format of the compilation (including notes and tables) is typical of the Federal Register of Legislative Instruments.

Implications for practitioners: The lack of amendment history means that, for any period after 6 July 1989, the regulations are static. A lawyer advising on entitlement for an employee of a listed body would need to check whether the amendment (AIDC Ltd.) applies, and whether any other changes occurred after the compilation date. The likelihood is that the regulations were repealed when the Productivity Benefit Act was repealed by the Superannuation Legislation Amendment Act 1992 or similar, but that is not in the source.

The source does not mention any litigation involving these regulations. No cases are cited in the text or notes. This is consistent with the regulations being a narrow, definitional instrument unlikely to generate disputes. However, we can infer some possibilities.

Potential areas of dispute: If litigation occurred, it would likely involve a question of whether a particular person fell within the definition of “qualified employee” under regulation 3. For example, a dispute could arise over whether an employee “does not have employer-sponsored superannuation benefits” - what constitutes “benefits” or “contributes” under the definition in regulation 2. Also, the deeming provision in regulation 2(2) could be tested if an employer argued that a person was an officer, not an employee. The temporal condition in paragraph (n) could be litigated if there was doubt about when a superannuation scheme was “established”.

No reported decisions: A search of Australian legal databases (hypothetically) would likely show no reported cases directly on these regulations. The subject matter is obscure and the period of operation was limited. Any disputes would likely be resolved internally within the employer or through the Ombudsman or the Administrative Appeals Tribunal, without reaching a reported court decision.

Implications: The absence of litigation suggests that the regulations operated without controversy. The employees covered were likely unionised or well-advised, and the employers had clear procedures. Alternatively, the consequence of misclassification might have been too small to warrant legal action.

Comparison with other superannuation regulations: Other superannuation instruments have generated litigation, particularly around definitions of “employee” and “employer”. These regulations are less prone to litigation because they list specific employers, leaving little room for argument about who is covered.

Future relevance: If someone today needs to determine whether a historical employee of one of these bodies was entitled to the productivity benefit, the regulations would be the source of law. No case law clarifies ambiguous terms, so the text must be interpreted strictly.

No amendment by court order: The Table of Amendments shows only legislative amendment, not judicial modification.

Several aspects of these regulations are traps for the unwary practitioner or employer.

Narrow exclusion for existing qualified employees: Regulation 3 begins with the phrase “(other than a person referred to in paragraph (a), (b), (c), (d), (e) or (f) of that definition)”. This means that even if an employee works for a listed body and lacks employer-sponsored superannuation, they are not a qualified employee under these regulations if they are already covered by one of the primary paragraphs of the Act. For example, an employee of the ABC who is also a member of the Public Service superannuation scheme might fall under paragraph (a) of the Act (if employed under the Public Service Act) and thus be excluded from these regulations. The interplay must be checked.

The condition “does not have employer-sponsored superannuation benefits” is deceptively simple: The definition of that term in regulation 2 is broad: it includes any benefits under a scheme to which the employer of the person contributes. If an employee has a second job where that second employer makes superannuation contributions, those contributions may be “employer-sponsored” for the purposes of these regulations, disqualifying them. The definition does not limit “employer” to the employer under the regulation; it refers to “the employer of the person”. This could catch multiple jobholders.

The named fund exceptions are limited: A few paragraphs (e.g., (b), (c), (za)) allow an employee to be a qualified employee even if they have benefits under a specific named fund. But if the employee has employer-sponsored superannuation benefits under any other fund (even a comparable one), they are excluded. For example, an employee of the Anglo-Australian Telescope Board who is in a different superannuation fund (not the two named) would not be a qualified employee, even if that other fund is also employer-sponsored. The regulations are strict in this regard.

Temporal trap in paragraph (n): This paragraph applies only to employees of the Australian National Railways Commission who are employed on or after 1 January 1988 and who cease employment before the establishment of a particular superannuation scheme. If the employee continues in employment after that scheme is established, they cease to be a qualified employee. An employer might inadvertently continue making productivity benefit contributions after the scheme is set up, leading to overpayment. The date of establishment of the scheme must be determined.

Deeming of employment for officers: Regulation 2(2) deems an officer or employee to be employed by the employer. But this could create confusion if a person holds an office in multiple bodies, or if the employer is a body corporate that has subsidiaries. The deeming is for the purposes of these regulations only, not for other laws.

The amendment added AIDC Ltd. without transitional arrangements: The 1989 amendment added paragraph (zb) with no savings provision. This means that employees of AIDC Ltd. who were eligible employees under the Superannuation Act 1976 became qualified employees from 6 July 1989. But what about those who ceased employment before that date? They would not be covered unless the Act had retrospective operation (unlikely). The amendment applies prospectively only.

No sunset clause: The regulations are titled “Interim Arrangement” but contain no expiry date. They could remain in force indefinitely, even after the employers or the parent Act are superseded. A practitioner might assume they are no longer in force, but the compilation shows they were still current as of 2004. This creates uncertainty about their ongoing validity.

The “contradictory intention” proviso in regulation 2: The definition of “the Act” uses the phrase “unless the contrary intention appears”. This leaves room for interpretation that the meaning of “the Act” might change if the context indicates a different Act. This could matter if the regulations are read alongside other instruments.

No provision for multiple employers: The regulations assume a single employer. If an employee works for two of the listed bodies (e.g., part-time with each), it is unclear whether the conditions apply to each employment separately or overall.

The list is exhaustive and cannot be analogised: An employee of a body not listed, even if identically situated (e.g., lacking superannuation), is not a qualified employee under these regulations. They would need to rely on other paragraphs of the Act or other regulations. The closed list is a trap for those who assume it is illustrative.

Compliance with these regulations is primarily an employer responsibility, though employees also have a role.

Step 1: Identify whether the employer is listed. The employer must be one of the 27 bodies specified in regulation 3. If the employer is not listed, the regulations are irrelevant. The list includes historical entities that may have been renamed or restructured; the employer must confirm the current legal identity against the listed name. For example, the Australian National Railways Commission later became Australian National Railways and was eventually privatised. An employer that has replaced the original listed body may need to determine if it is the same legal entity.

Step 2: Determine whether the employee is excluded by other paragraphs of the Act. Before applying the regulations, the employer must check if the employee is already a qualified employee under paragraphs (a)-(f) of section 3(1) of the Act. If so, the regulations do not apply. This involves examining the employee’s employment status under other Commonwealth laws (e.g., Public Service Act, Members of Parliament (Staff) Act 1984 etc.).

Step 3: Assess whether the employee has “employer-sponsored superannuation benefits” under regulation 2. The employer must inquire: does the employee receive any superannuation or retirement benefits to which the employer (as defined) contributes? This includes contributions to any scheme, statutory or contractual. If the employee does have such benefits, they are excluded from most paragraphs, unless a specific paragraph name an alternative fund. For example, an employee of the Anglo-Australian Telescope Board who is in the named UK fund is still qualified. The employer must verify the existence and type of superannuation fund. This may require the employee to provide written declarations or fund statements.

Step 4: Check for special conditions in the relevant paragraph. Some paragraphs include additional conditions. For example, paragraph (k) requires employment before 1 May 1989 by the Australian Institute of Sport or on or after that date by the Australian Sports Commission. The employer must confirm the dates. Paragraph (n) imposes a temporal condition about ceasing employment before a scheme is established. The employer must know the establishment date of the Australian National Railways Productivity Superannuation Scheme. Paragraph (x) covers part-time members of certain boards and committees. The employer must confirm the exact role.

Step 5: Maintain records. The employer should keep records of the employee’s superannuation status, the basis for the determination, and any declarations obtained. This is good practice to defend against later claims of underpayment or overpayment. The regulations themselves do not prescribe record-keeping, but the parent Act may impose obligations.

Step 6: Provide the productivity benefit if the employee is determined to be a qualified employee. The benefit is defined in the Act; typically the employer must make contributions to a complying superannuation fund at the prescribed rate. The employer should coordinate with its payroll and superannuation provider to ensure contributions are made in a timely manner.

Step 7: Monitor ongoing eligibility. Some employees may later acquire employer-sponsored superannuation benefits (e.g., if the employer establishes a new scheme). If that happens, the employee ceases to be a qualified employee under the regulations, and the employer should stop making productivity benefit contributions. This is especially relevant for paragraph (n) where the establishment of a specific scheme terminates eligibility.

Step 8: Review after legislative changes. The regulations are interim and may be repealed. Employers should monitor the Federal Register of Legislation for any changes. As of the compilation date (2004), the regulations were in force. The employer should verify current status.

Step 9: Seek legal advice on borderline cases. If there is doubt about whether an employee’s superannuation is “employer-sponsored” (e.g., if the employee contributes personally and the employer only covers administrative costs), or about the interpretation of a named fund, legal advice should be obtained. The consequences of misclassification can be costly.
