What it does
This Determination, made under section 34 of the Superannuation Act 1990 (the Act), allocates responsibility for particular categories of costs that arise under the Act and the Trust Deed governing the Commonwealth superannuation fund (the Fund). It takes effect from 1 July 1993 (s 2) and was amended effective 1 July 2011 (see Notes). Mechanically, the instrument performs two tasks.
First, it defines terms relevant to the allocation exercise. Section 3(1) provides three express definitions: "Act" means the Superannuation Act 1990; "costs" means the costs of the administration of the Act and the Deed, including the costs of and incidental to the management of the Fund by CSC and the investment of its money; and "CSC" is defined as the Commonwealth Superannuation Corporation, described as the body corporate continued in existence by section 4 of the Governance of Australian Government Superannuation Schemes Act 2011. Section 3(2) further imports words and expressions defined in the Act and the Trust Deed into the Determination, so the instrument relies on those external texts for full meaning.
Second, the Determination prescribes the split of costs. Section 4 says the Costs described in Schedule 1 are to be paid by CSC from the Fund, and the Costs described in Schedule 2 are to be paid by the Commonwealth. Schedule 1 identifies as Fund-borne the costs "of and incidental to the management of the Fund by CSC and the investment of its money." Schedule 2 identifies as Commonwealth-borne the remaining costs of administering the Act and the Trust Deed other than those in Schedule 1.
The Determination therefore establishes a categorical division rather than an itemised tariff: management and investment costs are debited to the Fund; other administration costs remain the Commonwealth’s responsibility. The instrument does not set procedural rules for apportionment, invoicing, or dispute resolution between CSC and the Commonwealth, nor does it provide enforcement mechanisms within the Determination itself. The allocation depends on the definitions in the Act and Trust Deed as imported by s 3(2) and on the text of the two Schedules (s 4; Schedules 1-2).
