Submarine Cable (Northern Sydney Protection Zone) Declaration 2007

The Declaration creates a legal regime built on several core concepts. First is the protection zone as a bounded maritime area defined by geodetic coordinates and by the mean low water mark of the New South Wales coastline (clause 6). The boundary is expressed in tables of coordinates and by geodesic lines between those coordinates. All coordinates are declared to be WGS84, consistent with the Australian Geodetic Datum 1994 (note to clause 6).

Second is the notion of nominal location. For the purposes of the Schedule 3A framework, the Declaration fixes the nominal location of the Australian Japan Cable and the Southern Cross Cable within the zone by listing sequential geographic points and declaring that the cable’s nominal course joins those points by the shortest route (clause 7(1)-(2), tables 3-4). The instrument thus separates the concept of the protection zone boundary from the nominal course of particular submarine cables and their associated submerged plant items.

Third is the distinction between prohibited activities and restricted activities. Clause 8 (table 5) lists activities that are prohibited in the Northern Sydney Protection Zone, including a referral to parts of Schedule 3A (for instance subparagraph 10(4)(a)(i), (iv) or (viii)) and an explicit ban on gear capable of contacting the seabed, certain trawling and seine methods, scuttling a ship, and establishing spoil grounds or ocean disposal points. Clause 8(2) preserves a carve‑out for activities described in clause 8(2)(a) and listed as restricted activities in clause 9 table 6, recognising that some seabed‑contacting fishing operations may be permitted subject to conditions.

Fourth is the notification and consultation mechanism central to many restricted‑activity permissions. Several items in table 6 (notably items 7-14 and 17) require an entity responsible for an activity to provide each cable carrier with particulars and the location of the activity not later than 21 days before it starts, to comply with any reasonable written request for information from a cable carrier within 7 days, and to consider and respond to any reasonable representations made by a cable carrier concerning damage or impediment to the efficient operation, maintenance or repair of a submarine cable (see items 7(a)-(b), items 8(a)-(b), items 9-14 and 17). Item 7 includes additional substantive constraints such as minimising the path across the protection zone and ensuring a distance of at least 500 metres from submerged plant items unless otherwise determined following consultation.

Fifth is the focus on equipment‑specification limits. Multiple items set quantitative equipment thresholds: breaking strain caps of 850 kilograms for some trap ropes, droplines and anchors (for example items 2, 3, 16, 17); a 50 kilogram breaking strain for demersal J‑hook mainlines (item 4); shot weight limits and vessel depth restrictions for shotlines (item 16); and trip‑release or sliding ring anchor requirements for certain anchors (item 17 examples and definitions). The legislation therefore conditions activities not only procedurally but by technical parameters.

Sixth is the protection of electro‑optic submerged plant items. The Declaration defines submerged plant items to include repeaters, equalisers and branching units (clause 3), and explicitly requires seismic survey grid adjustments if predicted pressure waves of 2.0 bar or more will reach electro‑optic devices (item 12(d)). That creates a specific interaction between resource exploration techniques and cable integrity.

Finally, the Declaration links to and depends upon other legal instruments. It invokes terms and concepts defined in Schedule 3A of the Telecommunications Act 1997 and imports a NSW fisheries regulation definition as at commencement (clause 3). It also recognises Commonwealth and State designations for spoil grounds and ocean disposal points (definitions in clause 3). Clause 5 expressly limits the Declaration’s application to the extent consistent with Australia’s international law jurisdiction.

The Declaration affects multiple categories of actors both private and public, defined either directly in its wording or implied by the nature of the regulated activities. Primary parties directly addressed are cable carriers, fishing operators, vessels and shipowners, entities conducting seabed works (including pipeline and cable installers), seismic survey companies, resource exploration and exploitation companies, research institutions conducting seabed contact, authorities and contractors constructing or removing navigational aids and ship installations, and the Australian Defence Force where explosives use is concerned.

Cable carriers are central to the regime. They are defined in clause 3 in a manner that captures owners or joint owners of submarine cables, nominated carriers for network units, and carriers connected to network units immediately adjacent to the cable. Cable carriers are the recipients of required notifications and the parties whose reasonable information requests and representations must be considered and responded to (see table 6 items 7-14, 17). Practically, any entity proposing activities in the zone that may affect cables must identify who the cable carriers are and provide them with particulars and location details not later than 21 days before the activity.

Fishing operators are affected in several ways. The Declaration prohibits certain gear outright (table 5 item 2), including mid‑water trawls, demersal longlines, and types of nets, ropes and chains capable of contacting the seabed. It restricts other fishing activities to within 500 metres of the low‑water mark or imposes equipment limits such as maximum breaking strain or hook types (table 6 items 1-6, 11-17). The instrument therefore directly alters the acceptable methods and equipment for both commercial and some recreational fishing when operating in the zone.

Ship operators and owners are affected both by prohibitions on scuttling (table 5 item 4) and by restrictions on anchoring activities (table 6 item 17) and the lowering or raising of shotlines (item 16). The instrument prescribes weight limits for anchors and shots, depth constraints for the vessel, and trip‑release or sliding ring anchor requirements as permitted exceptions. Vessels undertaking salvage, wreck removal or anchoring near known shipwreck coordinates in table 7 must pay special attention to those exceptions.

Organisations constructing, maintaining or removing infrastructure such as electricity cables, oil and gas pipelines, installations for the use of ships, or navigational aids are directly affected by items 7-10 in table 6. For such entities the Declaration imposes preactivity notice and consultation duties, substantive constraints to avoid damage or impediment to submarine cables, and an obligation to minimise crossing paths and maintain specified separations from submerged plant items.

Seismic survey companies and resource explorers are addressed specifically. Item 12 requires preactivity notifications and responses to cable carriers and imposes a seismic pressure threshold of 2.0 bar at electro‑optic devices, above which the grid lines must be adjusted to reduce pressure below that threshold. The Declaration therefore affects survey planning, grid design and operational modalities for exploration companies working in the zone.

Research institutions conducting seabed contact, salvage contractors, and civil engineering firms performing coastal works are also affected. Several restricted items apply to civil engineering work and research that involves contact with the seabed, again subject to procedural notice and substantive non‑impediment requirements.

Finally, the Australian Defence Force is named indirectly in item 15 as an exception for the use of explosives in a declared Firing Practice Area, so certain Defence activities will be treated differently under the instrument.

Across these categories, the practical effect is that those who plan to perform almost any activity that might contact or otherwise affect the seabed, or to use heavy gear or explosives, must first determine whether the activity lies within the protection zone (use clause 6 coordinates and clause 7 nominal cable locations), whether it is prohibited, or whether it is restricted and therefore subject to notification, consultation and technical limits.

The Declaration establishes a mix of procedural duties, technical constraints and limited rights, most of which turn on whether an activity falls within the prohibited or restricted lists. The duties are largely incumbent on the entity responsible for an activity; the rights and participatory roles are vested in cable carriers and are procedural rather than substantive.

Principal duties on activity proposers

• Notification: For many classes of restricted activities, the responsible entity must provide each cable carrier with particulars of the activity and the location not later than 21 days before the activity commences. This requirement appears in items 7, 8, 9, 10, 12, 13 and 14 of table 6. The obligation to notify is precise in its timing and recipient, each cable carrier as defined in clause 3.
• Information cooperation: When a cable carrier makes a reasonable written request for information, the entity responsible must comply within 7 days (items 7(b)(i), 8(b)(i) and repeated in items 9-14). The instrument therefore imposes a prompt response duty.
• Consider and respond to representations: The entity responsible for the activity must consider and respond to any reasonable representations from a cable carrier concerning the likelihood of damage or impediment to efficient operation, maintenance or repair of submarine cables (items 7(b)(ii), 8(b)(ii) and repeatedly across items 9-14).
• Operational conduct: Activities must be carried out in a manner that does not damage or impede the efficient operation, maintenance or repair of submarine cables (items 7(c), 8(c), 9(c), 10(c), 11(c), 12(c), 13(c), 14(c)). Item 7 adds further obligations to minimise the path across the protection zone and to avoid approaching or crossing within 500 metres of submerged plant items as determined following consultation.
• Technical and spatial constraints: Specific technical requirements apply depending on the activity. Examples include limits on breaking strain (commonly 850 kilograms), hook types (circle hooks only for certain droplines), maximum weights for shots or anchors (e.g. 20 kilograms in item 16), trip‑release mechanisms or sliding ring anchors, and a 500 metre distance rule from the low water mark for many seabed contact activities (table 6 items 1-6 and 11-17).

Rights, procedural role and decision influence for cable carriers

• Right to information and representations: Cable carriers are entitled to receive at least 21 days advance notice and are entitled to make reasonable written requests for information which must be answered within 7 days. They are also entitled to make reasonable representations about likely damage or impediment to the efficient operation, maintenance or repair of submarine cables, and those representations must be considered and responded to by the activity proposer (items 7-14).
• Input on crossings and submerged plant items: Item 7(e) gives cable carriers a decisive consultative role in determining where submerged plant items are, for the purpose of establishing a 500 metre crossing buffer. This gives carriers a practical leverage point to influence the routing and methods of other infrastructure installations across the protection zone.
• De facto veto power via technical constraints and procedural timing: While not an explicit statutory veto, the combination of technical constraints, the 21‑day advance notice and the need to consider cable carriers’ representations creates an operational reality in which cable carriers can influence go/no‑go decisions or force redesigns, particularly for high‑risk activities like crossing the cable or seismic work near electro‑optic devices.

Other regime features affecting duties and rights

• Seismic threshold duty: If a seismic survey would result in pressure waves of 2.0 bar or more arriving at the seabed at locations of electro‑optic devices associated with a submarine cable, the survey company must adjust grid lines to reduce pressure to less than 2.0 bar (item 12(d)). That is a substantive technical duty on survey planners.
• Exceptions: The Declaration creates narrow exceptions and conditional permissions. For example, the ban on certain gear in table 5 is modified by clause 8(2) which allows activities described in the clause to be treated as restricted rather than prohibited if carried out as fishing operations and where they are also listed among restricted activities in table 6.

Limitations and legal context

• Application subject to international law: Clause 5 limits the Declaration’s application to the extent consistent with Australia’s jurisdiction under international law. This is a legal constraint on how duties and rights can be asserted against foreign actors or vessels outside domestic jurisdiction.
• Delegated enforcement and penalties not specified in the Declaration: The instrument does not itself set out penalties. It must be read together with Schedule 3A of the Telecommunications Act 1997 for enforcement consequences and any civil or criminal liability arising from noncompliance.

In short, the legal architecture creates clear duties on activity proposers to notify and cooperate, and gives cable carriers a structured role to protect the operational integrity of submarine cables, backed by technical constraints and timing rules that shape planning and operational choices.

The Declaration by itself does not set out express monetary fines, criminal offences or detailed enforcement procedures. It operates by declaring prohibited and restricted activities under Schedule 3A to the Telecommunications Act 1997 (see the instrument heading and repeated references to Schedule 3A, clauses 8 and 9). Consequently, to identify statutory penalties, enforcement powers, injunctive remedies or administrative sanctions that apply for breach, practitioners must consult Schedule 3A of the Telecommunications Act 1997 and any relevant provisions of that Act. The Declaration repeatedly references specific paragraphs and clauses of Schedule 3A (for example clause 8 refers to subparagraph 10(4)(a) of Schedule 3A and clause 9 notes connections to paragraph 11(3) of Schedule 3A), indicating that enforcement and liability are governed at the Act level.

What the Declaration does supply, and what is enforceable in practice, are clear behavioural requirements: absolute prohibitions in table 5 and conditional permissions in table 6 that require procedural compliance (for example, 21 days notice to cable carriers and compliance with reasonable written requests within 7 days). These prescriptive requirements create expectations that can be enforced under the Act or by statute or regulation implementing Schedule 3A. The instrument also imposes technical limits such as maximum breaking strain values, weight limits for shots and anchors, and distance buffers. Failure to adhere to those requirements will place the activity outside the permitted conditions in the Declaration, which, when read with Schedule 3A, is likely to trigger enforcement action under the Act or associated regulations.

Enforcement actors implied by the instrument

• The Australian Communications and Media Authority is the declaring authority (endorsements by the ACMA Chair and Deputy Chair appear on the Declaration) and is the logical administrative arm for administering Schedule 3A declarations, although the specific enforcement powers, directions or penalty notices are not set out in the Declaration text itself.
• Cable carriers are given a participatory role but are not assigned express enforcement powers in the Declaration. Their role is to receive notices, make reasonable information requests and representations, and to assist in determining locations of submerged plant items. Whether cable carriers can seek private remedies (for example injunctions or damages) or must rely on ACMA or other statutory enforcement mechanisms is a matter for the Act and general law.

Jurisdictional and practical limits

• Clause 5 limits the Declaration’s legal reach to the extent consistent with Australia’s jurisdiction under international law. That will be relevant if the activity is conducted by a foreign vessel or involves a foreign flag ship beyond the extent of coastal state jurisdiction applicable under international law.
• The Declaration’s effectiveness as an enforcement tool therefore depends on (a) the enforcement provisions and sanctions in Schedule 3A and the Telecommunications Act 1997, (b) operational capacity by ACMA or other agencies to monitor and respond to breaches, and (c) the ability to coordinate with non‑state actors and state agencies for activities that touch on other regulatory domains.

Practitioners should therefore treat the Declaration as the substantive rulebook for permitted and prohibited conduct in the Northern Sydney Protection Zone, and must consult Schedule 3A of the Telecommunications Act 1997 and any ACMA guidance or instruments for the enforcement regime, sanctions, and powers to issue directions, notices or seek remedies following noncompliance.

The Declaration is designed as a Schedule 3A instrument under the Telecommunications Act 1997 and repeatedly cross‑references that Schedule for definitions, the legal basis of prohibited and restricted activities, and the enforcement framework (see the instrument heading and clauses 3-5, 8 and 9 notes). It therefore does not stand alone but must be read alongside Schedule 3A and the parent Act to understand full legal consequences, including definitions like line, installation, and network unit that are imported from the Act.

Direct cross‑references and incorporations in the text

• Clause 3 imports several definitions and refers back to clause 2 of Schedule 3A to the Act for meanings of Australia, Australian waters, conduct, installation and ship. The Declaration therefore interacts with those definitions in the Act.
• Clause 8(1) refers to subparagraph 10(4)(a)(i), (iv) or (viii) of Schedule 3A to the Act. Clause 9 notes that various items relate to paragraph 11(3) of Schedule 3A. Those cross‑references indicate that the Declaration operates under the architecture and procedural framework created in Schedule 3A.
• The definition of a beach safety meshing net relies on the Fisheries Management (General) Regulation 2002 (NSW) as in force at commencement (clause 3). That import ties fisheries regulation and the Declaration together, at least temporally, for the purpose of examples.

Overlap with other regulatory domains

• Fisheries and marine resource regimes: The Declaration sets fishing‑gear restrictions and explicit references to NSW fisheries regulation, so it interacts operationally with fisheries law. Practitioners advising fishers or fisheries agencies will need to reconcile state fisheries rules and any relevant Commonwealth fisheries instruments, noting that the Declaration frames activities by distance from the low‑water mark and by gear specification.
• Maritime and navigation law: Ship operations, anchoring, scuttling and the use or removal of navigational aids are specified. Those activities will also engage laws governing navigation, marine safety and port state requirements. The Declaration’s procedural obligations to consult cable carriers sit alongside any permit or safety obligations required by marine authorities.
• Offshore infrastructure and petroleum regulation: Items 7 and 8 dealing with the installation, maintenance and removal of electricity cables, oil or gas pipelines, and like infrastructure will intersect with licensing, environmental approvals and petroleum or marine infrastructure statutes and regulations.
• Environmental law: Activities that involve seabed contact, spoil grounds, ocean disposal points and resource exploitation are covered and will interact with environmental impact assessment laws and approvals where those apply. The instrument itself prohibits establishing or using spoil grounds and other ocean disposal points in the zone (table 5 item 5).
• Defence and ordnance regulation: Item 15 makes an exception for the use of explosives in exercises conducted by or with the Australian Defence Force within a declared Firing Practice Area. That cross‑reference indicates that some Defence activities are dealt with under Defence or other specific instruments rather than by the protection zone rules.
• State and local regulation: Because the Declaration references mean low water mark and uses NSW coastline points, activities likely trigger state and local permits and regulatory regimes relating to coastal works and fisheries.

Procedural and practical interactions

• The 21 day notice and 7 day response regime creates an operational intersection between the private sector, cable carriers and ACMA. For certain infrastructure projects and exploration programs this will necessitate parallel compliance with permits under other regimes and preapplication consultation to ensure timing aligns with the Declaration’s 21 day window.
• The Declaration expressly defers to Australia’s international law jurisdiction (clause 5), which creates interaction with maritime law concerning foreign vessels, flag state jurisdiction and the limits of coastal state enforcement. Foreign vessels operating beyond the territorial sea or under rights provided by international law may not be subject to the same domestic enforcement, depending on circumstances.

In practice, compliance with the Declaration will rarely be an isolated exercise. Entities must map out the full checklist of domestic and state approvals, environmental and fisheries permits, safety and navigation notifications, and contractual coordination with cable carriers. Lawyers and compliance officers should therefore read the Declaration in tandem with Schedule 3A to the Telecommunications Act 1997, the relevant state regulations (for example NSW fisheries instruments invoked), and sector‑specific regimes for seabed works, exploration and marine infrastructure.

The Declaration text itself records a single creation event. It is titled Submarine Cable (Northern Sydney Protection Zone) Declaration 2007, dated 6 July 2007, and states a commencement date of 1 October 2007 (clauses 1-2 and the header page). The instrument bears the signatures of ACMA officials, Chris Chapman (Chairman) and Lyn Maddock (Deputy Chair), indicating the administrative origin and date of execution.

Within the text there are temporal references that anchor parts of it to the state of other instruments at the time of commencement. For example clause 3 imports the meaning of beach safety meshing net as given by clause 42 of the Fisheries Management (General) Regulation 2002 (NSW) "as in force when this instrument commenced". That locates the interpretation of that term to the regulatory state at commencement rather than to any later amendment of that NSW regulation. Users should note this temporal cross‑reference when comparing definitions over time.

Other than the creation date and the commencement date, the Declaration contains no subsequent amendment notes, revocation notices or modification provisions within the instrument text provided. There is no schedule of amendments, no transitional provisions beyond the commencement, and no stated expiry or sunsetting clause. The instrument therefore stands as a static declaration from the date it commenced until it is subsequently amended or revoked by ACMA or replaced by another instrument under the enabling powers in the Telecommunications Act 1997.

Practitioners should however treat the absence of recorded amendments in the text as a description only of this document. To determine whether the Declaration has been amended, superseded, revoked or otherwise altered since commencement, one must consult the consolidated instruments database, the ACMA register of protection zone declarations, or the consolidated version of subordinate legislation to confirm whether ACMA has issued later amending instruments or whether Schedule 3A itself has been amended. The Declaration itself does not include that history.

In sum, the available text shows a single instrument made in 2007 and commencing in October 2007, with definitions and references anchored to contemporaneous instruments at commencement. Any later changes to definitions, coordinates, affected cables, or procedural rules would appear only in amending instruments or in changes to the parent Schedule 3A or Act, and are not reflected within the body of this Declaration as provided.

The Declaration text contains no references to litigation, court decisions, tribunal determinations or administrative appeals. It does not list any cases, judicial interpretations or precedent. The instrument is a declaratory subordinate instrument and does not itself record any disputes or litigation outcomes.

Because the Declaration implements prohibited and restricted activities under Schedule 3A of the Telecommunications Act 1997, litigation about the effect, interpretation or enforcement of the Declaration is likely to occur in the context of disputes under the Act, but any such litigation history is not present in the Declaration as provided. The instrument explicitly references parts of Schedule 3A (for example subparagraph 10(4)(a), paragraph 11(3) and other clauses). Any judicial treatment of those Schedule 3A provisions, or of particular application of a protection zone declaration, would be found in case law addressing Schedule 3A and the Telecommunications Act rather than in the Declaration itself.

For practitioners seeking precedent or judicial guidance on enforcement, scope, or interpretation issues arising from the Northern Sydney Protection Zone Declaration, the Declaration directs attention to the Act as the relevant statutory backdrop. A search for litigation should therefore focus on:

• cases interpreting Schedule 3A to the Telecommunications Act 1997;
• disputes involving ACMA’s exercise of powers under Schedule 3A, including declaratory or injunctive relief; and
• any matters where cable carriers or infrastructure proponents sought judicial review of ACMA decisions or statutory enforcement actions tied to protection zone declarations.

Because the document contains no litigation history, users should not infer that no disputes have arisen; rather, the Declaration does not itself report adjudications. To establish whether there has been litigation concerning this protection zone, cable carriers, activities within the zone, or Schedule 3A generally, practitioners must search relevant court, tribunal and administrative law records.

Several features of the Declaration create practical traps for planners, operators and advisers unless they are closely analysed and operationalised.

1. The 500 metre and low‑water mark rule is spatially precise but practically complex Multiple restricted activities are permitted only within 500 metres of the low‑water mark or are prohibited beyond that distance (table 6 items 1-6, 11-17). Determining what is "waters more than 500 metres from the low‑water mark" requires accurate, contemporaneous measurement from the mean low water mark as referenced in clause 6. Practitioners must use the exact coastal datum specified in the Declaration (WGS84 coordinates and mean low water mark) and avoid relying on informal or approximate measures. Miscalculation can convert a permitted activity into a prohibited one.

2. Identifying the correct "cable carrier" recipients of notices is non‑trivial The recipient list for 21 day notices is "each cable carrier" as defined in clause 3. The cable carrier definition varies by whether the submarine cable is a network unit, whether the cable was installed with a protection zone installation permit, or where a network unit is immediately connected. Entities must correctly determine, in advance, which legal persons qualify as cable carriers under the three alternative definitions in clause 3. Getting this wrong can void compliance with the notification obligation.

3. Timing constraints and short operational windows The Declaration requires notices "not later than 21 days before the activity" and compliance with reasonable written requests within 7 days. For projects on tight timelines, these windows create sequencing and planning constraints. A failure to factor in those timeframes can result in a breach of the procedural prerequisites, even if technical mitigation measures would have been acceptable.

4. "Reasonable written request" and "reasonable representations" are undefined Several duties hinge on responding to cable carriers’ "reasonable written request for information" within 7 days and "considered and responded to any reasonable representations" about likely damage or impediment. There is no statutory definition of "reasonable" in the Declaration. That opens a potential for dispute over whether a cable carrier’s request or representation is reasonable, and over the adequacy of a proposer's response. Practitioners should preserve written records of all communications and the basis for decisions, and consider seeking a meeting or written acceptance from carriers to reduce ambiguity.

5. Seismic pressure modelling obligations require technical expertise and cooperation Item 12(d) requires adjustment of seismic grid lines if a planned survey would result in pressure waves of 2.0 bar or more arriving at the seabed in the location of any electro‑optic devices. Determining predicted seabed pressure at particular electro‑optic device locations requires hydroacoustic modelling, knowledge of device positions, and consultation with cable carriers. Failure to model properly or to secure necessary location data from carriers can delay or preclude a survey.

6. Nominal cable locations extend beyond the local zone and include distant points Tables 3 and 4 list coordinates for the nominal courses of the two named cables, including points with latitudes and longitudes that extend far beyond the immediate Northern Sydney coastal area. Practitioners must not assume that the nominal location table lists only local points; the course is the shortest route joining those coordinates and may require careful geodesic plotting to identify local intersections with proposed activities.

7. Technical limits require equipment changes The Declaration imposes specific maximum breaking strains and weight limits for certain fishing gear and anchors (for example 850 kilograms in several items, 50 kilograms for demersal J‑hook lines in item 4, and shot weights not exceeding 20 kilograms in item 16). Operators using heavier or wire‑based mainlines must change equipment to conform. That involves procurement, refitting and potential productivity impacts for fishers, not merely a paperwork exercise.

8. Shipwreck anchor exception complexity Item 17(b) allows anchors up to 30 kilograms if anchored within 200 metres of a shipwreck site listed in table 7. Table 7 lists 15 coordinates in close proximity, often within a few seconds of latitude/longitude. Operators must precisely map these coordinates to identify whether the shipwreck exception applies, and documentation must be kept to show the anchoring occurred within the specified 200 metre radius.

9. Jurisdictional limits for foreign vessels and international law caveat Clause 5 limits the Declaration’s application to the extent consistent with Australia’s jurisdiction under international law. This does not itself define the scope but signals that enforcement against foreign vessels outside relevant coastal state jurisdiction may be constrained. Entities dealing with foreign vessels should assess flag state, territorial sea, exclusive economic zone and other maritime law factors.

10. No penalties in the Declaration itself The absence of penalties in the text means that the consequences of noncompliance depend on Schedule 3A and the parent Act. Advisers must therefore not assume the level or nature of fines or enforcement mechanisms from this Declaration alone and should consult the Act for enforcement provisions.

11. Temporal definitions anchored at commencement may differ later Because the instrument references the Fisheries Management (General) Regulation 2002 (NSW) "as in force" at commencement for one example, later amendments to that regulation could change the meaning of that term for subsequent activities unless an amending instrument updates the reference. Practitioners need to verify whether subsequent instruments have updated cross‑references or definitions.

12. Recordkeeping and proof Several duties are procedural and demand written notices and responses. Practitioners should ensure robust recordkeeping and timestamped deliveries to cable carriers to demonstrate compliance with 21 day notices and 7 day responses. Absent good records, it will be difficult to prove compliance should the matter be contested.

In short, the Declaration combines precise geodetic requirements, technical equipment limits, tight procedural timelines and undefined standards of "reasonableness" that together create multiple operational and legal friction points. Early identification of cable carriers, precise spatial analysis, hydroacoustic modelling capacity for seismic work, and conservative scheduling are practical antidotes to many of these gotchas.

Compliance requires a combination of legal, technical and project management actions. The steps below translate the Declaration’s prescriptions into an operational compliance checklist that maps to the specific clauses and tables of the instrument.

1. Geospatial screening and mapping

• Map the Northern Sydney Protection Zone using the coordinates in clause 6 and the geodesic lines between them. Use WGS84 datum as specified in the note to clause 6.
• Overlay proposed activity footprints and cable nominal locations from clause 7 (tables 3 and 4). Plot submerged plant item locations where known, or identify the need to obtain precise locations from cable carriers as requested under item 7.
• Determine whether the activity lies within "waters more than 500 metres from the low‑water mark" or within 500 metres, because many prohibitions and restrictions pivot on that distance (table 6 items 1-6, 11-17).

2. Categorise the activity against prohibited and restricted lists

• Check whether the planned activity is listed in table 5 as prohibited. If it is, do not proceed unless a narrow exception in clause 8(2) applies.
• If the activity is listed among the restricted activities in table 6, identify all relevant subconditions that must be satisfied (notification, equipment limits, distance rules, non‑impediment conduct).

3. Identify the correct cable carriers and their contact details

• Apply the definition of cable carrier in clause 3 to determine the legal persons who must receive the 21 day notices and to whom you must respond to reasonable written requests. This will involve determining whether the cable is a network unit, whether the cable was installed after the commencement with a protection zone installation permit, and whether adjacent network units confer responsibility.
• Secure contact details and a primary point of contact for each cable carrier early in project planning.

4. Prepare and deliver the 21 day notice packages

• For activities requiring notice (items 7-14 and others), prepare a written notice that includes particulars of the activity and precise location as mandated. Deliver these notices to each cable carrier not later than 21 days before the planned activity.
• Use registered delivery, email with read receipts and other recordable means to create an audit trail of delivery times and contents.

5. Be ready to comply with 7 day information requests and to respond to representations

• Designate a project legal and technical liaison to respond to any "reasonable written request for information" from cable carriers within 7 days. That liaison should have authority to provide technical data, scheduling details and mitigation plans promptly.
• Where cable carriers make reasonable representations about likely damage or impediment, ensure that the project team documents consideration of the representations and prepares a written response addressing the carriers’ concerns.

6. Technical mitigation and equipment conformity

• Conform to the technical limits set out in table 6: for example, ensure trap ropes and certain mainlines do not exceed a breaking strain of 850 kilograms, demersal J‑hook lines do not exceed 50 kilograms breaking strain where allowed, shot weights and maximum anchor weights comply with items 16 and 17, and consider use of trip release mechanisms or sliding ring anchors where appropriate.
• For seismic surveys, engage hydroacoustic modelling specialists early to predict pressure levels at the seabed near electro‑optic devices. If modelling predicts pressure of 2.0 bar or more at electro‑optic devices, adjust grid lines to reduce predicted pressure below 2.0 bar as required by item 12(d).

7. Minimise crossing paths and meet submerged plant item separation requirements

• Where installing a new cable, pipeline or related equipment (item 7), design the route to minimise the path across the Northern Sydney Protection Zone and, following consultation with each cable carrier, ensure the new infrastructure does not approach or cross a submarine cable less than 500 metres from the cable’s submerged plant items unless the carrier consents or a different determination is reached via consultation.

8. Recordkeeping and escalation

• Maintain contemporaneous written records of notices, responses, technical assessments, modelling outputs, carrier representations and the entity’s considered replies. These records will be essential to demonstrate compliance with the procedural duties.
• Establish an escalation protocol in the project plan for carrier objections that are not resolved within the notice and response periods, including legal review and potential redesign or delay.

9. Equipment procurement and crew training

• Procure equipment that meets the specified breaking strain and weight limits, and train vessel crews and fishing operators on the altered operating parameters within the zone.
• For fishing operators, instruct skippers on where certain gear is permitted and where it is prohibited, including the detailed exceptions for fishing operations in clause 8(2) and table 6.

10. Cross‑agency and multi‑regime approvals

• Parallel to the Declaration’s requirements, obtain any required permits or consents under relevant Commonwealth, state or local laws, including fisheries permits, coastal works approvals and environmental approvals. The Declaration interacts with those regimes and compliance will often require aligning multiple approvals.
• Verify whether activity is inside any declared firing practice area or other Defence jurisdiction which may trigger alternate procedures under Defence practice or exemption in item 15.

11. Validate shipwreck exceptions

• If anchoring under the shipwreck exception in item 17(b), precisely map table 7 shipwreck coordinates and confirm anchoring will occur within 200 metres. Document the basis for concluding that the exception applies.

12. Legal review and contingency planning

• Have legal counsel familiar with Schedule 3A of the Telecommunications Act 1997 review the planned activity, the notice package, the technical mitigation measures and the communications plan with cable carriers. Because the Declaration does not itself set penalties, counsel should review the parent Act and any enforcement or penalty provisions that apply.
• Incorporate contingency plans for redesign, delay or cancellation in the event that cable carriers’ representations require changes to protect cable integrity.

13. Engage cable carriers proactively

• Early, constructive engagement can reduce the risk of late objections. Consider meeting with carriers to agree technical parameters and to obtain written acknowledgements where possible. While carriers’ representations must be considered and responded to, documented early agreements reduce uncertainty.

14. Monitor and audit during activity

• Implement an on‑site or remote monitoring plan to ensure activities remain within the specified technical limits and keep contemporaneous logs of any deviations and corrective actions taken.

Following these steps will align operational practice with the procedural and technical constraints set out in the Declaration. Remember to consult Schedule 3A of the Telecommunications Act 1997 for enforcement mechanisms and to verify whether any amending instruments have altered the Declaration or its cross‑references since 2007.
