Subdivision (Registrar's Fees) Regulations 2016

The central concept is the prescribed fee, defined in regulation 6 as the amount specified in Column 4 of Schedule 1 for a given section of the Subdivision Act 1988. The schedule is organised by item numbers, each linked to a specific section of the Act and a description of the service. Fees are expressed in fee units unless otherwise stated. A fee unit is a legislative device that avoids the need to update dollar amounts annually; the value for a given financial year is published by the Treasurer. Practitioners must convert fee units to dollars at the relevant rate on the date of payment.

The term “parcel” is critical for interpreting many fees. Plans that create land parcels (subdivision, consolidation, staged plans, vesting of land, creation of lots) attract not only a base fee but also a per‑parcel fee. For example, item 1 specifies 41.88 fee units plus 12.95 fee units per parcel for a certified plan of subdivision. The same structure applies to staged plans (item 2) where each stage and each parcel within that stage incurs fees separately. “Parcel” is not defined in the regulation but takes its meaning from the Subdivision Act 1988: generally a lot or piece of land created by the plan.

Another key concept is the “plan” type. The regulation distinguishes plans of subdivision, consolidation, re‑subdivision, boundary plans, plans to create/remove/vary easements or restrictions, plans to vest land, and owners corporation plans. Each type maps to a specific fee item. For example, a plan to create an owners corporation (item 27) is 6.65 fee units, while a plan to alter boundaries of land under section 32(c) (item 13) is 41.88 fee units plus per‑parcel fee. The description in Column 3 of the schedule is the operative test for which fee applies.

The regulation also introduces the concept of an “aggregate fee” in item 24 for plans that make more than one alteration under section 32(a) to (l) of the Act. Instead of charging each item separately, the fee is the sum of the individual item fees capped at 41.88 fee units plus 12.95 fee units per parcel created. This prevents the fee from escalating for combined alteration plans.

Owners corporation matters appear frequently. The fee for recording rules (regulation 7(1) and item 10), altering purposes (item 11), altering functions of limited owners corporations (item 12), and various plans under section 32AD are all priced separately. The regulation thus creates a cost structure for each stage of owners corporation lifecycle management: creation, amendment, dissolution, merger, and boundary changes.

An important structural feature is that the regulation does not define who pays. It simply states the prescribed fee for lodgment or application. The underlying Act determines who the applicant is. For example, a plan of subdivision is lodged by the applicant under section 22(1); the fee is payable by that applicant. The regulation is silent on refunds, waivers, or concessions; no provision allows the Registrar to reduce or waive a fee.

The regulation directly affects any person or entity who lodges a plan or makes an application under the Subdivision Act 1988. This includes landowners and developers subdividing land, consolidating lots, or creating easements and restrictions. Conveyancers, surveyors and town planners acting on behalf of applicants must factor the fees into transaction costs and ensure correct payment. The fee schedule imposes a variable cost: small subdivisions with few parcels pay less per parcel than the base fee suggests, while large subdivisions incur significant cumulative per‑parcel charges.

Owners corporations are heavily affected. The regulation prescribes fees for at least 15 distinct owners corporation transactions in Schedule 1, plus the separate fee for owners corporation rules lodgment under regulation 7(1). An owners corporation that needs to alter its boundaries, merge with another corporation, dissolve, alter lot entitlement or lot liability, or amend a scheme of development must pay the prescribed fee. These are not one‑off costs; an owners corporation may need to lodge multiple documents over its life, making the regulation a recurring compliance burden.

Acquiring authorities (such as government agencies exercising compulsory acquisition powers) are affected by item 32, which sets a fee of 41.88 fee units plus per‑parcel fee for lodging a plan of acquisition. This fee is payable by the authority, not the landowner, shifting the transaction cost to the public entity.

Mortgagees, chargees, lessees, sub‑lessees, annuitants and caveators are indirectly affected. Item 4 prescribes a fee of 6.65 fee units for an application to serve notice on any of these parties who have not consented to a plan registration. The applicant pays for this service, but the notice recipients may have their interests affected without direct cost.

Victorian Civil and Administrative Tribunal (VCAT) plays a role in owners corporation wind‑ups. Item 30 sets a 3.32 fee unit fee for notice to the Registrar that an application has been made to VCAT for winding up. Item 31 sets 13.30 fee units for an application to amend or cancel a plan in accordance with a VCAT order. Thus, parties involved in VCAT proceedings about owners corporations must budget for these registration fees.

The regulation also affects the broader real estate market through the pricing signal it sends. Higher fees for subdivision and consolidation increase the cost of land development, which can flow through to lot prices for purchasers. The per‑parcel structure means the marginal cost of creating additional lots is positive, potentially discouraging very fine‑grained subdivisions. Conversely, the flat fee for creating or removing a restriction (6.65 fee units) is low relative to the value of the land right, so it is unlikely to deter such transactions.

Lawyers and conveyancers must know the fee schedule to render accurate cost estimates to clients. The fee‑unit indexing means they must also check the current fee‑unit dollar value each year. These professional intermediaries bear the compliance cost of staying updated, though ultimately those costs are passed to clients.

The regulation creates no standalone duties beyond the obligation to pay the prescribed fee when engaging in a registrable transaction under the Subdivision Act 1988. The duty arises from the operation of section 43 of that Act, which empowers the making of regulations prescribing fees, and from the Act’s own provisions that require lodgment or application to the Registrar. The regulation does not add new conditions or require additional documentation; it merely sets the price.

The right conferred by payment is the right to have the Registrar process the lodgment or application. The regulation does not guarantee registration or approval; it only secures the Registrar’s consideration. If the plan or application meets the substantive requirements of the Subdivision Act 1988 and the Transfer of Land Act 1958, the Registrar will register or record it. Non‑payment would presumably result in the Registrar refusing to accept or process the document.

The regulation specifies fees for specific actions. For example, item 33 (application to amend a plan to show a lot as no longer an accessory lot) costs 3.32 fee units per lot. Item 34 (application to show a lot as no longer a restricted lot) also costs 3.32 fee units per lot. These are per‑lot charges, so an owner with multiple lots must pay the fee for each one. The right to make such an amendment exists under the Act; the regulation simply attaches a fee.

An important nuance is that the regulation does not impose a duty on the Registrar to provide any additional service beyond what the Act already requires. The fee is for the lodgment or application itself, not for a guaranteed outcome. For instance, item 9 (application for approval of a boundary plan) costs 13.30 fee units. If the Registrar rejects the plan, the fee is not refundable under the regulation. The regulation is silent on refunds; practitioners should assume no refund is available.

The regulation does not create rights of appeal, review, or waiver. There is no provision for the Registrar to reduce a fee for hardship, administrative error, or any other reason. The fees are mandatory and fixed by the schedule. Any challenge to a fee would have to be under the general law (e.g., jurisdictional error or ultra vires) rather than under the regulation.

For owners corporations, the regulation imposes a duty to pay the correct fee when making alterations to the corporation’s structure or when recording rules. Item 10 requires 3.32 fee units for lodging rules that accompany a plan creating an owners corporation or merging corporations. This is a one‑time cost at creation or merger. Item 28 imposes 6.65 fee units for an application to alter lot entitlement or lot liability. Owners corporations must ensure they pay the correct fee for the specific alteration type; misclassifying an alteration could lead to underpayment and delay.

The regulation itself does not create any penalties. It prescribes fees; it does not set fines, imprisonment, infringement notices, or any enforcement mechanism for non‑payment. The consequence of failing to pay the prescribed fee is likely that the Registrar will not accept the lodgment or process the application. That consequence flows from the Registrar’s administrative practice rather than from a penalty provision in these regulations.

If a person lodges a plan without paying the correct fee, the Registrar would presumably return the document or require payment before proceeding. The regulation does not authorise the Registrar to impose a late payment surcharge or interest. There is no provision for compounding fees for repeated non‑compliance. The enforcement is purely transactional: no fee, no service.

The underlying Subdivision Act 1988 contains its own offence provisions for other matters (such as false statements or unapproved subdivision), but those are not part of this regulation. The regulation does not cross‑reference any penalty sections. Therefore, the risk for non‑payment is delay and additional costs of re‑lodgment, not prosecution.

The regulation also does not audit or verify payment. The Registrar’s office would check the fee at the time of lodgment; there is no mechanism for retrospective adjustment if the wrong fee was paid. If an applicant underpaid, the Registrar might request the balance before proceeding; if they overpaid, there is no express provision for a refund. Practitioners should exercise care to calculate the correct fee upfront.

The regulation revokes the 2015 interim regulations (regulation 4), but non‑compliance with the revoked instrument is not pursued; those fees no longer apply. The enforcement of the current fees is administrative, not punitive.

For owners corporations, failure to pay the prescribed fee when recording rule alterations or boundary changes could mean the alteration is not recorded, leaving the corporation in a state of legal uncertainty. For example, if an owners corporation seeks to alter lot liability under item 28 and does not pay the 6.65 fee units, the Registrar will not record the alteration, and the existing lot liability remains in effect. This could create disputes among lot owners if the corporation acts as though the alteration occurred despite non‑registration.

In summary, the regulation’s enforcement mechanism is the Registrar’s gatekeeping function. There are no fines, no court proceedings, and no criminal sanctions for non‑payment. The cost of non‑compliance is operational: delay, inability to register, and potential legal uncertainty for owners corporations.

The regulation is made under section 43 of the Subdivision Act 1988 and sections 97(1) and 120 of the Transfer of Land Act 1958. It operates within the framework of those Acts, prescribing fees for services they require or permit. For example, the fee for lodging a plan of subdivision (item 1) corresponds to the requirement in section 22(1) of the Subdivision Act 1988. The fee for an application to serve notice on non‑consenting parties (item 4) corresponds to section 22(1B). The regulation does not alter the substantive criteria for registration; it only sets the price.

The regulation also interacts with the Owners Corporations Act 2006. Regulation 7(1) sets a fee for lodgment of owners corporation rules made or amended in accordance with Part 8 of that Act. This fee applies to rules that accompany a plan (item 10) and to standalone rule changes. The interaction means that owners corporations must budget for these fees in addition to the substantive compliance requirements of the Owners Corporations Act 2006.

The Cluster Titles Act 1974 is referenced in item 23, which sets a fee of 6.65 fee units for a plan to amend or cancel a scheme of development under that Act. Although the Cluster Titles Act 1974 is largely historical, any remaining cluster title schemes require this fee for amendments.

The regulation also interacts with the Valuation of Land Act 1960 indirectly through the concept of “fee units,” though that Act is not cited. Fee units are defined under the Monetary Units Act 2004, which is the source of the annual dollar value. Practitioners must consult the Monetary Units Act or government gazette to convert fee units to dollars for a given financial year.

The Subordinate Legislation Act 1994 governs the sunset provision. The regulation will expire on 19 April 2026 unless remade. This interaction forces periodic review; if the government does not remake or replace the regulation, the fees would lapse, and the Registrar might have no lawful authority to charge fees for those services until new regulations are made. That could create a gap in the fee‑setting regime.

The Transfer of Land Act 1958 provides for the Registrar’s general powers to register dealings and charge fees. Sections 97(1) and 120 are the specific authorising provisions. Section 97(1) allows regulations to prescribe fees under that Act, while section 120 deals with the Registrar’s powers. The regulation thus sits at the intersection of subdivision planning law and Torrens title registration law.

There is no explicit interaction with planning and environment legislation such as the Planning and Environment Act 1987. However, in practice, many subdivision plans require both planning permits and registration. The fees prescribed here apply at the registration stage, adding a transaction cost on top of planning application fees. Developers must account for both layers.

The regulation does not interact with the Australian Consumer Law, contract law, or competition law directly. It is a statutory price list, not a market‑driven fee. This insulates the Registrar from competition; the fee is mandatory and non‑negotiable.

The regulation is Version No. 001, meaning no amendments have been made since its making on 19 April 2016. The Table of Amendments in the endnotes confirms: “There are no amendments made to the Subdivision (Registrar’s Fees) Regulations 2016 by statutory rules, subordinate instruments and Acts.” The regulation is in its original form as at the commencement date of 1 July 2016.

The instrument replaced the Subdivision (Registrar’s Fees) Interim Regulations 2015 (S.R. No. 105/2015), which were revoked by regulation 4. Those interim regulations were likely a temporary measure, perhaps in place for less than a year. No details of their content are provided, but they presumably set fees between 2015 and the current regulations.

The endnotes also indicate that there are no amendments not in operation. This means the regulation has not been subject to any amending statutory rules or Acts, and no future amendments are scheduled to take effect.

The fee‑unit amounts themselves may have changed in real dollar terms due to annual adjustments under the Monetary Units Act 2004, but the regulation’s text has not been amended. The fee‑unit values are set externally; the regulation simply references “fee units.” So while the dollar amounts rise each year, the regulation’s language remains static. This is a deliberate drafting technique to avoid frequent amendments.

The sunset date is 19 April 2026. If the government intends to continue the fees beyond that date, it must remake the regulations before sunset. The amendment history section will show a new version number when that occurs. For now, practitioners should note that the regulation has a finite life, and planning for its expiry or replacement should be done if long‑term projects are involved.

Because the regulation has not been amended, there is no track of changed fees, new items, or removed items. The schedule has remained constant since 2016. This stability is beneficial for compliance: practitioners can rely on the same fee structure year after year, subject only to fee‑unit indexation.

However, stability also means that any changes in land administration practice or technology (e.g., electronic lodgment) are not reflected. The regulation does not address electronic applications or reduced fees for digital lodgments. It is a traditional, paper‑oriented fee schedule.

There is no litigation history apparent from the text of the regulation itself. The instrument does not reference any court cases, and the endnotes do not mention any judicial consideration. No cases are cited or discussed. The regulation is purely administrative and has likely not been challenged in court.

The lack of litigation is unsurprising. Fee‑setting regulations are typically challenged on grounds such as ultra vires (exceeding the enabling power) or unreasonableness, but the amounts here are modest and the legislative authority is clear. Section 43 of the Subdivision Act 1988 explicitly allows prescribing fees. The fees are not patentably excessive; they are in line with typical government charge levels.

If any litigation did occur, it would likely be about the definition of a parcel, or whether a particular plan falls under a specific item, or whether the fee was lawfully applied to a particular transaction. For example, a dispute could arise over whether a plan that creates both lots and common property triggers multiple fee items or a single item. The regulation provides no interpretation rules; courts would need to construe the schedule text.

Another potential source of litigation is the fee‑unit indexation. If a party argued that the fee‑unit conversion rate was incorrectly applied, that might be litigated in a minor civil claim. However, such disputes are likely resolved administratively without reported decisions.

Practitioners should not assume that litigation is impossible; they should be aware that the regulation has not been judicially tested. The absence of authority means that interpretive questions remain open. For example, item 24’s aggregate fee cap for multiple alterations under section 32(a) to (l) - what counts as a “parcel created” in that context? Could a plan that alters boundaries without creating new parcels still attract the per‑parcel fee? The regulation is silent.

Owners corporation disputes might lead to VCAT proceedings that incidentally involve the fees. For instance, if an owners corporation fails to pay the fee to record an alteration and then tries to enforce the alteration, a lot owner might challenge the validity. That would be resolved under the Owners Corporations Act 2006, but the fee regulation would be relevant.

In summary, the regulation has no reported litigation. It is a low‑profile, uncontroversial instrument. But its interpretive gaps could become contested in future, especially as the volume of owners corporation transactions grows.

Several features of the regulation can catch practitioners off guard. The most significant is the use of fee units. The regulation states fees like “41·88 fee units” without a dollar sign. Practitioners must know the current value of a fee unit, which changes each financial year. Using outdated fee‑unit values will lead to overpayment or underpayment. There is no grace period for indexation; the value on the day of payment applies.

The per‑parcel fee is easily overlooked. For a plan of subdivision with 100 lots, the base fee of 41.88 fee units plus 12.95 fee units per parcel quickly adds up. Item 1: 100 parcels × 12.95 = 1,295 fee units, plus 41.88 = 1,336.88 fee units total. At a hypothetical fee‑unit value of, say, $15.80, that is over $21,000. The schedule does not cap per‑parcel charges; only item 24 has a cap, and that applies only to section 32 alterations. For standard subdivisions, the total fee scales linearly with parcel count.

Staged plans (item 2) can be particularly expensive. Each stage incurs a separate base fee of 41.88 fee units plus per‑parcel fees. A developer with five stages and 50 parcels each would pay 5 × 41.88 = 209.40 fee units in base fees, plus 5 × 50 × 12.95 = 3,237.50 fee units in per‑parcel fees. That is over 3,400 fee units for the whole project. The regulation does not offer a bulk discount.

Item 24’s aggregate fee cap is a subtle benefit but only applies when making more than one alteration under section 32(a) to (l) in a single plan. If the plan combines alterations with other transactions (e.g., consolidation under section 32(j) plus easement creation under section 32(i)), the cap applies. However, the cap is not free: it is the sum of individual items up to a maximum of 41.88 fee units plus 12.95 per parcel. So for two alterations each with a 6.65 fee item, the sum is 13.30, well under the cap, so the cap does not reduce the fee. It only caps when the sum would exceed 41.88 base fee. Practitioners must calculate the sum of applicable item fees first.

The $10 fee for plan number allocation in regulation 7(2) is fixed and not indexed. This contrasts with fee‑unit fees that rise with inflation. Over time, this $10 fee may become relatively cheap, but it cannot be increased without amending the regulation.

Item 4 (service of notice on non‑consenting parties) is easily missed. When lodging a plan that requires consent from mortgagees, chargees, lessees, etc., if some do not consent, the applicant must pay 6.65 fee units to have the Registrar serve notice. Some practitioners might assume notice is automatic or included in the lodgment fee; it is not.

The fee for lodging owners corporation rules (regulation 7(1)) is separate from the plan fee. If a plan creating an owners corporation is lodged under item 10 (3.32 fee units for the rules), that is in addition to the plan fee under item 27 (6.65 fee units for the plan to create an owners corporation). So the total for creating an owners corporation from scratch is at least 9.97 fee units for the plan and rules, plus any per‑parcel fees if the plan also creates lots.

Item 33 and 34 (removing accessory lot or restricted lot status) are per‑lot fees. If an owner has five lots that need redesignation, the fee is 5 × 3.32 = 16.60 fee units. The schedule does not grant a discount for multiple lots.

VCAT applications: item 30 requires a fee to notify the Registrar of a winding‑up application. That fee is 3.32 fee units. But if the winding up proceeds, item 31 requires a further 13.30 fee units to amend or cancel the plan. These are sequential costs.

The regulation revokes the 2015 interim regulations, but no transitional provisions are included. If a plan was lodged before 1 July 2016 under the old fees, the old fees apply. After that date, the new fees apply. There is no grace period for plans in progress.

Sunset: the regulation expires on 19 April 2026. After that date, unless new regulations are made, there will be no prescribed fees for these services. This could cause a legislative gap. Practitioners with long‑term projects should monitor the expiry.

Compliance with the Subdivision (Registrar’s Fees) Regulations 2016 is straightforward: identify the correct fee item for the transaction, calculate the fee in fee units, convert to dollars using the current fee‑unit value, and pay that amount at the time of lodgment or application. The regulation does not specify the payment method; that is a matter for the Registrar’s administrative procedures.

Step one: determine the type of plan or application. Cross‑reference the description in Column 3 of Schedule 1 to the nature of the document. For example, if you are lodging a certified plan of subdivision (not staged), use item 1. If it is a plan of consolidation, use item 3. If it involves an owners corporation alteration, locate the relevant item among items 10 to 24.

Step two: count the number of parcels created. This is critical because many items have an additional per‑parcel fee. The schedule states “for each parcel of land created.” If the plan creates 10 new lots, the per‑parcel fee applies 10 times. For consolidations, “creates” may mean the number of consolidated parcels; the regulation does not define this, so practitioners should apply common sense: a consolidation of two lots into one creates one parcel.

Step three: if the plan involves more than one alteration under section 32(a) to (l) of the Act, refer to item 24. Calculate the sum of the individual item fees for each alteration; if that sum exceeds 41.88 fee units, the base fee is capped at 41.88 fee units. Then add 12.95 fee units for each parcel created. Note that the cap applies only to items covered by section 32; for other alterations, normal fees apply.

Step four: convert fee units to dollars. Obtain the current fee‑unit value from the Victorian Government Gazette or the Department of Treasury and Finance website. Multiply each fee by that value. For the fixed $10 fee in regulation 7(2), no conversion is needed.

Step five: include the correct amount with the lodgment. If using a conveyancing or registration service, confirm that the fee is calculated correctly and paid on the day of lodgment. Underpayment may result in rejection or delay; overpayment may not be refunded.

Step six: for owners corporation rules lodged separately (not accompanying a plan), use regulation 7(1) - 3.32 fee units - rather than a schedule item. If the rules accompany a plan creating an owners corporation, item 10 applies. If rules are amended later and lodged alone, regulation 7(1) applies.

Step seven: for plans involving VCAT orders (items 30 and 31), ensure the fee is paid when giving notice or applying to amend the plan. The fee for notice is 3.32 fee units; for the amendment application it is 13.30 fee units.

Step eight: keep records of the fee calculation and proof of payment. Although the regulation does not require record‑keeping, it is prudent in case the Registrar queries the amount later.

Step nine: monitor the sunset date. If your project extends beyond April 2026, consider whether new regulations will be in place. If not, you may need to lodge before the expiry or rely on transitional provisions in any successor regulation.

Step ten: for complex transactions (e.g., a staged plan with multiple types of alterations), seek advice from an experienced property lawyer or the Registrar’s office to ensure correct classification. The regulation does not provide a dispute resolution mechanism for fee disagreements.

The regulation does not impose ongoing compliance obligations; once the fee is paid and the document is accepted, compliance is complete. There are no annual fees, reporting requirements, or audits under this instrument. The burden is transactional and front‑loaded.
