Superannuation Amendment (PSS Trust Deed) Instrument 2019

The instrument concentrates on three legal/administrative concepts embedded in the PSS Trust Deed: definitions that determine entitlement, temporal scope (when the amendments apply), and a transitional protection mechanism to preserve certain pre‑amendment benefit entitlements.

Definitions: The two definitions altered are "eligible child" and "partially dependent child" in Rule 1.2.1 (Schedule 1, items 1 and 2). Before amendment, an "eligible child" included persons who had not reached age 16, or who were aged 16 but less than 25 and both receiving full‑time education and not ordinarily employed or self‑employed. The amendment substitutes an "under 18" baseline and retains the 18-under‑25 full‑time education requirement, but removes the "not ordinarily employed or self‑employed" condition for the older cohort. Thus there are two conceptually distinct thresholds: an automatic under‑18 category and an education‑conditioned 18-24 category.

Partially dependent child: The amendment aligns the partially dependent child definition with the new eligible child test for young persons (Schedule 1, item 2). The partially dependent child definition remains status‑based (not an eligible child) and age/education conditioned as stated.

Temporal application: The instrument introduces a detailed application rule (Schedule 1, item 3) that defines which young persons are treated under the revised terms for the purposes of paying benefits. The main points are:

• The amendments apply to a person (the young person) insofar as the benefit is payable for a day occurring on or after 1 January 2020 if either (a) the benefit is payable because of a death that occurred on or after 1 January 2020, or (b) on 31 December 2019 a benefit was already payable under the PSS Rules to/for the young person or to/for another person in respect of the young person (item 3(1)(a) and (ii)).

• If neither condition applies, the amendments apply from the later of 1 January 2020 and the day notice is first given as contemplated in item 3(2). Notice can take the form of an application under the PSS Rules for a benefit or a request to CSC (the trustee/administrator) by the young person or a person to whom a benefit is payable for or in respect of the young person (item 3(2)).

This design treats 1 January 2020 as the critical date while providing a notice-triggered application route for cases that arise after registration or where the other conditions do not apply.

Transitional protection: Item 4 is a narrowly framed non-reduction rule. It applies when, but for the item, the amendments would reduce the amount of a benefit payable to an existing beneficiary for a post‑commencement day while increasing the benefit payable to another person (a new beneficiary) for that same day because of the death of a deceased person (item 4(1)). Where that condition is met the existing beneficiary’s post‑commencement benefit is increased to the amount it would have been if the instrument had not been made (item 4(2)). The corresponding increase is taken out of the new beneficiaries’ post‑commencement benefits: if one new beneficiary exists, their post‑commencement benefit is reduced by the amount of the increase (item 4(3)); if there are multiple new beneficiaries the total of their post‑commencement benefits is reduced by that amount and the reduction is applied proportionately (item 4(4)).

Legal authority: The instrument is made under s 5 of the Superannuation Act 1990 (s 3); it amends the trust deed through the Schedule (s 4 Schedules). Commencement mechanics are specified in s 2, with an express notation that the day-after-registration and 1 January 2020 timings are operative.

Operational actors: The instrument assumes a role for CSC (Commonwealth Superannuation Corporation) or the trustee/administrator charged with applying the PSS Rules, because item 3(2)(b) contemplates a "request CSC to apply the amendments" and item 3(2)(a) contemplates an application under the PSS Rules. The instrument does not itself define the trustee’s procedural obligations but implicitly requires administrators to process applications and requests and to calculate post-commencement benefits in accordance with the revised rules and transitional protection.

Key legal mechanics summary: replace age/employment conditions in two definitions; set a 1 January 2020 effective date for most payment days; allow notice-triggered application; and shield certain existing beneficiaries from reductions by reallocating amounts to preserve their pre-amendment entitlement.

Primary affected parties

• Young persons who are potential or actual recipients of benefits under the PSS Rules and their families. The amendments alter which children qualify as "eligible" or "partially dependent" children and therefore who may receive benefits payable under the PSS Rules. Specifically, persons under 18 become eligible children (Schedule 1, item 1), whereas previously the baseline automatic eligibility was younger than 16. Persons aged 18 but under 25 remain dependent only if in full‑time education, but the prior employment exclusion for that group is removed (Schedule 1, item 1). This alters the set of individuals who can receive survivor or death-related benefits.

• Existing beneficiaries and potential new beneficiaries of death benefits payable under the PSS Rules. The transitional protection in Schedule 1, item 4 directly affects how benefit amounts are adjusted where a change would reduce an existing beneficiary and increase another. Existing beneficiaries who had an entitlement or a benefit payable immediately before commencement (31 December 2019) are potentially protected for post‑commencement days under the transitional rule.

Secondary affected parties

• The trustee/administrator (referred to implicitly, with direct mention of CSC in item 3(2)(b)). Administrators must implement the new definitions, accept and process applications/requests, determine the relevant commencement day for each benefit-payment day, and perform the transitional calculations specified in item 4. The instrument imposes administrative and record‑keeping tasks, including tracking death dates, benefit payable dates, notices received, and calculations of proportionate reductions among new beneficiaries where necessary.

• The PSS fund (the trust’s assets and, by extension, sponsoring departments or budget allocations that support liability management). The numeric effect is not in the text, but expanding eligibility to persons under 18 and widening eligibility for 18-24 full‑time students who are employed may increase the universe of beneficiaries for death benefits; the instrument itself does not specify funding changes, contribution rates, or employer obligations.

Tertiary affected parties

• Members and employers connected with the PSS who will see the trust deed language change but who are not immediate beneficiaries. The revised definitions may influence actuarial assessments of liabilities and future pricing of employer contributions or budgetary provisioning, but no explicit financial mechanics are set out in the text.

Who has agency

• The Minister for Finance made the instrument under statutory authority (s 3). Trustees/administrators decide how to apply the PSS Rules operationally, including processing notices (Schedule 1, item 3(2)) and performing the transitional benefit adjustments (Schedule 1, item 4). Young persons and persons to whom benefits are payable have the right to request that CSC apply the amendments (item 3(2)(b)(i) and (ii)), thereby exercising agency over when the amendments start to apply in some cases.

Who bears costs

• The instrument does not specify funding. Practically, increased benefit entitlements are paid from the PSS fund under the trust deed and PSS Rules. Where the amendments increase benefits, the fund liabilities increase, which affects whoever funds benefit shortfalls or absorbs higher liability in PSS governance arrangements. The text itself does not allocate who meets additional funding needs.

Matters not addressed in the instrument

• The instrument does not alter contribution arrangements, tax treatment, or detailed trustee duties beyond requiring application of the revised definitions and transitional calculations. It also does not amend other schedules, rules or statutes, other than the PSS Trust Deed provisions specified.

Duties arising from the instrument

• Duty to apply the amended definitions. Trustees or administrators responsible for paying benefits under the PSS Rules must apply the substituted definitions of "eligible child" and "partially dependent child" in Rule 1.2.1 when determining entitlement for benefits payable for days on or after the applicable commencement times (Schedule 1, items 1 and 2; s 2 Commencement).

• Duty to determine temporal applicability. Administrators must determine whether the benefit is payable for a day occurring on or after 1 January 2020, and whether the death giving rise to the benefit occurred on or after 1 January 2020, or whether a benefit was payable on 31 December 2019 (Schedule 1, item 3(1)). If neither condition applies, administrators must recognise the instrument’s notice mechanism and apply the amendments only from the later of 1 January 2020 and the day notice is first given (item 3(1)(b) and (2)).

• Duty to process notices and applications. The instrument contemplates administrators accepting an application under the PSS Rules for a benefit or a request to CSC by the young person or by a person to whom a benefit is (or would be) payable in respect of the young person (Schedule 1, item 3(2)(a) and (b)). Administrators must treat such notices as triggering the application date described in item 3(1)(b).

• Duty to compute transitional adjustments. When the conditions in item 4(1) are met, administrators must increase the existing beneficiary’s post‑commencement benefit to its pre‑amendment level (item 4(2)), and apply corresponding reductions to new beneficiary amounts (items 4(3) and 4(4)). For multiple new beneficiaries, the reduction must be allocated in proportion to each beneficiary’s share of the total (item 4(4)(b)).

Rights arising from the instrument

• Right of young persons and beneficiaries to request application. The instrument explicitly recognises the right of a young person or a person to whom a benefit is or would be payable to request CSC to apply the amendments, thereby creating a practical ability to accelerate the amendments’ application for their circumstances (Schedule 1, item 3(2)(b)).

• Right to transitional protection. Where the conditions in item 4 are met, an existing beneficiary has a substantive right to have their post‑commencement benefit increased to the pre‑amendment amount, which is a defined, enforceable entitlement under the transitional rule.

Discretion and limits

• The instrument does not give the trustee a discretion to ignore or distort the substituting definitions. The trust deed definitions are replaced; trustees must apply them consistently for the relevant benefit days. However the instrument builds in a procedural discretion for administrators to identify the right commencement day based on the presence of notices, applications or the specific death and benefit-payable dates.

• The instrument does not create new discretionary powers to change policy or payment methodology outside of calculating proportionate reductions among new beneficiaries under item 4(4). The mechanics of the proportional reduction are prescribed in general terms but require trustees to determine each new beneficiary’s share of the total to implement the proportionate reduction.

Interaction with existing PSS Rules and entitlements

• The duties flow from the trust deed and the PSS Rules as amended. The instrument does not itself rewrite other trust deed provisions, nor does it set out procedural timelines for trustees to respond to the notices. Trustees will need to reconcile the instrument with operational PSS Rules and standard claim administration procedures.

Enforcement mechanisms implied

• Enforcement of these duties will occur through the trust deed’s internal governance, PSS Rules, and any statutory obligations trustees hold under the Superannuation Act 1990. The instrument does not create new regulatory penalties; compliance will be a matter for trust governance and any applicable remedies in law for breach of trust or failure to pay benefits correctly.

The instrument itself contains no express penalty provisions or enforcement mechanisms in the criminal or civil penalty sense. It is an amendment instrument that substitutes definitions and sets application and transitional rules within the PSS Trust Deed. The text does not create new offences, fines, or specific regulatory enforcement processes.

How compliance will be enforced in practice (as implied by the instrument)

• Trustee/administrator obligation: The primary compliance mechanism is the trustee’s duty to administer the trust deed and PSS Rules correctly. Trustees are generally subject to fiduciary obligations and statutory duties under superannuation law and trust law. The instrument does not alter those general duties; it requires trustees to apply the substituted definitions and transitional rules when determining and paying benefits (Schedule 1, items 1-4). Non‑compliance would therefore be actionable through existing trust law remedies or statutory regulatory mechanisms that apply to trustees, though none are specified in this instrument.

• Member/beneficiary remedies: Beneficiaries or persons seeking benefits who believe the trustee has misapplied the amended definitions or transitional protections have existing legal remedies outside the instrument, such as complaining to the trustee, seeking internal dispute resolution, or pursuing litigation or complaint to a superannuation complaints body, where relevant. The instrument provides the substantive eligibility and transitional entitlements which would be enforceable as trust deed rights.

• Administrative review: The instrument references CSC as the agency to which a young person or a beneficiary may request application of the amendments (Schedule 1, item 3(2)(b)). CSC’s internal administrative processes, including claim handling and reviews, are therefore a practical enforcement channel to implement the instrument. The instrument does not set up a new review body or time limits for CSC to respond.

No sanctions section

• There is no sanctions section in the instrument. There is also no express requirement to publish changes to members, no fines for late implementation, and no new criminal offences for errant administrators. Any enforcement will rely on existing supervisory frameworks and legal remedies for trustees.

Practical effect on enforcement risk

• Because the instrument creates new entitlement categories and a non‑reduction guarantee in specified circumstances (Schedule 1, item 4), trustees must make accurate determinations of whose entitlement changed and perform sometimes complex arithmetic allocations where multiple new beneficiaries exist. Errors in calculation or failure to follow the transitional allocation could expose trustees to claims for breach of trust or entitlements under the PSS Rules.

• The notice mechanism in item 3(2) introduces a step where beneficiaries or young persons may trigger application of the amendments. Trustees must have procedures to log and respond to such requests. Failure to treat such requests correctly could be a source of disputes.

In short, penalties and enforcement are governed indirectly by the trustee’s existing legal obligations and remedies available to beneficiaries. The instrument prescribes substantive rights but leaves enforcement to existing administrative and legal frameworks.

Statutory basis

• The instrument is made under section 5 of the Superannuation Act 1990 (s 3 Authority). It therefore exercises delegated legislative power to amend a trust deed that falls under the governance scheme established by the Superannuation Act 1990. The instrument itself does not amend that Act; it operates within the authority conferred by it.

Interaction with the PSS Trust Deed and PSS Rules

• The instrument directly amends the Public Sector Superannuation Scheme Trust Deed by substituting the definitions in Rule 1.2.1 (Schedule 1, items 1 and 2) and by inserting application and transitional items (Schedule 1, items 3 and 4). Those substituted definitions and items must be read into and operate as part of the PSS Trust Deed and as part of the PSS Rules that flow from the trust deed. The instrument therefore modifies the internal legal structure that determines entitlement to death and dependent benefits under the PSS.

Temporal interactions with existing entitlements

• The application provisions (Schedule 1, item 3) define the interaction between the amended trust deed provisions and events or status existing at 31 December 2019. Where a benefit was payable under the PSS Rules to or for a young person or to or for another person in respect of the young person on 31 December 2019, the amendments apply to benefits payable for days occurring on or after 1 January 2020 (item 3(1)(a)(ii)). This cross‑references existing entitlement status and therefore modifies entitlement calculation going forward for persons who already had benefits payable before commencement.

No explicit cross-references to tax, social security or other statutes

• The instrument does not make express references to taxation law, social security law, or other Commonwealth or State statutes. It therefore does not purport to alter tax treatment or social security means tests. Any downstream tax or social security effect would arise from the application of those separate regimes to death benefits or pensions paid under the PSS Rules, but the instrument does not address or alter those regimes.

Interaction with trustee fiduciary and statutory duties

• The instrument places new substantive obligations on trustees to apply the amended definitions and transitional calculations. Trustees’ obligations arise under the trust deed, the Superannuation Act 1990 and general trust and fiduciary law. The instrument does not relieve trustees of other statutory compliance obligations, including reporting and prudential obligations applying to superannuation entities where applicable. Trustees must reconcile the instrument with those duties when calculating liabilities and making payments.

Interaction with the Federal Register of Legislation and commencement timing

• Section 2 specifies commencement by reference to registration on the Federal Register of Legislation and to the date 1 January 2020. The instrument therefore interacts procedurally with the Federal Register of Legislation: some operative parts take effect the day after registration, others commence on 1 January 2020, and item 3 commences the day after registration (s 2 Commencement). Accurate record of registration date is therefore necessary to determine which parts apply when.

Matters not altered or overridden

• The instrument does not amend other parts of the PSS Trust Deed beyond the specified rule and items. It also does not alter the beneficiaries’ legal status under other laws, nor the general operation of the PSS for other categories of benefits. It does not change contribution rules, accruals, tax concessions, or the trustee’s investment powers. Any determination that the instrument conflicts with another statute is outside the instrument; the text contains no savings or overriding clauses other than the narrow transitional protection in item 4.

In summary, the instrument is a trust‑deed amendment exercising power under the Superannuation Act 1990 and interacting primarily with the PSS Trust Deed, the PSS Rules, and the trust administration procedures triggered by notices and by benefit-payable dates. It does not purport to change or override taxation or social security laws and does not create new statutory enforcement mechanisms beyond those that already apply to trustees.

Instrument metadata and authorship

• The instrument is titled Superannuation Amendment (PSS Trust Deed) Instrument 2019 and is dated 16 September 2019 with Mathias Hubert Paul Cormann, Minister for Finance, as the maker (cover page).

Authority and legal basis

• The instrument is made under section 5 of the Superannuation Act 1990 (s 3 Authority). It amends the Public Sector Superannuation Scheme Trust Deed by operation of its Schedule (s 4 Schedules).

Commencement mechanics

• The instrument contains a commencement table in section 2 that stages the start of different provisions:

  • Sections 1 to 4 and any part of the instrument not otherwise covered commence the day after this instrument is registered on the Federal Register of Legislation (s 2, Commencement table, item 1).

  • Items 1, 2 and 4 in the Schedule commence on 1 January 2020 (s 2, Commencement table, item 2). Those are the substituted definitions for "eligible child" and "partially dependent child" and the transitional non‑reduction provision.

  • Item 3 in the Schedule (the application rule) commences the day after registration on the Federal Register of Legislation (s 2, Commencement table, item 3). The instrument also includes the standard note that any information in Column 3 of the commencement table is not part of the instrument (s 2(1) and (3)).

Schedule amendments

• Schedule 1,Amendment of the Public Sector Superannuation Scheme Trust Deed, contains the operative amendments under three labelled items:

  • Item 1 substitutes the definition of "eligible child" in Rule 1.2.1 (Schedule 1, item 1).

  • Item 2 substitutes the definition of "partially dependent child" in Rule 1.2.1 (Schedule 1, item 2).

  • Item 3 sets out application rules linked to death dates, benefits payable as at 31 December 2019, and a notice mechanism to trigger application where the other conditions do not apply (Schedule 1, item 3).

  • Item 4 provides a transitional provision preventing a decrease to certain existing beneficiaries and allocating necessary reductions to new beneficiaries proportionately (Schedule 1, item 4).

No prior or subsequent amendments recorded in the supplied text

• The instrument text supplied contains only this single amendment instrument. It does not include prior versions of the PSS Trust Deed or any other amending instruments. It also does not itself record any subsequent amendments. The only dates within the instrument are the making date (16 September 2019), the staged commencement dates (day-after-registration and 1 January 2020), and the pre‑commencement reference date, 31 December 2019, used in the application rules.

Transitional operation and savings

• Item 4 operates as a savings/transitional provision protecting certain existing beneficiaries’ entitlements. It prescribes an adjustment mechanism that increases the existing beneficiary’s post‑commencement benefit to the pre‑amendment level, and subtracts that increase from new beneficiaries’ post‑commencement benefits either wholly (if one new beneficiary) or proportionately (if more than one new beneficiary) (Schedule 1, item 4(2)-(4)).

Recordation and public availability

• The instrument’s commencement references registration on the Federal Register of Legislation. The instrument must therefore be published and available publicly in the Register once registered, at which point various provisions commence as specified (s 2). The text supplied does not include any explanatory memorandum or second reading speech; those materials, if they exist, are not part of the supplied instrument.

Summary timeline

• Made 16 September 2019; registration date (not supplied) determines the "day after registration" triggers. Item 3 takes effect from day after registration; items 1, 2 and 4 take effect from 1 January 2020. The practical effect is that the main substantive definition changes operate for benefit‑payment days from 1 January 2020 with certain cases subject to the notice rule commencing from the day after registration.

The supplied instrument text contains no references to litigation, court decisions, or adjudications that interpret or challenge these amendments. It does not cite any cases, nor does it record any existing or previous disputes connected to the PSS Trust Deed amendments.

Implications of absence of litigation material

• There is no litigation history in the instrument material provided. Therefore there are no court-authoritative interpretations of the substituted definitions, the application item, or the transitional protection in item 4 in the supplied source.

• Because the instrument creates or alters substantive entitlements under a trust deed, disputes could arise in practice about interpretation (for example, the meaning of "receiving full-time education at a school, college or university" or the precise mechanics of the proportional reduction among new beneficiaries under item 4(4)). But the supplied text contains no adjudicated examples to draw upon.

Potential disputes implied by the instrument (based on the text)

• Interpretation of "receiving full-time education at a school, college or university." The instrument uses that phrase in both substituted definitions (Schedule 1, items 1 and 2). In practice, disputes could arise about what counts as full‑time education, what institutions qualify as "school, college or university," and how to treat mixed work-study arrangements. The instrument does not clarify these matters.

• Determining the relevant day for application. Item 3 refers to benefits being "payable for a day occurring on or after" 1 January 2020 and to deaths occurring on or after 1 January 2020, as well as to a benefit being payable on 31 December 2019. There is scope for disputes about how to characterise "payable for a day" and whether a particular payment, period or date falls on or after 1 January 2020.

• Calculating proportionate reductions. Item 4(4)(b) requires reductions to be applied to each new beneficiary in proportion to their share of the total. Trustees must calculate each beneficiary’s share which could be disputed, particularly where the PSS Rules contain multiple classes of beneficiary or differently characterised entitlements.

No precedent or guidance in the instrument

• The instrument does not provide guidance on dispute resolution, arbitration, timeframes for trustees to respond to requests, or internal dispute resolution processes. Any disputes that arise will be resolved under existing PSS dispute mechanisms, trust law, and any applicable superannuation dispute resolution framework, but such mechanisms are not described in the instrument.

Conclusion on litigation history

• There is no litigation history embedded in the instrument provided. Any legal disputes that arise from implementing or interpreting the amendments will occur after implementation and will need to be resolved by the standard legal forums or administrative dispute-resolution channels applicable to the PSS and its trustee.

1. Commencement timing is multi-layered and can be decisive. Items 1, 2 and 4 (the definition changes and the transitional protection) commence on 1 January 2020 (s 2, Commencement table). Item 3 (application of amendments) commences the day after registration. Sections 1 to 4 otherwise commence the day after registration. The precise registration date therefore affects when certain procedural mechanisms are available to members. Administrators must track the registration date on the Federal Register of Legislation to know when item 3 becomes operative. Misreading these staggered commencements can produce incorrect determinations of which definition applies on a given benefit-payment day.

2. The phrase "for a day occurring on or after 1 January 2020" ties application to payment days, not to when a claim is made or a consent given. Item 3(1) frames the amendments as applying "to the extent that the benefit is payable for a day occurring on or after" the relevant date. Trustees must therefore consider the period for which benefits are payable and map those to calendar days. Errors can occur if administrators treat the triggering event as the date of claim or the payroll date rather than the benefit-payable day.

3. The death-date condition vs. benefit-payable condition: item 3(1)(a)(i) says the amendments apply if "the benefit is payable because of the death of a person that occurred on or after 1 January 2020." If the death pre-dates 1 January 2020, but a benefit was payable on 31 December 2019 in respect of the young person, the amendments can still apply (item 3(1)(a)(ii)). If neither condition is satisfied, application can still be triggered by notice under item 3(1)(b) but only from the later of 1 January 2020 and the day notice is first given. Practically that means a death before 1 January 2020 with no benefit payable on 31 December 2019 will not automatically be brought under the amendments; a request or application will be required.

4. The notice mechanism has a narrow set of actors who can trigger it. Item 3(2) lists the ways to give notice: an application under the PSS Rules for a benefit to be paid to or for the young person, or a request to CSC by the young person or by a person to whom a benefit is payable (or would be payable if the amendments applied) in respect of the young person. Persons outside those categories may not be able to trigger the notice provision.

5. Transitional protection is asymmetrical and fact-specific. Item 4 applies only where the amendments would reduce an existing beneficiary’s post‑commencement benefit and would increase a new beneficiary’s post‑commencement benefit for the same post‑commencement day. The protection increases the existing beneficiary’s post‑commencement benefit to what it would have been pre-amendment and reduces the new beneficiaries’ amounts correspondingly. That means where an amendment would reduce an existing beneficiary without producing a corresponding increase to another person, item 4 may not apply. Trustees must run the "would reduce" and "would increase" hypotheticals to know whether the protection activates. Administrative complexity, and potential for disputes, increases where multiple new beneficiaries share the increase because trustees must compute proportionate reductions.

6. The employment condition removed for older students may produce counterintuitive eligibility. Previously, persons aged 16 to less than 25 had to be both in full‑time education and not ordinarily employed or self‑employed to be eligible. The amendment removes the employment exclusion for persons aged 18 to under 25 who are in full‑time education. That means a 19-year-old in full‑time university study who is ordinarily employed may now be an eligible child. Trustees must update their eligibility checks to remove the "not ordinarily employed or self-employed" test for that cohort.

7. Ambiguity over "receiving full-time education at a school, college or university." The instrument uses this phrase without defining "full-time" or specifying acceptable education forms. Disputes may arise about part‑time study, mixed employment/study load, vocational training, apprenticeships, or online study. Trustees may need policy guidelines or discretion to determine when a person is "receiving full-time education at a school, college or university."

8. The instrument does not discuss funding or contribution consequences. Increased eligibility may increase liabilities of the PSS fund. Trustees and sponsoring agencies should be prepared for actuarial re‑assessments. The instrument does not set out who bears those increased liabilities or whether contribution rates or budgetary provisions will change.

9. Record-keeping requirements are implicit but material. To apply these provisions trustees must reliably record death dates, benefit-payable dates, whether a benefit was payable on 31 December 2019, and the dates on which any relevant notice or application was given. Failure to maintain accurate records could lead to incorrect entitlements or disputes.

10. The instrument creates a procedural right to request CSC to apply the amendments. Beneficiaries and young persons may use that right strategically, for example where an application would produce a better outcome. Trustees must have a procedure in place to receive, record and action such requests. There are no timeframes in the instrument for trustees’ responses, which may become a source of dispute.

In short, the operational subtleties revolve around commencement mechanics, precise date mapping to payment days, the limited actors who can trigger notice-driven application, the scope of the transitional protection and the unelaborated meaning of "full‑time education." Trustees should plan for precise operational rules and documentation to avoid errors.

Administrative steps trustees/administrators should take (based strictly on instrument text)

1. Update trust deed text and internal definitions. Implement the substitution of Rule 1.2.1 definitions as set out in Schedule 1, items 1 and 2. Ensure that system logic reflects that an "eligible child" is now a person under 18 years, or a person 18 to under 25 who is receiving full‑time education at a school, college or university (Schedule 1, item 1). Likewise update the "partially dependent child" definition (Schedule 1, item 2).

2. Map benefit-payable days and death dates against the commencement timetable. For every claim or ongoing benefit determine whether the benefit is payable "for a day occurring on or after 1 January 2020" and whether the death on which the benefit is founded occurred on or after 1 January 2020 (Schedule 1, item 3(1)(a)(i)). If a benefit was payable on 31 December 2019 to or for the young person or to or for another person in respect of the young person, apply the amendments to benefits payable for days on or after 1 January 2020 (item 3(1)(a)(ii)).

3. Implement notice-handling procedures. Item 3(2) allows an application under the PSS Rules or a request to CSC by the young person or by a person to whom a benefit is or would be payable in respect of the young person to trigger the amendments’ application where required. Trustees must:

   • Publicise to members and likely beneficiaries how to make such an application or request.

   • Record the date the application or request is received; item 3(1)(b) makes the amendments apply from the later of 1 January 2020 and the day notice is first given.

   • Ensure internal claims staff know how to treat and escalate these notices.

4. Operationalise the transitional protection calculations. Where the conditions in Schedule 1, item 4(1) are met, trustees must:

   • Determine the amount of the "existing beneficiary’s post‑commencement benefit" that would have been payable absent the amendments and increase the existing beneficiary’s post‑commencement benefit to that amount (item 4(2)).

   • If there is a single new beneficiary, reduce that new beneficiary’s post‑commencement benefit by the amount of the increase (item 4(3)).

   • If there are multiple new beneficiaries, reduce the total of the new beneficiaries’ post‑commencement benefits by the amount of the increase and apply that reduction to each new beneficiary’s post‑commencement benefit in proportion to his or her share of the total (item 4(4)(a)-(b)).

   • Document and retain records supporting every step of the calculation and the proportional allocation for audit and dispute resolution.

5. Review member communications and guidance. Notify members and potential beneficiaries of the amendments and explain the practical effects, including how to request CSC to apply the amendments where relevant. Ensure communications clarify the age thresholds and the education requirement for persons aged 18 to under 25.

6. Define "full-time education" policy. Because the instrument does not define "receiving full-time education at a school, college or university," trustees should develop and publish an operational definition consistent with the trust deed and PSS Rules. The policy should address how to treat online study, mixed work‑study arrangements, vocational training, apprenticeships, and what documentary evidence is required to demonstrate full‑time enrolment.

7. Liaise with actuarial and funding teams. Although the instrument does not specify funding adjustments, trustees should assess actuarial implications of increased eligibility and the transitional protection. Trustees should coordinate with sponsoring departments and actuarial advisers to model liabilities and, if necessary, advise sponsors of potential funding implications.

8. Train claims and legal staff. Provide training for staff who will administer claims to ensure they understand the new definitions, the commencement rules, the notice mechanism, and the transitional calculation steps. Ensure legal staff are prepared to address disputes around interpretation of "full‑time education" and the mechanics of the proportional reductions.

9. Maintain detailed records tied to relevant dates. Because much of the instrument’s operation depends on specific dates (date of death, whether a benefit was payable on 31 December 2019, date notice was given, registration date), trustees must ensure reliable date-stamping and an auditable trail of decisions and communications.

10. Prepare dispute-resolution processes. Anticipate likely areas of dispute and prepare internal dispute resolution and escalation processes. The instrument does not provide specific timelines for responding to notices or disputes, so trustees should set and publish reasonable timeframes for handling applications and requests triggered by item 3(2).

Checklist for claims processing logic

• Is the claim a death-benefit claim? If yes, determine date of death and link to item 3(1)(a)(i).

• Was a benefit payable on 31 December 2019 to or for the young person or to or for another person in respect of the young person? If yes, apply the amendments for benefits payable on and after 1 January 2020 (item 3(1)(a)(ii)).

• If neither of the above, did the young person or a beneficiary make an application under the PSS Rules or a request to CSC? If yes, apply the amendments from the later of 1 January 2020 and the date the notice was given (item 3(1)(b) and (2)).

• If the amendments would decrease an existing beneficiary’s post‑commencement benefit while increasing another’s, apply the transitional protection calculations (item 4).
