Superannuation Benefit (Interim Arrangement) (Continuous Service) Regulations 1988

Qualifying service under the Superannuation (Productivity Benefit) Act 1988 is the period of continuous employment that an employee must complete before the employer is required to make a productivity benefit superannuation contribution on that employee’s behalf. The parent Act sets general rules for determining continuous service, but section 5(2) permits the regulations to prescribe classes of persons for whom a different method of counting service applies. These Regulations are that prescription.

Continuous service in the context of these Regulations means that certain types of breaks (casual engagements, relief assignments, part-time or fixed-term appointments, seasonal work) do not break the chain of continuous employment. For example, a nurse employed on a relief basis by Aboriginal Hostels Limited (paragraph (a)) who works intermittently will nonetheless have that service counted as continuous, provided the employment meets the description in the regulation. The concept is not defined in the Regulations themselves; it takes its meaning from the parent Act and from administrative practice.

Interim arrangement describes the temporary nature of the scheme. The parent Act was one of several responses to the 1980s productivity case in the Australian Conciliation and Arbitration Commission, which awarded a 3% employer superannuation contribution for employees under federal awards. The Commonwealth implemented it initially through interim administrative arrangements for its own employees, of which these Regulations are a part. “Interim” suggests that the regulation-making power was intended to be transitional pending permanent arrangements, but the Regulations have not been repealed and have been amended multiple times, most recently in 2005.

Prescribed classes are the thirty-one categories listed in regulation 2. They are narrowly drawn, typically by reference to the employing agency, the type of appointment (e.g. “relief basis”, “casual on-call basis”, “seasonal basis”), and sometimes the specific award classification or job title. The effect is to include employees who would otherwise fail to meet the standard continuous service test because of irregular work patterns. The precise boundaries matter: a person employed by the same agency but in a different role, or under a different award, may not be within a prescribed class and therefore may not have deemed continuity.

Other concepts implicit in the instrument include agency specificity (the list is tied to named Commonwealth entities, many of which no longer exist in the same form), award dependency (some classes refer to particular awards or internal orders, implying that changes to those instruments affect coverage), and exhaustive enumeration (no catch-all provision for similar categories). The instrument thus creates a patchwork of eligibility, with no principled rationale for why, say, a relief cleaner in one agency is included but a part-time cleaner in another is not, unless the second happens to fall under another listed class.

The Regulations directly affect persons employed in the listed categories by the named Commonwealth employers. The classes span a wide range of roles and agencies, including:

• Aboriginal Hostels Limited: relief hostel managers, assistant managers, nurses, catering, cleaning, security staff.
• ACT government agencies (at the time of drafting): Department of the Arts, Sport, the Environment, Tourism and Territories (ACT administration), ACT Health Authority (casual on-call staff), ACT Institute of TAFE (non-full-time), ACT Schools Authority (relief teachers and school assistants).
• Attorney-General’s Department: casual court reporting typists, reporters, part-time court attendants.
• Australian Bureau of Statistics: persons engaged under the Statistics Regulations to conduct interviews.
• Australian Broadcasting Corporation: part-time journalists (under ABC General Order 12/D/1 and the Journalists (ABC News) Award 1984) and part-time musicians (under the Musicians (ABC) Award 1985).
• Australian Institute of Criminology: temporary research assistants.
• Australian Institute of Family Studies: specialist assistants.
• Australian Maritime College: temporary academic or general staff.
• Australian National Railways Commission: full-time track maintenance or train operations staff.
• Australian Taxation Office: seasonal administrative services officers (clerical or data entry) and relief tea attendants.
• Australian Telecommunications Commission (Telecom): manual assistants.
• Australian Trade Commission: part-time, temporary, or fixed-term staff.
• Canberra Institute of the Arts: semester-by-semester teachers.
• Department of Finance: relief tea attendants.
• Department of Immigration, Local Government and Ethnic Affairs: relief telephone interpreters.
• Department of the House of Representatives: parliamentary sittings keyboard staff, security attendants, casual keyboard staff.
• Department of the Prime Minister and Cabinet: parliamentary sitting clerical/keyboard staff for liaison officers.
• Department of the Senate: full-time or relief parliamentary security attendants, full-time committee assistants.
• Department of Transport and Communications: relief seagoing crew or lighthouse keepers.
• Health Insurance Commission: regular relief staff.
• High Court of Australia: court reporting typists and casual attendants.
• Productivity Commission: temporary part-time associate commissioners.
• Joint House Department: catering staff during sittings, part-time guides.
• Law Reform Commission: part-time relief word processors.
• Special Broadcasting Service: editors, subtitlers, translators, journalists, broadcasters, operational officers, technical officers, administrative service officers.
• Office of the Supervising Scientist for the Alligator Rivers Region: temporary staff for routine duties.
• Department of Defence: casual bar attendants, butchers, catering attendants, cleaners (under Naval Defence Act), general duty cleaners, cooks, head cooks, gardeners, labourers, assistant printers, security officers, storemen, stores assistants.
• Medicare Australia: regular relief staff.

The indirect burden falls on the employing agencies. They must identify which of their employees fall within these classes and ensure that payroll and superannuation systems treat their service as continuous for the purposes of the productivity benefit. This requires record-keeping that captures not just the employee’s hours and status, but also the specific award or order classification and the agency’s own structure. The compliance cost is not trivial, especially for agencies with large, diverse workforces like Defence or the ATO.

The Regulations do not affect private sector employees or state government employees. Their scope is limited to the Commonwealth public sector and certain statutory authorities. However, because many of the listed agencies have been corporatised or privatised (e.g. Telecom became Telstra; Australian National Railways Commission), questions arise as to whether the references are still operative or have been impliedly repealed. The 2005 amendment did not remove defunct agencies but did add Medicare Australia.

The Regulations impose no duties directly on employees. They confer a right on covered employees to have their service treated as continuous for qualifying service purposes under the Superannuation (Productivity Benefit) Act 1988. That right is contingent on the employee actually falling within one of the prescribed classes. It is not a free-standing right to superannuation; it is a right to have the counting of service administered in a particular way.

The primary duty falls on the employer (the relevant Commonwealth agency or authority) to correctly classify employees and to administer the productivity benefit superannuation accordingly. This includes:

• Identifying which employees fall within the prescribed classes. This requires HR and payroll systems to cross-reference job titles, award classifications, employment basis (relief, casual, part-time, seasonal, temporary), and agency.
• Applying the continuous service rule. Even if an employee works only intermittently, each period of engagement counts toward the qualifying period as if the employee had been employed continuously. The employer must not treat a break between engagements as a break in qualifying service.
• Ensuring that correct superannuation contributions are made under the parent Act once the qualifying service period is met. The Regulations do not specify contribution rates or fund choice; those are governed by the parent Act and separate arrangements.
• Maintaining proper records of employment history, classification decisions, and any periods of service. This is necessary both for calculating contributions and for defending any audit or review.

If an employer misclassifies an employee, the employee may lose the benefit of continuity. That could result in the employer failing to make a contribution when it was due, which might constitute a breach of the parent Act. Conversely, if an employer incorrectly deems continuity for an employee who does not fall within a prescribed class, it may make contributions that were not required. Overpayment is generally not recoverable from the employee, but it creates a financial exposure for the agency.

The Regulations also create a compliance burden for employers to monitor changes in the listed awards or agencies. For example, paragraph (h) refers to specific ABC General Orders and awards. If those awards are replaced or varied, the reference may become ambiguous. The employer (the ABC) then has to determine whether similar categories of employees remain covered. This interpretive risk is a cost that is not reflected in the instrument itself.

The Regulations themselves contain no penalty provisions. Penalties for non-compliance with the superannuation contribution obligations under the Superannuation (Productivity Benefit) Act 1988 would be found in that Act or in the general law (e.g. for breach of a Commonwealth award or employment contract). The Regulations are definitional; they shape which employees are entitled to contributions, but they do not create offences.

Enforcement is indirect. If an employer fails to recognise an employee as being within a prescribed class and therefore fails to make a required superannuation contribution, the employee may lodge a complaint. The responsible regulator for the productivity benefit scheme has historically been the Australian Prudential Regulation Authority (APRA) or the Australian Taxation Office (ATO), depending on the fund and the employer. In practice, enforcement relies on audit and grievance processes. The Regulations are a factor in determining whether a breach has occurred: if the employee was within a prescribed class, the employer’s failure to treat service as continuous may be an error under the parent Act.

The absence of specific penalties in the Regulations does not mean the provision is toothless. The parent Act may impose civil penalties for failure to make contributions. Additionally, the Commonwealth’s own financial management rules would treat incorrect non-contributions as a failure of administrative duty, potentially leading to internal sanctions or adverse audit findings. However, the level of enforcement risk is low because the instrument is obscure and applies to a small subset of employees. Most agencies have long-standing practices for dealing with casual and part-time staff, and the productivity benefit scheme has been largely superseded by the Superannuation Guarantee regime for most Commonwealth employees. The interim arrangement may still operate for historic cases or for employees not covered by later schemes.

The 2005 amendment (SLI 2005 No. 207) which updated the Regulations was made under multiple acts, including the Financial Management and Accountability Act 1997, suggesting that the government considered it appropriate to keep the Regulations in force. No penalty provisions were added.

The Regulations are made under section 5(2)(b) of the Superannuation (Productivity Benefit) Act 1988. They operate within the framework of that Act, which itself is a specific Commonwealth superannuation scheme for employees not covered by the more general Superannuation Guarantee regime. The parent Act sets out the conditions for contributions, and these Regulations determine continuous service for certain employees. They do not override the Act’s general definition of qualifying service; they supplement it by providing alternative counting methods for the prescribed classes.

The interaction with the Superannuation Guarantee (Administration) Act 1992 is complex. The productivity benefit scheme predates the superannuation guarantee and, for many Commonwealth employees, was replaced by it. Where an employee is covered by the superannuation guarantee, the productivity benefit may still apply as an additional employer contribution. However, the continuous service rules under these Regulations may affect whether an employee meets the threshold for the productivity benefit, which in turn affects the total contribution obligation. Practitioners need to determine whether the productivity benefit scheme still applies to each class of employee, or whether it has been implicitly overtaken by later arrangements.

The Regulations also interact with numerous industrial awards and agreements. Several paragraphs incorporate by reference specific awards (e.g. the Journalists (ABC News) Award 1984; the Musicians (ABC) Award 1985) or internal orders (ABC General Order 12/D/1). If those awards are varied or replaced, the regulation does not automatically update. The employee’s coverage may become uncertain. Similarly, the references to agencies that have been renamed (e.g. Department of the Arts, Sport, the Environment, Tourism and Territories; Australian Telecommunications Commission; Health Insurance Commission; Medicare Australia) require interpretative guidance from the Acts Interpretation Act 1901 or machinery-of-government orders. The 2005 amendment added paragraph (ze) for Medicare Australia, demonstrating that updates occur only when the government actively amends the list.

The instrument also interacts with the Legislative Instruments Act 2003 (now the Legislation Act 2003). As noted in the compilation, from 1 January 2005 legislative instruments must be registered on the Federal Register of Legislative Instruments. The Regulations were amended by SLI 2005 No. 207, which was registered. The instrument’s continued validity depends on registration and on not having been repealed by later instruments. The compilation from 2005 is the last available version; practitioners should check the current Federal Register for any subsequent amendments or repeal.

The Regulations were originally made as Statutory Rules 1988 No. 266, notified in the Gazette on 4 November 1988 and commencing on that date. Since then they have been amended four times:

• 1989 No. 181 (notified 6 July 1989, commenced same day): amended regulation 2. The Table of Amendments shows that regulation 2 was amended by this instrument. The specific changes are not described in the source, but it likely added new classes or modified existing ones.

• 1990 No. 43 (notified 27 February 1990, commenced same day): further amended regulation 2. Again, the source does not specify the content, but it would have extended coverage to additional employee categories or agencies.

• 1998 No. 114 (notified 27 May 1998, commenced same day): amended regulation 2 and included an application provision (regulation 4). The application provision states that the amendment made by subregulation 3.2 has effect from the commencement of the Productivity Commission Act 1998. This is reflected in the current text by paragraph (y), which was added to cover persons appointed as Associate Commissioners of the Productivity Commission on a temporary, part-time basis. The amendment was necessary because the Productivity Commission replaced the Industry Commission, and the new commissioners needed to be included.

• 2005 No. 207 (Select Legislative Instrument, registered on FRLI 19 September 2005, commenced 1 October 2005): this was a major omnibus instrument made under multiple Acts (listed in the compilation). It amended regulation 1 (the name of the Regulations was substituted to the current title) and further amended regulation 2. The most notable addition is paragraph (ze), covering persons employed in Medicare Australia on a regular relief basis. It also likely updated references to reflect machinery-of-government changes, though the text still retains many defunct agency names.

The Table of Amendments notes that regulation 2 was amended by the 1989, 1990, 1998, and 2005 instruments. The current compiled version is as at 1 October 2005. There is no indication of further amendments in the source document, but practitioners should verify the current status given that the compilation is nearly two decades old.

The source document contains no reference to any litigation involving these Regulations. No cases are cited in the notes or amendments. The Regulations are highly specific and definitional, making them unlikely to be the subject of judicial consideration. Litigation might arise under the parent Act, where the meaning of “continuous service” is contested, but that would more likely involve the Act’s general provisions rather than the prescribed classes. Even if a dispute arose over whether a particular employee falls within a prescribed class, it would probably be resolved at the administrative level or through internal review rather than through the courts.

The absence of reported cases suggests that the instrument has operated without significant legal controversy. This could reflect either clarity in the definitions or a low level of enforcement activity. Given the interim nature and the fact that the productivity benefit scheme has been largely overtaken by other arrangements, the Regulations may now be of limited practical importance. No litigant has challenged the validity of any of the prescribed classes or sought judicial interpretation of the terms used (such as “relief basis” or “regular relief basis”). However, the lack of case law means that there is little authoritative guidance on borderline questions, such as what constitutes “regular relief” for the purposes of paragraph (w) or (ze). Employers must rely on administrative practice.

Several features of these Regulations create traps for the unwary.

First, the list is exhaustive. If an employee’s position is not exactly described in one of the thirty-one paragraphs, the continuous service benefit does not apply. There is no catch-all for similar categories. This means that a part-time employee in the same agency but performing duties not listed misses out. For example, a part-time cleaner in a department not mentioned (e.g., Department of Social Security) is not covered, even though a similar role in Defence (casual cleaners) is covered. The rationale for such distinctions is not apparent from the instrument.

Second, many of the employing agencies no longer exist under the names used. The Department of the Arts, Sport, the Environment, Tourism and Territories was restructured long ago. Australian Telecommunications Commission became Telstra and is now a private company. Australian National Railways Commission became Australian Rail Track Corporation and other entities. Health Insurance Commission became Medicare Australia (and is now part of Services Australia). The continued legal effect of references to defunct bodies is uncertain. The Acts Interpretation Act 1901 allows references to be read as references to successor bodies, but only if there is a clear line of succession. Practitioners may need to determine whether the entity still exists as a Commonwealth authority or whether the position has been abolished.

Third, the employment basis terms are not defined. “Relief basis”, “casual on-call basis”, “regular relief basis”, “seasonal basis” and “temporary basis” all appear, but the Regulations offer no criteria for what amounts to each. An employer must decide, for example, whether a “relief” employee includes someone who fills in for absent staff irregularly, or only those formally designated as relief workers in an award. Disputes are possible.

Fourth, some paragraphs incorporate by reference specific awards and orders that may have been varied, replaced, or terminated. Paragraph (h) refers to ABC General Order 12/D/1 and two named awards from 1984 and 1985. If those awards were later varied, or if new awards cover ABC employees, the reference may be ambiguous. The ABC may have updated its internal orders, but the regulation text remains frozen.

Fifth, the interim nature of the arrangement should not be ignored. The Regulations were intended as a temporary measure, but they have been on the books for over three decades. This raises the possibility that they have been implicitly repealed by later comprehensive schemes, such as the Superannuation Guarantee. However, the 2005 amendment suggests that the government considered them still necessary, at least for the categories added. Employers should not assume they are obsolete without legal advice.

Sixth, the application provision from the 1998 amendment (regulation 4 of SR 1998 No. 114) only addresses the Productivity Commission amendment. There is no general transitional provision for other amendments. This means that for amendments made before 1998, the coverage may have expanded the original categories, but the exact scope of each amendment is not readily available from the compiled text. Only by reading the amending instruments themselves can one determine the precise changes.

Seventh, the Regulations do not address what happens when a listed agency is privatised or its employees are transferred to the private sector. For example, if a person was employed by Australian Telecommunications Commission as a manual assistant, and that employer was subsequently privatised, does the regulation continue to apply for service accrued before privatisation? The text does not provide for this; it merely lists the class of persons employed by the named employer. Once the employer ceases to exist, no new employees can fall within the class. Existing employees may retain rights under the parent Act, but this is not specified in the Regulations.

Compliance with these Regulations is primarily the responsibility of each Commonwealth employer named in the list, or that employer’s successor. There is no central compliance authority that checks whether agencies are correctly applying the continuous service rules. Agencies must self-regulate.

The first step is to identify which, if any, of the employee categories in regulation 2 currently exist within the agency. This requires a reconciliation of the current workforce against the historical list. For agencies that have been renamed or restructured, a determination must be made whether the modern entity is the same legal employer as the one listed. The Attorney-General’s Department or the Department of Finance may provide guidance on machinery-of-government changes.

Second, for each category identified, the employer must verify that employees fall within the exact description. This means checking the appointment type (“relief”, “casual”, “seasonal”, “part-time”, “temporary”, “fixed-term”) and the specific job title or award classification. Employers should maintain a register of positions that fall within the prescribed classes, and ensure that HR systems flag those employees for continuous service treatment.

Third, payroll systems must be configured to disregard breaks in service for these employees when calculating qualifying service for the productivity benefit. For example, if a relief tea attendant works one day a week for a year, with gaps of weeks between shifts, the system should treat the entire period as continuous. This may require manual override of standard casual rules.

Fourth, employers should keep documentary evidence of how they determined that a particular class applies. If an employee challenges non-payment of a productivity benefit contribution, the employer will need to show that it considered the regulation and concluded the employee was not within a prescribed class, or if it did, that it applied the rule correctly.

Fifth, given the age and obsolescence of many references, employers should obtain legal advice on whether the regulation still has effect for their agency. A strong argument could be made that the instrument is spent in most respects, but the 2005 amendment to add Medicare Australia indicates that at least one agency considered it live. The risk of non-compliance is low because few employees are likely to claim the benefit, and the dollar amounts are small. However, for an aggrieved employee, the regulation provides a clear right that can be enforced through internal mechanisms.

Sixth, any future amendment to the Regulations would require a legislative instrument amending the list. Agencies that discover they have employees who are not covered but arguably should be cannot unilaterally extend the list. They would need to propose an amendment to the responsible minister. Given the low priority of this instrument, such amendments are unlikely. Agencies should manage expectations accordingly.

Finally, employers should monitor the Federal Register of Legislative Instruments for any repeal or amendment. If the Regulations are repealed, the transitional provisions of the repealing instrument will determine whether existing rights are preserved. As of the compiled version (2005), no repeal is recorded.
