Succession to the Crown Act 2015

Succession rules frozen by date: The Act creates a temporal dividing line. Section 6 applies gender-neutral succession only to persons born after 28 October 2011 (by United Kingdom time). The Act therefore leaves intact the pre-2011 order for persons born before that moment and alters the ordering going forward for births after that date. The date is a fixed reference point in the Act; the text prescribes the effect without creating a mechanism for retrospective reordering of births prior to that date.

Marital disqualification: The Act eliminates one historic marital disqualification and imports another. Section 7 removes the historic disqualification from succeeding that arose from marrying a Roman Catholic. That removal is applied to marriages that took place before commencement where the person is alive at commencement (s 7(2)), and Schedule 1 Part 1 makes parallel textual amendments in the Act of Settlement and the Bill of Rights by excising phrases such as “or marry a papist” (Schedule 1 items 1-6). Conversely, s 8 incorporates the disqualification found in subsection 3(3) of the UK Succession to the Crown Act 2013 as it exists at the commencement of s 8; therefore domestic succession is also constrained by that UK provision as frozen at that date.

Repeal and validation of marriages: Schedule 1 Part 2 repeals the Royal Marriages Act 1772 “the whole of the Act” so far as it is part of Australian law (Schedule 1 item 8). Schedule 1 item 9 sets out four cumulative conditions under which a marriage that had been void under the Royal Marriages Act is to be treated as never having been void (items 9(1)(a)-(d)). That validation is expressly limited: subitem 9(2) states it applies for all purposes except those relating to succession to the Crown. Practically, that means some marriages once void for royal-marriage-formality reasons may now be treated as valid for civil and private-law purposes, but that treatment does not affect the order of succession.

Textual and interpretive carryover: Section 9 gives effect to the Schedule by amending or repealing the listed English Acts “so far as that Act is part of the law of the Commonwealth, a State or a Territory.” Section 10 requires that references in any laws forming part of Commonwealth or Territory law to the Bill of Rights or Act of Settlement “relating to succession to, or possession of, the Crown” be read as including references to the provisions of this Act. Section 11 identifies particular union articles that are subject to this Act insofar as they are part of Australia’s law.

Entrenchment mechanism: Section 12 requires that this Act be repealed or amended only by an Act passed at the request or with the concurrence of the Parliaments of all the States. That creates a procedural or constitutional barrier to ordinary Commonwealth amendment by majority alone.

Scope limits: The Preamble and s 3 state that the Act’s object is to change domestic law “consistently with changes made to that law in the United Kingdom, so that the Sovereign of Australia is the same person as the Sovereign of the United Kingdom.” Section 4 states expressly that the Act is not intended to affect the relationship between the Sovereign and the Commonwealth, the States and the Territories as it existed immediately before enactment. Section 5 defines Crown to mean the Crown “in all of its capacities,” which places the Act’s references to the Crown across Crown capacities rather than restricting them to a single institutional capacity.

Commencement sequencing: Section 2 provides a commencement table. Sections 1, 2 and unspecified provisions commence on Royal Assent (24 March 2015). Sections 3-5 also commence on Royal Assent. Parts 2-4 and the Schedule were to commence by proclamation; the table records a proclamation date (26 March 2015) indicating when those operative changes were taken to be brought into force.

Individuals in the line of succession: The primary direct subjects are individuals in or potentially in the line of succession to the Crown. Section 6 changes the ordering rule based on gender for those born after 28 October 2011, thereby affecting the legal precedence among descendants and the order in which persons succeed. Section 7 removes the disqualification that formerly applied to persons who married Roman Catholics, thereby widening the class of persons who remain eligible to succeed and possess the Crown. Section 8 creates another class of disqualified persons by reference to the UK Succession to the Crown Act 2013 s 3(3) as in force at the commencement of s 8; such persons, if disqualified under that UK provision, are excluded from succession in Australia.

Spouses and families: People who married members of the royal family may be affected in two ways. First, marriages to Roman Catholics no longer operate as a disqualification for the spouse. Second, some marriages previously void under the Royal Marriages Act 1772 may now be treated as never having been void, subject to the four listed conditions in Schedule 1 item 9(1)(a)-(d). That validation applies for all purposes other than succession (Schedule 1 item 9(2)), so civil status, property rights and other private-law consequences of marriage may be restored by the Schedule where the conditions are met.

Government and Crown officers: Ministers, Attorneys-General, the Governor-General’s office, government departments and officials who advise on constitutional questions involving the Crown or who administer matters in which succession or royal status is material will be affected. Section 10 changes how references to the Bill of Rights and Act of Settlement are to be read in Australian law where those references concern succession or possession of the Crown. Section 11 makes explicit that particular union articles are subject to this Act as part of Australian law. These provisions require executive and legislative drafters, statutory interpreters and legal advisers to reinterpret existing instruments in light of this Act.

State and Territory parliaments: The Act was enacted in response to requests from the Parliaments of all the States under paragraph 51(xxxviii) of the Constitution, recorded in the Preamble. Section 12 requires that repeal or amendment of the Act be done only by an Act passed at the request or with the concurrence of all State Parliaments. That affects state legislatures by giving them an institutional role in any future legislative reversal or modification.

Practitioners and registrars: Family law practitioners, registry officers and private lawyers dealing with marriage validity or status for individuals whose marriage might have been affected by the Royal Marriages Act 1772 will need to consider the Schedule 1 validation provisions. The Schedule validates some marriages for “all purposes except those relating to succession to the Crown” (Schedule 1 item 9(2)), so registrars, probate courts and contract parties may have to reassess legal status, inheritance rights, or contractual entitlements based on a marriage now treated as never having been void.

Researchers, journalists and commentators: Those tracking the constitutional and legal relationship between Australia and the United Kingdom, and those analysing the statutory corpus such as the Act of Settlement or the Bill of Rights as they operate in Australian law, are affected because the Act requires textual amendments and interpretive adjustments (Schedule 1 items 1-6, s 10).

No criminal penalties or novel regulatory burdens are specified in the Act itself, so regulatory agencies or enforcement bodies do not gain new enforcement powers under this statute; rather the Act alters substantive status and interpretive instruments governing succession and marriage validity.

Rights created or clarified

• Right to be eligible for succession regardless of sex for persons born after 28 October 2011: Section 6 creates a rule of precedence that removes gender as a basis for preference in determining succession for the specified cohort. This is a substantive change in order-of-succession rights for that cohort and their descendants.
• Right not to be disqualified for marrying a Roman Catholic: Section 7(1) establishes that a person is not disqualified from succeeding to or possessing the Crown as a result of marrying a Roman Catholic. Section 7(2) extends that right to marriages occurring before commencement, where the person concerned is alive at commencement.
• Validation of certain marriages previously void under the Royal Marriages Act for non-succession purposes: Schedule 1 item 9(1) sets out conditions under which a marriage previously void under the Royal Marriages Act is to be treated as never having been void. Schedule 1 item 9(2) confines that validation to purposes other than succession.

Duties and obligations

• No new enforcement duties, fines, or criminal offences: The Act does not create specific statutory duties enforceable by penalty provisions. It operates by changing eligibility and textual references rather than by imposing duties or sanctions. Implementation obligations will arise in practice for statutory drafters, registrars and officials who must reflect the amended legal positions in registers, guidance, and statutory text, but the Act does not itself prescribe enforcement procedures or penalties.
• Duty on legal interpreters and administrators to read historic references to include this Act: Section 10 requires that references in laws forming part of Commonwealth or Territory law to the Bill of Rights or Act of Settlement “relating to succession to, or possession of, the Crown” be read as including references to this Act. That creates an interpretive obligation for courts, public officers and private lawyers to treat those references as incorporating the Act’s provisions.
• Duty on drafters to amend or repeal specified English Acts insofar as they are part of Australian law: Section 9 and Schedule 1 effect specific textual amendments and repeals of Acts such as the Act of Settlement, the Bill of Rights and the Royal Marriages Act 1772, so the duty falls to those maintaining official statute books to update texts to reflect the Schedule.

Rights preserved and limits

• Relationship with the Sovereign unchanged: Section 4 states the Act is not intended to affect the relationship between the Sovereign and the Commonwealth, the States and the Territories as it existed immediately before enactment. That preserves existing constitutional allocations of function and status of the Crown even as succession rules change.
• Disqualification by UK provision retained: Section 8 imports the disqualification contained in subsection 3(3) of the UK Succession to the Crown Act 2013 as in force at commencement. That creates a limit on the expansion of eligibility by subjecting domestic succession to a specified UK disqualification as frozen at commencement.
• Validation excluded for succession purposes: Schedule 1 item 9(2) explicitly excludes succession consequences from the validation of some marriages; therefore rights restored by validation do not include rights of succession.

Entrenchment of amendment process

• Procedural constraint on repeal or amendment: Section 12 requires that any amendment or repeal of this Act be made only by an Act passed at the request or with the concurrence of all State Parliaments. That imposes a procedural right to State participation and a corresponding limit on unilateral Commonwealth amendment; it is a constitutional-level constraint on future legislative change.

Practical administrative obligations

• Update statutory texts: Schedule 1 mandates textual removals in the Act of Settlement and the Bill of Rights (Schedule 1 items 1-6), so courts, official publishers and counsel must consult the Schedule when citing those instruments. Section 11 identifies union articles impacted so drafters must reconcile treaties and articles as part of Australia’s law with this Act.

The Act therefore creates substantive rights to eligibility in particular cohorts, removes a historic marital disqualification, sets out validation for some marriages, and places interpretive and administrative obligations on legal officers, drafters and registrars; it does not create new criminal or civil penalties within its text.

No penal scheme in the Act: The Succession to the Crown Act 2015 does not create criminal offences, civil penalties, administrative sanctions or an enforcement agency. The Act operates by altering legal status, textual references and statutory validity, not by establishing regulatory offences or enforcement processes. There are therefore no monetary fines, imprisonment terms, disqualification orders, or administrative penalty regimes created by the Act itself.

Enforcement by legal effect and interpretation: The Act’s effects are enforced through legal operation, judicial interpretation and administrative practice. The changes that matter , succession order (s 6), removal of a marital disqualification (s 7), imported disqualification by reference to a UK provision (s 8), and validation of certain marriages (Schedule 1 item 9) , will be given effect by relevant decision-makers when those questions arise: courts adjudicating inheritance or status disputes, officials applying rules of ceremonial precedence, or the executive advising on who may be the Sovereign of Australia. The Act modifies substantive legal rules and local statutory texts, which will be applied by courts and administrative agencies in the ordinary course.

Role of courts and registrars: Courts will adjudicate disputes that turn on the Act where relevant questions are justiciable, for example whether a particular marriage is to be treated as never having been void under Schedule 1 item 9(1), or whether a person falls within the cohort covered by s 6. Registry agencies maintaining marriage or birth records will implement changes in administrative practice where required, for instance recognising validated marriages for “all purposes except those relating to succession to the Crown” (Schedule 1 item 9(2)). Those exercises are not enforcement in the statutory penalty sense but administrative application of amended legal status.

Interpretive effects in other statutes: Section 10 imposes a reading obligation on any law that forms part of Commonwealth or Territory law which references the Bill of Rights or Act of Settlement “relating to succession to, or possession of, the Crown”,such references are to be read as including references to this Act. That is an interpretive mechanism that operates across existing statutory frameworks and will be given effect by courts and statutory officers. It is not policed by a distinct enforcement authority but is applied through ordinary statutory interpretation.

Entrenchment as a procedural barrier: Section 12 does not create a criminal or pecuniary penalty but it creates a procedural constraint: repeal or amendment is permitted only by an Act passed at the request or with the concurrence of the Parliaments of all the States. The practical enforcement of that constraint lies in constitutional and parliamentary processes; it means standard federal parliamentary mechanisms alone cannot unilaterally repeal or amend the Act without the specified State participation.

Limitations on succession impact from validation: Schedule 1 item 9(2) enforces a limit: marriages that are validated by item 9(1) remain excluded from altering succession. That restriction will be applied by officials and courts when succession questions arise.

In sum, the Act changes substantive legal status and creates interpretive obligations; enforcement is by ordinary legal application, judicial determination and administrative recognition rather than by a new statutory enforcement or penalty apparatus.

Modifying historic English statutes as Australian law: The Act expressly amends or repeals specified Acts of England or Great Britain “so far as that Act is part of the law of the Commonwealth, a State or a Territory” (s 9). Schedule 1 Part 1 effects textual excisions in the Act of Settlement and the Bill of Rights by removing phrases related to marrying a “papist” (Schedule 1 items 1-6). Schedule 1 Part 2 repeals the Royal Marriages Act 1772 where it forms part of Australian law (item 8). These interventions change the domestic textual corpus where those English statutes continue to be part of Australian law.

Interpretive carryover via s 10: Section 10 requires that references in any law forming part of Commonwealth or Territory law to provisions of the Bill of Rights or the Act of Settlement “relating to succession to, or possession of, the Crown” are to be read as including references to the provisions of this Act. That has cross-cutting interpretive implications. Any statute, instrument or decision-maker that invokes the Bill of Rights or Act of Settlement on succession-related matters is to treat such invocation as also referring to the Succession to the Crown Act 2015. The effect is to fold the 2015 Act into the interpretive web where succession or possession of the Crown is being considered in Commonwealth and Territory law.

Union legislation: Section 11 lists particular union articles , Article II of the Union with Scotland Act 1706 (England), Article II of the Union with England Act 1707 (Scotland), Article Second of the Union with Ireland Act 1800 (Great Britain), and Article Second of the Act of Union (Ireland) 1800 , and states these are subject to this Act so far as they form part of Commonwealth, State or Territory law. This is an express statement that where those union articles are part of domestic law, their effect is to be read in the light of this Act.

Imports from UK law fixed at commencement: Section 8 disqualifies a person if they are disqualified by subsection 3(3) of the UK Succession to the Crown Act 2013 “as in force at the commencement of this section” from succeeding to the Crown in right of the United Kingdom. That language imports the UK provision but fixes it as at commencement of s 8. Consequently, subsequent amendments to the UK subsection 3(3) after commencement will not automatically alter Australia’s corresponding domestic disqualification under s 8 because s 8 refers to the UK provision as it stood at commencement.

Scope limitations and non-retrospectivity: The Act, and Schedule 1 item 9 in particular, draws careful lines on retrospective effect. Schedule 1 item 9(1) sets out the conditions under which a marriage previously void under the Royal Marriages Act is to be treated as never having been void. The validation is expressly limited by item 9(2) to “all purposes except those relating to succession to the Crown.” Section 7(2) and Schedule 1 item 7 apply the removal of disqualification for marrying a Roman Catholic to marriages occurring before commencement if the person is alive at commencement. Those clauses therefore create limited retroactive effects in specific circumstances and with stated bounds.

Statutory consolidation and publication obligations: Sections 9 and Schedule 1 require textual amendments in historic statutes where they are treated as part of Australian law. Official publishers, statute compilers and legal databases must therefore alter their texts to reflect the Schedule. The Act itself notes in s 2(2) that any information in the commencement table’s column 3 is not part of the Act; that is a technical publication note for statutory publishers.

Constitutional context for amendment and state involvement: The Preamble states the Parliaments of all the States requested the Commonwealth Parliament to enact an Act in these terms for the purposes of paragraph 51(xxxviii) of the Constitution. Section 12 requires that repeal or amendment of the Act may occur only by an Act passed at the request or with the concurrence of the Parliaments of all the States. That interaction confers a constitutional or parliamentary safeguard: other Commonwealth Acts that interact with the Crown and succession must be interpreted against the background of this entrenchment mechanism.

No express alteration of other non-successive legal regimes: The Act does not include provisions that directly change family law, immigration law, succession law for private estates, or corporate law. However the validation clause in Schedule 1 item 9(2) may have downstream effects in those domains because validated marriages are to be treated as never having been void for all purposes except succession. Courts and administrators in those other legal domains will therefore apply the Act’s validation clause where relevant.

Original enactment details and commencement: The Act’s short title is Succession to the Crown Act 2015 (s 1). The Act received Royal Assent on 24 March 2015, which is recorded as the commencement date for ss 1 and 2 and other matters "not elsewhere covered by this table" (s 2 commencement table). Sections 3, 4 and 5 also commenced on Royal Assent. Parts 2, 3 and 4 and Schedule 1 were to commence on a day or days to be fixed by proclamation; the commencement table records a proclamation date of 26 March 2015 for Parts 2, 3, 4 and Schedule 1. Part 5 (s 12) commenced on Royal Assent.

No subsequent amendments recorded in this instrument: The text provided is the Act as originally enacted. The Act itself contains a note in s 2 that the commencement table relates only to provisions as originally enacted and will not be amended in the Act to deal with later amendments. The provided text contains no later-amending Act entries, and there is no schedule of amendments appended to this text.

Entrenchment of future amendments: Section 12 imposes a special procedural requirement for future repeal or amendment: such change may be made only by an Act passed at the request or with the concurrence of the Parliaments of all the States. That places a constitutional or statutory barrier around future alteration. The Preamble explains the statutory route used under paragraph 51(xxxviii) of the Constitution to implement the changes at the request of all State Parliaments.

Schedule adjustments at enactment: Schedule 1 formed part of the Act and contains two parts. Part 1 makes textual amendments to the Act of Settlement and Bill of Rights as they form part of Australian law, omitting phrases such as “or marry a papist” (Schedule 1 items 1-6). Part 2 repeals the Royal Marriages Act 1772 for Australian purposes (item 8) and validates some marriages previously void under that Act subject to listed conditions (item 9).

Commencement technicality: Section 2 contains a publication note in sub-s 2(2) stating that information in column 3 of the commencement table is not part of the Act and may be edited in published versions. That is a drafting and publication detail and does not affect substantive content.

No express transitional amendment trajectory beyond those specific retroactive clauses: The Act contains limited transitional or retrospective provisions. Section 7(2) applies the removal of the Roman Catholic-marriage disqualification to marriages before commencement where the person is alive at commencement. Schedule 1 item 7 applies the Schedule Part 1 amendments to marriages occurring before commencement if the person concerned is alive at commencement. Schedule 1 item 9(1) sets out conditions for treating previously void marriages as never void; Schedule 1 item 9(2) excludes succession from the effect of that validation. Beyond these bounded transitional measures there are no further transitional amendment sequences or saving provisions included in the text as presented.

No record of later legislative change in the text provided: The text supplied does not include any later Acts that amend or repeal parts of the Succession to the Crown Act 2015. Any future amendment would need to conform to s 12, but this text contains no entry showing such an amendment having occurred.

No cases or judicial interpretations recorded in the Act: The text of the Succession to the Crown Act 2015, as supplied, contains no reference to any litigation, no notes of judicial consideration, and no case law citations. The Act includes only the legislative text, Preamble, the commencement table and the Schedule; it does not record subsequent or contemporaneous judicial decisions.

No administrative determinations recorded: There are no administrative rulings, determinations, or declarations included in the Act text. There is a reference to the Minister’s second reading speeches being made in the House of Representatives on 5 March 2015 and the Senate on 18 March 2015; those speeches are listed but not reproduced in the material provided. The Act does not summarise any judicial or tribunal engagement with its provisions.

Implication for litigators and advisors: Because the Act changes substantive legal status, who may succeed, which marriages are validated for non-succession purposes, and how references to historic statutes are to be read,it creates potential for legal disputes in areas such as marital status, property entitlements or ceremonial precedence. However, no such disputes or judicial rulings are recorded in the statutory text available here. Practitioners should therefore not rely on precedent from this Act contained in this text; instead they must search case law databases and court records for any subsequent adjudication applying these provisions.

Limits on justiciability and jurisdictional questions: The Act preserves the relationship between the Sovereign and the Commonwealth, States and Territories as existing immediately prior to enactment (s 4). That is a legislative statement about intent rather than a judicial determination; whether certain disputes about succession or royal status are justiciable in courts is not addressed in the Act. The Act also imports a UK provision by reference (s 8) “as in force at the commencement of this section,” which fixes the imported text as at that time; any litigation arising from the interpretation of that imported provision would treat the imported UK text as the operative source for s 8.

If a reader requires up-to-date litigation history, they must consult judicial databases and law reports; none is provided in the Act text supplied.

Temporal limitation on gender-neutral succession: Section 6 applies gender-neutral succession only to persons born after 28 October 2011 (by United Kingdom time). That date is a carve-out and creates two cohorts. Persons born before that timestamp retain the prior rules for ordering. Practically, birth timing matters not only by day but by reference to “United Kingdom time”, which can produce cross-timezone questions about whether a birth qualifies. The Act does not provide mechanisms for resolving disputes about time-of-birth in this specific context; those issues may require evidentiary proof in any adjudication.

Import of UK law frozen at commencement: Section 8 disqualifies persons in Australia from succession if they are disqualified under subsection 3(3) of the UK Succession to the Crown Act 2013 “as in force at the commencement of this section.” That language freezes the UK text at commencement; future UK changes to subsection 3(3) will not automatically change Australian effect. Conversely, if one reads s 8 carelessly as importing a dynamic UK rule, that is an error. Legal advisers must consult the UK Act as it stood at the commencement date to understand exactly whom s 8 disqualifies.

Validation does not affect succession: Schedule 1 item 9(2) is critical: it validates certain marriages that were void under the Royal Marriages Act 1772 “for all purposes except those relating to succession to the Crown.” This is a double-edged provision: validated marriages may be treated as never void for private-law purposes , for example property, marital status, or inheritance , but the same marriages remain excluded from altering succession. Parties relying on validation should not assume it affects royal succession.

Retroactivity limited and conditional: Some provisions apply retroactively only in narrowly specified circumstances. Section 7(2) applies the removal of the Roman Catholic marriage disqualification to marriages occurring before commencement only if the person concerned is alive at commencement. Schedule 1 item 7 applies similar limits to textual amendments. Schedule 1 item 9(1) provides four cumulative conditions for validation of marriages previously void; failure to satisfy any of those conditions means the marriage remains void for non-succession purposes. The conditions include, among others, that “neither party was one of the 6 persons next in the line of succession at the time of the marriage” and that “no person acted, before the commencement of this item, on the basis that the marriage was void.” These are factual gates that may generate litigation.

Textual amendments to historic statutes must be applied “so far as” the English Acts are part of Australian law: Sections 9 and the Schedule repeatedly qualify amendments and repeal by the phrase “so far as that Act is part of the law of the Commonwealth, a State or a Territory.” That means amendments apply only to those portions of the historic Acts that are properly part of Australian law. Determining the territorial and constitutional extent of those historic enactments as they survive in Australia may require close legal analysis. Do not assume the Schedule automatically rewrites every historical reference without examining whether the relevant historic text is part of Australian law.

Broad interpretive effect under s 10: Section 10 requires that references in any law forming part of the Commonwealth or Territory law to Bill of Rights or Act of Settlement provisions “relating to succession to, or possession of, the Crown” are to be read as including references to this Act. That can reach many statutes in unexpected ways. Drafters and litigious parties should audit statutes that cite those historic instruments to see whether the inclusion of this Act alters interpretation in their contexts.

Entrenchment procedural trap: Section 12 requires amendment or repeal of the Act only by an Act passed at the request or with the concurrence of all State Parliaments. This is a procedural entrenchment rather than a substantive constitutional entrenchment. Still, it means ordinary federal parliamentary change will be procedurally constrained and any party seeking repeal must secure State-level agreement. Practitioners should not assume the Act can be amended by regular Commonwealth majority action alone.

No penalties but administrative work: Because the Act contains no penalty provisions, there is no enforcement machinery to compel administrative compliance. Nevertheless, administrators, statutory publishers, registry officers and legal counsel must update statutory texts, databases and guidance. Failure to update may cause errors in citations, registrations or legal advice.

Ambiguity about ceremonial versus legal effects: The Act declares it is not intended to affect the relationship between the Sovereign and the Commonwealth, States and Territories as it existed immediately before enactment (s 4). That leaves open interpretive questions about ceremonial or constitutional conventions versus legal rights. For example, who occupies certain ceremonial roles, or how an oath or allegiance provision is applied, may raise questions not directly answered by the Act’s text.

Be cautious about cross-jurisdictional questions: Section 11 lists union articles subject to the Act “so far as they are part of the law” of Australia. Determining whether a specific union article clause operates in a State or Territory context may require legal-history work. The Act does not simplify that determination; it simply states the articles are subject to this Act where they already form part of the law.

For government drafters and statutory publishers

• Update statutory texts: Implement the Schedule 1 textual deletions in the copies of the Act of Settlement and the Bill of Rights “so far as” those Acts are part of Commonwealth, State or Territory law (Schedule 1 items 1-6). Repeal references to the Royal Marriages Act 1772 in domestic statute books as set out in Schedule 1 item 8. Ensure published versions of affected historic statutes show the Schedule-made changes and include appropriate editorial notes about the limits of application (s 9, Schedule 1).
• Apply s 10 broadly in statutory interpretation guidance: Where any Commonwealth or Territory law contains references to the Bill of Rights or Act of Settlement relating to succession or possession of the Crown, ensure internal guidance and explanatory notes instruct officers to read those references as including the Succession to the Crown Act 2015 (s 10).

For registrars, vital-statistics authorities and family law practitioners

• Recognise validated marriages: Apply Schedule 1 item 9(1) and 9(2) when assessing the validity of historical marriages that were void under the Royal Marriages Act 1772. If the four cumulative conditions of item 9(1)(a)-(d) are met, treat the marriage as never having been void for all purposes except succession. Update internal record-keeping and certification practices to reflect the marriage’s validated status where applicable. Be prepared to require documentary evidence for each of the four conditions.
• Note the succession exception: Do not treat validation under Schedule 1 item 9 as conferring any succession rights. Item 9(2) explicitly excludes succession-related purposes. Where advice concerns both private-law consequences and succession, provide separate analysis for each.

For constitutional and advisory legal officers

• Use the frozen UK text for s 8 analysis: When advising whether a particular person is disqualified under s 8, consult subsection 3(3) of the UK Succession to the Crown Act 2013 “as in force at the commencement of this section.” That specific historical text is the operative imported standard; later UK amendments are not automatically incorporated. Document the version used and the commencement date as the reference.
• Apply s 6 timestamp rules: For succession ordering questions, determine whether persons were born after 28 October 2011 (United Kingdom time). Record time-zone evidence where necessary. The cohort distinction is decisive in ordering.

For ministers, the Governor-General’s office and state executives

• Account for s 12 entrenchment: Any move to amend or repeal this Act must be made only by an Act passed at the request or with the concurrence of the Parliaments of all the States (s 12). If policy change is proposed, consult State Attorneys-General early to determine whether the required State-level concurrence or request can be obtained and to plan the legislative path.
• Coordinate ceremonial and constitutional advice: Although s 4 preserves the pre-existing relationship with the Sovereign, changes to succession and marital qualification may require updates to standard ceremonial procedures and advice to offices of State and Commonwealth governors where status or precedence is affected.

For private individuals and families

• Seek evidence for validation conditions: If a marriage was previously void under the Royal Marriages Act and you believe it meets Schedule 1 item 9 conditions, collect evidence for each of the four subitems: (a) proof neither party was one of the six next in line at the time of marriage; (b) evidence that no consent or notice under sections 1 or 2 of the Royal Marriages Act was sought; (c) circumstances showing it was reasonable not to have been aware the Royal Marriages Act applied; and (d) proof no one acted before commencement on the basis the marriage was void. Legal advice should be obtained to assemble and present such evidence to registries, courts or other relevant decision-makers.

For legal advisers and litigators

• Prepare to separate succession and private-law claims: Where issues of marital validity and succession intersect, litigants should structure claims to reflect the statutory distinction: Schedule 1 item 9 validation for non-succession purposes, and separate consideration of succession rights under s 6, s 7 and s 8.
• Audit prior legal instruments referencing historic statutes: Contracts, trust deeds, oaths, or instruments that refer to the Act of Settlement or Bill of Rights in succession-related ways may be read as including this Act under s 10. Review such instruments to see whether the Act’s changes affect interpretation or operation.

For publishers, databases and educational materials

• Update editorial notes and citations: Clearly annotate the versions of the Act of Settlement and the Bill of Rights to show textual deletions as effected by Schedule 1. In databases, ensure the imported UK text used for s 8 is archived and linked with the relevant commencement date. Provide user guidance on the non-succession scope of Schedule 1 item 9 validation.

Record-keeping and evidence standards

• Keep contemporaneous records of dates and times: Because s 6 depends on the United Kingdom time of birth and because Schedule 1 item 9 requires proof of what persons did or did not do prior to commencement, maintain precise records of birth times, marriage notices, and any consents or actions taken in relation to marriages historically. Those records will be crucial if validation or succession questions are litigated.

In sum, compliance is primarily an exercise in statutory updating, record audit and careful evidentiary work in respect of validated marriages, together with intergovernmental coordination for any proposed future amendment of the Act.
