Subordinate Legislation (Casino Control (Fees) Regulations 2015) Extension Regulations 2025

The instrument relies on and operates through three core concepts: temporal extension of a subordinate instrument, authorisation under the Subordinate Legislation Act 1994, and the treatment of form and interpretation matters under the Interpretation of Legislation Act 1984. Each concept has direct textual support in the Regulations and associated endnotes.

1. Temporal extension of subordinate legislation. Regulation 3 sets the substantive mechanics: “The operation of the Casino Control (Fees) Regulations 2015 is extended for the period beginning on 20 April 2025 and ending on 19 April 2026.” The instrument does not purport to vary the content of the 2015 regulations, only to prolong their operation. Regulation 1 explains why: absent the extension, the 2015 instrument “would otherwise be revoked by virtue of section 5(1) of the Subordinate Legislation Act 1994.” That references an automatic expiry or revocation mechanism in the parent Act and identifies the extension instrument’s purpose as preventing that sunset from taking immediate effect for the specified period.

2. Statutory authorisation and form. Regulation 2 identifies the statutory anchors for the Governor in Council’s power to make this extension: these Regulations are made under sections 5A and 28 of the Subordinate Legislation Act 1994. The endnotes repeat the formalities: the instrument was made on 15 April 2025 by the Governor in Council under those sections and came into operation on 15 April 2025 (Endnote 1). The document is therefore an exercise of delegated power under the Subordinate Legislation Act 1994; its form and dating details (S.R. No. 19/2025; Version No. 001) are recorded in the title block and endnotes.

3. Interpretation and treatment of non‑operative materials. The endnotes include a substantial interpretative note drawing on the Interpretation of Legislation Act 1984 (ILA). That material explains how headings, examples, diagrams, notes, punctuation and provision numbers are to be treated as forming part of a Statutory Rule where relevant (Endnotes: Interpretation). It also explains that explanatory memoranda, tables of provisions, endnotes, index and other material printed after the Endnotes do not form part of the Statutory Rule (Endnotes: Other material). That has the consequence that the substantive extension effect must be read from the operative regulations themselves (regulations 1-4) while the other printed material in the document serves explanatory or administrative purposes only.

These concepts operate together: the Governor in Council, using powers in ss 5A and 28 of the Subordinate Legislation Act 1994, issues a statutory rule identified as S.R. No. 19/2025 that extends an earlier subordinate instrument for a defined temporal window, and that rule must be read in light of ILA interpretative rules described in the endnotes. The Regulations are therefore a discrete, formal legal mechanism to preserve the existing fee regime for a further year while leaving the content and enforcement architecture of the original fees regulation intact.

The extension Regulation directly affects the class of persons and entities that are subject to the Casino Control (Fees) Regulations 2015. The instrument does not define that class itself; it preserves the legal operation of the referenced 2015 regulations so that the rights, liabilities, duties and fee liabilities created by that earlier instrument continue to bind the persons to whom those provisions apply for the extension period (regulation 3). Because this extension does not amend substance, it applies to the same regulated population as the 2015 instrument.

Administratively, the decisionmaker who made the extension is the Governor in Council under the Subordinate Legislation Act 1994 (regulation 2; Endnote 1). That identifies who decides to extend the instrument, and therefore which executive actor is responsible for the continuation decision. The endnote records the making date and the fact the instrument was made pursuant to ss 5A and 28 of the Subordinate Legislation Act 1994 (Endnote 1). Those are the formal decision‑makers and legal authorities behind the extension.

Indirectly, this instrument affects any person or body that relies on the 2015 regulations having been revoked , for example, a person planning to act on the assumption that the fee regime would lapse on the automatic revocation date under s 5(1) of the Subordinate Legislation Act 1994. The extension nullifies that assumption for the specified period. The instrument therefore affects planning and compliance choices by regulated entities, advisers, and possibly enforcement or revenue collection agencies that implement the fee regime, because the 2015 regime remains operative from 20 April 2025 to 19 April 2026 (regulation 3).

The Regulations also have an effect on persons monitoring statutory instruments. The document is S.R. No. 19/2025 and Version No. 001 (Title block), and the endnotes advise that the extension Regulations were made on 15 April 2025 and will be revoked on 20 April 2026 (Endnote 1; regulation 4). Those dates matter to legal practitioners, corporate counsel, compliance officers and auditors who must maintain registers of current instruments and advise clients whether the fee instrument applies at a given time.

Finally, while the extension does not itself create new fees or obligations, it preserves the financial and compliance consequences of the 2015 fees instrument for the same class of affected persons. Therefore, anyone who would have been required to pay fees under the 2015 regulations continues to be liable for those fees during the extension period; conversely, anyone relying on the expiry of that fee regime for relief must take account of the extension.

This extension Regulation performs no substantive alteration of duties and rights; its operative effect is temporal preservation. The key legal consequence is that the duties, liabilities and rights established by the Casino Control (Fees) Regulations 2015 remain in force for the period specified in regulation 3. Put formally: the operation of the 2015 regulations is extended from 20 April 2025 to 19 April 2026 (regulation 3). Therefore, any duty to pay fees, any obligation to comply with administrative fee procedures, and any entitlement or right created by the 2015 regulations continue to operate as if the 2015 instrument had not reached the automatic revocation date under section 5(1) of the Subordinate Legislation Act 1994 (regulation 1).

Because the extension does not purport to modify the 2015 regulations, the substantive content of duties and rights remains governed by the original instrument. The extension Regulation itself contains no fees, exemptions, procedural steps, registration requirements, enforcement mechanisms or appeal rights; it contains only the mechanism to prolong the existing framework. The legal effect is therefore preservation, not amendment.

Practically, the duty to comply with the 2015 instrument continues during the extension window; parties subject to those regulations must satisfy payment obligations and procedural obligations set out in the 2015 instrument for any time within 20 April 2025-19 April 2026. Those obligations might include payment deadlines, return filings or other compliance steps specified in the 2015 instrument; the extension Regulation ensures they remain current and enforceable for the period specified (regulation 3).

For administrators and revenue collectors, the extension delivers continuity of enforcement rights. The Governor in Council made the extension under ss 5A and 28 of the Subordinate Legislation Act 1994 (regulation 2). That statutory authorisation implies that the extension is legally effective for the period specified and therefore that administrative entities responsible for implementing the 2015 fees regime may continue to apply, collect and enforce the fees and associated compliance obligations during that time.

Finally, because the extension is time‑limited and the extension Regulations are themselves revoked on 20 April 2026 (regulation 4), any rights or duties that are contingent on the existence of the 2015 regulations will, absent further action, cease to be operative after the end of the extension period. That creates a foreseeable time boundary to the duties and rights preserved by this instrument.

The Extension Regulations contain no express penalty provisions, criminal offences, or enforcement mechanisms. There are only four operative regulations, none of which create new sanctions. Regulation 3 performs a temporal extension of the Casino Control (Fees) Regulations 2015; any penalties and enforcement mechanisms therefore remain those provided in the 2015 regulations and the parent legislation under which those 2015 regulations were made.

Because the document is made under sections 5A and 28 of the Subordinate Legislation Act 1994 (regulation 2), enforcement of fee liabilities and associated penalties will continue to be effectuated under the legal architecture established by the Casino Control (Fees) Regulations 2015 and the statutes that empowered their creation. The extension instrument leaves that enforcement architecture intact for the period 20 April 2025 to 19 April 2026 (regulation 3).

Practically, regulated entities should expect that any sanctioning, collection or administrative enforcement that would have applied under the 2015 regulations continues to apply during the extension period. The extension therefore preserves the ability of enforcement agencies and administrative decision‑makers to require payment of fees or to pursue remedies for non‑compliance under the 2015 instrument.

The extension Regulations also set an explicit revocation date for themselves (regulation 4). That provides a clear temporal limit for enforcement continuity: unless a further extension or replacement instrument is made, enforcement machinery anchored in the 2015 regulations will cease to be operative after 19 April 2026 because the 2015 instrument will no longer be extended beyond that date. The extension instrument therefore imposes an administrative planning requirement on enforcement bodies: they must account for the termination date specified in the extension when scheduling compliance, auditing, or enforcement activities that extend into or beyond April 2026.

Finally, the endnotes record that explanatory material printed after the Endnotes does not form part of the Statutory Rule (Endnotes: Other material). That means that any descriptive commentary in the printed package cannot be relied upon to create or vary enforcement powers; the operative enforcement provisions remain those in the 2015 instrument and the enabling statutes.

The Regulations are an exercise of delegated legislative power under the Subordinate Legislation Act 1994 and therefore operate in a supporting, temporal role relative to both the enabling statute and the principal subordinate instrument. Regulation 1 explicitly references section 5(1) of the Subordinate Legislation Act 1994 as the mechanism that would otherwise revoke the Casino Control (Fees) Regulations 2015, and regulation 2 identifies sections 5A and 28 of that Act as the authorising provisions for making this extension Regulations. The legal interaction is therefore direct: the Subordinate Legislation Act 1994 supplies both the automatic revocation trigger that the extension avoids (regulation 1) and the power under which the extension may be made (regulation 2).

The Regulations do not themselves amend or displace any provision of the Casino Control (Fees) Regulations 2015 or of the Casino Control Act or other primary legislation. Their effect is to maintain the operation of the 2015 instrument, so the substantive legal relationships established by the 2015 instrument continue to interact with all related laws as they did before the extension. For example, fee liabilities that interact with taxation, administrative law review processes, or enforcement regimes will continue to do so for the period of extension; the extension simply keeps those interactions in place.

The endnotes also import interpretative rules from the Interpretation of Legislation Act 1984 (ILA). Those rules instruct how headings, notes, punctuation and numbered provisions are to be treated as forming part of the statutory rule (Endnotes: Interpretation). They also record that explanatory memoranda and tables of provisions printed after the Endnotes do not form part of the Statutory Rule (Endnotes: Other material). Those interactions affect statutory construction: when courts or practitioners interpret this extension instrument, they will apply the ILA rules identified in the endnotes to determine what textual elements are operative and which are merely explanatory.

Administrative interactions are also implicit. Because the extension was made by the Governor in Council and recorded as S.R. No. 19/2025 (Endnote 1; title block), it will be entered into statutory registers and databases that maintain current versions of subordinate legislation. That administrative interaction ensures that the 2015 instrument appears on registers as operative between 20 April 2025 and 19 April 2026. The endnote instructs readers to consult the official website (www.legislation.vic.gov.au) for up‑to‑date legislative information (Endnote 1), which is an administrative interface through which the extension interacts with public law information systems.

In summary, the Regulations interact with the Subordinate Legislation Act 1994 by both invoking its revocation rules and relying on its extension powers; they leave substantive interactions between the 2015 fees regulation and other statutes unchanged, and they are to be interpreted subject to the ILA interpretative rules flagged in the endnotes.

The document includes a Table of Amendments section which records that there are no amendments made to the Subordinate Legislation (Casino Control (Fees) Regulations 2015) Extension Regulations 2025 by statutory rules, subordinate instruments or Acts (Endnote 2: Table of Amendments). The extension Regulations are Version No. 001 and are recorded as S.R. No. 19/2025 (Title block). That indicates this printed text is the initial version and that no subsequent statutory rule has altered these Regulations up to the Version date shown (Version as at 15 April 2025).

The endnotes identify formalities about the making and operation of the instrument. The Regulations were made on 15 April 2025 by the Governor in Council under ss 5A and 28 of the Subordinate Legislation Act 1994, and they came into operation on 15 April 2025 (Endnote 1). Regulation 4 specifies the extension Regulations themselves will be revoked on 20 April 2026. There is also an Explanatory Details entry noting that Regulation 3 references S.R. No. 27/2015 (Explanatory details: 1. Reg. 3: S.R. No. 27/2015), which ties the extension to the original 2015 instrument. The Table of Provisions and Version numbering provide the standard statutory recording of the instrument’s lifecycle.

Because the Table of Amendments records no amendments, practitioners should treat this as the only iteration of the extension Regulations to date. Any future amendment, extension, replacement or revocation beyond the stated revocation date would require a further statutory rule or Act and would create an additional entry in the Table of Amendments and a subsequent version number. The present document therefore stands as a single, time‑limited instrument whose internal amendment history is nil up to the specified version date.

The printed Regulations and endnotes do not record any litigation history. There are no cases named in the text, no references to judicial determinations about the validity, operation or interpretation of this extension instrument, and the Table of Amendments notes that there have been no statutory amendments to this instrument (Endnote 2). The document is therefore silent on any court challenges, declaratory proceedings, or other litigation concerning this extension Regulations as at the Version date.

Given the instrument’s form , a discrete temporal extension under express empowering provisions , any litigation that might arise would be directed at either the validity of the delegated power exercised under sections 5A and 28 of the Subordinate Legislation Act 1994, or at the operation of the underlying Casino Control (Fees) Regulations 2015 during the extension period. The Regulations themselves provide no factual or legal narrative that would indicate existing litigation; the endnotes confine themselves to formal matters of interpretation and recording. Practitioners needing to determine whether litigation exists should consult judicial databases and the statutory registers referenced in the endnotes (see Endnote 1: “See www.legislation.vic.gov.au for Victorian Bills, Acts and current Versions of legislation and up‑to‑date legislative information”).

Because the extension preserves the pre‑existing 2015 instrument, any litigation history that pertains to the 2015 regulations would carry forward in the sense that rights and liabilities remain in place. However, the extension Regulations do not themselves add to or alter potential grounds for dispute; they are a temporal mechanism rather than a substantive amendment. The document’s silence on litigation therefore reflects both the limited scope of the instrument and the absence of recorded judicial engagement in the printed material.

This extension Regulations appears simple, but there are several concrete technical points and operational traps for practitioners and administrators to note, all grounded in the instrument’s text and endnotes.

1. Extension period does not coincide exactly with the instrument’s making date. The Regulations were made on 15 April 2025 and came into operation on that date (Endnote 1), but the period for which the Casino Control (Fees) Regulations 2015 is extended runs from 20 April 2025 to 19 April 2026 (regulation 3). That means the extension instrument exists and is in force for five days before the extension window begins. Practitioners should not assume automatic continuity outside the dates specified in regulation 3; the operative preservation of the 2015 fees regulation applies only from 20 April 2025 through 19 April 2026.

2. The extension is time‑limited and the instrument is self‑revoking. Regulation 4 expressly revokes the extension Regulations on 20 April 2026. Unless further action is taken before that date, the preservation effect ends and the automatic revocation mechanism referenced in regulation 1 will again operate. Parties planning compliance, revenue collection, transitional arrangements or policy change should make contingency arrangements for the post‑19 April 2026 position.

3. The extension preserves the 2015 instrument but does not change substance. The Regulations do not alter fees, exemptions, procedures, or enforcement powers; they maintain the status quo for a fixed period. Any change in fee levels or policy must be effected by amendment to the 2015 Regulations (or by replacement instrument), not by this extension instrument.

4. Interpretative materials in the printed package are limited in weight. The endnotes incorporate a suite of ILA interpretative rules about headings, punctuation and numbering and explicitly state that explanatory memoranda and other printed materials after the Endnotes do not form part of the Statutory Rule (Endnotes: Other material). Practitioners should therefore rely on the operative regulations (regs 1-4) and on ILA rules where interpretation issues arise, rather than treating the printed explanatory text as legally operative.

5. Recordkeeping and registers matter. The title block identifies the extension Regulations as S.R. No. 19/2025, Version No. 001 (Title block). The endnotes instruct readers to consult the official legislation site for current versions (Endnote 1). Failure to check up‑to‑date registers could lead to advising clients incorrectly about whether the 2015 fees regime is currently in force.

6. No change to penalties or enforcement architecture. Because the extension creates no new sanctions, practitioners should not assume any amelioration or tightening of enforcement will flow from the extension alone; any such changes would require amendment to the underlying 2015 instrument or to the enabling statutes.

7. Narrow scope for challenge within the printed text. The instrument’s limited content reduces the number of plausible doctrines for judicial challenge based solely on the printed content. Challenges, if any, would likely focus on whether the Governor in Council validly exercised the powers in ss 5A and 28 of the Subordinate Legislation Act 1994 or on the substance of the 2015 Regulations themselves.

These practical points are grounded in the Regulations’ text (regs 1-4) and the endnotes’ interpretative directives. They identify the operational edges of the instrument where mistakes or misinterpretations are most likely to arise.

Compliance, as imposed by this extension instrument, is primarily a matter of continuation of existing obligations under the Casino Control (Fees) Regulations 2015 for the extension window. The extension itself does not create new procedural compliance tasks beyond ensuring that persons and entities subject to the 2015 instrument continue to meet whatever fee, filing and administrative obligations that instrument requires between 20 April 2025 and 19 April 2026 (regulation 3).

Practical compliance steps that follow from the Regulations’ text and form are:

1. Confirm applicability. Organisations and advisers should verify whether the Casino Control (Fees) Regulations 2015 apply to them. The extension does not alter the scope of application; it keeps the 2015 instrument in force for the stated period (regulation 3). Advisers should consult the 2015 instrument itself to identify specific duties and liabilities.

2. Maintain payment and filing systems. Any payment schedules, lodgement deadlines or other procedural obligations that fall within 20 April 2025-19 April 2026 should be treated as continuing obligations. Administrators should ensure finance and compliance systems remain set to capture and process fees in accordance with the 2015 regulations during that period.

3. Update legal registers and client advice. Because the extension instrument is S.R. No. 19/2025 and in force from 15 April 2025 (Title block; Endnote 1), maintain registers that record the extension. When advising clients, cite regulation 3 for the extension period and Endnote 1 for the making and operation dates. The endnotes instruct that the official legislation website should be used for up‑to‑date information (Endnote 1).

4. Monitor the revocation date and plan transitions. Regulation 4 states the extension Regulations are revoked on 20 April 2026. If clients or agencies plan to rely on the fee regime beyond that date, they should prepare for either a further statutory extension, an amendment, or the introduction of a replacement instrument. Administrative bodies responsible for enforcement should schedule audits, collections and policy changes to avoid being caught by the expiry date.

5. Do not rely on explanatory print as operative law. The endnotes note that explanatory memoranda, tables of provisions and similar materials printed after the Endnotes do not form part of the Statutory Rule (Endnotes: Other material). Legal advice and compliance actions should be grounded in the operative regulations (regs 1-4) and in the text of the Casino Control (Fees) Regulations 2015 rather than on ancillary printed commentary.

6. Document decision rationale for internal records. While the Regulations themselves are short, organisations that are affected should record the impact analysis showing how the continuation of the 2015 regime affects budgeting, pricing, contracts and compliance obligations for the 12‑month period, so internal stakeholders are not surprised if the instrument is not renewed beyond 19 April 2026.

7. Verify no amendments to this extension instrument. The Table of Amendments notes there are no amendments to this extension Regulations up to the Version date (Endnote 2). Before relying on the status quo, check the statutory registers to ensure no subsequent modification has occurred.

Following these steps will align internal processes and external advice with the narrow legal effect of the extension Regulations, which is to keep the 2015 fees regime alive and enforceable between 20 April 2025 and 19 April 2026 (regulation 3), subject to the formalities governing statutory rules set out in the endnotes.
