Suicide Prevention Regulations 2022

The Regulations establish a small set of interlocking concepts that operate within the framework of the Suicide Prevention Act 2021. Each concept is defined by reference to a specific regulation and cross-referenced Act provision where the Regulations adopt or implement an Act-based requirement.

• State authority, inclusion and exclusion: Regulation 4 uses the Minister’s Gazette power to declare a person or body to be a State authority for the purposes of the Act’s definition (see reg 4(1) referencing paragraph (d) of the definition in s 3(1) of the Act). Conversely, reg 4(2) gives the Minister the power by Gazette notice to declare that a specified person or body is excluded from the ambit of that same definition. The Regulations thus treat the composition of the statutory class “State authority” as administratively adjustable by ministerial Gazette notice.

• Prescribed State authority for action plans: Regulation 5 prescribes, by Gazette notice, State authorities that count as “prescribed State authorities” for the purposes of section 25(9) of the Act. The Regulation does not itself set the content of any action plans, it only nominates which State authorities fall within that specific statutory category.

• South Australian Suicide Register content: Regulation 6 implements section 35(2) of the Act by specifying discrete categories of required information to be recorded in the Register. The categories are: methods used by individuals who died by suicide; demographic information; and a list of particular items of clinical and contextual information if known to the Chief Executive, including physical or mental health diagnoses, previous suicide attempts, known stressors, substance misuse, justice contacts, prior suicidal intent, and findings of the State Coroner (reg 6(1)(a)-(c)(i)-(vii)).

• Manner and form of data provision: Regulation 6(2) delegates to the Chief Executive the power to determine the manner and form for supplying the information set out in reg 6(1), invoking section 35(3) of the Act. This is an administrative standardisation mechanism.

• Access, permission and disclosure tests: Regulation 7 makes inspection of the Register contingent on the Chief Executive’s permission (reg 7(1)). The Chief Executive must grant inspection access to certain listed official bodies if satisfied particular necessity tests are met, for example that disclosure is reasonably necessary to protect lives or for relevant statutory functions (reg 7(2)). The State Coroner and Coroner’s Court must be granted access for inquest purposes and may request reports from the Chief Executive (reg 7(3)). Access to the sensitive subset of data identified in reg 6(1)(c) is subject to stricter tests (reg 7(4)), including protection of life/health safety, approved research ethics with a “best interests” check, or requirements linked to the Office of the Chief Psychiatrist’s statutory functions under the Act or the Mental Health Act 2009. The Chief Executive is required to balance privacy against risk of harm when deciding on these disclosures (reg 7(5)). Finally, reg 7(6) permits de-identified register data to be disclosed for reporting to Parliament and to the Australian Institute of Health and Welfare.

• De-identification and reporting limits: The Regulations draw a clear distinction between identifiable register content, which is under strict control, and de-identified data which can be used for certain reporting purposes (reg 7(6)).

These concepts show that the Regulations are primarily about administrative classification, data specification and controlled disclosure. Decision-making power is concentrated with the Minister for the scope of the statutory classes, and with the Chief Executive for the technical implementation of the register and for access/disclosure decisions.

The Regulations affect a defined set of executive bodies, statutory officers and entities that interact with the South Australian Suicide Register or are vulnerable to inclusion in the statutory classes managed by ministerial notice. The extent of effect depends on whether the Minister chooses to include or exclude an entity from the State authority definition, or to prescribe it for action-plan purposes.

• The Minister: The Regulations give the Minister two operational powers: to declare by Gazette that a person or body is a State authority for s 3(1) purposes (reg 4(1)), and to declare by Gazette that a person or body is excluded from that definition (reg 4(2)). Under reg 5, the Minister may prescribe specified State authorities as prescribed State authorities for s 25(9) purposes. The Minister therefore controls the membership of categories that trigger further responsibilities under the Act.

• The Chief Executive: The Chief Executive is the central administrative actor in relation to the Register, with responsibility to record the information specified in reg 6(1) as is “known to the Chief Executive”, to set the manner and form of how the information is provided (reg 6(2)), and to approve or refuse inspection and disclosure of the Register (reg 7(1)). The Chief Executive must satisfy statutory tests in granting access and must perform a privacy-versus-risk balancing exercise (reg 7(5)).

• Office of the Chief Psychiatrist: The Office has a specified access route to the Register, and the Chief Executive must grant permission if satisfied disclosure is reasonably necessary for the Chief Psychiatrist to perform functions under the Act or the Mental Health Act 2009 (reg 7(2) and reg 7(4)(c)). The Office therefore has both a statutory interest and a special position in the disclosure hierarchy.

• South Australia Police: The Police must be granted access under reg 7(2) if the Chief Executive is satisfied that disclosure contained in the Register is reasonably necessary to protect the lives of others. The Regulations thus create conditional access for law enforcement relevant to public safety.

• State Coroner and Coroner’s Court: The State Coroner and the Coroner’s Court must be granted access for the purposes of determining whether to hold an inquest, and for inquests respectively (reg 7(3)). The Chief Executive must provide reports if requested by those bodies, making coronial processes a routine user of register information when relevant.

• Treating health services: A decedent’s treating health service may obtain access if the Chief Executive is satisfied that the disclosure is reasonably necessary to protect the lives of others (reg 7(2)). This creates a potential clinical-use pathway linked to immediate public protection concerns.

• Researchers: Research access to the sensitive items in reg 6(1)(c) is permitted only where the research methodology has been approved by an ethics committee and there is no reason to believe disclosure would be contrary to the deceased individual’s best interests (reg 7(4)(b)). The Regulations therefore limit research access to ethically approved projects and add a best-interests filtering step.

• Parliament and the Australian Institute of Health and Welfare: Both are recipients of de-identified register data for reporting purposes under reg 7(6). That is an explicitly permitted disclosure channel for de-identified outputs.

• State authorities and bodies that may be prescribed: Entities that may be declared as State authorities or excluded from that definition, and those that may be prescribed as “prescribed State authorities”, are directly affected because those classifications operate to engage or remove statutory duties and roles set out in the Act. The Regulations require such classifications to be made by Gazette notice (regs 4 and 5), so affected bodies must monitor Gazette notices to know whether the Act applies to them in particular ways.

• Families of deceased persons and data subjects in the Register: The Regulations determine what information is retained about deceased persons for the State Register (reg 6(1)), and the circumstances in which identifiable or sensitive information may be disclosed (reg 7). The Chief Executive’s balancing test in reg 7(5) is the procedural safeguard the Regulations require to protect privacy.

Entities outside these categories are not directly mentioned in the Regulations. The Regulations do not, for example, create an express general public right to access the Register, nor do they create community reporting powers. The scope of who is affected is therefore narrow, but the design concentrates practical control of data and access in the hands of the Chief Executive, and of statutory inclusion in the hands of the Minister.

The Regulations allocate a small set of duties to the Minister and the Chief Executive, and outline rights of access for specified public bodies and actors. These duties and rights are administrative rather than criminal or civil remedies. They are phrased as mandatory and conditional obligations placed on the decision-making actors.

Duties allocated to the Minister

• Gazette notices to declare State authorities: The Minister must declare by Gazette notice a person or body to be a State authority for the purposes of paragraph (d) in the definition in s 3(1) of the Act (reg 4(1)). This is a duty to use delegated rule-making power to determine the composition of the statutory category.
• Gazette notices to exclude State authorities: The Minister may, by Gazette notice, declare a person or body excluded from the ambit of the State authority definition (reg 4(2)). This is framed as a power to carve out exclusions.
• Prescribe State authorities for action-plan purposes: The Minister must (or may) specify State authorities by Gazette notice to be “prescribed” for the purposes of s 25(9) concerning suicide prevention action plans (reg 5). The result is that the Minister’s notices have the legal effect of bringing particular State authorities into the Act’s “prescribed” class.

Duties allocated to the Chief Executive

• Recording mandated Register content: The Chief Executive must ensure the required categories of information set out in reg 6(1) are recorded on the South Australian Suicide Register to the extent known to the Chief Executive (reg 6(1)). Those categories are specified and include methods, demographics and listed clinical/contextual items.
• Determining manner and form: Under reg 6(2), the Chief Executive must determine the manner and form in which the required information is provided to the Register, under the authority given by s 35(3) of the Act.
• Permission for inspection: The Chief Executive controls inspection of the Register, because inspection may only occur with the Chief Executive’s permission (reg 7(1)).
• Granting access under tests: The Chief Executive must grant permission to inspect to certain bodies when satisfied particular standards are met. For example, reg 7(2) requires the Chief Executive to grant permission to the Office of the Chief Psychiatrist, South Australia Police, the State Coroner, or an individual’s treating health service, if satisfied disclosure is reasonably necessary to protect the lives of others, or where for the Chief Psychiatrist it is reasonably necessary to perform statutory functions under the Act or Mental Health Act 2009.
• Granting access to coroner bodies: The Chief Executive must grant permission to the State Coroner and the Coroner’s Court for inquest purposes and must provide a report if requested by those bodies (reg 7(3)).
• Limitations on disclosure of sensitive information: The Chief Executive may only grant permission to inspect the specific sensitive categories listed in reg 6(1)(c) if one of three tests in reg 7(4)(a)-(c) is met: serious threat to life/health/safety; approved medical or social research with ethics approval and no reason to believe disclosure would be contrary to the deceased’s best interests; or, for the Office of the Chief Psychiatrist, reasonably necessary for statutory functions.
• Balancing privacy and harm: In considering disclosures under reg 7(4)(a), the Chief Executive must balance the right to privacy of the individual and others against the risk of harm if the information is not disclosed (reg 7(5)). This is a mandated decision-making criterion.

Rights and entitlements

• Right of specified bodies to request access subject to tests: The Office of the Chief Psychiatrist, South Australia Police, the State Coroner, and an individual’s treating health service have recognised routes to obtain permission to inspect the Register, but those routes are conditional upon the Chief Executive’s satisfaction that specific tests are met (reg 7(2)).
• Right of the State Coroner and the Coroner’s Court to access for inquest purposes and to request reports: These bodies are not merely allowed access; on the stated basis their access must be granted for the specified purposes, and reports must be provided if requested (reg 7(3)).
• Right of Parliament and the Australian Institute of Health and Welfare to receive de-identified data for reporting: Regulation 7(6) permits disclosure of de-identified information specifically for reporting to Parliament and the AIHW.

Notable absences

• No statutory duty to record beyond the specific categories in reg 6(1) is imposed by the Regulations; the duties are limited to those categories being recorded “as may be known to the Chief Executive”.
• The Regulations do not set timeframes for recording or disclosure decisions, nor do they impose explicit administrative review or appeal rights against the Chief Executive’s decision to grant or refuse access.
• The Regulations do not create offences, fines or criminal sanctions for failure to comply with the data-recording or access provisions.

Collectively the Regulations create a rights framework that provides access for a circumscribed set of public bodies and researchers under specified conditions, while placing operational duties on the Minister to define the set of State authorities, and on the Chief Executive to implement data standards and to exercise controlled disclosure.

The Regulations themselves do not create criminal offences, monetary penalties, administrative fines or explicit enforcement mechanisms. They are an administrative instrument that prescribes procedures and decision-making standards. The express texts are limited to powers, duties and criteria; there are no penalty clauses within the Regulations.

What the Regulations do say about control and enforcement is procedural:

• Inspection of the South Australian Suicide Register is expressly limited to those who have the Chief Executive’s permission (reg 7(1)). The implicit enforcement mechanism is administrative control: access without permission is not authorised, and the Chief Executive is the gatekeeper.
• The Chief Executive must grant permission in particular cases and must grant permission for State Coroner/Coroner’s Court access for inquest purposes and provide a report if requested (reg 7(3)). That obligation imposes an administrative duty on the Chief Executive to respond when statutory conditions exist.
• For sensitive categories of information in reg 6(1)(c), the Chief Executive may only grant permission where one of the tests in reg 7(4) is met. The rule imposes a substantive threshold test; failure to satisfy that test is a basis for refusal.

Because the Regulations do not create penalties, enforcement or sanctioning of non-compliance would arise, if at all, from other legal instruments or from administrative remedies. Possible enforcement or accountability routes that could intersect with these Regulations, but are not stated in the Regulations themselves, include:

• obligations or offences provided by the primary Act, the Suicide Prevention Act 2021, which the Regulations implement in discrete ways by reference to its sections, for example sections referenced in the Regulations such as s 35(2), s 35(3) and s 37; any enforcement mechanisms that exist in the Act would operate alongside these Regulations but are not reproduced in them;
• general public sector administrative law principles and remedies (judicial review) which could be available to challenge a Chief Executive or Minister decision made under these Regulations if a challenger establishes relevant grounds in judicial review proceedings, though the Regulations themselves do not articulate a statutory appeal or review pathway; and
• statutory obligations under other laws that are not mentioned in the Regulations, for example medical records law or coronial rules, which may interact in practice.

The Regulations do involve reporting obligations (reg 6(2): Chief Executive determines manner and form of information to be provided), and procedural duties in responding to requests for inspection (reg 7). But the instrument contains no enforcement clauses prescribing civil or criminal sanction for failure to meet those obligations. Practitioners should therefore look to the Act and other statutory and administrative law mechanisms for enforcement, noting that those mechanisms are not described in the Regulations.

The Regulations operate entirely by reference to the Suicide Prevention Act 2021 and make cross-references to other statutory instruments explicitly. The interaction is one of operational implementation rather than substantive change to other laws.

Primary Act interaction

• The Regulations explicitly implement provisions of the Act. Each of the following Reg provisions references sections of the Act:
  • reg 4 references the definition of State authority in s 3(1) of the Act, by giving the Minister power to declare inclusions or exclusions by Gazette notice (reg 4(1)-(2));
  • reg 5 references section 25(9) of the Act to prescribe State authorities for the purpose of “prescribed State authority”; and
  • regs 6 and 7 operate pursuant to sections 35(2), 35(3) and 37 of the Act, by prescribing required Register content and setting access and disclosure rules.

Because the Regulations expressly implement the Act’s sections, they should be read as procedural detail that fills out statutory powers and duties provided in the Act. Any obligation or power in these Regulations that corresponds to the Act depends on the Act for its substantive legal basis. Conversely, any enforcement provisions or remedies in the Act are the proper place to look for statutory consequences for non-compliance.

Mental Health Act 2009

• The Regulations refer to the Mental Health Act 2009 in reg 7(2) and reg 7(4)(c), by making access for the Office of the Chief Psychiatrist recognisable where disclosure is reasonably necessary for the Chief Psychiatrist to perform functions under the Act or the Mental Health Act 2009. This creates a cross-reference: certain disclosures are permitted if reasonably necessary to perform duties under either statute.

Coronial law

• The State Coroner and the Coroner’s Court are given express rights to access the Register under reg 7(3) for the purposes of determining whether to hold an inquest and for inquests, and the Chief Executive must provide reports if requested. This places the Register as a potential source of evidence or information in coronial processes, and the Regulations explicitly create that cooperation pathway.

Research ethics and best-interests test

• Regulation 7(4)(b) requires research methodology to be approved by an ethics committee and that there is no reason to believe disclosure would be contrary to a deceased individual’s best interests. This provision interacts with institutional research governance structures (ethics committees), and imposes an ethical gate as a statutory precondition to disclosure of sensitive data.

Reporting to Parliament and the Australian Institute of Health and Welfare

• Regulation 7(6) permits de-identified information from the Register to be disclosed for reporting to Parliament or the AIHW. This establishes an information flow between executive-held data and institutional reporting obligations and processes to Parliament and a Commonwealth agency. The Regulation frames such disclosure as conditioned on de-identification.

Privacy considerations (procedural, not a substitution for privacy law)

• The Regulations require the Chief Executive to balance privacy against risk in considering disclosure under reg 7(4)(a) (reg 7(5)). The instrument does not reference other privacy statutes or specific data protection obligations, but the mandated balancing exercise creates an administrative privacy safeguard incorporated into decisions under the Regulations.

Interaction summary

• The Regulations are tightly tied to the Act for their legal foundation, create a specific cross-reference to the Mental Health Act 2009, and interact operationally with coronial processes and institutional research ethics frameworks. They provide a mechanism for de-identified reporting to Parliament and the AIHW. They do not themselves modify other statutes, nor do they provide comprehensive privacy law coverage; practitioners must therefore read the Regulations alongside the Act and relevant external legal regimes (for example coronial rules, research ethics requirements, and applicable privacy law) to understand the full legal context.

The Regulations are a single, compact instrument with a recorded principal regulations entry in the legislative history. The source provides the following publication details:

• Principal regulations: Year 2022, No 76, Gazette 1.9.2022 p5828, commencement 5.9.2022 (reg 2 and Legislative history notes).

There are no amendments recorded in the text supplied. The Regulations themselves are the product of a single Gazetted instrument (No 76 of 2022) which commenced on 5 September 2022. The legislative history notes in the provided text do not list subsequent amending instruments or repeals.

Practical points in tracking amendment risk

• Because the Minister’s power under reg 4 and reg 5 depends on Gazette notices to include, exclude or prescribe particular bodies, the content and scope of who is a “State authority” or a “prescribed State authority” can change over time without amendment to these Regulations, by the straightforward method of publishing a new Gazette notice. That administrative flexibility creates a real-world amendment risk to the set of bodies affected, although it is not a formal regulatory amendment to the text of the Regulations themselves.
• Any future amendment to the Regulations, if made, would be recorded in the legislative history. Practitioners should monitor the South Australian legislation website and Gazettes for notices under regs 4 and 5, and for formal amending regulations.

As of the source text provided, there is a single instrument entry and no subsequent amendments are listed.

The provided Regulations text contains no reference to any litigation, judicial review, or court decisions concerning these Regulations. There are no cases, proceedings, or legal challenges cited in the document.

What the absence of litigation in the text signifies

• The Regulations themselves do not include judicial or litigative history. That absence cannot be taken as proof that no litigation has occurred, but it does mean that within this instrument’s published text there are no annotations, notes or included references to case law or challenges.
• If litigation were to arise, the likely legal focal points would be administrative law challenges to the Chief Executive’s decisions under reg 7 (for example whether a disclosure was “reasonably necessary”, or whether the balancing required by reg 7(5) was properly performed), or challenges to Ministerial Gazette notices under regs 4 and 5 (for example on grounds of invalidity or procedural error). However, any such litigation would derive from general administrative law principles and the relevant statutory provisions in the Act and Regulations, not from any litigation history contained in the instrument.

For the purpose of compliance and legal risk assessment, practitioners should monitor court lists and legal reporting for any judicial review or other litigation that interprets:

• the meaning of “reasonably necessary” as used in reg 7(2) and reg 7(4)(c);
• the appropriate application of reg 7(5)’s balancing between privacy and risk; or
• any claim that a Ministerial Gazette notice under reg 4 or reg 5 was invalidly made.

None of those potential legal lines appears in the Regulations text itself.

The Regulations are concise and specific, but they contain several operational features that can produce unexpected consequences or administrative traps if practitioners do not attend to the governance architecture created. The following points are grounded in the text and identify places where attention to process and decision-making is necessary.

1. Ministerial Gazette notices change the statute’s scope without amending the Regulations

• Reg 4(1)-(2) and reg 5 make the Minister the instrument that can add or remove bodies from statutory classes by Gazette notice. That means a body’s status as a “State authority” or “prescribed State authority” can change by notice, with immediate legal effects for duties under the Act. Affected bodies must actively monitor Gazette notices; passive assumptions about statutory status risk surprise.

2. Chief Executive’s control of manner and form creates operational dependency

• Reg 6(2) gives the Chief Executive the power to determine the manner and form of information provided to the Register. This centralises technical requirements, and could create a bottleneck. Entities required to provide data must be prepared to meet whatever format or submission processes the Chief Executive sets, and delays or changes in those administrative standards can affect compliance timelines.

3. “As may be known to the Chief Executive” is a potentially limiting phrase

• Reg 6(1) requires recording the listed items “as may be known to the Chief Executive.” This wording does not obligate other bodies to supply all of those items; it frames what is required for the Register in terms of what the Chief Executive knows. Practically, that may affect what data is actually captured and could create an expectation management issue between the Chief Executive, data providers and coronial bodies as to who must actively source missing data.

4. Access is permission-based with subjective standards

• Reg 7(1) conditions inspection on the Chief Executive’s permission. Reg 7(2) and reg 7(4) use standards such as “reasonably necessary” and “reasonably required to lessen or prevent a serious threat” which are context-sensitive. The absence of detailed statutory criteria or timelines means decisions may be subjective and could be challenged in administrative law proceedings if a party alleges unreasonable or unlawful exercise of discretion.

5. Sensitive information access is further restricted

• The tranche of items in reg 6(1)(c) is subject to stricter tests in reg 7(4). Researchers need ethics committee approval and a “no reason to believe” check that disclosure would be contrary to the deceased’s best interests. That places a practical burden on research applicants and may require institutional ethics committee preparation and documentation well in advance.

6. Balancing privacy and risk requires documented judgment

• Reg 7(5) mandates that the Chief Executive balance the right to privacy with the risk of harm in considering disclosures under reg 7(4)(a). That balancing exercise suggests an administrative records obligation: decisions granting or refusing disclosure should be documented to show how privacy and harm were weighed.

7. Coroner’s requests require reports from the Chief Executive

• Reg 7(3) requires the Chief Executive to provide a report if requested by the State Coroner or the Coroner’s Court. That can create an ad hoc reporting resource demand for the office maintaining the Register, and the Chief Executive must be able to respond to such requests.

8. De-identified reporting is permitted but identifiable disclosure is tightly controlled

• Reg 7(6) allows only de-identified information for Parliament and AIHW reporting. This delineation means agencies cannot rely on routine identifiable data flows for those reporting purposes, and any request for identifiable data must meet the higher thresholds in reg 7(4), with implications for data governance and security.

9. No penalties in the Regulations, but obligations exist elsewhere

• The Regulations do not state penalties for non-compliance. Nevertheless, the Act may contain obligations and possible consequences not reproduced here. Parties should cross-reference the Act for any sanctioning provisions.

10. Limited public transparency as to decision-making criteria

• The Regulations give the Minister and the Chief Executive discretionary powers (for example via Gazette notice and permission to inspect). The Regulations do not require publication of reasons, redress mechanisms, or timelines for decisions. That may lead to uncertainty for entities seeking access or for those whose status as a State authority fluctuates.

Each of these “gotchas” follows directly from the regulatory text. Practical mitigation usually involves monitoring Gazettes, preparing documentation for ethics and privacy considerations, establishing internal data capture processes aligned to formats the Chief Executive may require, and planning capacity to respond to coronial report requests.

Compliance with these Regulations mostly requires procedural readiness, monitoring of administrative notices, and internal processes for data collection and disclosure requests. The Regulations allocate clear roles to the Minister and the Chief Executive; affected parties should direct implementation steps accordingly.

1. Monitor Gazette notices and determine statutory status

• Organisations that may be State authorities or wish to know whether they are “prescribed” for action-plan purposes must monitor the South Australian Government Gazette for notices made under regs 4 and 5. The Minister’s notices determine who is in or out of the statutory classes (reg 4(1)-(2), reg 5). Establish a regulatory monitoring process to detect such notices promptly and to update legal/compliance registers.

2. Establish data capture aligned to the Register’s required items

• The Register requires the categories in reg 6(1). To comply with any requests to provide information to the Chief Executive in the manner and form determined by the Chief Executive, organisations that contribute data should:
  • map internal records to the Register’s data categories in reg 6(1)(a)-(c);
  • prepare to supply demographic, method-of-death and contextual clinical/social/justice data when requested, to the extent such information is known or recorded internally;
  • coordinate with clinical record keepers, coronial liaisons and information governance teams to ensure data completeness and accuracy.

3. Prepare for format and submission requirements set by the Chief Executive

• Under reg 6(2), the Chief Executive determines the manner and form of information provision. Organisations should:
  • seek early guidance from the Chief Executive’s office on data submission templates, electronic formats, secure transfer channels and timing;
  • when guidance is not immediately available, design internal processes that capture the specified data elements in a way that can be adapted to common formats (structured fields, coded categories), reducing transformation costs when the Chief Executive’s formality is published.

4. Create a policy for disclosure requests and privacy balancing

• Because inspection is permission-based (reg 7(1)) and the Chief Executive must balance privacy and risk (reg 7(5)), organisations that will request access, or that receive requests from others, should:
  • document the factual basis for any claim that disclosure is “reasonably necessary” or “reasonably required to lessen or prevent a serious threat” (regs 7(2) and 7(4)(a));
  • keep records that show how privacy interests and the risk of harm were weighed, particularly where requests concern the sensitive items in reg 6(1)(c);
  • develop templates for requests that articulate the statutory tests and include supporting evidence.

5. Researchers: secure ethics approval and demonstrate best-interests assessment

• For research access to the sensitive categories in reg 6(1)(c), ensure:
  • research methodology is approved by a recognised ethics committee before applying (reg 7(4)(b));
  • the research application addresses whether there is any reason to believe disclosure would be contrary to the deceased individual’s best interests, and includes safeguards such as de-identification, minimal necessary data, secure handling and, if relevant, engagement with families or community stakeholders;
  • where practicable, provide the Chief Executive with the ethics committee approval certificate and a detailed data management plan.

6. Coroners and inquests: maintain rapid-response capability

• The Chief Executive must provide reports if requested by the State Coroner or the Coroner’s Court (reg 7(3)). Agencies that maintain custodial information should:
  • set up an internal unit able to compile and deliver the register material in response to coronial requests within operationally reasonable timeframes;
  • ensure data extraction procedures align with coronial time pressures and legal standards for inquest evidence.

7. Treating health services: prepare clinical risk assessments in requests

• Treating health services who may apply for access under reg 7(2) should:
  • document clinical reasons why disclosure is “reasonably necessary” to protect the lives of others;
  • include evidence or clinical assessment showing the nature and immediacy of risk, and why the Register contains information necessary to mitigate that risk.

8. De-identification for reporting to Parliament and AIHW

• If providing de-identified data for reporting under reg 7(6), ensure:
  • de-identification techniques are robust and documented, consistent with the technical standards expected by Parliament or AIHW;
  • mapping of de-identification processes is retained so that the Chief Executive or data custodian can demonstrate that data disclosed is not identifiable at the individual level.

9. Document decision-making for possible administrative review

• Because the Regulations provide discretion to the Chief Executive and to the Minister by Gazette notice, maintain administrative records of:
  • requests for access and the reasons decisions were made or refused;
  • interactions and correspondence with the Chief Executive’s office regarding data provision formats;
  • internal rationales for data sharing, ethics approvals, and best-interests assessments.

10. Cross-reference the Act and other relevant instruments

• The Regulations work in tandem with the Suicide Prevention Act 2021 (and reference the Mental Health Act 2009). For full compliance, consult the relevant sections of the Act mentioned in the Regulations (for example s 3(1), s 25(9), s 35(2)-(3), s 37), and ensure institutional policies reflect both the Regulations and any obligations or enforcement provisions contained in the Act.

These steps are procedural and administrative, reflecting the Regulations’ focus on data specification, decision-making gates and ministerial classification power. Compliance attention is mostly about monitoring, accurate data capture, obtaining ethics approvals where needed, and documenting statutory tests and balancing exercises.
