Subordinate Legislation (Gambling Regulations 2015) Extension Regulations 2025, S.R. No. 37/2025

The primary legal concept in S.R. No. 37/2025 is temporal extension of subordinate legislation. The regulation relies on the framework in the Subordinate Legislation Act 1994 that causes subordinate instruments to lapse or be revoked unless steps are taken to preserve them. The Objective in regulation 1 identifies section 5(1) of the Subordinate Legislation Act 1994 as the provision that would otherwise cause revocation; the extension is authorised by sections 5A and 28 of the same Act (regulations 1 and 2). The extension is framed as a discrete exercise of those statutory powers rather than as an amendment to the principal instrument.

A second concept is statutory commencement and expiry. The instrument contains both an effective extension period (15 June 2025 to 14 June 2026, reg 3) and a separate revocation date for the extension regulations themselves (revoked on 15 June 2026, reg 4). The instrument also records its own date of making and commencement in the Endnotes: made on 3 June 2025 and in operation on 3 June 2025 (Endnotes, para 1). This creates a temporal layering: the extension regulation comes into force prior to the beginning of the extended operation period it creates for the Gambling Regulations 2015.

A third concept concerns interpretation and the form of statutory rules. The Endnotes include material drawn from the Interpretation of Legislation Act 1984 (ILA) about headings, examples, punctuation and provision numbers forming part of a statutory rule (Endnotes, section headed "Interpretation"). This material affects how the underlying Gambling Regulations 2015 should be read during the extension period: headings, examples, diagrams, notes and punctuation included in the statutory rule are to be treated as part of the rule (see Endnotes text referring to ILA s 36, s 36(1A)(2A)(2B), s 36(3A), s 36(3B), s 36(3C)). The Endnotes also make clear that explanatory memoranda and other post-endnote material are not part of the statutory rule (Endnotes: "Other material ... does not form part of a Statutory Rule", referring to ILA s 36(3)(3D)(3E)).

Another concept is traceability to the principal instrument and its amendment history: the Explanatory details note identifies the principal instrument as S.R. No. 55/2015 and lists its subsequent amending statutory rules (S.R. Nos 139/2015, 111/2016, 12/2017, 1/2019, 90/2020 and 121/2023) (Explanatory details, Reg. 3). That tells a reader which texts to assemble if they need the operative version of the Gambling Regulations 2015 while they are extended.

Finally, the instrument illustrates a narrow administrative function available under subordinate legislation frameworks: the executive preserves regulatory continuity by extending an existing subordinate instrument for a specified period without re-enacting or altering its substantive content. The extension therefore creates a predictable regulatory horizon for affected parties but no substantive policy change in itself.

The regulation affects anyone who is subject to, or benefits from, the Gambling Regulations 2015 while those regulations remain in force. The extension does not itself enumerate categories of persons, sectors, or licences; it operates by reference to the Gambling Regulations 2015 (regulation 3). Therefore the set of affected persons is defined entirely by the scope of that principal instrument. Practically, that means that operators, licence-holders, third-party service providers, compliance officers, advisers and enforcement bodies that are governed by the Gambling Regulations 2015 will continue to have the regulatory obligations, permissions and enforcement relationships set out in that instrument for the extended period.

Decision-makers are identified in the instrument’s metadata. The Endnotes record that the regulations were made on 3 June 2025 by the Lieutenant-Governor as the Governor’s deputy, with the advice of the Executive Council, under sections 5A and 28 of the Subordinate Legislation Act 1994 (Endnotes, para 1). That identifies the executive actors responsible for the instrument’s making and the statutory basis they invoked. The Subordinate Legislation Act 1994 provisions cited in regulation 2 are the legal source that authorises the extension; the Endnotes also indicate that section 5(1) of the Subordinate Legislation Act 1994 is the mechanism that would otherwise cause revocation of the principal instrument (regulation 1).

Because the instrument extends but does not change the underlying text, practical consequences for affected parties are continuity of regulatory obligations and the absence of change during the extension period. The extension removes, for the specified period, the legal uncertainty that a lapse would cause. Conversely, the instrument places a calendar constraint on affected parties: the extension lapses on 14 June 2026 and the extension regulation is revoked on 15 June 2026 (regulations 3 and 4). Absent further extension or replacement, obligations that depend on the Gambling Regulations 2015 will cease after the end of the extended period.

Finally, the Endnotes direct users to the official Victoria legislation website for authoritative texts and current versions (Endnotes, para 1). That is the official repository users should consult to determine whether a person or entity is in scope of the Gambling Regulations 2015 as extended by S.R. No. 37/2025.

S.R. No. 37/2025 does not itself create new substantive duties or rights. Its operative provision is a temporal extension: the operation of the Gambling Regulations 2015 is continued for a specified one-year period (regulation 3). Accordingly, any duties, obligations, licensing conditions, permissions, exemptions, record‑keeping requirements, reporting obligations, or rights to act that are set out in the Gambling Regulations 2015 continue to apply during the extension period to the extent they exist in the underlying instrument.

Because this extension regulation is narrowly framed, identifying duties and rights requires consulting the Gambling Regulations 2015 and its amending instruments (Explanatory details, Reg. 3). The extension regulation names the principal instrument and its amendment trail (S.R. No. 55/2015, as amended by S.R. Nos 139/2015, 111/2016, 12/2017, 1/2019, 90/2020 and 121/2023) and thereby points to the composite text that constitutes the operative regulatory regime during the extension period. Any enforcement powers, administrative discretions, or statutory remedies that are specified in the Gambling Regulations 2015 likewise remain operative during the extension.

Interpretation-related rules in the Interpretation of Legislation Act 1984, quoted in the Endnotes, affect how those duties and rights should be read. The Endnotes explain that headings, examples, diagrams, notes, punctuation and provision numbers included in a Statutory Rule made on or after 1 January 2001 form part of that Statutory Rule (Endnotes, section headed "Interpretation", citing ILA s 36 and related subsections). That means a practitioner should include those textual elements when determining the scope of duties and rights in the Gambling Regulations 2015 as extended.

The extension regulation itself does impose one temporal duty on users of the legislation: if continuity of particular regulatory arrangements is required beyond 14 June 2026, affected parties or the executive must secure further legislative action before that date. The extension regulation will be revoked on 15 June 2026 (regulation 4), and absent another instrument republishing or extending the principal instrument, the duties/rights created by the Gambling Regulations 2015 will no longer be effective after their extended expiry.

The extension regulation contains no penalty provisions and does not create enforcement machinery. Its effect is to preserve the enforcement regime that already exists in the Gambling Regulations 2015 for the extension period (regulation 3). Where the Gambling Regulations 2015 contain offences, monetary penalties, or enforcement frameworks, those will continue to be the operative mechanisms during the extended period; the extension regulation itself does not modify enforcement powers or sanctions.

Because S.R. No. 37/2025 is temporal and procedural, enforcement consequences arise only by reference to the underlying instrument. Practitioners will therefore need to consult the Gambling Regulations 2015 (S.R. No. 55/2015) and any of its amendments listed in the Explanatory details to determine:

• which contraventions attract penalties;
• which administrative or regulatory bodies have enforcement powers; and
• what procedural rights (notice, appeal, review) are available to regulated entities.

The Endnotes instruct users to consult the official legislation website for the current version of legislation (Endnotes, para 1). That is the source for authoritative details of penalties and enforcement provisions in the Gambling Regulations 2015 as extended.

Timing adds an enforcement risk: the extension terminates on 14 June 2026 and the extension regulation is revoked on 15 June 2026 (regulations 3 and 4). After revocation, any continuing conduct that relied on permissions, licences, or defences that exist only in the Gambling Regulations 2015 may no longer have legal effect. Parties with ongoing activities that depend on those regulatory permissions should either ensure compliance with any transitional arrangements in the principal instrument or secure further legislative or administrative action to avoid a gap in lawful authority. S.R. No. 37/2025 does not itself provide transitional provisions, nor does it purport to alter enforcement timelines.

Finally, the legal form of the instrument suggests that enforcement practice will continue along existing lines: the executive chose an extension rather than re‑designing the enforcement framework. That keeps enforcement predictable for the limited period, but the limited duration means enforcement priorities or remedies could change if the principal instrument is revised or allowed to lapse after 14 June 2026.

S.R. No. 37/2025 operates within the statutory framework created by the Subordinate Legislation Act 1994 and the Interpretation of Legislation Act 1984. Regulation 1 of the Extension Regulations expressly links the instrument to section 5(1) of the Subordinate Legislation Act 1994, identifying that subsection as the mechanism that would otherwise have revoked the Gambling Regulations 2015 (regulation 1). The Extension Regulations themselves are made under sections 5A and 28 of the Subordinate Legislation Act 1994 (regulation 2). Those references indicate that the extension is an exercise of delegated power under the Subordinate Legislation Act framework rather than an exercise of primary legislative power.

The Endnotes reproduce interpretive rules from the Interpretation of Legislation Act 1984 (ILA). These extract provisions on headings, examples, punctuation, provision numbers and the placement of "legislative items" such as penalties and notes in Statutory Rules (Endnotes: "Interpretation" and related paragraphs). Practically, that means any reading of the Gambling Regulations 2015 during the extension must take account of those interpretive rules because the ILA treats many textual features as integral to a Statutory Rule.

The Explanatory details tie the extension to a specific principal instrument and its amendment trail: the Gambling Regulations 2015, S.R. No. 55/2015, as amended by listed S.R. numbers (Explanatory details, Reg. 3). That identifies which subordinate rules are in play and which amending instruments form part of the operative body of subordinate legislation during the extension period. The extension regulation does not interact with primary legislation except insofar as the Subordinate Legislation Act 1994 governs the lifecycle of statutory rules.

The Endnotes make explicit that explanatory memoranda, tables of provisions and other material printed after the Endnotes do not form part of a Statutory Rule (Endnotes: "Other material ... does not form part of a Statutory Rule", citing ILA s 36(3)(3D)(3E)). That affects interaction with other materials often used for legislative intent: ancillary explanatory documents are not part of the rule and therefore do not have force as legal provisions. Practitioners should therefore rely on the text of the Gambling Regulations 2015 and the Extension Regulations themselves, together with the interpretive rules in the ILA, when assessing legal obligations.

Finally, the Extension Regulations do not amend or displace any primary legislation or other subordinate instruments beyond preserving the operation of the specified Gambling Regulations 2015 for a set period. Any conflict between the Gambling Regulations 2015 (as extended) and other statutory provisions would be resolved by standard principles of statutory construction and legal hierarchy; the Extension Regulations do not alter that hierarchy.

The Extension Regulations themselves have no amendment history: the Table of Amendments in the instrument records that there are no amendments made to S.R. No. 37/2025 by statutory rules, subordinate instruments or Acts (Endnotes, "2 Table of Amendments"). The instrument is Version No. 001 as at 3 June 2025.

The Explanatory details identify the principal instrument that the Extension Regulations operate upon: the Gambling Regulations 2015, S.R. No. 55/2015, and list the amending subordinate rules that have altered the Gambling Regulations 2015 since its original making. That list is in the Explanatory details (Reg. 3): S.R. Nos 139/2015, 111/2016, 12/2017, 1/2019, 90/2020 and 121/2023. Those citations indicate which subordinate instruments a reader must consult to assemble the operative text of the Gambling Regulations 2015 for the purposes of compliance during the extension period.

The Extension Regulations do not purport to change the content of the Gambling Regulations 2015 or to add to their amendment history. Instead, the Extension Regulations extend the operative life of the current composite of the Gambling Regulations 2015 and its amendments for a further 12 months. If further amendments to the Gambling Regulations 2015 are made during that 12‑month period, the extension preserves whatever new version results from those amendments for the remainder of the extension period, subject to the normal operation of the Subordinate Legislation Act 1994 and any amending instruments.

The Endnotes also include interpretive amendments authorised by the Interpretation of Legislation Act 1984 (e.g. style changes authorised by s 54A of the ILA and references to s 39B): these are not amendments to S.R. No. 37/2025 itself but indicate how legislative editing and insertion practices are reflected in statutory rules (Endnotes, "INTERPRETATION OF LEGISLATION ACT 1984 (ILA)" and following paragraphs). Practitioners assembling the text of the Gambling Regulations 2015 should therefore account both for explicit amending S.R. numbers and for standard legislative style adjustments recognised by the ILA.

The Extension Regulations record no litigation history. The instrument’s Endnotes and Table of Amendments do not reference any cases or judicial determinations concerning S.R. No. 37/2025 or its application. There are no judgments, appeals, or tribunal matters listed in the text supplied.

Because S.R. No. 37/2025 is a temporal preservation device rather than a source of novel regulatory obligations, it is unsurprising that the instrument itself has no litigation record in the document. Any litigation that may involve the practical operation of the Gambling Regulations 2015 during the extension period would appear, if it exists, under the records for the Gambling Regulations 2015 or in judicial decisions interpreting those substantive regulations. The Extension Regulations do not identify any cases and do not add litigation-specific provisions such as transitional enforcement rules or immunity clauses.

When assessing legal risk or precedent for matters occurring in the extension period, practitioners should therefore consult the case law and tribunal decisions relating to the Gambling Regulations 2015 and related primary legislation. The Extension Regulations indicate where to find the operative text (S.R. No. 55/2015 and its listed amendments) and do not purport to create or alter rights of appeal, judicial review windows, or enforcement processes themselves.

The Endnotes also direct users to the official Victorian legislation website for current texts and updates (Endnotes, para 1). That is the appropriate starting point for searching for any judicial consideration of the Gambling Regulations 2015 and its operation during the extended period.

Several practical traps are apparent from the text and form of S.R. No. 37/2025.

1. Extension versus amendment. The instrument extends the operation of the Gambling Regulations 2015; it does not amend them (regulation 3). If a practitioner reads S.R. No. 37/2025 without consulting the underlying instrument and its amending S.R.s, they may mischaracterise the rules still in force. The Explanatory details identify the amending instruments a reader must include (Explanatory details, Reg. 3).

2. Start of extension versus commencement of the instrument. The Extension Regulations were made and came into operation on 3 June 2025 (Endnotes, para 1) but the actual extended operation of the Gambling Regulations 2015 runs from 15 June 2025 to 14 June 2026 (regulation 3). That timing mismatch can cause confusion for transitional measures or for actions taken between 3 June 2025 and 14 June 2025 that rely on the extended operative period. Practitioners should be careful to distinguish the date the extension instrument commenced from the dates for which the principal instrument is extended.

3. Revocation timing. The Extension Regulations are revoked on 15 June 2026 (regulation 4). The extended operation of the Gambling Regulations 2015 ends on 14 June 2026 (regulation 3). The extension instrument therefore ceases to exist the day after the extension period ends. That sequencing means that, absent further legislative action, any ongoing regulatory permissions or obligations that depend on the Gambling Regulations 2015 will terminate at midnight on 14 June 2026.

4. No substantive change or transitional rules. Because the instrument only extends the existing regulations, it contains no transitional provisions or express savings clauses. If stakeholders require transitional protection, they must seek express provisions in the principal instrument, a further extension instrument with transitional text, or in primary legislation. The absence of transitional wording is a practical risk for licences, contracts or enforcement steps that straddle the extension’s expiry.

5. Interpretive features are part of the rule. The Endnotes emphasise that headings, examples, diagrams, notes, punctuation and provision numbers included in a Statutory Rule are part of that rule (Endnotes, "Interpretation", citing ILA s 36 and related subsections). When construing the Gambling Regulations 2015 during the extension period, include these textual features in statutory interpretation.

6. Explanatory materials do not form part of the rule. The Endnotes state that explanatory memoranda and similar materials printed after the Endnotes do not form part of a Statutory Rule (Endnotes, "Other material ... does not form part of a Statutory Rule", citing ILA s 36(3)(3D)(3E)). Practitioners who rely on explanatory notes for legal effect should be aware these materials have no legal force.

7. Reliance on online consolidations. The Endnotes direct readers to legislation.vic.gov.au for current versions and up-to-date legislative information (Endnotes, para 1). Given the composite nature of the Gambling Regulations 2015 with multiple amending S.R.s, parties should verify they are consulting the current consolidated text and the correct versions of amending instruments.

8. Narrow scope of the instrument. Because the Extension Regulations do not address primary legislation, any inconsistency between the Gambling Regulations 2015 (as extended) and primary legislation would be resolved by statutory hierarchy; the Extension Regulations will not shield subordinate provisions from conflict with primary law.

Compliance steps under S.R. No. 37/2025 are predominantly procedural: ensure that obligations and permissions that derive from the Gambling Regulations 2015 remain satisfied for the extended period and prepare for the expiry of that extension.

1. Identify the operative text. Obtain the Gambling Regulations 2015 (S.R. No. 55/2015) as amended by the listed S.R.s (S.R. Nos 139/2015, 111/2016, 12/2017, 1/2019, 90/2020 and 121/2023) and confirm the consolidated version that is in force during the extension period (Explanatory details, Reg. 3). The Endnotes direct users to the official legislation website as the authoritative repository (Endnotes, para 1).

2. Confirm temporal coverage. Note that the extension applies from 15 June 2025 to 14 June 2026 (regulation 3). The extension instrument itself was made and commenced on 3 June 2025 (Endnotes, para 1). Reconcile any compliance actions, licence renewals or reporting cycles with those dates.

3. Map duties, rights and enforcement. Because S.R. No. 37/2025 does not contain substantive regulatory provisions, map which duties and rights from the Gambling Regulations 2015 apply to your operations or clients and make sure compliance systems remain active for the entire extended period. This includes licence conditions, reporting obligations, record keeping, internal controls and any other regulatory requirements contained in the Gambling Regulations 2015.

4. Plan for expiry. The extension ends on 14 June 2026 and the Extension Regulations are revoked on 15 June 2026 (regulations 3 and 4). Identify any activities that would be affected by the lapse, and if continuity beyond that date is required, seek confirmation from regulators or the responsible executive that a further extension, replacement regulation, or primary legislative change will be made in time. If there is uncertainty, consider administrative risk mitigants such as seeking written guidance from the regulator, pursuing licence renewals earlier, or preparing contingency plans to adjust operations if the regulatory instrument lapses.

5. Interpretive approach. When construing obligations, include textual elements identified in the Endnotes as part of the statutory rule (headings, examples, punctuation, provision numbers), because the Interpretation of Legislation Act 1984 treats them as part of the rule (Endnotes, "Interpretation", citing ILA s 36 and related subsections). Do not rely on explanatory memoranda as part of the legal text (Endnotes: explanatory material does not form part of a Statutory Rule).

6. Monitor for amendments. Although the Extension Regulations themselves have no amendments (Table of Amendments), the Gambling Regulations 2015 have been amended previously and may be amended again during the extension period. Maintain a watch on the Victoria legislation website for any further S.R.s that amend the Gambling Regulations 2015 or any subsequent extension instruments.

7. Recordkeeping and evidence. Where obligations under the Gambling Regulations 2015 require reporting or record retention, ensure records clearly indicate compliance dates that fall within the extension period. If a dispute arises about whether an action occurred while the principal instrument was in force, contemporaneous documentation tied to the extension dates (15 June 2025 to 14 June 2026) will be relevant.

8. Seek authority confirmations where necessary. For entities whose commercial operations critically depend on continued regulatory permissions, obtain formal confirmation from the regulator or the Department responsible for gambling regulation about the practical effect of the extension on licences, approvals, and enforcement discretion.

Following these steps ensures that compliance planning aligns with the limited, time-bound function of S.R. No. 37/2025: it keeps the Gambling Regulations 2015 in force for a specified 12-month period but does not change their substantive content.
