Sunset Reserve Transformation Act 2014

The Act revolves around a small set of statutory concepts and instruments that together convert part of a Class A reserve into land able to be managed and disposed of for redevelopment while preserving an overall heritage precinct purpose.

Key defined terms include class A reserve, excised land, Minister for Works and Sunset Reserve (s 3(1)). Deposited plan 49483 is the cadastral reference that identifies the lots to be excised and is incorporated by reference (s 3(2)-(4); Sch 1). The Act consistently ties legal effects to the lots as shown on that deposited plan.

Reserve purpose change is the primary land law mechanism. Section 4 replaces the existing reservation purpose under the Land Administration Act 1997 Part 4 with a new purpose phrase: “Sunset Heritage Precinct for arts, cultural, community and ancillary commercial purposes”. That is a statutory amendment to the reserve’s reserved purpose rather than an administrative policy statement. The change operates in the reserve regime under the Land Administration Act.

Excision and transfer mechanisms follow conventional land-title mechanics but are done by statute. Sections 5 and 6 excise Lot 305 and Lot 304 from the reserve and add those lands to other specified Class A reserves (Class A reserve No. 29174 and Class A reserve No. 17391 respectively). Section 7 excises Lot 302 and transfers that excised land in fee simple to the Minister for Works, and expressly exempts that transfer from duty under the Duties Act 2008 (s 7(2)-(3)). The Registrar of Titles is required to register those amendments and the transfer and may treat sections 4 to 7 as if they were orders under the Land Administration Act 1997 to effect registration (s 8).

Planning law change is achieved by statutory amendment to the Metropolitan Region Scheme and the Nedlands planning scheme. Those changes convert hospital-purpose reservation to parks and recreation for retained reserve areas, delete reservation for excised land and rezone that excised land as Urban at the regional level (s 11), and zone the excised land Residential and designate R12.5 under the local planning scheme for R-Codes purposes (s 12). Section 13(1) gives those amendments the same effect as if enacted under the Planning and Development Act 2005, while s 13(2) clarifies that nothing here affects the operation of that Act with respect to the amendments.

The Minister for Works is given a broad functional mandate to plan, promote, coordinate and dispose of excised land and to enter into contracts and apply for approvals (s 14). Delegation of those functions is expressly permitted but must be in writing signed by the Minister (s 15). Where functions are delegated, actions taken by the delegate are taken to be in accordance with the terms of the delegation unless the contrary is shown (s 15(3)).

Fiscal and accounting concepts are contained in s 16, which establishes the Sunset Reserve Account as an agency special purpose account under the Financial Management Act 2006 s 16. The account is credited with proceeds of disposal of excised land, moneys received from lease or other use of any part of Sunset Reserve, and any appropriation or other lawful receipts. Moneys in the account must be applied to payment of costs and expenses incurred in conservation and management of Sunset Reserve (s 16(1)-(3)).

Finally, regulatory competency is preserved to the Executive through a general regulation-making power vested in the Governor to prescribe matters required or convenient to give effect to the Act (s 17). The Act also includes an express saving that nothing in Part 2 affects the Minister for Lands’ powers under the Land Administration Act 1997 (s 9), which retains existing administrative powers alongside the statutory changes enacted here.

The Act affects a discrete group of institutional and economic actors by altering title, planning status and management pathways for specific parcels of land within Sunset Reserve. Primary affected parties are:

• The Minister for Works: The statute transfers Lot 302 in fee simple to the Minister for Works (s 7(2)) and confers on that corporate body a statutory delegation of functions to plan, hold, deal with and dispose of the excised land, to sign documents, enter contracts and apply for permissions (s 14). The Minister for Works is therefore the central decision-maker authorised to manage disposal and redevelopment processes for the excised land.

• The Registrar of Titles: The Registrar is required to take measures necessary to register the amendments to reservation, classification and other changes to land effected by ss 4-7 and to register the transfer of the fee simple to the Minister for Works (s 8). The Registrar must treat ss 4-7 as if they were orders under the Land Administration Act 1997 for registration purposes (s 8(2)). The agency that holds deposited plan 49483 is the agency principally assisting in the administration of the Transfer of Land Act 1893 (s 3(3)); that agency will be involved in cadastral and title work.

• The Minister for Lands and the agency administering the Land Administration Act 1997: Part 2 includes an express saving that nothing in that Part affects the powers conferred on the Minister for Lands by the Land Administration Act 1997 in relation to Sunset Reserve (s 9). Therefore, administrative powers and decisions retained by the Minister for Lands under existing statute continue to be relevant to the reserve.

• Local government and planning authorities: The Metropolitan Region Scheme and the City of Nedlands Town Planning Scheme No. 2 are amended by statute (ss 11-12). The planning authorities responsible for administering those schemes will operate under the new statutory zoning and reservation matrix. The Nedlands planning scheme amendment designates excised land as R12.5 under the State Planning Policy 3.1 R-Codes framework, which will constrain and inform development approvals under local planning laws (s 12(b)).

• Potential private purchasers, developers and lessees: The Act removes reservation of the excised land and zones it Urban at the regional level and Residential R12.5 at the local level (ss 11-12). That creates a pool of land that the Minister for Works may hold, deal with or dispose of (s 14). Any private entities wishing to acquire, lease or develop excised land will be affected by the Minister for Works’ disposal process, the zoning/designation outcomes and the requirement that disposal proceeds be applied to the Sunset Reserve Account (s 16).

• The Western Australian public and cultural stakeholders: The change in reserve purpose to a Sunset Heritage Precinct for arts, cultural, community and ancillary commercial purposes (s 4) and the direction to apply account proceeds to conservation and management of Sunset Reserve (s 16(3)) have non-market and public-interest consequences for those concerned with heritage conservation, cultural facilities and public open space.

• Treasurer and Parliament: The Sunset Reserve Account is an agency special purpose account under the Financial Management Act 2006 (s 16(1)). Moneys may flow into it by appropriation or lawfully received receipts (s 16(2)(c)). Parliamentarily authorised appropriations remain a funding route.

• The Governor: The Governor may make regulations to prescribe matters required or convenient for the Act’s purposes (s 17), implicating executive regulation-making discretion.

Who does not gain an express exemption? The Act expressly clarifies that nothing in s 14 is to be read as conferring immunity on the Minister for Works from operation of any written law that applies in relation to the excised land (s 14(3)). Also, the statute contains an express duty exemption only for the transfer of the fee simple to the Minister for Works (s 7(3)); it does not purport to exempt subsequent dispositions by the Minister for Works from other taxes or charges.

The Act creates a compact set of statutory duties and rights for the relevant actors, organised around title registration, reserve management, planning classification, disposal powers and financial accounting.

Duties on the Registrar of Titles

• The Registrar must take necessary measures to register amendments to reservation, classification and other changes effected by ss 4-7, and to register the transfer effected under s 7(2) (s 8(1)). For registration purposes, ss 4-7 may be treated as if they were orders under the Land Administration Act 1997 (s 8(2)). This creates an enforceable administrative duty on the Registrar to effect title changes consistent with the statute.

Rights and obligations of the Minister for Works

• The Minister for Works receives fee simple title to Lot 302 (s 7(2)). That is a proprietary right, subject to the relevant statutory limitations and other written laws. The Act then confers broad statutory powers on the Minister to “plan, undertake, promote and coordinate the disposal of the excised land” (s 14(1)). Subsection 14(2) lists specific authorities: to hold, deal with and dispose of the excised land; sign documents; enter contracts and arrangements with any person including public authorities and local government; and apply for licences, approvals or other authorities required for those purposes. These are positive statutory rights to act as an owner and vendor of the excised land.

• The Act imposes a limitation of scope: nothing in s 14 is to be read as granting an immunity from any written law that applies in relation to the excised land (s 14(3)). Hence, regulatory and statutory obligations outside this Act continue to bind the Minister.

Delegation requirements

• The Minister for Works may delegate any function under s 14 but the delegation must be in writing signed by the Minister (s 15(1)-(2)). Actions by the delegate are taken to be performed in accordance with delegation terms unless the contrary is shown (s 15(3)). The provision also clarifies it does not limit the Minister’s ability to act through an officer or agent (s 15(4)). The statutory drafting sets a formal delegation duty and evidentiary standard for delegate actions.

Planning and zoning effects

• The Act alters the planning regime for the relevant parcels. The Metropolitan Region Scheme’s reservation for parts of Sunset Reserve formerly described as “Public Purposes , Hospitals” is changed to “Parks and Recreation” (s 11(a)), and the reservation for the excised land is deleted and that land zoned “Urban” (s 11(b)). The Nedlands planning scheme is amended to zone the excised land “Residential” and designate it R12.5 for purposes of State Planning Policy 3.1: Residential Design Codes (s 12). Those amendments have effect as though enacted under the Planning and Development Act 2005 (s 13(1)). These provisions impose statutory development controls and planning rights on future owners and developers of the excised land.

Financial duties and application of proceeds

• An agency special purpose account, the Sunset Reserve Account, must be established under the Financial Management Act 2006 s 16 (s 16(1)). The account is to be credited with proceeds of disposal of the excised land, moneys from leases or other use of any part of Sunset Reserve, and any parliamentary appropriation or lawful receipts (s 16(2)). Moneys in the account must be applied to payment of costs and expenses incurred in the conservation and management of Sunset Reserve (s 16(3)). The account therefore imposes an earmarking duty on the application of proceeds and receipts.

Duty exemption

• The Act explicitly provides that duty is not chargeable under the Duties Act 2008 on the transfer of the fee simple in the excised land to the Minister for Works (s 7(3)). That is a statutory tax concession limited to the transfer in s 7(2).

Regulation-making power

• The Governor may make regulations prescribing matters required or convenient to give effect to the Act (s 17). That creates an executive power to formulate secondary rules and administrative detail, and thereby an ongoing compliance framework once regulations are made.

Savings

• Nothing in Part 2 affects the powers conferred under the Land Administration Act 1997 on the Minister for Lands in relation to Sunset Reserve (s 9). That preserves pre-existing statutory administrative obligations and discretions relating to the reserve.

Overall, key rights are the fee simple transfer to the Minister for Works and the planning and disposal authorities conferred on the Minister. Key duties are the Registrar’s registration obligations, the Minister’s requirement to comply with other written laws and delegation formalities, and the fiduciary-like obligation to apply proceeds held in the Sunset Reserve Account to conservation and management of the reserve.

The Act contains no new criminal penalties, infringement schemes or express civil penalty provisions for non-compliance within its own text. It instead relies on a combination of administrative obligations, savings to other statutory regimes and the general operation of applicable laws to produce enforceable consequences.

Absence of express penalty clauses

• The Act does not create specific offences or monetary penalty mechanisms for breaches of any of its operative provisions. There are no express enforcement provisions within the text that establish criminal sanctions or civil penalties for failure to comply with duties such as registration (s 8), delegation formalities (s 15) or proper application of account moneys (s 16). Where a statutory duty is imposed, enforcement will therefore depend on pre-existing administrative or judicial remedies, the operation of other Acts, or the exercise of public law oversight.

Reliance on existing written laws and administrative enforcement

• The Act makes explicit that nothing in s 14 is to be read as conferring immunity from any written law applying in relation to the excised land (s 14(3)). That signals the Legislature’s intention that any contraventions of other applicable laws continue to attract the enforcement regimes provided under those other statutes, which may include criminal penalties, regulatory sanctions or administrative remedies. For example, planning breaches, contractual breaches, environmental obligations, procurement or public tendering obligations, taxation breaches, building approvals and heritage laws remain governed by their respective enforcement frameworks. The Act itself does not circumscribe those enforcement mechanisms.

Registrar obligations and remedy avenues

• The Registrar of Titles is required to register the amendments and the transfer (s 8). Failure by the Registrar to register could provoke administrative review, mandamus or other judicial review remedies in the Supreme Court, but the Act does not specify enforcement mechanisms; recourse would be under general administrative law principles and any statutory review rights in the Land Administration Act 1997 or Transfer of Land Act 1893.

Financial accountability and public finance controls

• The Sunset Reserve Account is an agency special purpose account under the Financial Management Act 2006 (s 16(1)). The Financial Management Act 2006 contains its own compliance, audit and accountability regimes, including obligations on agencies, trustees and account holders, and audit by the Auditor General. The Act’s reliance on that framework means enforcement regarding misuse or misapplication of account funds would be pursued under the Financial Management Act 2006 and related public finance governance mechanisms rather than under this Act.

Regulatory instruments

• The Governor may make regulations necessary to give effect to the Act (s 17). Regulations can include compliance obligations, offences and penalties where authorised by the enabling Act. The Act’s grant to the Governor therefore remains a potential enforcement avenue if the Executive chooses to prescribe contraventions and penalties by regulation, subject to legislative constraints.

Legal consequences of title and planning changes

• The statutory title alterations, reserve purpose change and planning reclassifications themselves will have legal consequences enforceable at common law and through statutory development control regimes. For instance, parties may seek specific performance or declaratory relief in respect of title or planning rights, or challenge administrative decisions under judicial review, but such actions will rely on existing legal procedures rather than on novel enforcement provisions in this Act.

In summary, enforcement is achieved by integrating the Act’s substantive changes into existing statutory and administrative enforcement architectures: land title registration mechanisms, the Financial Management Act audit regime, planning enforcement under the Planning and Development Act 2005 and other written laws applicable to the excised land. The Act itself does not create a standalone penalty regime.

The Act is expressly drafted to operate in concert with, not as a substitute for, a range of existing Western Australian statutes. It effects discrete statutory amendments while preserving or referencing the operation of other legal regimes.

Land Administration Act 1997

• The Act changes the reserved purpose of Sunset Reserve under the Land Administration Act 1997 Part 4 (s 4). For registration purposes, the Act permits sections 4 to 7 to be treated as if they were orders under the Land Administration Act 1997 (s 8(2)). At the same time, Part 2 includes an express saving that nothing in the Part affects the powers conferred under the Land Administration Act 1997 on the Minister for Lands in relation to Sunset Reserve (s 9). The combined effect is a statutory change to reserved purpose and classification while preserving the Minister for Lands’ statutory powers under the Land Administration Act 1997 and aligning title registration mechanics with that Act.

Transfer of Land Act 1893

• Deposited plan 49483, which defines the lots excised from Sunset Reserve, is held by the agency principally assisting administration of the Transfer of Land Act 1893 (s 3(3)). The Act therefore ties cadastral identification and registration work into the Transfer of Land Act machinery for title recording and registration.

Duties Act 2008

• Section 7(3) contains a specific exemption: duty is not chargeable under the Duties Act 2008 on the transfer of fee simple in Lot 302 to the Minister for Works. The Act thus interacts directly with the Duties Act to create a tax concession limited to that statutory transfer. The text does not attempt to address other potential duties or taxes in different circumstances.

Planning and Development Act 2005

• The Act amends the Metropolitan Region Scheme and the Nedlands planning scheme and provides that those amendments have effect as though enacted under the Planning and Development Act 2005 (s 13(1)). This gives the statutory amendments the same legal force as if they had been made using the normal Planning and Development Act processes. Section 13(2) clarifies that nothing in this Part affects the operation of the Planning and Development Act 2005 with respect to the amendments effected by this Part, preserving the underlying planning framework and any applicable processes or legal tests that flow from that Act.

State Planning Policy 3.1: Residential Design Codes

• The Act designates the excised land R12.5 for the purposes of State Planning Policy 3.1: Residential Design Codes (s 12(b)). The Act therefore invokes an external policy instrument by reference, linking the statutory zoning outcome to the R-Codes framework. The Act does not itself define R12.5 or the R-Codes’ operative standards; compliance and interpretation of the R-Codes remain governed by the planning policy and the Planning and Development Act machinery.

Financial Management Act 2006

• The Sunset Reserve Account is to be established as an agency special purpose account under the Financial Management Act 2006 s 16 (s 16(1)). This places the account within the Financial Management Act’s regime for public accounts, appropriation, audit and financial controls. Moneys credited to and applied from the account are subject to that Act’s governance.

Other written laws

• The Act expressly confirms that nothing in s 14 confers immunity from the operation of any written law that applies in relation to the excised land (s 14(3)). This preserves applicability of environmental, heritage, planning, building, public procurement and other statutes and regulations that might constrain how the Minister for Works holds, deals with or disposes of the excised land.

Regulations

• The Governor may make regulations prescribing matters required or convenient for giving effect to this Act (s 17). Such regulations could interact with and supplement the planning, administrative and financial frameworks referenced in the Act.

Taken together, the Act is intended to slot into the existing architecture of Western Australian land, planning and financial legislation. It produces statutory effects directly where necessary and relies on other regimes to provide detailed governance, enforcement and standards. The Act preserves the operation of the Land Administration Act 1997, the Planning and Development Act 2005 and other written laws, while providing specific alterations to title, zoning and ownership that the other laws will operationalise.

The Act’s compilation table supplied in the source sets out its short title, number, assent date and commencement dates. The legislative metadata in the source are:

• Short title: Sunset Reserve Transformation Act 2014 (as stated in s 1).
• Number and year: 7 of 2014.
• Assent: 22 April 2014.
• Commencement: Sections 1 and 2 commenced on 22 April 2014; the remainder of the Act commenced on 23 April 2014 (s 2 and compilation table).

The schedule of defined terms at the end of the compilation materials repeats definitions included in the Act: class A reserve, excised land, Metropolitan Region Scheme, Minister for Works, Nedlands planning scheme and Sunset Reserve. No amending Acts, subsequent repeals, or consolidated amendment notes are included in the provided compilation. The compilation table does not record any later amendments or indications of repeal or modification beyond the original enactment metadata.

The Act itself contains internal transitional mechanics rather than staged amendment dates. The immediate and full force of the operative provisions (ss 4-17) began the day after Royal Assent, per the commencement scheme (s 2). The structure of the Act directly effects the reserve purpose change, excision of lots, transfer, planning scheme amendments and establishment of the Sunset Reserve Account on that commencement timetable.

The Schedule includes deposited plan 49483, which was finalised and is referred to by s 3(2)-(4). The plan is identified in Schedule 1 with an indicative depiction. The compilation shows the plan was finalised by 5 September 2013 (the image file name references that date), indicating cadastral work preceded the Act. However, the Act does not include a separate savings or transition clause specifying staged implementation beyond the Registrar’s registration obligations (s 8).

No textual note in the provided compilation indicates subsequent statutory amendments to this Act, nor are any amendment Acts or dates recorded in the source document beyond its original enactment. If there have been amendments since the original enactment, they are not contained in the supplied text. Users should therefore cross-check current consolidated versions and the Western Australian legislation database for post-2014 amendments or repeals not present in the provided compilation.

The source contains no references to case law, judicial decisions, litigation or disputes arising under the Sunset Reserve Transformation Act 2014. The Act text and the compilation materials do not name any judicial proceedings, nor do they record citations to cases, or list any litigation history. The Act also does not refer to previous court determinations as part of its legislative background.

Because the supplied statutory material lacks any litigation references, no source-based statements can be made about judicial interpretation, contested administrative decisions, or remedies sought under the Act. The absence of litigation history in the source means that users seeking case law or precedential guidance on how courts have interpreted the Act’s provisions must consult external legal databases, court registries or subsequent consolidated legislation notes which might record judicial treatment or disputes. The Act itself does not establish a special dispute resolution forum or specify a tribunal for challenges; standard administrative and judicial review processes under general law and the other applicable statutes would therefore apply.

In short, the provided source does not record any litigation history. Any assertions about judicial treatment, contested political or contractual disputes, or precedent must be drawn from external sources not contained in the statutory text supplied here.

The Act contains a number of tightly drafted, technical provisions that create potential points of confusion or unintended consequence if implementers or stakeholders do not attend to the precise statutory wording. The following are source-grounded matters to watch.

Scope of the duty exemption

• Section 7(3) states that duty is not chargeable under the Duties Act 2008 on the transfer of fee simple in the excised land under s 7(2). That exemption is narrowly framed to the specific statutory transfer of Lot 302 to the Minister for Works. It does not, on its face, extend to subsequent dispositions by the Minister for Works, to transfers of Lots 304 or 305 (which are added to other Class A reserves), nor to other taxes, charges or levies that might attach to later dealings. Parties should not assume a broader tax immunity beyond the textual exemption.

Registration mechanics and reliance on deposited plan

• The Act references the lots as shown on deposited plan 49483 and requires the Registrar of Titles to register the amendments and transfer and allows the Registrar to treat ss 4-7 as if they were orders under the Land Administration Act 1997 (s 8). In practice, this requires careful cadastral matching between the statutory description and the deposited plan held by the agency assisting the Transfer of Land Act administration (s 3(3)). Mistakes or mismatches in the plan depiction could delay registration or create title uncertainty. The Schedule provides an indicative depiction only; parties should obtain certified cadastral material.

Planning designation implications

• The Nedlands planning scheme amendment designates excised land R12.5 under State Planning Policy 3.1: Residential Design Codes (s 12(b)). R12.5 is a specific numerical density/designation within the R-Codes framework. The Act itself does not define what R12.5 requires or allows, and compliance with the R-Codes and obtaining development approvals will still be subject to the planning process under the Planning and Development Act 2005. Assumptions about permissible densities or built form should be verified against the R-Codes and any relevant local planning policies.

Minister for Lands powers preserved

• Part 2 expressly states that nothing in that Part affects the Minister for Lands’ powers under the Land Administration Act 1997 in relation to Sunset Reserve (s 9). This means that administrative decisions or actions by the Minister for Lands under the Land Administration Act remain available and may interact with the statutory changes enacted here. Implementers should not assume the Minister for Works’ powers override existing Minister for Lands discretions.

No standalone enforcement or penalty provisions

• The Act creates duties and account requirements but does not itself create penalty schemes or enforcement clauses. Enforcement depends on other statutes and administrative law remedies. If implementers expect new criminal or civil penalty teeth, they will not find them in this Act; those will only arise from other applicable written laws.

Sunset Reserve Account earmarking

• Proceeds of disposal of excised land are to be credited to the Sunset Reserve Account and applied to conservation and management of Sunset Reserve (s 16). That earmarking restricts available uses for proceeds and may affect how funds from disposal are budgeted and used. The account is an agency special purpose account under the Financial Management Act 2006 (s 16(1)), so Financial Management Act governance will apply. Parties negotiating purchase prices or contemplating how proceeds will be allocated should be aware of the statutory constraint on application of account funds.

Delegation formalities and evidentiary standard

• Delegations by the Minister for Works under s 15 must be in writing signed by the Minister (s 15(2)). Section 15(3) provides that the person performing a delegated function is taken to do so in accordance with the delegation unless the contrary is shown. This creates an evidentiary rule that favourably treats delegate actions where a written delegation exists. Absent written delegation, actions may be questioned.

Regulatory discretion unexercised

• The Governor may make regulations for matters required or convenient for the Act (s 17). Until regulations are promulgated, certain procedural or detailed matters may be governed by administrative practice rather than a regulation-backed framework. That may produce transitional uncertainty for processes such as disposal protocols, tendering or consultation unless administrative guidance or regulations are issued.

Contemporaneous operation with Planning and Development Act

• Section 13(1) says the planning amendments have effect as though enacted under the Planning and Development Act 2005, and s 13(2) says nothing in this Part affects operation of that Act with respect to the amendments. That dual statement means the amendments operate in a planning environment still governed by the general Planning and Development Act processes. Stakeholders should not treat the statutory zoning change as an automatic permit to develop; subsequent approvals, development applications and compliance with the planning framework still apply.

No immunity from other written laws

• Section 14(3) explicitly negates any read-across that the Minister’s powers under s 14 confer immunity from any other written law. Developers or agents working with the Minister should carefully identify other applicable statutory obligations, including environmental, heritage, building, workplace safety and procurement laws.

In sum, attention to the statutory wording, cadastral documentation, planning policy instruments and the Financial Management Act’s account rules is required to avoid missteps. The Act creates rights and constraints that interact with existing regimes; assumptions about tax treatment, procedural rules, enforcement or development permissibility should be checked against the cited provisions and the other statutes they reference.

Compliance under this Act falls into several discrete operational streams: title and registration, planning approvals and controls, Ministerial processes for dealing with excised land, financial management of proceeds, delegation formalities and adherence to other written laws. The following checklist-style explanation sets out the main compliance tasks grounded in the Act.

Registrar and cadastral compliance

• The Registrar of Titles must register the amendments to reservation and classification effected by ss 4-7 and the transfer of Lot 302 to the Minister for Works (s 8(1)). To comply, the Registrar should: obtain and verify deposited plan 49483 held by the relevant Transfer of Land Act agency (s 3(2)-(4); Sch 1); treat ss 4-7 as if they were orders under the Land Administration Act 1997 for registration purposes (s 8(2)); and record the transfer of fee simple to the Minister for Works. Ensure the Registrar’s file includes the statutory instrument references and the deposited plan to anchor title changes.

Minister for Works disposal and approvals

• The Minister for Works may plan, undertake, promote and coordinate disposal of excised land and has powers to hold, deal with and dispose of it, sign documents, enter into contracts with any person including public authorities or local government, and apply for licences and approvals required for those purposes (s 14(1)-(2)). Compliance steps for the Minister’s office include: prepare documented disposal policies and probity controls consistent with other written laws; ensure applications for licences and approvals are lodged where necessary; execute contracts and deeds in a manner compliant with public law and procurement rules; and ensure that dispositions are consistent with planning zoning (s 11-12) and other statutory obligations.

Delegation formalities

• Any delegation by the Minister for Works under s 15 must be in writing and signed by the Minister (s 15(2)). Maintain a delegation register that records the text of each delegation, the functions delegated, any limits or conditions, and signatures. The register provides evidence that delegate actions are being carried out under valid delegation (s 15(3)). Review delegations periodically for currency and alignment with delegated authorities.

Planning compliance

• The excised land is zoned Urban at the regional level and Residential R12.5 under the Nedlands planning scheme (ss 11-12). Entities (including the Minister for Works when disposing) must ensure development proposals and any uses comply with the R12.5 designation, the State Planning Policy 3.1 R-Codes, and the Planning and Development Act 2005 processes. Before committing to sale, lease or development, obtain planning advice and pre-application assessments to ensure designs align with R-Codes requirements and any other development controls under the relevant planning scheme.

Financial control and accounting

• Establish and maintain the Sunset Reserve Account as an agency special purpose account under the Financial Management Act 2006 (s 16(1)). Credit the account with proceeds from disposal of excised land, lease or use receipts, and appropriations (s 16(2)). Ensure account transactions are recorded, audited and reported in accordance with Financial Management Act requirements. Apply moneys from the account only to conservation and management costs and expenses for Sunset Reserve per s 16(3). Implement internal controls, budget approvals and audit trails to demonstrate that expenditures meet the statutory application restriction.

Tax and duties

• Note the specific duty exemption for the transfer of Lot 302 to the Minister for Works (s 7(3)). For all other transfers, leases or transactions, obtain tax and duty advice; do not assume other exemptions apply. For dispositions by the Minister for Works, ensure tax counsel reviews each transaction to determine stamp duty, GST, land tax and other possible tax consequences under the relevant Acts.

Interplay with other written laws

• Section 14(3) makes clear that the Minister’s functions do not confer immunity from other written laws. Compliance processes must therefore integrate regulatory and statutory obligations such as environmental approvals, heritage protections, building codes, procurement rules, equal opportunity and workplace safety requirements. Prepare checklists of applicable statutory approvals for each disposal or development step and embed those into project management.

Regulatory compliance

• Monitor for regulations made under s 17 by the Governor. Regulations could prescribe procedural requirements, consultation obligations or other matters necessary to give effect to the Act. Ensure legal and policy teams are alerted to any regulations and adapt compliance frameworks accordingly.

Records, transparency and public accountability

• Given public interest in a heritage and community precinct, maintain transparent records of disposal processes, decision-making rationales, sale agreements, valuations and use of proceeds in the Sunset Reserve Account. Compliance with the Financial Management Act and public disclosure obligations will be necessary for audit and public confidence.

Cadastral verification and risk management

• Before entering into contracts or conveying titles, obtain certified copies of the deposited plan 49483 and confirm lot boundaries and easements. Ensure title insurance or warranties are considered where appropriate and perform environmental due diligence where necessary.

Engagement with local government and stakeholders

• Engage early with the City of Nedlands and other planning stakeholders to confirm planning expectations and approvals under the amended Nedlands planning scheme. Early engagement can identify planning conditions that must be met, infrastructure contributions or other municipal requirements.

Legal review and approvals

• For each major step , registration, transfer, disposal contract, planning application and account expenditure , obtain legal sign-offs that the action conforms to the Act’s requirements and to the other applicable statutes referenced in the Act.

By following these steps and anchoring each action to the cited statutory provisions (ss 3-17), responsible agencies and private parties can operationalise the Act’s changes while maintaining compliance with the broader body of law in which the Act sits.
