Subordinate Legislation (Architects Regulations 2015) Extension Regulations 2025

The instrument operates on a narrow set of subordinate-legislation concepts: extension, authorisation, operative period and revocation. The key legislative concepts used and their textual anchors in the instrument are:

• Extension of operation: expressed in regulation 3, which fixes the extension period for the Architects Regulations 2015 (reg 3). The instrument therefore functions as a temporal override to the automatic revocation process mentioned in reg 1.

• Authorising provision: the Regulations are made under sections 5A and 28 of the Subordinate Legislation Act 1994 (reg 2). The instrument does not reproduce the text of those sections; it records the legal source that confers power to make extension regulations.

• Revocation: the instrument self-terminates by regulation 4, which states the extension regulations are revoked on 27 April 2026 (reg 4). The instrument therefore creates a discrete, time-limited legal effect.

• Commencement and making: the endnotes record the date the instrument was made (15 April 2025) and that it came into operation on 15 April 2025 (endnote 1). This distinguishes the manufacture of the instrument from the period for which it extends the Architects Regulations 2015 (beginning 27 April 2025). Practitioners must read the instrument as a made and in-force instrument that produces a future-dated effect for the underlying regulations.

• Interpretive context under the ILA: the instrument’s endnotes summarise ILA provisions that affect statutory rules (headings, examples, punctuation, provision numbers, placement of legislative items, and material that is not part of the Statutory Rule) (endnote 1, "Interpretation"). Those references affect how the extension regulation and any related materials are to be read, and they clarify that explanatory material printed after the Endnotes does not form part of the Statutory Rule (endnote 1, "Other material").

The instrument does not itself create substantive regulatory duties, definitions, or penalties. Its conceptual role is temporal and instrumental: to keep an existing subordinate law operational for a specified period. The Explanatory Details point to the lineage of the underlying Architects Regulations 2015 (S.R. No. 28/2015, as amended by S.R. Nos 28/2023 and 135/2023), which is material to anyone seeking the substantive regulatory text that remains in force by virtue of this extension (endnote 3). The instrument’s narrow architecture means that legal analysis should focus on the temporal effects, authorising power and the interpretive constraints noted in the ILA endnotes.

Directly, the Regulations affect the legal status of the Architects Regulations 2015. By extending their operation for a one-year period, this instrument affects every person and entity who is regulated by, benefits from, or enforces the Architects Regulations 2015 because those obligations, permissions and enforcement mechanisms remain in force for the extended period (reg 3). The instrument does not list categories of regulated persons; it links to the underlying regulations which define who is regulated (reg 3; endnote 3 identifying S.R. No. 28/2015).

Who pays: the primary compliance costs continue to fall on those subject to the Architects Regulations 2015. Although this extension instrument does not itself impose monetary fees or penalties, keeping the underlying regulations in operation preserves any costs, obligations, licensing requirements, record-keeping duties, or other regulatory burdens contained in the Architects Regulations 2015. The instrument does not alter those burdens, it simply maintains them for the duration of the extension (reg 3).

Who decides: the instrument was made by the Governor in Council under the Subordinate Legislation Act 1994 (endnote 1). Regulation 2 records that the instrument is made under sections 5A and 28 of that Act, and the endnotes confirm the Governor in Council made the Regulations on 15 April 2025 (reg 2; endnote 1). Administrative decision-making about the timing and existence of the extension therefore rests with the executive acting under the statutory powers cited. Any further decisions about whether to further extend, replace, or permit the automatic revocation of the underlying regulations will also be an executive/legislative decision process under the Subordinate Legislation Act 1994.

Indirect effects: entities that contract with architects, professional indemnity insurers, certifiers, building owners, and others who interact with architects may experience downstream effects because the rules governing architects remain as they are for an additional year. The instrument itself does not describe these downstream provisions; to identify the precise set of affected commercial relationships one must consult the Architects Regulations 2015 (S.R. No. 28/2015) and its amendments (endnote 3).

Timing-related effects: note the instrument came into operation on 15 April 2025 but the extension period runs from 27 April 2025 to 26 April 2026 (reg 3; endnote 1). For the period between the instrument's commencement and the extension start date practitioners should confirm whether the underlying regulations were already in force or were subject to the automatic revocation mechanism referenced in reg 1.

This instrument does not itself create new regulatory duties or rights. Its sole substantive operation is to extend the life of an existing subordinate instrument, the Architects Regulations 2015, for the period 27 April 2025 to 26 April 2026 (reg 3). Therefore the operative duties and rights relevant to stakeholders continue to be those contained in the Architects Regulations 2015 (S.R. No. 28/2015) and any amendments to it (endnote 3). The extension regulation preserves those duties and rights without modification.

What the instrument does establish, as a legal consequence, is continuity of the status quo under the Architects Regulations 2015. Any duties (licensing obligations, conduct requirements, record keeping, fees, or compliance reporting) and rights (authorisations, certificates, or entitlements) which exist in S.R. No. 28/2015 remain binding during the extension period. Conversely, any proposed changes to those duties or rights are not implemented by this instrument; such changes would require amendment of the Architects Regulations 2015 or separate subordinate instruments (reg 3; reg 2).

Because the instrument is time-limited, affected parties gain the right to rely on the continued operation of the Architects Regulations 2015 for a defined period. That reliance right is qualified by the expiry of this extension on 26 April 2026 and by the revocation of these extension regulations on 27 April 2026 (reg 3; reg 4). Parties should therefore consider the temporal boundary when structuring contracts, compliance programmes, or business plans that assume the substantive rules will continue.

The instrument contains no enforcement provisions, no penalty clauses, and no mechanism for imposing new direct liabilities. Enforcement and penalties for non-compliance therefore remain as specified in the underlying Architects Regulations 2015 and any relevant primary legislation under which those regulations operate. The endnotes emphasise interpretation rules from the ILA which may affect the construction of headings, examples and legislative items in statutory rules, but they do not themselves create duties or rights (endnote 1, "Interpretation").

The Regulations under review do not specify penalties nor do they establish new enforcement mechanisms. Regulation 3 extends the operation of the Architects Regulations 2015; any penalties or enforcement processes applicable during the extension therefore derive entirely from the Architects Regulations 2015 (reg 3). This instrument does not modify enforcement powers, sanctions, or the allocation of prosecutorial or administrative responsibility.

Because the extension does not alter the substantive rule text, any enforcement activity that could occur under the Architects Regulations 2015 before the extension continues to be available to regulators, prosecuting authorities or administrative decision-makers for the period 27 April 2025 to 26 April 2026. The instrument is silent on whether any transitional enforcement approaches apply. It does, however, set a clear temporal boundary: these extension regulations cease on 27 April 2026 (reg 4), after which the legal position must be reviewed to determine whether the underlying regulations remain, have been replaced, or are revoked as a consequence of the Subordinate Legislation Act 1994 process referred to in reg 1.

Practitioners should therefore treat this instrument as a continuity device: the risk of enforcement actions under S.R. No. 28/2015 persists through the extension; remedies, fines and processes remain those of the underlying regulations. This extension neither increases nor decreases the range of sanctions available under the Architects Regulations 2015, and it contains no express saving provision for enforcement actions commenced during the extension. The endnotes caution that explanatory memoranda and other materials printed after the Endnotes do not form part of the Statutory Rule (endnote 1, "Other material"), so any guidance in accompanying material is not itself enforceable.

If a party seeks to challenge or test enforcement action during the extension, the legal questions will turn on the Architects Regulations 2015 and the primary Act under which they are made; this instrument will be relevant only to demonstrate that the Architects Regulations 2015 remained in force during the specified period (reg 3).

Statutorily, this instrument sits within the framework of the Subordinate Legislation Act 1994. It is made under sections 5A and 28 of that Act (reg 2), and reg 1 explicitly links the need for the extension to section 5(1) of the Subordinate Legislation Act 1994 (reg 1). The instrument therefore operates as a subordinate instrument that manages the temporal operation of another subordinate instrument (the Architects Regulations 2015). It does not amend the Architects Regulations 2015; rather it preserves their continued operation for the stated period.

The endnotes incorporate relevant interpretive guidance from the Interpretation of Legislation Act 1984 (ILA). The statutory note records that section 54A of the ILA authorises certain style changes and summarises the effects of amendments to section 36 of the ILA on headings, examples, punctuation, provision numbers and the location of legislative items (endnote 1, "Interpretation"). Practitioners must therefore read this instrument and the Architects Regulations 2015 with those interpretive rules in mind regarding how headings, notes, examples and punctuation form part of a Statutory Rule made on or after specified dates. The endnote further records that explanatory memoranda and other printed material after the Endnotes do not form part of a Statutory Rule (endnote 1, "Other material"); this affects the legal weight that can be attached to accompanying explanatory text.

The Explanatory Details link the Architects Regulations 2015 to S.R. No. 28/2015 and note amendments by S.R. Nos 28/2023 and 135/2023 (endnote 3). That identifies the chain of subordinate instruments that together make up the operative regulatory regime for architects while this extension is in place. The instrument therefore interacts with those specific statutory rules by preserving their effect; any conflict-of-law analysis during the extension period must refer to the hierarchy of instruments: primary Acts, subordinate instruments (including the Architects Regulations 2015 and their amendments), and the ILA interpretive rules referenced in the endnotes.

This instrument does not purport to displace primary legislation nor does it purport to change administrative decision-making powers embedded in other statutory instruments. It simply continues the application of the existing subordinate regulation within the legal structure established by the Subordinate Legislation Act 1994 and framed by interpretive rules under the ILA. Any subsequent amendments to, or replacement of, the Architects Regulations 2015 or changes in the primary Act will interact with this extension only to the extent that they are enacted and commence during or after the extension period.

The extension Regulations themselves are Version No. 001, S.R. No. 20/2025, and as recorded there are no amendments to them by other statutory rules, subordinate instruments or Acts (Table of Amendments: "There are no amendments made to the Subordinate Legislation (Architects Regulations 2015) Extension Regulations 2025 by statutory rules, subordinate instruments and Acts") (endnote 2). The instrument was made on 15 April 2025 and came into operation on the same date; it is scheduled to be revoked on 27 April 2026 (endnote 1; reg 4).

Although the extension Regulations have no amendments, the Explanatory Details identify the underlying Architects Regulations 2015 as S.R. No. 28/2015 as amended by S.R. Nos 28/2023 and 135/2023 (endnote 3). That indicates the Architects Regulations 2015 which are being preserved by this extension contain those prior amendments. The extension instrument does not detail the content of those amendments; it only records their existence and their relation to the reference in reg 3.

For version control and citation, the instrument includes standard endnote references directing readers to www.legislation.vic.gov.au for up-to-date legislative information (endnote 1). The instrument’s internal Table of Provisions lists reg 1-4 and the Endnotes, which function as the instrument’s internal metadata. The Explanatory Details footnote (Explanatory details 1) confirms reg 3’s reference to S.R. No. 28/2015 and its amendments, linking the extension to the precise statutory lineage of the Architects Regulations 2015 (endnote 3).

Practitioners tracking changes should note: there are no amendments to the extension Regulations as of the Version No. 001 dated 15 April 2025. Any future alterations to the legal landscape affecting architects will be made either by amending the Architects Regulations 2015 themselves, by enacting further extension regulations, or by changes to the Subordinate Legislation Act 1994; none of those changes are recorded here.

The instrument contains no references to litigation, court decisions, appeals or precedent. It does not list any cases, and the Endnotes include no litigation-related materials. The absence of litigation references in the instrument means that, on its face, there is no recorded litigation history tied to the making, validity or operation of these extension Regulations in the text supplied (see entire instrument and endnotes).

Practical consequence: if a party wishes to litigate about the validity or effect of the extension, or the effect of the continuing Architects Regulations 2015 during the extension, the controlling legal texts they would need to plead and rely on are the Subordinate Legislation Act 1994 (sections 5A, 5(1) and 28 are cited in the instrument), the Architects Regulations 2015 (S.R. No. 28/2015 as amended by S.R. Nos 28/2023 and 135/2023) and relevant provisions of the Interpretation of Legislation Act 1984 (ILA) that govern reading of statutory rules (endnote 1). Any contested litigation would therefore engage those instruments rather than the extension Regulations alone.

Because this instrument is purely temporal and does not create new substantive rights or obligations, the scope for litigation that challenges specific regulatory duties created by the extension Regulations themselves is limited. Disputes would more likely challenge the underlying Architects Regulations 2015, the process by which this extension was authorised under the Subordinate Legislation Act 1994, or interpretation questions arising under the ILA. The instrument does not supply any record of such proceedings.

Dates and commencement: the instrument was made on 15 April 2025 and came into operation on that date, but the extension period for the Architects Regulations 2015 runs from 27 April 2025 to 26 April 2026 (reg 3; endnote 1). Practitioners must not conflate the date on which the extension regulations were made (and commenced) with the period for which the underlying regulations are extended. Failure to note the discrete start and end dates could lead to incorrect assumptions about when specific regulatory obligations are legally preserved.

No substantive change: the extension neither amends nor consolidates the Architects Regulations 2015. It does not add or remove duties, nor does it insert saving or transitional clauses. The continuing applicability of obligations therefore depends entirely on the content of the Architects Regulations 2015 and their listed amendments (endnote 3). A common pitfall would be to assume the extension includes updates or clarifications; it does not.

Explanatory material not law: the instrument’s endnotes include explanatory detail and references to the ILA. The ILA note explicitly states that "Any explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule" (endnote 1, "Other material"). Lawyers relying on explanatory text must therefore be careful to distinguish authoritative provisions from non-enforceable explanatory material.

Chain of instruments: reg 3 extends S.R. No. 28/2015 "as amended by S.R. Nos 28/2023 and 135/2023" (endnote 3). Practitioners must examine the consolidated content of S.R. No. 28/2015 together with those amendments to establish the exact legal obligations in force. Consulting only the original S.R. No. 28/2015 without its amendments is a common error.

No penalty or enforcement provisions here: because the extension Regulations create no penalties or enforcement mechanisms, searching this instrument for such provisions is unproductive. Enforcement questions must be directed to the Architects Regulations 2015 and any relevant primary legislation.

Temporary nature and planning risk: the extension is explicitly time-limited (reg 3; reg 4). Relying on the continued operation of specific regulatory settings beyond 26 April 2026 without checking for further extensions, revocation of the underlying regulations, or replacement measures would be a planning risk. Parties should note the self-revocation date of these extension Regulations (reg 4) as an administrative marker for when the status quo may change.

Interpretive rules apply: the ILA notes about headings, examples, punctuation and legislative item placement affect how statutory rules are read (endnote 1). In particular, headings and notes included in a Statutory Rule made on or after 1 January 2001 "form part of that Statutory Rule"; practitioners should ensure they treat such material as part of the legislative text where the ILA indicates it is so incorporated.

No amendments recorded: the Table of Amendments states there are no amendments to the extension Regulations (endnote 2). That means no subsequent clarifications or corrigenda are available within this instrument; for updated positions one must check the central legislation.vic.gov.au repository.

1. Identify the operative text to comply with: this instrument does not itself contain obligations. Compliance requires reading the Architects Regulations 2015 (S.R. No. 28/2015) together with the amendments recorded (S.R. Nos 28/2023 and 135/2023) because reg 3 extends that composite instrument (reg 3; endnote 3). Obtain the consolidated text from the official source cited in the endnotes, www.legislation.vic.gov.au (endnote 1).

2. Note the relevant dates: the extension preserves the Architects Regulations 2015 for the period 27 April 2025 to 26 April 2026 (reg 3). The extension Regulations were made and commenced on 15 April 2025 and will be revoked on 27 April 2026 (endnote 1; reg 4). Ensure compliance processes cover that entire period and flagged contingencies for what happens after 26 April 2026.

3. Review existing compliance obligations and timelines under the Architects Regulations 2015: any licences, renewals, reporting deadlines or continuing professional obligations that fall within the extension period should be observed as if the underlying regulations remained unchanged. Because the extension does not alter substantive text, do not assume leniency or extension of individual deadlines unless explicitly provided in the underlying regulations.

4. Record reliance and risk: where contracts, tenders, insurance or project certifications depend on the rules preserved by this extension, document the temporal nature of the preservation. Specify in contractual risk allocations the contingency that the regulations could be changed, revoked or replaced after 26 April 2026.

5. Monitor for further subordinate instruments or primary-law change: this instrument is time-limited (reg 4). To remain compliant beyond the extension, monitor for either (a) further extensions under the Subordinate Legislation Act 1994, (b) amendments to the Architects Regulations 2015, or (c) replacement instruments. Do not rely on the extension as a substitute for active regulatory surveillance.

6. Use the ILA interpretive rules when construing the text: the endnotes summarise relevant ILA provisions affecting headings, examples, punctuation and the placement of legislative items (endnote 1). When in doubt about whether a heading, note or example forms part of the statutory text, apply the ILA rules cited in the endnotes rather than assuming the explanatory material is merely ancillary.

7. If enforcement or dispute risk arises, ground arguments in the underlying instruments: because this extension does not create penalties or enforcement mechanisms, any legal dispute or defence should be framed by reference to the Architects Regulations 2015, the Subordinate Legislation Act 1994 and the ILA interpretive material noted in the endnotes.

8. Record and cite the extension when evidencing regulatory status: where a third party requires proof that the Architects Regulations 2015 were in force on a particular date between 27 April 2025 and 26 April 2026, retain a copy of S.R. No. 20/2025 and note reg 3 as the source of continued operation.

9. Check authoritative sources for updates: the instrument points users to the official Victorian legislation website for current versions and Bills/Acts (endnote 1). Use that site for consolidated texts and amendment histories rather than relying on the explanatory material appended to these Regulations.

10. If seeking certainty about the effects of any particular clause in the Architects Regulations 2015 during the extension, obtain the precise provision from the consolidated S.R. No. 28/2015 plus the cited amendments (endnote 3) and, where necessary, seek tailored legal advice referencing those specific texts.
