12 Notice of decision (1) If a regulatory impact statement has been prepared, the responsible Minister must ensure that a notice advising of the decision to make or not to make the proposed statutory rule is published in— (a) the Government Gazette; and (b) a daily newspaper circulating generally throughout Victoria. (2) Notice of a decision not to make a proposed statutory rule must be published as soon as practicable after the decision has been made. (3) Notice of a decision to make a proposed statutory rule must be published before the proposed statutory rule is made. S. 12(4) inserted by No. 78/2010 s. 11. (4) A failure to comply with subsection (1), (2) or (3) does not affect the operation or effect of the statutory rule but the Scrutiny Committee may report the failure to each House of the Parliament.
