#### 109A Surrogacy arrangements 109A Surrogacy arrangements > > (1) A child of a surrogacy arrangement in respect of whom a parentage order is made is to be regarded, for the purposes of distribution on an intestacy, as a child of the intended parent or parents named in the parentage order and— > > > > > (a) the child’s family relationships are to be determined accordingly, and > > > > > (b) family relationships that exist as a matter of biological fact, and are not consistent with the relationship created by parentage order, are to be ignored. > > > (2) In this section, a parentage order means a parentage order, or an Interstate parentage order, within the meaning of the [Surrogacy Act 2010](/view/html/inforce/current/act-2010-102). > > **s 109A:** Ins 2010 No 102, Sch 2.8.
